09-05-18 REGULAR COUNCIL MEETINGREGULAR MEETING OF THE AGAWAM CITY COUNCIL Minutes dated September 5, 2018 Meeting was called to order by Council President Johnson at 7:00pm in the Auditorium at the Roberta G. Doering School, 68 Main Street, Agawam. Item A. Roll Call ROLL CALL –10 PRESENT, 1 ABSENT Roll Call was taken with the following councilors present: George Bitzas, Council Vice President Cecilia Calabrese, Paul Cavallo, Council President Christopher Johnson, Robert Magovern, Dino Mercadante, Robert Rossi, Rosemary Sandlin and Anthony Suffriti. Councilors Letellier and Mineo were absent however Councilor Mineo arrived late near the end of the meeting. With nine present, there was a quorum. Item B. Moment of Silence and the Pledge of Allegiance. Council President Johnson asked for a moment of silence and the Pledge of Allegiance. Item C. Citizen’s Speak Time None. Item D. Minutes 1. TOR-2018-1 1 - An Ordinance to amend the Code of the Town of Agawam Zoning Ordinances to allow site plan review waivers (Sponsored by Planning Board) (2 of 2 Readings) (Referred to Legislative Committee) Motion to approve the second and final reading made by Council Vice President Calabrese and seconded by Councilor Sandlin. The vote was 9 YES, 0 N0, 2 ABSENT (Councilors Letellier and Mineo) approving the second and final reading. 2. TO-2018-30 - An Order granting or renewing a Junk Dealer’s PERMIT for Baki’s Fine Jewelry, 9 North Westfield Street, Feeding Hills (Clerk) (Referred to Administrative Committee) Motion to approve made by Councilor Cavallo and seconded by Councilors Rossi and Suffriti. As Chair of the Administrative Committee, Councilor Rossi provided his report stating that everything was now in order with this application and the committee sent a positive recommendation to the Full Council by a vote of 4 Yes, 0 No, 1 Absent (Councilor Mineo). Please note the arrival of Councilor Mineo at 7:21pm. The vote was 10 YES, 0 N0, 1 ABSENT (Councilor Letellier) approving the Permit. 3. TOR-2018 -12 - An Ordinance to Amend Chapter 12 of the Code of the Town of Agawam (Mayor Sapelli) (1 of 2 Readings) (Referred to Legislative Committee) Motion to approve the first reading made by Councilor Sandlin and seconded by Councilor Suffriti. As Chair of the Legislative Committee, Councilor Magovern provided his report stating that the Agreement with Comcast expires soon (end of 2019 or early 2020). Need to beef up the use of the Cable Commission. There was an oversight on policy of use of the studio. The goal is to have transparency and more information with engaging content and integrate an HD Channel. We are now within the three year contract renegotiation period. Agawam assesses 1 ½% of the fee/user. This may be increased in the new contract. Motion to send a positive recommendation to the Full Council made by Councilor Bitzas and seconded by Councilor Rossi with a vote of 5 YES, 0 NO. The vote was 10 YES, 0 N0, 1 ABSENT (Councilor Letellier) approving the first reading. 4. TO-2018-31 - Budgetary Transfer of $5,000.00 from Municipal Golf Pro Shop Supplies (#65263-54200) to Municipal Golf Advertising & Promotions (#65262-52010) (Mayor Sapelli) (Referred to Finance Committee) Motion to approve made by Councilor Mercadante and seconded by Councilor Magovern. As Acting Chair of the Finance Committee, Council Vice President Calabrese provided the report stating that this is an interdepartmental transfer. Motion to send a positive recommendation to the Full Council was moved by Councilor Cavallo and seconded by Councilor Mercadante. The vote was 3 Yes, 0 No, 2 Absent (Councilor Letellier and Mineo). The vote was 10 YES, 0 N0, 1 ABSENT (Councilor Letellier) approving the transfer. Item K. New Business 1. TR-2018-82 - A Resolution accepting a grant ($5,000.00) from Westfield Bank pursuant to Massachusetts General Laws Chapter 44, Section 53A (Mayor Sapelli) Referred to Finance Committee, next Agenda. 2. TR-2018-83 - A Resolution to appropriate and authorize borrowing in the amount of One Million and Thirty Thousand and Three Hundred and Twenty Six Dollar ($1,030,326.00) to pay costs of the Doering School Wastewater and Stormwater Project (Mayor Sapelli) Referred to Finance Committee, next Agenda. Item L. Any other matter that may legally come before the City Council. Councilor Magovern reminded everyone of their right to vote and thanked everyone for getting out there and voting on Tuesday. Councilor Mercadante thanked the selfless people that they honored that evening and encouraged the community to help those in need. Councilor Bitzas also said the town is proud to honor all of the individuals that helped save those lives. He also wished all the students, parents and teachers a wonderful and productive school year. Councilor Cavallo commended Les Tingley on the Cable Commission and his efforts with that. Council Vice President thanked the poll workers especially in the high heat. Councilor Rossi agreed and thanked all of those folks. Councilor Suffriti was proud to see our community come together to honor those individuals – one of whom was his brother! He also thanked Mayor Sapelli for the noticeable change in town and what a breath of fresh air he has been. Council President Johnson reminded everyone of the ceremony on Sept 11th at 9:30am at the Agawam Fire Department on Main Street. He also reminded the Council to contact Barbara if they were planning on attending the tour at Tenaska on Wednesday Sept 19th. Councilor Sandlin also reminded everyone of a job fair this Saturday from 9-3 at OMG in the industrial park . Council Vice President also stated that with the Council’s permission, he would work with the Chamber to invite local businesses to come and introduce themselves to the City Council once a month so we could get to know them and what they do. Councilor Bitzas thought that was an amazing idea. Councilor Cavallo also spoke of the great job that Mayor Sapelli was doing for the town. Council President Johnson echoed and agreed it is a breath of fresh air to work with the Mayor noting he also would be happy to participate in the businesses attending the Council meetings. He also told the kids to enjoy their first “snow day” since they were getting a half day on their first day of school due to the heat. Item M. Adjournment. The Motion to adjourn was moved and seconded all around. Meeting was adjourned at 7:37pm.   TO-2018-30 Junk Dealer Permit was also approved.
