WHEREAS,the City of Agawam at the Public High School is in need of new;track and field
facilities to meet the needs of students,residents and various programs;and
WHEREAS,the Agawam City Council,The Agawam School Committee and the School
Administration,has endorsed the Track Master Plan and the purchaselplacementleDnstruction o
original "pment and furnishing of a new track,turf field,tennis and basketball courts,baseball
field,bleachemacession st facility at the School,including paving,
lighting, Po and other site improvements related to such construction,and for
reconstruction and renovation of High School locker rooms,including original equipment
and furnishings and including the payment of all other costs incidental and related to such
projects;and
WHEREAS,the Locker Room Renovations will meet the standards of Title IX and the
requirements of Accreditation Recommendations;and

WHEREAS, the City of Agawam at the Public High School is in need of new track and field facilities to meet the
needs of students,residents and various programs;and
WHEREAS,Article 4,Section 4 of the Agawam Charter states:No site for a school building shall be acquired by
the town unless the approval ofthe site by the school committee is first obtained.No plans for the construction of or
alterations in a school building shall be accepted,and no work shall be begun on the construction or alteration ofthe>
school building,unless with the approval of the school committee and the mayor.The mayor shall notify the school
committee in writing prior to or at the time of each change in plans sfier work is begun.
WHEREAS, the Agawam City Council, The Agawam School Committee and the School Administration,has
endorsed the Track Master flan and the purchase/placementleonstruction of original equipment and furnishing
of a new track,turf field,tennis and basketball courts, baseball field,bleachers, concession stand/restroom'

Ile Agawam Track Facility Exploratory Committee is prepared to move forward with the design and
construction of the athletic EacEtyF at Agawam High School ( iS). A previous award of$20,000 b
CPA provided the committee with a conceptual platy and an Opinion of Anticipated Casts. It has been
deterrained that the improvements at the AHS will include a new track and multi-purpose artificial turf
field,new bleachers,concemons,ADA restrooms,tennis courts,baseball field,basketball co
ticket window as well as Tide IX ituptov ements to the High School locker rooms. Information was
previously provided to the City Council..and School Committee at a combined workshop on April 22,
2014 which included a presentation ion fsorn Milone&Macbroomwith cost estiruabm(see attached). I am
also showing the latest estimate of the anticipated cost breakdown below.
The total anficipated coast of the project is$7.7 Million which includes the following
$5,825,000 (Project costs)

Just wanted to provide an update on what has occurred since the track resolution gent before the
City Co
A meeting was held Tuesday morning with Mayor Cohen, Laurel Placzek (Treasurer),Jennifer
Bonti.gho (CPA Representative),Vince Gioscia (Law Department) Dave Stratton (School`
Representative) and George Bitzas (Track Committee Representative). Linable to attend were Lou
Conte (Track Co 'tree Chair),Bill Sapelli (SchoolSuperintendent),Will Reichelt('Track
Committee Representative) and Christopher Johnson (City Council President),
M present agreed that the town will move forward with a resolution for bond
authorization for the full amount of the track facility project,including the costs for
construction documents and the clerk of the works. Vince Gioscia will prepare the
resolution,
It is cstimated that the total project cost ,will be approx. $y y Million
* Will Reichelt will prepare the RFQ (Request .for Quotes) for the
architectural/cons ction documents.
# I will prepare a CPA application for$1,035,000 for the tennis courts, lighting,baseball
fields and practice fields. This is the maximum amount CPA can afford at this time
and will reduce the amount of the bond if this amount is approved by the CPA
committee, Bonding through CPA was discussed and the'Treasurer is not in favor o
bonding future CPA revenues.
It was also discussed that any future CPA funds allocated would be used to reduce the
debt.

