FOR JULY, 2009 UNTIL APPROVAL OF FISCAL YEAR 2010
ANNUAL BUDGET FOR THE TOWN OF AGAWAM
WHEREAS, under the provisions of Massachusetts General Laws
Chapter 44, Section 32, the time by which the Fiscal Year 2010 annual
budget must be submitted by the mayor to the city council is within one
hundred and seventy days after the annual organization of city government,
or on or about June 21, 2009; and
WHEREAS, under the provisions of Massachusetts General Laws
Chapter 44, Section 32, the mayor may submit to the city council a
continuing appropriation budget on a month by month basis ,for a period not
to exceed three months if the town has not approved a Fiscal Year 2010
annual budget because of circumstances beyond it's control; and
WHEREAS, the Governor has proposed in his budget funding local aid
to cities and towns which will result in approximately $21,241,008 in cherry
sheet funding to the Town of Agawam; and
WHEREAS, the House of Representatives has proposed in its budget
funding local aid to cities and towns which will result in approximately
$21,202,043 in cherry sheet funding to the Town of Agawam; and
WHEREAS, the Senate has proposed in its budget funding local aid to
cities and towns at a level thirty (30%) percent below Fiscal Year 2009
appropriations which will result in a cut of approximately $1,572,586 in
cherry sheet funding to the Town of Agawam; and
WHEREAS, given the great differences between the Governor's
budget proposal, the House of Representatives' budget proposal and the
Senate's budget proposal, it is in the best interests of the Town of Agawam
to delay the submittal of the Fiscal Year 2010 annual budget until more
definite information is available from the Commonwealth of Massachusetts
regarding local aid funding to the Town of Agawam; and
WHEREAS, due to circumstances beyond the Town of Agawam's
control, it is necessary to adopt a continuing appropriation budget for July,
2009 until approval of the Fiscal Year 2010 annual budget; and
NOW THEREFORE, THE AGAWAM TOWN COUNCIL HEREBY
RESOLVES:

Section 32, a continuing appropriation budget is hereby adopted for July,
2009 which allows the Town of Agawam to raise the necessary revenue for
the expenditure of necessary funds for the operation of the Town of Agawam
during the month of July, 2009 until the city council approves the Fiscal Year
2010 annual budget.

Please be advised that I met this morning with the Mayor, Treasurer-
Collector and Solicitor regarding the above.Resolution.
I have the assurance of the Mayor that the Budget Team, including
Council members, will be meeting with the Mayor, Treasurer-
Collector and Department Heads once the final budget is passed by
the House and Senate to discuss the Municipal budget. This will be in
addition to and prior to the usual subcommittee meetings. We will
also continue to have the usual forty-five day period to review the
Municipal budget.
