11-18-19 REGULAR COUNCIL MEETINGREGULAR MEETING OF THE AGAWAM CITY COUNCIL Minutes dated November 18, 2019 Meeting was called to order by Council President Johnson at 7:00pm in the Auditorium at the Agawam Junior High School, 1305 Springfield Street, Feeding Hills. Item A. Roll Call ROLL CALL – 9 PRESENT, 2 ABSENT Roll Call was taken with the following councilors present: George Bitzas, Council Vice President Cecilia Calabrese, Paul Cavallo, Council President Christopher Johnson, Gina Letellier, Dino Mercadante, Rosemary Sandlin, Robert Rossi and Anthony Suffriti. Councilors Mineo and Councilor Magovern were absent. With nine present, there was a quorum. Item B. Moment of Silence and the Pledge of Allegiance. Council President Johnson asked for a moment of silence and the Pledge of Allegiance. Item C. Citizen’s Speak Time David Cecchi spoke on behalf of the Historical Commission in support of the CPA resolution regarding the Thomas Smith House. Item D. Minutes 1. Regular Council Meeting – November 6, 2019 Motion to approve the minutes was moved by Councilor Mercadante and seconded by Councilor Cavallo. Voice vote approved. Item E. Declaration from Council President Council President Johnson welcomed Councilors-Elect Gerry Smith and Mario Tedeschi and congratulated them on their victory. Item F. Presentation of Resolutions 1. TR-2019-55 - A Resolution to exercise the Right of First Refusal Option to meet a bona fide offer to purchase lands classified under M.G. L. Chapter 61A located at 497 South Westfield Street, Feeding Hills, Massachusetts (Mayor Sapelli) (Tabled 9/3/19) This item will remain on the table until our next meeting. 2. TR-2019-67 - A Resolution authorizing the Mayor to enter into a Lease Agreement between the Town of Agawam and Cellco Partnership d/b/a Verizon Wireless regarding a monopole tower at 128 Southwick Street, Feeding Hills, Massachusetts (Mayor Sapelli) (Referred to Community Relations Committee) Motion to approve made by Councilor Sandlin and seconded by Councilor Mercadante. As Chair of the Community Relations Committee, Councilor Suffriti provided the report stating that at their November 14th meeting, Attorney Fenton represented Verizon and was in attendance to answer questions. Solicitor Buoniconti explained the process of cell bids and the reasoning behind the Town entertaining a new cell tower. This resolution is just for the land lease. The benefits include an annual income of $23,600 with an annual increase of three percent. There is future space reserved at the top of the tower for anything the Town may deem necessary. This is a five year lease with 4 five year term extension options. Councilor Bitzas asked if the funds could be earmarked for the golf course which Solicitor Buoniconti replied no that it must go in to the General Fund. The only involvement of the City Council is to allow the lease of the property. Councilor Suffriti reminded everyone that this was just to allow the Mayor to go into a lease agreement and not about debating the specifics on the cell tower. Verizon and Emergency Management would have space on the tower as well. The Committee made a Motion to send a positive recommendation to the Full Council which was made by Councilor Mercadante and seconded by Councilor Suffriti. Councilor Bitzas wanted to wait to hear what the people had to say about the tower being there so he would abstain from the vote. The vote was 2 Yes (Councilors Suffriti and Mercadante), 0 No, 1 Abstention (Councilor Bitzas), 2 Absent (Councilors Letellier and Magovern) Councilor Bitzas began the discussion suggesting the Council table this item until after the balloon test to see how it would affect the neighborhood. Why rush it? He added that he wanted this earmarked for the golf course. Councilor Suffriti stated that Attorney Fenton stated that Verizon can NOT move forward with a balloon or anything else without this signed lease. He also stated that the Solicitor emphasized that the funds cannot be earmarked for the golf course and must go in to the General Fund. Councilor Bitzas said that the manager of the golf course told him the balloon test would definitely be happening on Thursday. Councilor Mercadante mentioned that this was just a vehicle to move forward with the cell tower allowing Verizon to perform the necessary testing. This is a process they have to go through. Councilor Suffriti agreed it was the first step in the process and we should not table it this evening. Councilor Letellier commented that for many people, cell phones are their only forms of telephone. In the long run, this will prove to be very fruitful. She was prepared to vote this evening. Councilor Bitzas corrected Councilor Letellier and said it was nothing about Silver Street and Suffield Street area. Councilor Cavallo agreed with Councilor Letellier and wanted to vote this evening. Councilor Letellier doesn’t normally want to do the back and forth thing however she corrected Councilor Bitzas saying she never said this pole would help where her office was. She did, however say we need more towers to help places like where her office is. Council President Johnson said we normally would see these items come before the City Council because they would require a zone change however the golf course was already placed within the overlay district so this item will not need to come before the Council for a zone change. If this is approved, the next step for Verizon would be to go through the Zoning Board of Appeals process. Just a note that the tower will not be at the crest or highest point of the golf course but lower in the parking lot which should minimize what is seen of the tower. Councilor Bitzas asked if