Minutes dated December 2, 2019
Meeting was called to order by Council President Johnson at 7:00pm in the Auditorium at the Agawam Junior High School, 1305 Springfield Street, Feeding Hills.
Item A. Roll Call
ROLL CALL – 8 PRESENT, 3 ABSENT
Roll Call was taken with the following councilors present: George Bitzas, Council Vice President Cecilia Calabrese, Paul Cavallo, Council President Christopher Johnson, Dino Mercadante,
Rosemary Sandlin, Robert Rossi and Anthony Suffriti. Councilors Letellier, Mineo and Magovern were absent. With eight present, there was a quorum.

Council President Johnson asked for a moment of silence and the Pledge of Allegiance.

William Clark spoke about cell tower funds going into the Golf Course/General Fund.

Motion to approve the minutes was moved by Councilor Mercadante and seconded by Councilor Sandlin. Voice vote approved.

Item F. Presentation of Resolutions
1. TR-2019-55 - A Resolution to exercise the Right of First Refusal Option to meet a bona fide offer to purchase lands classified under M.G. L. Chapter 61A located at 497 South Westfield
Street, Feeding Hills, Massachusetts (Mayor Sapelli) (Tabled 9/3/19)
Motion to remove the item from the table made by Council Vice President Calabrese and seconded by Councilor Cavallo. Council President Johnson stated that the developers have asked
to withdraw this item so he asked for a Motion to remove the item from the Agenda which was made by Councilor Sandlin and seconded by Councilor Mercadante.
The vote was 8 YES, 0 N0, 3 ABSENT (Councilors Letellier, Mineo and Magovern) removing the item from the Agenda.
2. TR-2019-71 - A Resolution to appropriate Twelve Thousand Dollars ($12,000.00) from Golf Retained Earnings to fund the Agawam Golf Course FY2020 Budget (Mayor Sapelli)
Motion to approve made by Councilor Rossi and seconded by Councilors Bitzas, Cavallo and Mercadante. Councilor Sandlin inquired about this item. Council President Johnson stated that
the DOR just certified our Free Cash and also determines the Retained Earnings in Revolving Funds. Last year there was money that was greater than the
expenditures. This year, they are doing better and need more money. Councilor Sandlin said so this might be a good place to take back money at some point if necessary? Council President
confirmed essentially yes.

