Young , Councilor Agawam Town Council 36 Main Street Agawam, MA 01001 Dear Councilors: At its duly called meeting held on April 19,2007,the Agawam Planning Board voted to recommend that the Agawam Town Council not approve the zone change for Mushy's Golf Center LLC. The request was to expand the Wireless Telecommunications Overlay District to include 23.03 acres of land located to the rear of Main Street. After considerable deliberation, the Planning Board in a voted of 3 (Hopkins, Baldwin and Meagar) in favor of the negative recommendation and 1 abstaining(Ward) for the following reasons: 1. The applicant has not adequately pursued all possible alternatives to this proposal. During the course of the public hearing which was extended over three meetings, the applicant only pursued alternatives raised by the Planning Board. The applicant has indicated that at least one other site would be better with regard to providing the necessary service and yet the owner of this site has not been approached in the last three years according to the applicant. Other sites may also be satisfactory. 2. During the drafting of the Town's Wireless Telecommunications Overlay District in 1998, the Town was careful to provide locations in all areas of Town. These locations were in keeping with the character and land use of the surrounding areas. 3. The proposed site is over 20 acres in size. Once included in the Overlay District more than one tower could potentially be located on the parcel. 4. The applicant floated a balloon on the site which was observed by the Planning Board members. The balloon was highly visible when traveling north on Main Street. A large expanse of open area, uninterrupted by trees, buildings or other obstructions give those traveling north on Main Street clear views of the tower. 5. The proposed tower location is in Agawam Meadows. The Meadows is in the floodplain of the Westfield River and is the habitat for many plant and animal species. A portion of the Meadows is designated as Priority Habitat by the Massachusetts Natural Heritage Program. 6. Main Street is an important thoroughfare in Agawam. Within approximately one- half mile, the Agawam National Register Historic District begins. The Town is in the process of completing the design for an over$3 million renovation project which includes re-establishing an historic"grand allee"of shade trees on both sides of Main Street,new lighting, granite curbing,historic signs and traffic improvements. The proposed tower location, though not in the historic district, is close enough to not be in keeping with the character which the Main Street Improvement Project is intending to evoke. 7. During the Planning Board's public hearing at least one abutter expressed concern over the proposed zone change and the impact it would have on his property value. The Planning Board must take into consideration existing property owners when considering zone changes. Sincerely, Dennis B. The present road off Main Street, which leads into the area commonly referred to as "the meadows", is also the entrance to "Xtreme Paintball". My concern is that if any cell towers are erected within paintball gun distance of the land used by Xtreme Paintball,.the equipment could be damaged by errant paintballs and police officers, during the course of their malicious damage investigation,will need to get to the equipment to verify the damage. Other than the above mentioned concern, any equipment placed on this "rear land on Main Street"within a Wireless Telecommunications Overlay District would produce little negative impact on pedestrian, bicycle, and or motor vehicle traffic safety. DACHOS, DIRECTOR OFFICE OF PLANNING AND COMMUNITY DEVELOPMENT SUBJECT: PROPOSED CHANGE TO THE TELECOMMUNICATION ORDINANCE OVERLAY DISTRICT/Grasso DATE: February 26, 2007 The PIanning Board is in receipt of a proposal to amend the Wireless Telecommunications Overlay District by the inclusion of a new parcel. The parcel is owned by Mushy's Golf Center, LLC and is located to the rear of 369 Main Street. The applicant proposes to lease land for a wireless communication facility on this parcel. Specific information concerning the telecommunications company and the proposed facility have not been provided. On March 2, 1998,the Town of Agawam adopted an amendment to the Zoning Ordinance which regulates the location and construction of telecommunication facilities. The amendment included an overlay district which identifies those areas within the.Town of Agawam where free standing monopoles may be installed. The amendment prohibits the erection of monopoles anywhere but in the overlay district. It is the position of the applicant that erection of a monopole in any of the areas identified in the overlay district will not provide adequate coverage of the northeast corner of Town, in particular, along the Route 