A RES0=T1ON PPORTING THE PASSAGE OF SPEfJAL LEGISLATION
PROVIDING THAT PROPERTY OWNED BY THE W STMASS AREA
DEVELOPMENT CORPORATION LOCATED IN THE CITY KNOWN AS THE
' TOWN OF AGAWAM SHALL BE EXEMPT FROM TAXATION
WHEREAS, Springfield Area Development Corporation waste,,'-

formed by Chapter 192 of the Acts of 1960; and c_
WHEREAS, The Commonwealth of Massachusetts by Chapter 246�'�
of the Acts of 1963 provided that "Real property owned by thei-W
' [Springfield Area Development] corporation shall not be-
subject to taxation by the city or town in which it is located "
until ten years from the date of its acquisition or until such c
property is leased, rented or otherwise disposed of, whichever
is first. " ; and
WHEREAS, Springfield Area Development Corporation changed
its name to WestMass Area Development Corporation in 1981;
and
WHEREAS WestMass Area Development Corporation acquired

the property known as the Agawam Regional Industrial Park from
The Republican Company by deed dated December 31, 1982 and
recorded in the Hampden County Registry of Deeds at Book 5386
Page 345; and
WHEREAS, Pursuant to Chapter 246 of the Acts of 1963,
' WestMass Area Development Corporation's tax exempt status with
regard to the Agawam Regional Industrial Park shall expire on
December 31, 1992 ; and
WHEREAS, It is in the best interests of the Town of
Agawam to support the passage of the special legislation
' contained herein which provides that the property owned by
WestMass Area Development Corporation located in the city
known as the Town of Agawam shall be exempt from taxation for
the periods therein stated;

' NOW THEREFORE, the Agawam Town Council does hereby
resolve to support the filing and passage of the following
special act with the General Court of the Commonwealth of
Massachusetts:
' Section 1.
The real property owned by WestMass Area Development
' Corporation shall not be subject to taxation by the city known
as the Town of Agawam until December 31, 1997 or until such
property is sold, leased, rented or otherwise disposed of,
whichever is first, provided, WestMass Area Development
' Corporation records in the Hampden County Registry of Deeds
the existing Protective Restrictions for the Agawam Regional
Industrial Park on all the real property owned by it.
Section 2 .
The Agawam Town Council may by majority vote with the
concurrence of the Mayor continue the exemption from taxation
for real property owned by WestMass Area Development Corpora-
tion until December 31, 2002 or until such property is sold,
' leased, rented or otherwise disposed of, whichever is first,
but in no event shall said continuation be granted unless the
extension of the existing Bowles Road in the Agawam Regional
industrial Park is constructed by WestMass Area Development
' Corporation or the Commonwealth of Massachusetts from the
present layout terminus of said road some 1, 660 feet to Garden
Street at the Route 57 east bound on-ramp.
Section 3 .
' The provisions of this act shall take effect as of
January 1, 1993 .