Item I. Public Hearings
1. TOR-2019-12 - An Ordinance to amend Section 147 of Chapter 180 of the Code of the Town of Agawam by banning recreational marijuana establishments (Mayor Sapelli) (1 of 2 Readings)
(Tabled 11/6/19) – Joint Public Hearing with Planning Board
Council President Johnson explained how the joint Public Hearing will proceed. Council President Johnson extended an invitation for the members of the Planning Board to come up on stage
and open their Public Hearing and then they would proceed with the joint Public Hearing. Planning Board Chairman, Mark Paleologopoulos, declared it open at 7:06pm. (Chairman Paleologopoulos
and members Mario Tedeschi and Charles Elfman were in attendance for the Planning Board) At this point, Council President Johnson also declared the Public Hearing opened at 7:06pm
and asked to hear from anyone wishing to address both the Planning Board and the City Council to speak in favor of TOR-2019-12 to approach. No one approached. He asked for anyone
to speak in favor in name only of TOR-2019-12. No one spoke. Council President Johnson then asked for anyone to address both the Planning Board and the City Council to speak in opposition
of TOR-2019-12 to approach. No one approached. He also called for anyone wishing to speak in opposition in name only, no one spoke. Council President Johnson declared the Public
Hearing closed at 7:07pm and refer to the Planning Board to make its recommendation.
As Chairman of the Planning Board, Mark Paleologopoulos stated that the Planning Board’s role in this process was that of a recommending body. Mario Tedeschi spoke first stating that
this was a tough decision as a Planning Board member versus a Councilor-elect. He is in favor of the ordinance. His main reason for running was to increase the business/industrial
tax base for Agawam so he is torn because voters had the opportunity to change this however they did not. As a result of that vote, he believes it is not yet time for Agawam to get
involved in the recreational marijuana industry. Personally, in his business he sees a lot with contractors and job sites and he feels marijuana is not “respected” in the workplace”
and has witnessed workers taking breaks and smoking pot. If you want to smoke in your own home, that’s fine but not on the workplace. Therefore, he gave a positive recommendation
to say ban recreational marijuana in the Town of Agawam. Mark Paleologopoulos stated that he has lived in Massachusetts his entire life and in Agawam for over fifty years. He is speaking
personally and not as the Planning Board Chairman. It seems that the Town of Agawam has had many opportunities over the years to promote change and be proactive and Agawam pretends
it is 1965 and doesn’t take the opportunity to positive change. He did say that the fact of the matter is that the regulated sale of marijuana is legal in Massachusetts and this ordinance
hurts the Town of Agawam. At a time when budgets are tight and people are dealing with increases in taxes and sewer issues, etc, it doesn’t make sense to turn down revenue. Agawam
needs vision to deal with an aging population and high cost infrastructure items. It also needs money and without increasing revenue, the burden of paying for these things falls on
the residents and even more heavily on the businesses. Allowing marijuana dispensaries may not fix some of these burdens but Agawam chooses to “shoot itself in the foot” when these
types of opportunities come before it to take advantage of a revenue source. I’ve heard both sides and my conclusion is to allow the sale of recreational marijuana to be sold in Agawam.
Since he is not bound by the will of the voters, he opposes the ordinance. Charles Elfman agreed with Chairman Paleologopoulos and stated he believes it to be a missed opportunity
for the town to gain more tax revenue. He opposed the ordinance.
Motion to send a positive recommendation to the City Council made by member Tedeschi and seconded by Member Elfman. The vote was 1 Yes, 2 No sending a negative recommendation to the
City Council. Council President Johnson asked if anyone had any questions for the Planning Board. Councilor Mercadante spoke but that will be under discussion of the City Council.
Motion to close the Planning Board meeting made by Member Charles Elfman and seconded by Member Mario Tedeschi. Planning Board meeting was adjourned at 7:15pm. Council President
thanked them for attending to hold the joint Public Hearing. Planning Board left the stage.
Motion to approve the first reading of TOR-2019-12 made by Council Vice President Calabrese and seconded by Cou0ncilor Mercadante. The floor was opened for discussion at 7:15pm. Councilor
Mercadante’s comments stated that this is a democracy and that is what counts. We have missed opportunities all over the place and is not so sure that this is a missed opportunity
for the Town of Agawam. It is highly unfortunate that only 24% of voters turned out to vote but he will honor the will of the people. Councilor Cavallo said it was made quite clear
at the Council meeting where we voted to place this item on the ballot that we would leave it to the people and the vote was clear. We have to be responsible to the people. Councilor
Rossi stated that he believed the people of Agawam spoke pretty clearly the first time but agreed to place on the ballot and again it was pretty clear that Agawam does not want recreational
marijuana. In terms of revenues brought in to the town, who knows what that would look like but the problems it could bring our town could be huge. He believes Agawam made the right
choice. Councilor Suffriti thinks the Council did what they should have done by sending it to the ballot for the people to decide. People will still have the ability to grow marijuana,
use marijuana and go to another town to purchase marijuana however what we won’t have is the possible revenue from this. You will however see increased fees from the services needed
to address any related issues in the future however he will follow the will of the people. Councilor Bitzas was glad to see the people’s response to this ballot question. He supported
medical marijuana but not recreational. He was glad that Agawam voted to not sell marijuana in town.

