A RESOLUTION APPROPRIATING FROM THE COMMUNITY
PRESERVATION FUND AND AUTHORIZING THE EXPENDEITURE OF
COMMUNITY PRESERVATION FUNDS FOR THE PURCHASE AND
PLANTING OF ARBORVITAES AT TOWN HALL
Whereas, voters of Agawam chose to form a Community Preservation Committee
(CPA); and
Whereas,pursuant to Massachusetts General Law Chapter 44B, Section 5(2) allows the
CPA Committee to make recommendations to the legislative body; and
Whereas,pursuant to Massachusetts General Law Chapter 44B, Section 5(3)(d)states
that the legislative body shall then take such action and approve such appropriations for
the CPA Committee; and
Whereas, The Community Preservation Committee has recommended appropriation and
expenditure in the amount of nine thousand five hundred and fifty dollars ($9,550.00)
from the budgeted reserve fund balance;and
Whereas,the expenditure will rehabilitate land owned by the Town of Agawam located
at the Town Hall;
NOW THEREFORE, THE AGAWAM CITY COUNCIL hereby further resolves,
appropriates and authorizes the expenditure of Community Preservation Funds in the
amount of nine thousand five hundred and fifty dollars ($9,550.00)from the budgeted
reserve fund balance for the purchase and planting of arborvitaes at Town Hall in
accordance with M.G.L. Ch. 44b, Sec. 2.
THE AGAWAM TO)XW COUNCIL hereby further resolves that the Mayor is authorized
to expend said funds,as permitted by law,and to do all things necessary for the purposes
so stated.

The Community Preservation Committee is in receipt of an application for plantings
of arborvitaes at the Town Hall. (See attached)
I am aware the Committee can now make recommendations to the legislative body for the
rehabilitation and restoration and preservation of open space.
Since the CPA application guidelines require review by our local solicitor, i am asking for
your opinion as to whether this application is eligible for CPA funding. .
I would appreciate your guidance on this matter. Let me know if you have any
