After the public hearing and after a thorough review of the facts presented, the Agawam Zoning Board of Appeals made the following findings' 1. The subject property is located in an area of town zoned Industrial B. 2. The proposed business will transport motor vehicles to/from individual sales or auctions. 3. There will be no creation of a junkyard nor the scrapping or salvaging of motor vehicles or parts. 4. Therewillbe no body work or painting of vehicles on site. 5. There will be no sales of vehicles on the subject property. 6. There will be a maximum of fifteen (15) carriers, two (2) tow trucks and fifteen to twenty (15-20) transported vehicles at any one time on the subject property. 7. Site Plan Review Approval was received from the Agawam Planning Board on May 4, 2018. 8. A memo from Ms. Kathleen Auer, Agawam Health Agent, dated January 17, 2018, was received by this Board: 9. The Board has found that this specific site is an appropriate location for the proposed use in an Industrial B. zoning district. 10. No evidence was provided to this Board showing that the use as developed will adversely affect the health, safety, or property value of the neighborhood. 11. The proposed use will meet all building and fire safety regulations providing adequate and appropriate facilities and controls for its proper and safe operation. 12. No evidence was presented to this "Board showing there will be any nuisance or potential hazard to vehicular or pedestrian safety. 13. The Board does not consider this use to be so objectionable or obnoxioussothat the Page 1 of 2 .Mn 0 0 proposed use would be against the public interest or detrimental or injurious to the character of the neighborhood. If the driveway through the Berkshire Power Company property is to be abandoned, the Developer shall install a gated fence along the edge of the property line. If the Developer intents to use this driveway in the fiiture, a Driveway Permit must be filed with the Town and a proper curb cut must be installed in accordance with Town Standards. 2. The proposed paved curb cut for to the ;subject site should be redesigned so that the westem curb radius does not infringe on the frontage of the property owned by Marcin Wardak. R. Levesque Associates shall perform a turning radius analysis to verify the proposed curb radii are large enough for the vehicles that the Owner intents to use on the site. 3. The Site Plan shows an existing sewer manhole in the northeastern corner of the site. The Developer shall verify if this manhole is active and if it is connected to the Town sewer system or part of a private septic system. 4. There is a monitoring well by the existing garage on the north side of the site. The Developer shall verify if there was contamination on the site and if so, whether such contamination was removed. 5.. The Application for Site Plan Approval narrative states that the existing gravel area at the northern side of the site will be utilized for the storage of trwck trailers and tow trucks,. Engineering is concerned that the trailers and tow trucks will compact the gravel over time or that the voids between the gravel stones will be filled with sediment tracked in by the vehicles. This would reduce the permeability of the gravel and make it act similar to impervious pavement If this occurs, the Developer may have to remove the existing gravel and install new gravel in order to retain a porous surface. 6. The Site Plan shows that there is a private storm drainage system located on the eastern and northern sides of the subject parcel that appears to connect into the Town -owned drainage system in Shoemaka Lane via a catch basin east, of the existing single-family home. This constitutes an illicit connection since it was not authorized by the Town. Due to the proposed use of the property, there is the potential for pollutants (i.e. gasoline and oil) flowing into the Town drainage system. The Developer shall eliminate the existing private drain connection. All stormwater runoff generated onsite shall be mitigated either by infiltration or a new discharge point to be designed and permitted m accordance with allapplicableAgawam Ordinances and Massachusetts Stormwater Regulations. 7. If the Developer plans to seek permission from the town to connect the private drain system into the Town drainage system, the following issues must be addressed: a. All connections to the private drainage system must be shown on the Site Plan for analysis. The Site Plan shows that there is a 4" pipe flowing into a private catch basin in the northern area of the site and a private drain manhole along the eastern property line. The upstream inverts of the 4" pipes are not shown on the plan. The Developer shall determine the locations and elevations of all upstream inverts of these pipes. b. There is a drain manhole within the 60-FT access easement along the western property line of the site. The Developer shall determine if this manhole is connected to the private drainage system on the subject parcel. c. According to the Site Plan, the private drainage system on the subject parcel was installed such that larger diameter pipes upstream are flowing into smaller diameter pipes downstream. The smallex diameter pipes create a pinch point downsft m, increasing the possibility that the system will surcharge during heavy storm events. Before a connection to the Town drainage system can be approved, the private drainage system would have to be reconstructed such that smaller diameter pipes upstream are flowing into larger diameter pipes downstream. d. The Massachusetts Small MS4 General Perut,_currently scheduled to take effect July 1, 2018, requires that redevelopment sites improve existing conditions by retaining the volume of runoff equivalent to or greater than 0.80 inches multiplied by the total post -construction impervious surface area on the site. Also, 80% of the average annual 'Total Suspended Solids (TSS) and 50% of the average annual Total Phosphorus (TP) generated from the post -construction impervious surface area must be removed from the runoff before it discharges into the Town drainage system. (See attached Section 2.3.6.a(ii)4.b of the M84 permit) e. A HydroCAD analysis of the subject parcel shall be completed to verify that peak post - development stormwater flows do not exceed peak pre -development stormwater flows for the 2-, 10- and 100-year storm events. f. An approved stormwater connection from private property to the Town drainage system shall be through a drain manhole within Shoemaker Lane, not the existing catch basin.. g. The Developer shall create an Operation and Maintenance Manual for the Owner's use once construction on the drainage system is complete. The Manual will include a description of each component of the drainage system, inspections, maintenance, and the frequency of each for continued operation of the system. A copy of the manual shall be kept on the subject parcel and updated as needed. 0 h. The Developer shall create a Spill Prevention, Control and Countermeasures (SPCC) Plan which includes procedures, methods and equipment necessary to help prevent and/or contain a discharge of pollutants that may flow into the Town drainage system. If'a spill greater than ten (10) gallons of material occurs, the Owner i notify the Town immediately.
