WHEREAS , in the interest of the public health, the environment of th community, and the water quality of rivers and streams the (-, municipality has constructed and operates and maintains a syst@p off-? sanitary sewers to provide adequate wastewater treatment , and c M S-7 WHEREAS , sewer system expansion over the past decade has increased principal and interest payments on sewer project bondl ttJ7 over $675 , 000 in fiscal year 1991 , and WHEREAS , the older portions of the sewer system are in neeg6 of - improvements to provide adequate capacity for future growth and.,�o c eliminate the discharge of combined sewers into our rivers , and— WHEREAS , due to reduced financial assistance from the Commonwealth of Massachusetts and limitations on the property tax revenues of the City, the general fund can no longer support the entire cost of these improvements, and WHEREAS , the City Ordinance states that all sewer users shall pay regular charges for service and that the sewer use charge and schedules of other charges and fees shall be determined by the Department of Public Works with the approval of the Town Council, Now, Therefore Resolved; That the City Council of the City of Agawam hereby approve the following rates for sewer use and the following fees and charges for services and system development. DPW q� To: Christopher C . 3ohnson, Mayor Subj : Sewer Use Rate - TR-90-19 1 The Department of Public Works recommends that Resolution TR-90-18 be amended effective with the issuance of bills based on ::peter readings -aken on or after May 1 , 1990 by adding the following. ' D . Those elderly citizens that own and occupy single family 7 homes and that qualify for clause 18 or clause 41C property tax exemption will be eligible to receive a 25% reduction in the sewer use rate on the first 2 , 500 cubic feet of water consumption in a 6 month billing period with a minimum charge of $12 . 50 for any billing period. Those elderly citizens that own and occupy single family homes and that qualify for a clause 17D property tax exemption will be -� eligible to receive a 10% reduction in the sewer use rate on the first 2 , 500 cubic feet of water consumption in a 6 month billing period with a minimum charge of $15. 00 for any billing period. These citizens must apply for said sewer use abatement at the office of the Department of Public Works prior to the due date of the sewer use bill and show proof of property tax abatement and occupancy. The Assessors determination for the tax year containing any January 1, shall be used for determining sewer use abatements for meter readings taken iii the calendar year containing the same January 1 . This amendment will in effect negate any increase in surer use charge for those elderly at poverty level (clause 18 ) or with limited income and assets (clause 41C - $12 , 000/year single , - $15 , 000/year :Harried and assets under $30 , 000 excluding domicile) and with average sewer use . This year Assessors report that no one met the clause 18 requi,rement in Fiscal 1990 and that 155 citizens qualified for clause 41C. For those elderly that qualify for clause 17D (no income limitation but assets excluding domicile not greater than $40 , 000) a 10% reduction would apply. There are under 100 elderly citizens who qualified for this tax exemption. The 5000 cubic feet established as the limit for the reduction represents the average yearly water useage for those elderly qualifying for tax exemption and would cover their basic living needs. Extensive lawn watering would cause their useage to exceed this level. No change in the recommended rate would be required at this level of abatement. f ohn P. Stone, Supt. DPW JPS/arc
