REGULAR MEETING OF THE AGAWAM CITY COUNCIL
Minutes dated May S, 2014
• Meeting was called to order by President Johnson at 7:00pm at the Auditorium at the
Roberta G. Doering School, 68 Main Street, Agawam.
Item 1. Roll Call
ROLL CALL —10 PRESENT, 1 ABSENT (Councilor Mineo)
Roll Call was taken with the following councilors present: George Bitzas, Cecilia
Calabrese, Paul Cavallo, Council President Christopher Johnson, James Cichetti, Gina
Letellier, Vice President Dennis Perry, Robert Rossi, -Donald Rheault and Anthony
• Suffriti. Councilor Joseph Mineo was not in attendance but should be arriving shortly.
With ten councilors present,there was a quorum.
Item 2. Moment of Silence and the PledgeofAllegiance.
President Johnson asked for a moment of silence and the Pledge of Allegiance.
Item 3. Citizen's Speak Time
There was only one citizen signed up to speak. Henry Kozloski spoke about the Annual
CPA Public Hearing which will be on May 28th at 7pm in the Senior Center and the
public is encouraged to attend.
Item 4. Minutes
There was a Motion to approve the April 22, 2014 Regular City Council meeting minutes
i made by Councilors Cichetti and Rheault and seconded by Councilor Letellier. The
minutes were approved by a vote of: 9 Yes, 0 No, 1 Abstention (Councilor Suffriti) and
1 Absent (Councilor Mineo).

Item 6. Presentation of Petitions. Memorials A Remonstrances
1. TR-2014-21 - A Resolution accepting a Grant in the amount of One Thousand
Five Hundred ($1,500.00)Dollars from the Massachusetts Emergency
Management Agency Project Management Office pursuant to Massachusetts
General Laves Chapter 44,Section 53A for Haz-Mat Planning Activities(Mayor)
Motion was made by many including Councilors Rheault and Cichetti and seconded by
• Councilor Suffriti.
The Resolution was approved by a vote of 10 Yes, 0 No, 1 Absent(Councilor Mineo).

2. TR-2014-22 - A Resolution confirming the reappointment of Henry Kozloski, 102
Meadow Street,Agawam,Ma to the Community Preservation Act Committee to
a term expiring April 30,2017 (City Council)
Motion was made by Councilors Bitzas and Cavallo and seconded by Councilor Cichetti.

The Resolution was approved by a vote of 10 Yes, 0 No, 1 Absent(Councilor Mineo).
3. TR-2014-23 - A Resolution confirming the reappointment of Violet Baldwin, 1245
Main Street,Agawam,Ma to the Community Preservation Act Committee to a term
expiring April 30,2017(City Council)
Motion was made by Councilors Rheault and Rossi and seconded by Councilors Cichetti
and Cavallo.
The Resolution was approved by a vote of 10 Yes, 0 No, 1 Absent (Councilor Mineo).
Council President extended thanks to both Henry Kozloski and Vi Baldwin for their
continued service and dedication to the town.
Next Agenda and referred to the Administrative Sub-Committee.

• 2. PH-2014-2 (TOR-2014-4) -An Ordinance amending the Zoning Code of the
Town of Agawam creating the Mixed Use Business C District (Planning Board)
(Referred to Legislative Committee) (Two Readings Required) - Public Hearing
Date set for May 19,2014
This item was tabled until May 19,2014.

3. PH-2014-3 (TR-2014-20) - A Resolution adopting the Fiscal Year 2015-2019
Capital Improvement Program (Referred to Finance Committee) (Mayor) — Public
Hearing Date set for June 2,2014

Item 10. Old Business
1. (TOR-2014-1) (PH-2014-1) -An Ordinance to Amend the Zoning Ordinance of
the Town of Agawam to allow Registered Medical MarijuanaFacilities (Planning
Board) (2 of 2 readings)
Motion was made by Councilor Cavallo and seconded by Councilor Cichetti. Councilor
Rossi questioned whether the town could receive any licensing fees, taxes or anything to

aid the town if one of these facilities were to be in Agawam. The ordinance contained no
provision regarding the collection of certain taxes or licensing fees. Councilor Suffriti
also expressed this concern about a collection of program fees similar to sales tax and
whether or not local government could impose these taxes. Council President stated that
the City Council is the licensing authority in town and referred this to the Legislative
Committee to investigate whether or not these fees could be imposed solely by the
Commonwealth or if local communities could do this however the item being voted on
this evening only concerned the zoning.
The second reading of the Ordinance was approved by a vote of 10 Yes, 0 No, 1 Absent

2. TOR-2014-2 - An Ordinance to Amend the Code of the Town of Agawam to
Establish the Agawam Housing Committee (Councilor Johnson) (Referred to
Legislative Committee) (2 of 2 readings)

Motion was made by Councilor Letellier and seconded by Councilors Cichetti and Bitzas.
The second reading of the Ordinance was approved by a vote of 10 Yes, 0 No, 1 Absent
(Councilor Mineo).

3. TOR-2014-3 - An Ordinance to Amend the Chapter 114 of the Agawam Town
Code entitled "Junk and Secondhand Dealers"(Mayor)(Two Readings Required)
Motion made to leave this item on the table by Councilor Rossi and seconded by
Councilor Rheault. It was unanimously approved by a voice vote.
4. TO-2014-10 -An Order granting or renewing a LICENSE for an Automatic
Amusement Device and Weekly Amusement Permit for Six Flags New England
located at 1623 Main Street,Agawam,MA (Clerk)
• Motion was made by Councilor Rheault and seconded by Councilors Rossi, Letellier and
Cichetti. Councilor Rossi gave the report of the Administrative Committee stating that
his committee gave a positive recommendation for approval of this item.
The item was approved by a vote of 10 Yes,0 No, 1 Absent (Councilor Mineo).

Item 11. New Business
1. TO-2014-11 - An order approving the Site Plan for the Class 2 Dealer's
License of Dino Carando d/b/a Euro Imports at 325 Main Street, Agawam,
MA (Council)
Next Agenda, referred to the Administrative Committee.
Item 12. Any other matter that may legallE come before the Ct Council.
Councilor Calabrese along with the entire Council wished everyone a Happy Mother's
Day. Councilor Letellier mentioned the receipt of a Memo from Jennifer Bonfiglio,
Administrative Assistant to the CPA, regarding using CPA funds for the track project.
Councilor Letellier strongly suggests that the Mayor consider using these funds when we

get to that point. Councilor Bitzas agreed. Council President stated in a recent meeting
with the Mayor that the Mayor is not opposed to using CPA funds. He is just trying to
find the right balance of town and CPA funds. Council President suggests having a
workshop at some point regarding this. Council President also discussed the upcoming
receipt of the Operating Budget which is anticipated to be May 15`h. If the suggested
public hearing is at our June 16 Council meeting, it only leaves a little over thirty days
to review. The suggestion was made and agreed upon to have a Special Meeting of the
City Council on June 23 d at which the Council will hold their public hearing for the
Operating Budget. As was done last year, the administration will provide a two-day
presentation of the budget by Department Heads. Barbara will work with the Mayor's
Office to try to schedule these during the first two weeks of June. Councilor Letellier
also requests a hard copy of the year to date reports from the Auditor.
