TR-2011-62 SEWER RATES ._._ __T -� �� - - --- TR-201 1'-62 A RESOLUTION APPROVING SEWER USE RATES FIXED BY THE DEPARTMENT OF PUBLIC WORKS Sponsored by: Mayor Richard A. Cohen WHEREAS, in the interest of the public health, the environment of the community, and the quality of our rivers and streams the municipality has constructed and operates and maintains a system of sanitary sewers to provide adequate wastewater treatment, and WHEREAS the operation, maintenance, improvement of the sewer syst4 a enterprise system requires a revenue source separate and apart from the property its, adequate to cover such expenses, and 7P - ?e-10 WHEREAS the Agawam Town Council voted to proceed with the South West'§e Area expansion and associated debt service to implement the expansion, and T WHEREAS, City Ordinance §175-60 and §175-61 state that all sewer users shall pay regular charges for service and that the sewer use charge shall be determined by the Dcpartrr�e—A of Public Works with the approval of the Town Council. NOW THEREFORE, THE AGAWAM CITY COUNCIL in accordance with §175-61 A of the Code of the Town of Agawam hereby approves the following rates for sewer use: Effective with the issuance of bills, charges will be applied on all bills rendered on or after January 1, 2012. A. A rate of$3.04 per hundred cubic feet of wastewater discha rged into the sewer system, B, A flat rate of$273.60 per year per dwelling unit for users without water service which is equivalent to a yearly discharge of 9,000 cubic feet. C. A minimum charge of$30.40 for any billing. D. Those elderly citizens that own and occupy single family homes and that qualify for clause 18 or clause 4 1 C property tax exemption will be able to receive a 25% reduction in the sewer use rate on the first 2,500 cubic feet of water consumption in a 6 month billing period with a minimum charge of$18.00 per billing period. Those elderly citizens that own and occupy single family homes and that qualify for clause 17D property tax exemption will be able to receive a 10% reduction in the sewer use rate on the first 2,500 cubic feet of water consumption in a 6 month billing period with a minimum charge of$21.60 per billing period. These citizens must apply for said sewer use abatement at the office of the Department of Public Works prior to the due date of the sewer use bill and show proof of property tax abatement and occupancy. The Assessor's determination for the tax year containing any January 1, shall be used for determining sewer use abatements for meter reading taken in the calendar year containing the same January 1.