they could negotiate for more money and could that money be earmarked for the golf course. Council President Johnson said years ago, the town could have negotiated for more money however it is too competitive at this point and from his understanding this was the most lucrative of the two bids. As was mentioned, this money cannot be earmarked for the golf course but maybe after a while maybe the Council could suggest this. Councilor Cavallo moved the question. The vote was 8 YES, 0 NO, 1 PRESENT (Councilor Bitzas), 2 ABSENT (Councilors Magovern and Mineo) approving the item. 3. TR-2019-68 - A Resolution appropriating from the Community Preservation Fund and authorizing the expenditure of Community Preservation Funds for design services at Memorial Field Park (CPA) (Referred to Community Relations Committee) Motion to approve made by Council Vice President Calabrese and seconded by Councilor Letellier. As Chair of the Community Relations Committee, Councilor Suffriti provided the report stating that at their November 14th meeting, Jennifer Bonfiglio explained the process and that the Town is using a new company not used by the town yet. The committee made a Motion to send a positive recommendation to the Full Council which was made by Councilor Bitzas and seconded by Councilor Mercadante. The vote was 3 YES, 0 No, 2 Absent (Councilors Letellier and Magovern) Councilor Bitzas strongly supported this and said it was money well spent. It was a good investment for our youth. Councilor Letellier said as a baseball mom, this is greatly needed. The field drainage needs a lot of work and suggested the town work with the heads of Little League, Youth Football and Youth Cheerleading as well. The vote was 9 YES, 0 NO, 2 ABSENT (Councilors Magovern and Mineo) approving the item. 4. TR-2019-69 - A Resolution appropriating from the Community Preservation Fund and authorizing the expenditure of Community Preservation Funds for the preservation and rehabilitation of the Thomas Smith House Garage (CPA) (Referred to Community Relations Committee) Motion to approve made by Councilor Sandlin and seconded by Councilor Letellier. As Chair of the Community Relations Committee, Councilor Suffriti provided the report stating that at their November 14th meeting, Jennifer Bonfiglio explained this expenditure. It is a historical investment. David Cecchi explained the historical side of the property and reasons behind the rehab and preservation of the garage. The house is from the 1750’s and the garage is 1920’s and shows the evolution from farming to industrial. Once the rehab is complete, the garage will have historical tractors on display. Motion to send a positive recommendation to the Full Council made by Councilor Bitzas and seconded by Councilor Mercadante. The vote was 3 Yes, 0 No, 2 Absent (Councilors Letellier and Magovern) Councilor Bitzas said it was important to not let those people down. Councilor Rossi said it was a worthwhile project and was used a lot with various events throughout the year. The vote was 9 YES, 0 NO, 2 ABSENT (Councilors Magovern and Mineo) approving the item. TOR-2019-13 - An Ordinance to amend Section 2013-11 of Chapter 103 of the Code of the Town of Agawam for the Perry Lane Summer Camp programs (Mayor Sapelli) (1 of 2 Readings) Motion to approve the first reading by Council Vice President Calabrese and seconded by Councilors Mercadante and Cavallo. Council President Johnson noted that this was to raise fees for the Perry Lane Pre-School Camp. They were last raised about six years ago. The increase in minimum wage is why the main reason for the increase and will help to attract counselors. The vote was 9 YES, 0 NO, 2 ABSENT (Councilors Magovern and Mineo) approving the first reading. Item K. New Business 1. Item L. Any other matter that may legally come before the City Council. Councilor Mercadante welcomed Mario Tedeschi and Gerry Smith. He remembered being warmly welcomed as a newcomer to the group two years ago and he believes it will be the same for them. Councilor Bitzas added a Happy Thanksgiving to everyone. Councilor Rossi reported on the Public Hearing that his Administrative Committee had on two Eversource pole placements. Councilor Mercadante added that there are a couple missing street lights at the bottom of North Street and since the town now owns the street lights, how would we go about getting these fixed in the interim. Barbara will find out. Councilor Cavallo welcomed Mr. Smith as well for his first time on stage and wished everyone a Happy Thanksgiving. Council Vice President Calabrese thanked the Agawam Family Cinemas for two showings of Jack Jonah’s film which is a very powerful and moving film. She gave special thanks to Les Tingley and also wished everyone a Happy Thanksgiving. Councilor Suffriti also welcomed the councilors-elect and said he was looking forward to working with them. He provided a report from the Energy Commission and gave insight to help answer Councilor Mercadante’s question. Councilor Letellier said she is extremely grateful this Thanksgiving and wished everyone a Happy Thanksgiving as well. She also mentioned the Rosie Robotics team working with the seniors at the Senior Center. Councilor Sandlin also wished everyone a Happy Thanksgiving and welcomed Mario and Gerry. Councilor-Elect Tedeschi thanked everyone again for their well wishes and wished everyone a Happy Thanksgiving. He is excited to sit at the “big boy” table come the New Year. Councilor-Elect Smith said it is an honor to serve and thanked everyone for welcoming him. He promised to do his best to carry out that responsibility and agreed with Mario that he looked forward to sitting at the “big boy” table.
