Dear Mr. Taylor:
On behalf of the Governor I am responding to your letter of May
20th containing the City's Resolution requesting a delay of the
implementation of the limitation on disposal of yard waste. The
text of the Resolution asserts that the yard waste restriction may
be considered an unfunded mandate but also confirms that Agawam and
Springfield intend to jointly process yard waste as part of a
regional composting plan. Since the Resolution was enacted
Springfield has received a grant from the Department for a shredder
' to process yard and wood waste. This grant was premised on its use
in a regional program and we strongly anticipate that Agawam will
be invited to participate.
While we do not accept the Auditor's opinion that requiring solid
waste facility operators not to dispose compostable yard waste is
an unfunded mandate, the Department has made a substantial
' commitment of resources through grants and technical assistance to
mitigate the transitional costs to communities to operate within a
integrated solid waste management system. We are confident that in
the near term diversion of recyclable and compostable material will
be cost effective for virtually every community. We will continue
to work with communities to provide resources and promote regional
solutions which will further reduce their expenditures.
' If you have further questions on the grant or require additional
technical assistance please contact Jack Macy in the Division of
Solid Waste Management at (617) 292- 5628.
