R 9 6 ` off� (A$ AMENDED - SEE ATTACHED) �-� A-LA . _1 � ce 3 a.V, A ROLUTIbN AUTHORIZING THE MAYOR TO OFFER FOR SALE IN ACCORDANCE WITH MASSACHUSETTS GENERAL LAWS CHAPTER 30B, AND TO EXECUTE ANY AND ALL DOCUMENTS TO SELL THE FRONTAGE LOTS ALONG PINE STREET IN THE FEEDING HILLS SECTION OF AGAWAM AND TO OFFER FOR LEASE IN ACCORDANCE WITH MASSACHUSETTS GENERAL LAWS 1 CHAPTER 30B, AND TO EXECUTE ANY AND ALL DOCUMENTS TO LEASE, IN WHOLE OR IN PART, THE LAND AND PROPERTY KNOWN AS THE "TUCKAHOE TURF FARM", LOCATED ALONG PINE STREET AND SOUTH WEST STREET, CONTAINING APPROXIMATELY 292 ACRES, IDENTIFIED AS PARCELS D5-1-1 AND C7-2-4 , AND FURTHER DESCRIBED IN TWO DEEDS RECORDED IN THE HAMPDEN COUNTY REGISTRY OF DEEDS AT BOOK 5574 , PAGE 220; AND BOOK 5364, PAGE 135, uT 1 FEEDING HILLS/AGAWAM, HAMPDEN COUNTY, MASSACHUSETTS w ter, FOR AGRICULTURAL PURPOSES r r WHEREAS, the Town of Agawam has authorized the acquisition of land and property known as Tuckahoe Turf Farm, located along Pine Street and South West Street, containing approximately 292 acres, identified as Parcels D5-1-1 and C7-- 2-4, and further described in two deeds recorded in the Hampden County Registry of Deeds at Book 5574, Page 220; and Book 5364, Page 135, Feeding Hills/Agawam, Hampden County, Massachusetts; and WHEREAS, it is in the best interests of the Town of ' Agawam to sell the frontage lots along said Pine Street; and ' WHEREAS, it is in the best interests of the Town of Agawam to lease, in whole or in part, said land and property for agricultural purposes; and NOW THEREFORE the Agawam Town Council hereb y resolves to authorize the Mayor to: ' (a) Offer for sale in accordance with Massachusetts General Law --Chapter 30B, and execute any and all documents to sell the frontage lots along Pine Street in the Feeding Hills section of Agawam; and ` (b) Offer for lease in accordance with Massachu- setts General Law Chapter 30B, and execute any and all documents to lease in whole or in part the land and property known as "Tuckahoe Turf Farm" , located along Pane Street and South West Street, containing approximately 292 acres, identified as Parcels D5-1-1 and C7--2-4, and further described in two deeds recorded in the Hampden County Registry of Deeds at Book 5574 , Page 220; and Book 5364, Page 135, Feeding Hills/Agawam, Hampden County Massachusetts for agricultural purposes. Locke, Solicitor AMENDMENT TO TR--93-26 Resolution TR-93-26 is hereby amended by adding the i following: (c) Apply any and all proceeds received from: (i) the sale of the frontage lots along Pine Street; (ii) the pursuit of an Agricultural Preservation Restriction; and (iii) the taking of land for Route 57 Phase II to the indebtedness incurred for the acquisition of Tuckahoe Turf Farm under TR-93-23. (d) Apply any and all proceeds received from the lease of the property known as Tuckahoe Turf Farm to the indebtedness incurred for the acquisition of said property under TR-93-23 .
