RESOLUTION TR-90— 19
A Resolution Authorizing the Transfer of Two Easements at
Marlene Drive to Nicholas J. 5 Marjorie Santinello for Sanitary
Sewer Purposes
WHEREAS, Two easements for sanitary sewer purposes were taken
on May 6, 1111 from Nicholas J. and Marjorie Santinello; and,
WHEREAS, New sanitary sewer easements were taken in 1987 by
eminent domain for the construction of the Phase IV sanitary sewers
through the Santinello property; and,
WHEREAS, Since the easements taken in 1974 were never utilized
by the Town of Agawam, the Town has been requested to return said two
easements to Nicholas J. and Marjorie Santinello;
NOW, THEREFORE, THE TOWN COUNCIL OF THE TOWN OF AGAWAM hereby
votes to return two easements taken for sanitary sewer purposes on
May 6, 1974 to Nicholas J. and Marjorie Santinello as specified on
attached plan.

EASEMENT FOR SANITARY SEWER SYSTEM
AGAWAM, MASSACHUSETrS
we, HICHOLAS T. and MARJORIE SANTINELLO,, the undersigned,
for consideration received, the sufficiency of which is hereby
acknowledged, hereby grant to Agawam:, a municipal. corporation
duly established under the laws of The Commonwealth of
Massachusetts and located in the County of Hampden, with its
principal office at 36 Main Street, in said Agawam, the
following described easements for public' purpose, to wit:
The purpose of constructing, repairing and maintaining
a sanitary sewer main necessary for public convenience and
health, over a parcel of land as hereinafter described,
not otherwise used for a public purpose, said easement or
right--of-Tway over said parcel to be an easement to lay,
operate and forever maintain a sanitary sewer system, and
to enter freely upon said parcel with such machinery, tools
and other apparatus as is necessary to alter, repair, renew,
inspect and examine the same, and to do any and all other
things reasonably necessary for construction and maintenance
of said sanitary sewer system, and to place upon said land
materials and apparatus during such construction, replacement
or repair.
The land within which said easements are hereby granted
is the same as shown on a plan entitled:
