TR-87-6 "TIGHE & BONE} l L ComSU4.TING ENGINEERS 1 Resolution No. TR-87 6 ' 2 A Resolution Authorizing The Order of Taking 3 tinder The Authority of Section 14 of Chapter 40 4 and of Chapter 79 of The General Laws for ' 5 The Phase IV Sanitary Sewer Project 6 ' 7 WHEREAS, in the interest of the public's safety, health and welfare, 8 it is necessary to construct the Phase IV Sanitary Sewer Project and May ' 9 Hollow Pumping Station; and 10 WHEREAS, the Town Council has appropriated $3,520,000 for the Phase ' 11 IV Project; and 12 WHEREAS, it is necessary to install portions of the Phase IV Sani- ' 13 tary Sewer System across private property; 14 NOW THEREFORE BE IT RESOLVED: ' 15 That the Town Council of the Town of Agawam adopt the Order of 16 'Taking - Phase IV Sanitary Sewer Project, and that under the authority of 11 Section 14 of Chapter 40 and of Chapter 79 of the General Laws, and of 18 all acts in addition thereto and in amendment thereof, and of all power 19 and authority the Town Council hereto enabling, and an appropriation of 20 money having been duly made for the purpose by a two-thirds vote of the 21 Town Council, under Part I of this Order permanent and temporary ease- ' 22 ments in the following described parcels of land within the limits of the 23 Town of Agawam, for the purpose of a common sanitary sewer, with all 24 necessary manholes and appurtenances, and alterations of grades and ' 25 slopes, within, through and upon the land hereinafter- described, together 26 with the right to enter including the right to cut, trim and remove any 27 and all trees and shrubbery located on land within said easements be and 28 hereby are taken, and Under Part II of this Order parcels of land within ' 29 the limits of the Town of Agawam, together with all trees thereon, and 30 all structures affixed thereto, and all rights therein both legal and 31 equitable, including all easements, privileges, appurtenances, restric- t 32 tions, conditions and all estates and rights or reverter for the purpose 33 of a common sanitary sewer, with all necessary manholes and appurtenances 34 and for the purpose of providing open space and recreation be and hereby ' 35 are taken in fee; - 36 PART I Easements ' 37 Said easements being shown on six (6) plan sheets (Sheets 1, 2, 3, 38 4, 5, 6, of 6) entitled: 1 l TIGHE & BOND CONSULTING ENGINEERS ' 39 Plan of Easements 40 For ' 41 Phase IV Sanitary Sewers 42 Town of Agawam, Massachusetts 43 Tighe & Bond, Consulting Engineers 44 Easthampton, Mass. 45 Date: March 2, 1987 46 and being more particularly described as follows: 47 Parcel No. 1 48 A permanent easement on land N/F of Raymond R. and Marguerite P. 49 Moreau.
