meeting for Monday, November 17, 2008. Barbara could you please call the roll?

President Letellier—Thank you. We have one item of agenda this evening and that's to
go into Executive Session to discuss personnel. Moved by Councilor Calabrese to go
into Executive Session, seconded by Councilor Rossi, Barbara, could you please call the

have a meeting. I mean, I would like to attend.

the Auditor time to put her information together.

1. TOR-2008-4 -An Ordinance Amending Article XIII
of the Code of the Town of Agawam Governing Signs (Mayor)
President Letellier—This was tabled on November S'', this is the second reading. Do
we have a motion to take it off the table? Moved by Councilor Rheault, seconded by
Councilor Calabrese. Do we have a report from the Zoning or the Ordinance Committee?
Which of you wants to give this report? Councilor Rheault with the Ordinance
Committee.
Councilor Rheault—We had a joint meeting with the Zoning and Ordinance on 11/10.
Myself and Councilor Calabrese were present from the Ordinance. Councilor Messick
and Councilor Rossi from the Zoning. Also present was our Solicitor, Chris Johnson.
r Meeting was called to order at 7:00. And the first item of agenda was the review of the
Sign Ordinance in general and we had a lengthy discussion on it and we felt that the
ordinance as amended was sufficient with no other changes. And that vote was 2-0 and
0
also Zoning Committee sent a positive recommendation as the same. That was under the
first item. We've got a separate item,haven't we?
President Letellier—Yes, we do. Why don't we stick to one, if that's okay,just for
record keeping purposes?
Councilor Rheault—So it's a unanimous vote by both committees to take that motion as
amended on the ordinance of the signs.
President Letellier—And we have a copy of the amended version right here.
Councilor Rheault—Yes. That fee was removed.

Councilor Perry. Do we have a report from the License Committee?
Councilor Rossi—Yes. Thank you. The License Committee met to discuss the Class II
Licenses and the renewal of the Amusement Licenses and we find no reason not to
reissue these licenses and it was unanimous that we submit a positive recommendation to
the Council for approval. And if it pleases the Council, I would like to take these as one
grouping, rather than doing individually for the sake of saving time and they would be
included and I would break them down into two parcels because one is Class II Dealers
and the others are Amusement Licenses and we'll take these two separately if you will.
The Class II Dealers License will be TO-2008-51, -52, -53, -54, -55, -56, -57, and-62.
Those are all Class II Dealer Licenses that the committee would submit a positive

recommendation to the Council.
• President Letellier— Let's do that by a motion to consolidate,that way if anybody wants
to vote no or abstain, we won't consolidate them.

Councilor Rheault—Yes. Again,we met on 11/10 regarding this ordinance and the
general discussion, it's a standard procedural item requested by the state and the vote was
2-0 from the Ordinance Sub-Committee and the Zoning Review Sub-Committee to send
• a positive recommendation for approval from the Council.

Councilor Calabrese--What we're doing is establishing the DPW as the permitting
granting authority and establishing the fee at the lowest possible fee which is $25.00.

nights.

President Letellier— Thank you Councilor Simpson. Councilor Mineo?
Councilor Mineo--Welcome back Gina and good luck with everything and that's it for
me tonight. Thank you.
President Letellier—Thank you Councilor Mineo. Councilor Cavallo?
Councilor Cavallo—Yea. I have one item. At the last meeting I brought up the problem
I thought with the cable TV and the way our program is being transmitted and so forth
and when I took upon myself to visit with our Auditor, Cheryl, and I have some
information to report to you regarding ...application and the Cable TV, Comcast Cable,
reimburses the town or gives the town a check based on the entire proceeds they received
for the year and we get 1 '/z % of that gross revenue and in the year 2007, the town
received $113,913.00. In 2008,just recently, we received $117,895.00. As of 11/1 when
• I spoke with Cheryl, she said the balance in the account was $213,000.00 so she wasn't
quite sure exactly how this money is expended except I did call, she told me to call, Jeff
Hulbert who is the IT Director. He told me that of the amount that comes in basically
$100,000.00+ every year, $4,700.00 a month is paid to Comcast for rental of the fiber
optic cable that was installed. Okay? That's part of it. And when I asked about the
remaining money, well he said sometimes we do updates and so forth and so on and I
looked at the amount, I'm looking at$213,000.00 as a balance. Then in addition to that,
the Town receives two $10,000.00 grants from Comcast, every year, this is a given. One
of them is in account#608 and it's called the PEG account. It's actually devoted or
designated for updating cable TV, new control board,buying cameras and so forth.
• That's one account and Tony that's maintained the cameras, etc. etc. The other account
is a#607 account and that is for data support. This is what Jeff Hulbert told me okay? I
don't know how much money has been expended out of either of these two grants. Upon