57 and Route 159 corridors. No information-has been submitted by the telecommunications company to support this position. Previous requests for expansion of the overlay district have been accompanied by documentation from radio frequency experts. The property consists of approximately 20 acres. It is located within the Industrial A District. The property is located in an area of town referred to as Agawam Meadows. All of the property is zoned Industrial A. The property abutting Main Street is zoned Business A and B. Please refer to the attached land use map. Please also refer to the attached National Flood Insurance Program Flood Insurance Rate Map. This map indicates that most of the land in question is within the 100 year floodplain and is therefore under the jurisdiction of the Board of Appeals and the Conservation Commission. As with the other towers found in Agawam, the greatest impact on the community is aesthetics. Cell towers are imposing structures and, unless mounted on an existing structure such as a tower or steeple, are usually the most prominent features on the landscape. In an attempt to determine what type of impact the proposed tower location will have, the applicant should be requested to float a balloon in the exact Iocation of the tower. This method will allow the Board to determine from what distance the tower will be viewed. Finally, the proposed site is just north of Agawam's Main Street National Register Historic District. This area is also the site of a number of proposed roadway improvements including major landscaping,new pavement and granite curbing,and signage. A cell tower in this area could impact these improvements. PETITION FOR ZONE CHANGE PH 2, 17 WHEREAS, Mushy's Golf Center, LLC is a Massachusetts limited liability company and it owns the property located at Rear Main Street, Agawam, Hampden County, Massachusetts which it acquired from Janice Bell, Executrix of the Estate of Frank A. Grasso by deed (PARCEL 1) dated April 26, 2006 which is recorded in the Hampden County Registry of Deeds in Book 15903, Page 197 (hereinafter "the Mushy's Parcel") A copy of said deed is attached hereto and marked EXHIBIT A.; WHEREAS, the Mushy's Parcel is located in the Industrial A District Zone; WHEREAS, Mushy's Golf Center, LLC proposes to lease a portion of the Mushy's Parcel in an area located northeast of its golf range facility for the construction, operation and maintenance of a telecommunications facility; WHEREAS, in March of 1998, the Town of Agawam (Town) enacted an ordinance creating a Wireless Telecommunications Overlay District (WTOD) "to protect the scenic, historic, natural and other resources of the Town of Agawam while allowing adequate Personal Wireless Telecommunications to be developed." (See §18D-94); WHEREAS, the WTOD designates certain specific parcels where wireless telecommunications structures and facilities may be located and constructed; WHEREAS, the WTOD does not designate any eligible parcels in the entire northeast quadrant of the Town; WHEREAS, the addition of the Mushy's Parcel to the WTOD is necessary to provide wireless communications services in the Town and Hampden County; WHEREAS, the United States Congress, through adoption of the Telecommunications Act of 1996, recognized the important public need for high quality telecommunication services .throughout the United States. With respect to wireless communications services, the Telecommunications Act of 1996 expressly preserved local land use authority over wireless facilities, but it placed several requirements and legal limitations on the exercise of such authority. In essence, Congress struck a balance between legitimate areas of local regulatory control over wireless infrastructure and the public's interest in its timely deployment to meet the public need for wireless services; WHEREAS, wireless telecommunication devices are used..to:�-provieLk--awk4alez-s communication, data, internet and 911 service and being_wltb on more frequently as a primary form of communication for both personal g#nd business needs. Wireless devices have become integral to the telecommunica ns n �ref^ee'p't1b'#?f4%`i it benefits can no longer be considered a luxury; ,? p 14;41 WHEREAS, in an effort to ensure the benefits of wireless technologies to all Americans, Congress enacted the Wireless Communications and Public Safety Act of 1999 (the "911 Act"). The purpose of this legislation was to promote public safety through the deployment of a seamless, nationwide emergency communications infrastructure that includes wireless communications services. In enacting the 911 Act, Congress found that networks that would provide for the rapid, efficient deployment of emergency services would enable faster delivery of emergency care with reduced fatalities and severity of injuries. As an outgrowth of the 911 Act, the FCC