2. TR-2019-70 - A Resolution adopting a Residential Factor of 0.8253 pursuant to Massachusetts General Laws, Chapter 40, Section 56 (Mayor Sapelli)
Motion to approve made by Council Vice President Calabrese and seconded by Councilor Mercadante. Council President Johnson invited Mayor Sapelli and Assessor Sam Konieczny to the stage
for their presentation and declared the Public Hearing open at 7:23pm. Mayor Sapelli thanked Sam and Sam’s office staff for their hard work, research and data noting Agawam has the
lowest split rate in the area. One of the main things that make Agawam a great place to live is its lower tax rate. The commercial split is almost double that of residential and we
need to be more fair to our businesses. Mayor stated we need to walk the walk and talk the talk when we say we are a business friendly community. As a Council, you take two important
votes – one is the operating budget and the other is setting the tax rate. We need to be fair to both the residents and the businesses. It is true that we have many residents on fixed
incomes but the businesses can only bear the burden for so long – they will begin to pass that burden along to the consumer. He strongly supports this shift. Assessor Sam Konieczny
began the presentation by thanking the City Council for having him and said it was an honor to present this every year. We stated that again this year, Agawam has the lowest rate.
We need to find a balance between residential and business. Even though we have the lowest rates we have had significant increases on the commercial/industrial side. There has been
a lot of new growth in Agawam and we have retained our AA+ rating from Standard & Poor’s. He noted that a lot of work went into calculating this rate.
Council President Johnson asked for anyone wishing to speak in favor of TR-2019-70. William Clark spoke in favor but wondered why it says tax factor and not the rate and why no press
release. The Assessor spoke saying typically the rate is not known until last minute and that is why there was no press release. There will be a press release after the Public Hearing
however noting that rates. Ryan Martin also spoke stating he believed this to be a fair rate. As a resident, he is willing to do this to help bring new business to town. Council
President Johnson asked if anyone wished to speak in name only in favor; in opposition and in opposition name only – no one approached to speak. Council President Johnson declared
the Public Hearing closed at 7:51pm.
Discussion began with Councilor Mercadante praising the great presentation. He supports the proposed rate. We need to find a way to slow down the business tax rate. He is a resident
and also owns a business in town so either way he will pay however the bottom line for him is the businesses do not utilize the town services like residents do. It is important that
we make Agawam always be at the forefront of the business world. Councilor Rossi thanked the Mayor and Assessor for the great job. Historically, he leans towards the residents however
he sees their point and agrees it has gotten a little out of hand. Councilor Rossi sees the value of doing this and thinks it is fair. Councilor Sandlin stated she would support this
but would hope we can do something with the Industrial Park and hopes this will entice new businesses to come to Agawam. Mayor Sapelli agreed and said that was exactly what they were
hoping to do. Councilor Cavallo was at first against this rate and thinks it is fair. His questions were clarified during the presentation and will support it. Councilor-Elect Tedeschi
said it was his first time up here listening to the presentation and noted the great job and agreed it was a great first step forward in promoting Agawam. He stated it shows surrounding
communities that we are serious. Councilor Mercadante added that businesses always bear a burden and as our costs go up, then businesses raise their prices which end up in the residents
laps. We have to be ever mindful of this and believes this to be a wonderful job. Council President Johnson stepped from the Chair to say he agreed with Councilor Sandlin about getting
another industrial park. He thinks it is fair and they did a great job. Councilor Bitzas echoed the comments about the industrial park.
The vote was 8 YES, 0 N0, 3 ABSENT (Councilors Letellier, Mineo and Magovern) approving the tax shift as proposed by the Mayor. Mayor Sapelli thanked everyone and once again thanked
Sam Konieczny, Laurel Placzek and her office. He noted that we work together as a team with the City Council and he appreciates the Council’s support. The Assessor Sam Konieczny thanked
the two incredible ladies in the Assessor’s Office for their constant hard work.
3. TOR-2019-14 - An Ordinance to amend the Code of the Town of Agawam Zoning Ordinance to modify Use Restrictions in Residence A-3 Districts (Mayor Sapelli) (Two Readings Required) -

Councilor Bitzas announced the Rotary Holiday concert on December 16th at 7pm at the Agawam High School. He will be attending at the close of the Council meeting and hopes to see everyone
there. Councilor-Elect Smith complimented the DPW on the fine job they did keeping the roads clean during the recent storm. Council President Johnson reminded everyone of the Town
Employee Holiday party on Thursday 12/5 at the Golf Course from 4:30pm to 8:00pm and the Council party the following Thursday.

The Motion to adjourn was moved and seconded around the house. Meeting was adjourned at 8:23pm.
Weekly Amusement Permit TO-2019-74 through and including TO-2019-88 were all approved