further investigating, I discovered and it kind of came through me after talking with some
people including Jeff, that the new Senior Center may certainly become our home in the
• future for telecasts of both School Committee meetings and City Council meetings
because that will be equipped with up-to-date technology for televising more so than here
and I asked Jeff I said why can't we do something here with the cable? And he said the
cable that we have here that they transmit through is a coaxial cable. Now I'm not an
engineer and you really need the fiber optic to be updated and the cost would be
• prohibitive to install a new cable. In fact he said, we're better off renting from cable TV
because that makes more sense if we bought the fiber optic cable, that cost would be
prohibitive too. So I just wanted to bring you up-to-date of the money that's in that
account and contrary to what somebody had told me, they thought the money went into
the General Fund, it does not go into the General Fund, there are three designated
accounts for that money. So I just thought that you would want to know. My only
question would be I would like somewhere down the line, and I'm not trying to check on
anybody to see how the money is being spent,but I'd like to see how this balance over
the next twelve months,how that's gonna be designated and exactly what are the updates.
Is the School Department using some of this money which is fine to update their
technology? I don't know. We obviously don't have any control over this but it would
be interesting for us to I think delve into this a little bit. That's a sizeable amount of
money and especially with the fact that they said that in the future, again, my
investigation, if when the new contract comes up in three years I believe, right Ray,three
years, if we don't start using some of these $10,000.00 grants, okay, then that could very
well be taken away from us in a contract negotiation. Now in West Springfield,Ray told
• me that he visited West Springfield and they're truly using their access channel like it
should be used. Senator Buoniconti twice a month or once a month gives a report to his
constituents via the access cable channel. There are programs that are going on that
students do that are again televised and they are, you know,people can view them on the
access channel. So there's a lot that can be done with this channel 15 that we have and
I'm not throwing any stones at anybody here but we should be making and utilizing this
particular program that we have to its full capacity. So somewhere down the line, we've
gotta see if maybe we can initiate something to get it doing, especially if we have the
Senior Center as our main base and I believe you said that 200 people, Mr. Rossi, it will
hold in the audience, right?

Councilor Rossi--I don't know.
Councilor Cavallo—You don't know but there's an auditorium there, is there not? I
think, well anyway, if that's our home base, there's no reason why we can't be doing
something with that as well in terms of even the Council communicating to the people. I
know I'm going a little further but I just wanted to get that, Councilor Perry, all due
respect to you, I just wanted to get that information out to you. I hope it was of some
value. Okay, thank you very much.
• President Letellier—Thank you. Well, while you were speaking, Vice President
Calabrese and I brainstormed and we're gonna make an Ad Hoc Committee on that—
Technology and the cable vision and we'll think of a good name for it. So if anybody

wants to volunteer with Councilor Cavallo to figure out what to do with this cable system
and with all that money to make recommendations with the Mayor's office, we can
• certainly do that. All right? So we'll have Councilor Cavallo and anybody else who's
interested let Barbara know or let me know. Oh, Councilor Simpson. Oh, we've got
Councilor Messick and Councilor Perry, who wants it more? Oh, Councilor Mineo.
Okay, Councilor Mineo, you have a lot of time on your hands now that you're not on the
Sewer Committee anymore. Thank you Councilor Cavallo. Next we have Councilor

Councilor Bitzas—Point of Information? I think the Mayor also has a committee.
President Letellier—The Mayor has a Cable Committee.
• Councilor Bitzas—Ray is a member of it so I think they should coordinate the
committees.

President Letellier— So we'll figure out the name of the Committee and then you can
coordinate with the Mayor's office for your meetings. Councilor Rossi?
Councilor Rossi—Thank you. First I'd like to say that I've never, ever been in the
Senior Center, so I really don't know what that is. I haven't been invited. When I'm
• invited, I'll take a look around.

Councilor Rossi—Yea, maybe I could get an invitation,he seems to be invited
everywhere.

Councilor Rossi—And the other thing too maybe if, and this is just a suggestion to the
Chair, maybe the chair would like to hand this over to the Finance Committee for an
• audit on that thing.
President Letellier—If that's a recommendation by the sub-committee then that's what
we'll do,but let's do some digging before we make accusations, let's figure out what's
going on.