mandated wireless carriers to provide enhanced 911 services ("E911") as park of their communications Networks. These services ultimately allow 911 public safety dispatchers to identify a wireless caller's geographical location within several hundred feet. The addition of wireless communications facilities on the Mushy's Parcel will promote the availability of enhanced 911 services in the Town; WHEREAS, a gap in coverage currently exists in the Town, specifically in the northeast corner of the community along the Route 57 and Route 159 corridors. SEC. 704. FACILITIES SITING;RADIO FREQUENCY EMISSION STANDARDS. (a)NATIONAL WIRELESS TELECOMMUNICATIONS SITING POLICY- Section 332(c) (47 U.S.C. 332(c)) is amended by adding at the end the following new paragraph: '(7) PRESERVATION OF LOCAL ZONING AUTHORITY- '(A) GENERAL AUTHORITY- Except as provided in this paragraph, nothing in this Act shall limit or affect the authority of a State or local government or instrumentality thereof over decisions regarding the placement, construction,and modification of personal wireless service facilities. '(B)LIMITATIONS- '(i) The regulation of the placement,construction, and modification of personal wireless service facilities by any State or local government or instrumentality thereof-- '(I)-sb l�Upre-gsanah.lydiscrim;nate among providers of functionally equivalent s rvices; and '(II) shall not prohibit or hUg the effect of prohibiting the provision of personal wireless services. '(ii)A State or local government or instrumentality thereof shall act on any request for authorization to place,construct,or modify personal wireless service facilities within a reasonable period of time after the request is duly filed with such government or instrumentality,taking into account the nature and scope of such request. '(iii)Any decision by a State or local government or instrumentality thereof to deny a request to place, construct, or modify personal wireless service facilities shall be in writing and supported by substantial evidence contained in a written record. '(iv)No State or local government or instrumentality thereof may regulate the placement, construction, and modification of personal wireless service facilities on the basis of the environmental effects of radio frequency emissions to the extent that such facilities comply with the Commission's regulations concerning such emissions. '(v)Any person adversely affected by any final action or failure to act by a State or local government or any instrumentality thereof that is inconsistent with this subparagraph may,within 30 days after such action or failure to act, commence an action in any court of competent jurisdiction. The court shall hear and decide such action on an expedited basis. Any person adversely affected by an act or failure to act by a State or local government or any instrumentality thereof that is inconsistent with clause(iv)may petition the Commission for relief. '(C) DEFINITIONS- For purposes of this paragraph-- '(i)the term 'personal wireless services' means commercial mobile services, unlicensed wireless services, and common carrier wireless exchange access services; '(ii)the term 'personal wireless service facilities' means facilities for the provision of personal wireless services; and '(iii)the term 'unlicensed wireless service'means the offering of telecommunications services using duly authorized devices which do not require individual licenses, but does not mean the provision of direct-to-home satellite services (as defined in section 303(v)).'. (b) RADIO FREQUENCY EMISSIONS- Within 180 days after the enactment of this Act, the Commission shall complete action in ET Docket 93-62 to prescribe and make effective rules regarding the environmental effects of radio frequency emissions. (c)AVAILABILITY OF PROPERTY- Within 180 days of the enactment of this Act, the President or his designee shall prescribe procedures by which Federal departments and agencies may make available on a fair, reasonable, and nondiscriminatory basis, property, rights-of-way, and easements under their control for the placement of new telecommunications services that are dependent, in whole or in part, upon the utilization of Federal spectrum rights for the transmission or reception of such services. These procedures may establish a presumption that requests for the use of property, rights-of-way, and easements by duly authorized providers should be granted absent unavoidable direct conflict with the department or agency's mission, or the current or planned use of the property, rights-of-way, and easements in question.Reasonable fees may be charged to providers of such telecommunications services for use of property, rights-of-way, and easements. The Commission shall provide technical support to States to encourage them to make property, rights-of-way, and easements under their