WHEREAS, the Agawam School Nurses and the Agawam Community
Health Nurse through their designated collective bargaining

representative, the General Teamsters, Chauffeurs, Warehousemen etYl
and Helpers, Building Materials, Heavy and Highway Construction e�
Employees Local Union 404 have requested Agawam City Council
support for the special act contained herein; and
WHEREAS, the Agawam Clerical Employees through their
designated collective bargaining representative, the American [,LQAir.
Federation of State, County, and Municipal Employees, AFL-CIO
State Council No. 93, Local Union No. 1364 have requested Agawam SatxC 10A.J
City Council support for the special act contained herein; and
WHEREAS, it is in the best interests of the City of Agawam i
to secure passage of the special act contained herein. Au �n
NOW THEREFORE, the Agawam City Council does hereby resolve t�J
to support the filing of the following special act with the
' Senate and House of Representatives in General Court of the ('
Commonwealth of Massachusetts:
Section 1: Board of Health Established
The Board of Health shall consist of three (3) persons, one
(1) of whom shall be a physician. No one of them shall be a

member of the city council. One member shall be appointed in co :E-
January of each year for three (3) years from the first Monday of
the followingFebruary. The members shall be a y the
y. appointed b
mayor, subject to city council confirmation, and may be removed
by the mayor for cause, and vacancies shall be filled by
appointment for the residue of the unexpired term. The terms of
the existing members of the Board of Health shall continue r�
uninterrupted, with future appointments to be made in accordance
with this section.

Section 2: Organization of the Board of Health
The Board of Health shall organize annually by the choice of
one of its members as chairperson. It may make rules and
regulations for its own government.

Section 3: Appointment of Health Agent and Other Officers,
-
Employees oyees and-Assistants
There shall be a health agent appointed by the mayor, who
shall be designated as the chief administrative officer of the
department. The health agent shall be responsible for the
enforcement of the health laws and regulations promulgated by the
t Board of Health. Any other officers, employees and assistants
shall be appointed by the mayor. The health agent and all other
officers, employees and assistants shall work under the general
' supervision and direction of the mayor. The Board of Health
shall advise and assist the health agent and all other officers,
employees and assistants in the performance of their duties. The
' salary and compensation of the health agent and all other
officers, employees and assistants shall be set in accordance
with city ordinances.
' Section 4: Other Powers of the Board of Health
The Board of Health shall have all other powers and duties
granted to it under the laws of the Commonwealth of
Massachusetts, to the extent they are not inconsistent with the
express provisions of this act.
Section 5: Effective Date
1 This act shall take effect immediately upon its passage.
