CC MTG MINUTES NOVEMBER 7 2018 REGULAR MEETING OF THE AGA WAM CITY COUNCIL Minutes dated November 7, 201 S ' Meeting was called to order by Council President Johnson at 7:00pm in the Auditorium at the Agawam Junior High School, 1305 Springfield Street, Feeding Hills. Council President Johnson welcomed everyone to the new location and thanked everyone for their hard work in the move. He pointed out all of the exits in case of emergency as well as noting where the bathrooms were located. ' Item A. Roll Call ROLL CALL—8 PRESENT,3 ABSENT ' Roll Call was taken with the following councilors present: George Bitzas, Council Vice President Cecilia Calabrese, Paul Cavallo, Council President Christopher Johnson, Dino Mercadante, Joseph Mineo, Robert Rossi and Anthony Suffriti. Councilors Letellier,Magovern and Sandlin were absent. With eight present,there was a quorum. Item B. Moment of Silence and the Pledge ofAlle2iance. Council President Johnson asked for a moment of silence and the Pledge of Allegiance. Item C Citizen's Sneak Time ' Mayor Sapelli thanked Jeff Hulbert, IT Director, who played a key role in getting the Jr. High ready for bringing the meetings to the Jr. High. There was a lot involved and together with a very active Cable Commission (which is ' chaired by Les Tingley along with Doug Reed, Derek Jarvis, Ray Moreau and Richard Janik), they were able to get it all done in time for this evening. They expect to have 80"TV monitors soon as well as future live streaming. Mayor Sapelli also stated that he attended the Administrative Committee meeting earlier and presented a letter to them regarding the street acceptance. He read the letter into the record. TR-2018-53 - A Resolution adopting the order that Abbey Lane be laid out and accepted as a Public Way(Mayor Sapelli)(Referred to Administrative Committee) Motion to accept made by Councilor Rossi and seconded by Councilors Suffriti and Cavallo. Councilor Johnson thanked the members of the Administrative Committee for all of the hard work involved in viewing the streets and ' holding three separate public hearings. He also thanked Barbara Bard for being the "cruise director" and keeping everything organized. As Chair of the Administrative Committee, Councilor Rossi provided a report also thanking all involved in getting this done. There were three separate meetings on October 4 h, 9`h and 18`6 involving 29 streets to be viewed and accepted and then Public Hearing were held where abutters had an opportunity to speak. The committee found no issues with any of the streets and sent a positive recommendation to the Mayor and Council for acceptance of the streets. In the meeting, Mayor Sapelli presented the Administrative Committee with a written letter of recommendation as well. Councilor Rossi stated the Administrative Committee is providing a formal recommendation to adopt TR-2018-53 through and including TR-2018-81. ZC-2018-3 (PH-2018-11) - Petition for Zone Change by owners Blue Sky Builders, LLC dfb/a Burns Builders and Gustin Caruso, Sarah Whitman and Cynthia Rimek for property located at 0 Silver Street and 0 Doane Avenue from Industrial B and Residence A-1 to Residence A-1 (Referred to Legislative Committee) Council President noted that a protest petition was received by Council Administrative Assistance and then turned over to the City Clerk. Council President requested a written legal opinion from the Solicitor since he believed that this protest petition triggered a change in the voting requirements per M.G.L. Chapter 40A, Section 5. The Solicitor stated indeed it changed the required vote from a two-thirds vote to a three-fourths vote. Council President Johnson then stated that since there were only eight councilors present and nine votes were necessary to approve the zone change, he would be asking for a tabling motion after the conclusion of the Public Hearing. Council President Johnson declared the Public Hearing open at 7:27pm. Prior to making his presentation, the Petitioner Kirk McNaughton asked if it made sense to have a continuance since only eight councilors were present. Council President noted that the absent councilors would have minutes and video available to review prior to taking any vote and it did not make sense to continue the Public Hearing since it had already been advertised and residents were in attendance to speak. Kirk McNaughton made his presentation. Councilor Mercadante asked what the price point of these homes would be to which Mr. McNaughton replied $450,000 - $500,000. Council President Johnson inquired if the wooded area would be deed restricted. Mr. McNaughton stated that as suggested by Mass Heritage there would be a permanent deed restriction in a land trust. No one else spoke in favor or in favor name only. The following residents spoke in opposition of the zone change: Ruth Cossimini, Jim Consolini, Rock (?) and Stu Kibbe. They raised issues of traffic concerns and noted that this item had been previously rejected and wondered what had changed from then to now. No one else spoke in opposition name only. Mr. McNaughton asked for permission to address some of the issues raised. He mentioned that he received preliminary approval by both the APD and DPW regarding traffic issues agreeing on `illegal to enter' signage placed as you would enter from new street onto Doane Avenue. He also stated he now had an approved ten lot sub-division. In the interest of fairness, Council President asked if anyone in opposition would like 1 to speak. Jim Consolini asked what the legal process would be to place signage on streets. He also heard there were wetlands in the back of the property. Council President Johnson declared the Public Hearing closed at 7:56pm. Councilor Rossi asked for a copy of the traffic and police studies and wanted to know if there were any significant changes from the previously defeated zone change and the current one. Council President stated we would ask for this any information from Engineering and Planning. Motion to table made by Council Vice President Calabrese and seconded by Councilor Suffriti. He also noted how nice it was to see the Pride Station on Main Street demolished. He mentioned that it was very difficult to hear speakers at the podium. Council Vice President Calabrese discussed the recent tour of the Tuckahoe property noting its breathtaking beauty which would be perfect for passive recreation and thanked the Mayor for organizing the tour. Councilor Cavallo also thanked the employees of the DPW who took the time to take them on the Tuckahoc tour. Councilor Bitzas congratulated everyone in town for turning out to vote and thanked the poll workers as well. He mentioned that our town is looking better and better every day.