jurisdiction available for such purposes. SEC. 705. Visual Resource Evaluation Optasite Towers LLC seeks approval to construct a telecommunications Facility within the Town of Agawam,Massachusetts to be located on property at 369 Main Street(host property).This"Visual Resource Evaluation"was conducted to approximate the visibility of the proposed Facility within a two-mile radius of the Site(Study Area). Portions of the neighboring municipalities of Springfield and West Springfield are contained within the Study Area and as such have been included in this analysis. Project introduction The proposed Facility includes the construction of a 170-foot tall monopole and associated ground equipment to be located within a fenced enclosure at the base of the tower. Based on information provided by the project engineer,Maguire Group Inc.,the proposed project area would be located at approximately 62 feet Above Mean Sea Level(AMSL). Access to the proposed Facility would primarily follow an existing gravel driveway currently located on the host property. Site Description and Setting The host property is identified by the Town of Agawam Assessor's Office as three contiguous parcels of land depicted on Assessor's Map No.K13,Block 2,Lots 9,6,and 2. Lot 9 of the host property contains 20.17 acres of land,which is currently utilized as Mushy's Driving Range. Lot 6(±0.78 acre)of the host property is currently occupied by the Main Street Grill restaurant,and Lot 2(t2.47 acres)currently exists as undeveloped,manicured lawn. The proposed Facility is situated within the northern portion of Lot 9,located just north of the driving range limits. This area is currently open,undeveloped grass land. Land use within the general vicinity of the host property is mainly comprised of various commercial and industrial parcels Iocated along Main Street. Further to the west/southwest,the predominant land use transitions to medium-density residential parcels. The Study Area contains approximately 224 linear miles of roadways. This includes segments of Interstates 91 and 291 as well as a number of key,state-numbered routes such as Route 147,Route 75, Route 57,Route 20 and Route 5. The topography in the Study Area is generally characterized by gently rolling hills that range * in ground elevation from approximately 50 feet AMSL to just over 200 feet AMSL. The tree cover within the Study Area consists of mixed deciduous hardwood species.The tree canopy occupies approximately 2,700 acres of the 8,042-acre study area(34%). During the in-field activities associated with this analysis,an infrared laser range finder was used to accurately determine the average tree canopy height throughout the Study Area. Numerous trees were selected for measurement and the average tree canopy established,in this case 65 feet. Lastly,the Study Area contains approximately 882 acres of surface water,dominated in large f W0999.10XYV0rls%agawam_vis"_re;wLcbc 1 L[7� Vanasse Hangen$rustlin,Inc measure by portions of the Connecticut River to the east and the Westfield River located to i the north. ■ METHODOLOGY To estimate the visibility associated with the proposed Facility,VHB incorporates a two-fold approach utilizing both a predictive computer model and in-field analysis. The predictive model is employed to assess potential visibility throughout the entire Study Area,including private property and/or otherwise inaccessible areas for field verification. A"balloon float" and Study Area drive-through reconnaissance are also conducted to obtain locational and height representations,back check the initial computer model results and provide photographic documentation from publicly accessible areas. Results of both activities are analyzed and incorporated into the final viewshed map. A description of the methodologies used in the analysis is provided below. Visibility Analysis • Using ESRI's ArcView®Spatial Analyst,a computer modeling tool,the areas from where the proposed Facility is expected to be visible are calculated. This is based on information entered into the computer model,including the height of the proposed Facility,its ground elevation,the surrounding topography,existing vegetation and/or any significant structures/objects that may act to obstruct potential views. The base topographic data was derived from the 1:24,000-scale USGS National Elevation Dataset. The forest layer was derived through on-screen digitizing in ArcView@ GIS from high resolution,2005 natural color digital orthophotos obtained from MassGIS. Once the data are entered,a series of constraints are applied to the computer model to S achieve an estimate of where the Facility will be visible. Initially,only topography was used as a visual constraint;the tree canopy is omitted to evaluate all areas of potential visibility without any vegetative screening.Although this is an overly conservative