Whereas, the Southwest Area sewer project is necessary for the public
health of the residents of southwestern Agawam; and,
Whereas, the Town Council has previously adopted an order of public notv

Whereas, the Town Council approved, on February 16, 2010, a "Reso�&Jipn C-)
Amending TR-2008-48 Authorizing an Appropriation and Loan Order In The ArAbunt
Of $3,730,000.00 For Phases Two And Three The Construction Of Sanitary Sewers
In the Town of Agawam", TR-2010-05; and
Whereas, the Ad Hoc Sewer Sub-committee has approved this Order of
Assessment; and
Now, therefore, the City Council of the Town of Agawam hereby votes to
adopt the Order of Assessment for the Phase 1 Southwest Area Sewer Project
according to the attached schedule of sewer assessments.

ORDERED, that a general benefit assessment and a special benefit assessment for
the laying out and construction of sanitary sewer facilities in the TOWN OF
AGAWAM, MASSACHUSETTS be levied to the estate within the Phase 1 Southwest
Area Sewer Project; said assessment being as shown on the following Schedule of
Sewer Assessment. The charge per existing or potential dwelling or business unit
being $675.00 for the general benefit assessment and $1,666.00 for the special
benefit assessment.

Said assessment being a proportionate share of the cost of the general benefit and
special benefit facilities improvements, but does not exceed the adjudged general
or special benefit or advantage to the estate within the Phase 1 Southwest Area
Sewer Project;
that said assessment be levied in accordance with and by virtue of the
General Laws of the Commonwealth of Massachusetts, and the Code of the Town of
Agawam, to that limited and determinable area, as above mentioned, which
receives a general or special benefit or advantage from the laying out and
construction of sanitary sewer facilities in the TOWN OF AGAWAM,
MASSACHUSETTS;
that the full amount of said assessment shall become due and payable upon
the adoption of this Order and recordation hereof in the Hampden County Registry
of Deeds;
that the Town Clerk is hereby directed to certify and transmit a copy of this
Order to the Town Assessor within thirty (30) days hereof;
that the Town Assessor shall forthwith commit such assessment with their
warrant to the Town Collector;
that the Town Collector shall collect, in accordance with the General laws and
the Town Code, said amounts as shown on the aforementioned Schedule of Sewer
Assessments.
