A RESOLUTION RE-AUTHORIZING THE APPLICATION AND ACCEPTANCE OF
A GRANT FROM THE COMMONWEALTH OF MASSACHUSETTS EXECUTIVE
OFFICE OF ENERGY AND ENVIRONMENTAL AFFAIRS FOR THE
CONSTRUCTION OF SCHOOL STREET PARK, SCHOOL STREET/RIVER ROAD,
AGAWAM, MA

WHEREAS, the Council has previously passed TR 2005-23, A Resolution Authorizing
the Mayor to submit a Grant Application to the Commonwealth of Massachusetts
Executive Office of Energy and Environmental Affairs for the Construction of School
Street Park, School Street/River Road, Agawam MA and it is now time to submit; and
WHEREAS, The Town of Agawam has received information concerning the availability
of grant funds through the Executive Office of Energy and Environmental Affairs
Division of Conservation Services for development or renovation projects; and
WHEREAS, the Town will apply for a grant not to exceed $500,000.00 for the
development of School Street Park; and
WHEREAS, the proposed use of funds received under the grant would be expended for
the continued construction of School Street Park, School; and
WHEREAS, the Town could be eligible to receive 68% reimbursement for development
or renovation projects under the Parkland Acquisitions and Renovations for Communities
Grant Program; and
WHEREAS, the Community Preservation Act Committee has the appropriation of
$2,000,000.00 to fund 100% of the remaining portion of this project; and
WHEREAS, the preservation of land as a park for recreational use on property owned by
the city of Agawam, located on School Street is dedicated to Park and Recreation
purposes pursuant to M.G.L. c. 45 § 14; and
WHEREAS, It is in the best interest?f the citizens and The Town of Agawam to submit
grant applications to the Executive 0,�fice of Energy and Environmental Affairs Division
of Conservation Services for the Parpand Acquisitions and Renovations for
Communities Grant Program; and
NOW THEREFORE, The Agawam Tft.

Subject: CPA Resolution
Hello. The CPA committee met last night and had a concern about the status of the School Street Park
resolution.
In light of the fact that the PARC grant was not awarded, the committee was informed at last nights CPA
Ad-Hoc meeting that the resolution will be recommended to be withdrawn from the council agenda.
At the January 9, 2012 meeting the committee recommended $2,000,000 to the city council for the School
Street Park and the funds had been certified as to availability by the city auditor. The CPA committee is
concerned as to what this action does to their"recommendation" and is questioning what their next step
shall be.
According to the CPA Act (M.G.L. Ch, 446), the council can only approve, deny or reduce a CPA
recommendation, but since it is being withdrawn the committee believes that that you (the applicant)
should withdraw your application from CPA and they will rescind their vote.
I am not clear as to what the proper procedure should be, but the Committee is concerned that without
this withdrawal, that money is still reserved and will affect any future project that comes before them.