prediction,the initial omission of these layers provides a reference for comparison once the tree canopy is established and also assists in the evaluation of potential seasonal visibility of the proposed Facility. A conservative tree canopy height of 50 feet is then used to prepare a preliminary viewshed map for use during the Study Area reconnaissance.The average height of the tree canopy is determined in the field using a hand held infra-red laser range finder.The average tree canopy height is incorporated into the final viewshed map;in this case,65 feet was identified as the average tree canopy height. The forested areas within the Study Area were then overlaid on the elevation grid with a height of 65 feet added and the visibility IW0999.t01repon5ingawam t�sual_repnrl.doc 2 f1J17 Vanasse Hangen Brusthn,Inc. calculated. The forested areas are then extracted from the areas of visibility,with the assumption that a person standing among the trees will not be able to view the Facility. Balloon Float and Study Area Reconnaissance On March 9,2007 Vanasse Hangen Brustlin Inc.,(VHB)conducted a balloon float at the proposed Facility in order to evaluate the potential viewshed within the Study Area.The balloon float consisted of raising and maintaining a tethered,helium filled weather balloon at the proposed Site location at a height of 170 feet.Once the balloon was aloft,VH13 personnel drove the public road system in the study area to inventory those areas where the balloon was visible. During the balloon float,weather conditions were sunny with temperatures r ranging from approximately 5 to 25 degrees Fahrenheight. Photographic Documentation r During the balloon float,VHB staff conducted a drive-by reconnaissance along the roads located within the Study Area with an emphasis on nearby residential areas and other potential sensitive receptors in order to evaluate and refine the results of the preliminary viewshed map and to verify where the balloon was,and was not,visible above and/or through the tree canopy. The balloon was photographed from a number of different vantage points to document the actual view towards the proposed Facility. The locations and orientations of the photos are described below: 1. For the 35 mm camera format,which gives a 24x36 mm image,the normal focal length is about 50 minn"' The optical zoom lens for the Nikon COOLPLX was set at a range of 50 mm to 70 mm for the purposes of this Visual Resource Evaluation. The locations of the photographic points are recorded in the field using a hand held GPS • receiver and are subsequently plotted on the maps contained in the attachments to this document. Photographic Simulation Photographic Simulations were generated for the eleven locations identified above. The Photographic Simulations represent a scaled depiction of the proposed monopole from these locations. The height of the Facility is determined based on the location of the balloon in the photographs and a proportional monopole linage is simulated into the photographs. The simulations are contained in Attachment A. ■ CONCLUSIONS • Based on this analysis,areas from where the proposed 170-foot monopole would be visible above the tree canopy comprise approximately 124 acres,or roughly 1.5 percent of the 8,042- acre Study Area. As depicted on the attached viewshed map,visibility associated with the proposed Facility is primarily confined to the host property and portions of Main Street • located within the immediate vicinity thereof;the Eastern States Exposition Grounds and adjacent portions of Route 147 to the north; undeveloped,open fields to the east;and an approximate 0.35-mile segment of Route 57 located to the south. Other areas of year-round visibility include select portions of Interstate 91,Route 147,Columbus Street and several locations on private,industrial properties to the northeast. In general,land use within these areas is non-residential. As such,potential views of the proposed Facility from private • residences would be minimal. VHB estimates that approximately S residences within the Study Area would have partial,year round views of the proposed monopole from select portions of their properties. Of these properties,three are located along or adjacent to Main within the general vicinity of the proposed Site Street(including limited segments of Harvey Johnson Drive,Cooper Street and Federal Street)while the remaining five properties are located just over one mile away along Columbus Street where several residences located on the south side of the roadway have open views in the direction of the host property. The viewshed map also depicts additional areas where seasonal(Le.during"leaf off"conditions) views through the trees are anticipated. These areas comprise approximately 63 additional acres and are mostly limited to the immediate vicinity of the host property.
