CC MTG MINUTES OCTOBER 24 2018 LEGISLATIVE SUB-COMMITTEE MINUTES October 24, 2018 'resent: Robert Magovern- Chair ' George Bitzas—Vice Chair Robert Rossi Absent: Cecilia Calabrese and Rosemary Sandlin Also Present: Councilors Cavallo, Solicitor Buoniconti and Kirk McNaughton Called to Order: Meeting was called to order by Chairman Magovem at 7:00pm in the Peirce Room at the Agawam Public Library, 750 Cooper Street, Agawam. iAGENDA 1. Approval of Minutes dated September 5, 2018 Motion to approve the minutes was moved by Councilor Bitzas and seconded by Councilor Rossi. ' The vote was 3 YES,0 NO, 2 ABSENT(Councilors Calabrese and Sandlin) approving the minutes. 2. TOR-2018-13 (PH-2018-7) - An Ordinance to amend the Code of the Town of Agawam Zoning ' Ordinance to include a table of uses and dimensions (Mayor Sapelli) (Two Readings Required) — Public Hearing set for Nov. 7,2018 (Tabled 10/1/18) �olicitor Buoniconti explained that zone changes dealing with the table of uses and dimensions will be phased out t the end of Motion to send a positive recommendation to the Full Council made by Councilor Rossi and seconded by Councilor Bitzas. ' The vote was 3 YES,0 NO,2 ABSENT (Councilors Calabrese and Sandlin) 3. TOR-2018-14(PH-2018-8) - An Ordinance to amend the Code of the Town of Agawam Zoning Ordinance to delete building material terms (Mayor Sapelli) (Two Readings Required) — Public ' Hearing set for Nov.7,2018(Tabled 10/1/18) Solicitor Buoniconti explained that any reference to building materials are to be removed in the ordinance. Motion to send a positive recommendation to the Full Council made by Councilor Bitzas and seconded by Councilor Rossi. The vote was 3 YES, 0 NO, 2 ABSENT (Councilors Calabrese and Sandlin) 4. TOR-2018-15 (PH-2018-9) - An Ordinance to amend the Code of the Town of Agawam Zoning Ordinance to delete special use permit exceptions (Mayor Sapelli) (Two Readings Required)—Public Hearing set for Nov. 7,2018(Tabled 10/1/18) ' Solicitor Buoniconti explained that this ordinance is (1) Deleting the special use permit exception language and (2) they are amending the time requirements of notice to other departments for special permit process and(3)amending or the conditions of review on a special permit. Motion to send a positive recommendation to the Full Council made by Councilor Bitzas and seconded by Councilor Rossi. The vote was 3 YES,0 NO, 2 ABSENT(Councilors Calabrese and Sandlin) 5. TOR-2018-16 (PH-2018-10) - An Ordinance to amend the Code of the Town of Agawam Zoning ' Ordinance regarding mobile homes (Mayor Sapelli) (Two Readings Required)— Public Hearing set for Nov. 7,2018 (Tabled 10/1/18) '*Solicitor Buoniconti explained that they are creating an exception to Residence A-2 that allows mobile homes to be occupied on a temporary basis up to 12 months. Motion to send a positive recommendation to the Full Council made by Councilor Bitzas and seconded by Councilor Rossi. The vote was 3 YES, 0 NO,2 ABSENT (Councilors Calabrese and Sandlin) 6. ZC-2018-3 - Petition for Zone Change by owners Blue Sky Builders, LLC d/b/a Burns Builders and Gustin Caruso,Sarah Whitman and Cynthia Rimek for property located at 0 Silver Street and 0 Doane Avenue from Industrial B and Residence A-1 to Residence A-1 (Referred to Legislative Committee)—Public Hearing set for Nov.7, 2018 Kirk McNaughton made a presentation of his proposed sub-division. Motion to send no recommendation to the Full Council until after the Public Hearing at the November 7`h City Council meeting made by Councilor Bitzas and seconded by Councilor Rossi. The vote was 3 YES, 0 NO, 2 ABSENT (Councilors Calabrese and Sandlin) ' 7. Any other business that may legally come before the Committee. None. 168. Adjournment.
