TR-93-33 r TR-93- lay 33 ctff:,"� A A TH Y RESOLUTIONAUTHORIZING THE MAYOR TO ENTER INTO AN INTERMUNICIPAL AGREEMENT BETWEEN THE CITY OF SPRINGFIEI.D FOR THE DISPOSAL OF YARD WASTE ----------------- ------------—-------------------------------------------------------------------------------- WHEREAS, the City of Springfield has been awarded a Yard/Wood Waste Processing Equipment Grant from the Department of Environmental Protection, and said grant is to be utilized to create a regional program for the disposal of yard waste; and WHEREAS, the City of Springfield plans to begin implementation of the regional program for the disposal of yard waste at Bondi's Island on or about July 1, 1993; and WHEREAS, it is in the best interests of the Town of Agawam to participate in the regional program for the disposal of yard waste at Bondi's Island; and NOW THEREFORE, the Agawam Town Council does hereby resolve to authorize the Mayor to enter into the "Intermunicipal Agreement between the City of Springfield and the City of Agawam." which is marked as EXHIBIT A and which is attached hereto and incorporated herein by reference. Taylor President Agawam City Council ' 36 Main Street Agawam, MA 01001 Dear Mr. Taylor: On behalf of the Governor I am responding to your letter of May 20th containing the City's Resolution requesting a delay of the implementation of the limitation on disposal of yard waste. The text of the Resolution asserts that the yard waste restriction may be considered an unfunded mandate but also confirms that Agawam and Springfield intend to jointly process yard waste as part of a regional composting plan. Since the Resolution was enacted Springfield has received a grant from the Department for a shredder ' to process yard and wood waste. This grant was premised on its use in a regional program and we strongly anticipate that Agawam will be invited to participate. While we do not accept the Auditor's opinion that requiring solid waste facility operators not to dispose compostable yard waste is an unfunded mandate, the Department has made a substantial ' commitment of resources through grants and technical assistance to mitigate the transitional costs to communities to operate within a integrated solid waste management system. We are confident that in the near term diversion of recyclable and compostable material will be cost effective for virtually every community. We will continue to work with communities to provide resources and promote regional solutions which will further reduce their expenditures.