Councilor Rheault—And second, there is rumor that we are going to relocate down to
the Senior Center. Do you have any idea on the time frame?
President Letellier— I do not. Let's send a letter off to find out.
Councilor Rheault—And it's my understanding from the Mayor's comments,that
there's a room that will hold as many people as this auditorium, that's what I hear. I
don't have the privilege of that tour myself. That's all this evening.

• Councilor Perry—Just a few things, thank you, Madam President and welcome back.

Councilor Perry—You know when we approved the Senior Center, I don't remember a
200 seat auditorium there. That's what I was shaking my head at Paul--a two hundred
seat auditorium? Where? I don't remember. The third floor maybe, I don't know,
whatever. But if we could, Madam President, it's been brought to my attention that, I
think we've all received some of the memos from the Mayor in regards to the economic
times and the budgets and looking at reducing department heads in their, well not
department heads but they're asking the department heads to reduce their budgets a
certain amount, I think in our last packet, there was 3%, 5% or 7%or that type of thing,
it's been brought to my attention,we spent millions of dollars on the new DPW garage to
get the DPW out of that place on Main Street. I have it from a good source that they're
actually putting money into that old building down there and rumor has it that they're
moving Building Maintenance down there, from the High School down to the old garage
+ on Main Street.
President Letellier— Sounds like something for the Public Safety Committee?
Councilor Perry—Okay, well I can do that, that's not a problem but I just thought I
would bring it to your attention, I found that out the other day in regards to that. They're
working on it. They're moving Building Maintenance there. I heard Park&Rec is
moving out of the high school to make rooms. I mean so there's a lot of things going on
that and where's this money coming from and how's it being spent? And I'll gladly look
into it,that's not a problem.
President Letellier—Please do because when we created that committee, there were
complaints about rats and -

Councilor Perry—The DPW Liaison Committee is what you're getting at?

President Letellier—other vermin and yes, we had the DPW, and we took a tour and it
wasn't fit for man nor beast, right? So suddenly it's fit for occupation again?
Councilor Perry—I'm assuming.
President Letellier—Yes, it was not fit for man nor beast so why it suddenly is fit again
is beyond me.
Councilor Perry—I don't know but that's what they told me.
President Letellier—It will be in your good hands, Councilor Perry.
Councilor Perry--Okay, not a problem and I think this is our last meeting before
Thanksgiving so I'd like to wish all of my colleagues a Happy Thanksgiving and to the
crew here, the camera crew and everybody at home. Happy safe Thanksgiving! Thank

Councilor Messick—Well, I do actually have a comment for public cable. I would
actually prefer not to be seen more clearly. I kind of like it fuzzy. No, I actually heard
the least rumors of anybody sitting here this week. I hadn't really heard much at all but I
do want to remind everybody and it was a nice lead in from Councilor Perry, that
Thanksgiving is coming up. There is still a desperate need in all the local food pantries,
every single one of them needs either funding or canned goods or donation of turkeys.
I've heard of one shelter down in Hartford that's anticipating the need for 15,000 turkeys
this year. There's more than double the need so please give as generously as possible as
soon as you can and Happy Thanksgiving. Thank you.

reminder that the Finance Committee is meeting this Wednesday at 7:00 pm in cafeteria
here in the Middle School to review the information from the Treasurer and the Assessor
on the tax factor and their recommendations and the Finance Committee will be looking
at that to come up with a recommendation for the next meeting on the tax factor. I

believe and with the communication I got from the Assessor today that he would be
looking to have Barbara help him deliver that information to I don't know if it's the Full
• Council or the Sub-Committee. I asked specifically to get it before the meeting so we
didn't get surprised when we got there so work it out and let me know if there's an issue
and maybe we can arrange for a courier or something. Thank you.

Councilor Calabrese—Welcome back Madam President. It was really my honor and
privilege to step in for you but I'm so glad you're back. I'm gonna put in a request now
for soft focus if we do go with fiber optic cable. I just want to wish everybody a Happy
Thanksgiving and we'll see you all in December.
President Letellier-- I have a couple things. One Happy Thanksgiving to everybody and
thank you all for your kind words and thoughts and the public as well that saw me and
congratulated me. There is one item of business and that is for the Ordinance Committee
to look at the issue of the Noise Ordinance. The letter that we got from Mr. Czelacewicz
. and from the Mayor's office, talking about the noise ordinance only applies to individuals
