AN ORDINANCE TO AMEND CHAPTER 103
OF THE CODE OF THE TOWN OF AGAWAM
CONSERVATION COMMISSION FEES
WHEREAS, the Agawam Conservation Commission handles many Requests for
Determinations ofApplicability; and
WHEREAS, the fee for Requests for Determinations of Applicability performed
the Agawam Conservation Commission needs to be adjusted to reflect the cost
0sociated with the service; and
to WHEREAS, the costs associated with the advertisement of legal notices for

WHEREAS, it is in the best interests of the Town of Agawam to amend Chaptert,
103 of the Code of the Town of Agawam to increase the fee charged by the Agawam"o

NOW THEREFORE, BE IT RESOLVED BY THE AGAWAM CITY
COUNCIL that the following amendment is hereby made to Chapter 103 of the Coderof
the Town of Agawam:
Section 103-5 entitled "Conservation Commission" is hereby amended by increasingpe
Determination of Applicability fee to fifty dollars ($50.00).

Dear Councilors:
The Agawam Conservation Commission is requesting an increase in the filing fee for Requests
for Determinations of Applicability(RDA's). The Commission currently charges a filing fee of
$25.00. Due to the yearly increase in advertising costs, the average legal notice for an RDA is
now $33.00. The Commission is requesting that this fee be increased to $50.00 which should
cover future advertising increases.