A RESOLUTION ENDORSING THE TRACK MASTER PLAN AS PRESENTED
AND THE ADMINISTRATION'S INTENTION TO CONTINUE WITH THE
PROJECT, WITH SUPPORT FROM THE EXPLORATORY COMMITTEE,AND
SEEK BIDS FOR CONSTRUCTION DOCUMENTS
Sponsored by Mayor Richard A Cohen
WHEREAS, the Track Facility Exploratory Committee seeks the support of the
City Council before moving forward with the second phase of this project;and
WHEREAS, the Town of Agawam commissioned the creation of a Master Plan
layout the renovation of the Track&Field Facility at the High School;and
WHEREAS, said plan was presented to the City Council and School Committee
at ajoiat meeting in April where it received positive feedback; and
WHEREAS,the next phase of the project would involve a bid for a firm to create
construction drawings which would be used to bid for the construction of the facility; and
WHEREAS, it is in the best interests of the Town of Agawam to continue with
this project in seeking bids for the creation of construction documents.
NOW THEREFORE, the Agawam City Council resolves to endorse the Track
Master Plan as previously presented and encourage the Administration and Track Facility
Exploratory Committee to continue with the project and pursue a firm for the creation of
construction drawings for the final phase of the project.

Re: Agawam Track Facility Master Plan
Dear Councilors:
I would like to provide you all with an update regarding the Agawam Track
Facility Master Plan. At this time we are continuing our work with Milone & MacBroom to
develop a conceptual plan to present to the Agawam Track Exploratory Committee for
review and comment. The planning process Is progressing smoothly and a draft should
be ready for presentation shortly. After presenting the draft to the Committee, the same
plan will be presented to the full City Council for review comment. After all comments
have been reviewed and incorporated we will come back with the final plan. After
reviewing the final plan, including cost estimations, we will look to begin the next phase
which will involve construction drawings and bid documentation.
I look forward to seeing and sharing Milone & MacBroom's Master Plan and hope
to work with you all very soon in continuing the planning process into a physical reality.

RE. MSBA Loan for High School Track& Athletic Facility
Dear Councilor Bitzes;
Per your request I have contacted the Massachusetts School Building Association
("MSBA") regarding use of their loan program. They have informed me that their loans
can only be utilized for the construction of buildings. Track facilities and similar sporting
fields are, under their program, the responsibility of the municipality. The MSBA would
not be an available funding source for our track and field project.

City Council.
meeting was held Tuesday morning with Mayor Cohen, Laurel Placzek (Treasurer),Jennifer
onfigho (CPA Representative), Vince + ioscia (Law Department) lave ,Stratton (School
Representative) and. George Bitzas (Track Committee Representative). Unable to attend were Lou
Conte ('Track Committee Chair), Pill Sapelli (School Superintendent), Will Reichert (Track
Conmaittee Representative) and. Christopher Johnson (City Council President);
• All present agreed that the town will move forward with a resolution for band
authorization for the full amount of the track facility pro)et, including the casts for
construction documents and the clerk of the works. Vince Gioscia will prepare the
resolution,
a It is estimated that the total project cost will be appro . $7.7 Million
• Will Reichelt'will prepare the RFQ (Request for Quotes) for the
architectural/construction documents.
• I will prepare a CPS. application for $1,035,000 for the tennis courts, lighting, baseball
fields and practice fields; This is the maximum amount CPA can afford at this time
and will reduce the amount of the bond if this amount is approved by the CPA
committee. Bonding through CPA was discussed and the 'Treasurer is not in favor of
bonding future CPA revenues:
+ It was also discussed that any future CPA funds allocated would be used to :reduce the
debt.

A RESOLUTION TO BOND A NEW TRACK, FIELD AND SCHOOL LOCKER FACILITY
AT THE AGAWAM HIGH SCHOOL

WHEREAS,the City of Agawam at the Public High School is in need of new track and field
facilities to meet the needs of students,residents and various programs;and
WHEREAS,the Agawam City Council, The Agawam School Committee and the School
Administration,has endorsed the Track Master Plan and the purchaselplacementiconstruction of
original equipment and furnishing of a new truck, turf field, tennis and basketball courts,baseball
field,bleachers, concession stand/restroom facility at the High School, including paving,
lighting,landscaping and other site improvements related to such construction,and for
reconstruction and renovation of the High School locker rooms, including original equipment o
and furnishings and including the payment of all other costs incidental and related to sucli� y-
projects; and
WHEREAS,the Locker Room Renovations will meet the standards of Title IX and the
requirements of Accreditation Recommendations;and

WHEREAS,on July, 14,2014 The Agawam City Council endorsed the Track Master plan and
the purchase/placementiconstruction of original equipment and furnishing of a new track,turf
field,tennis and basketball courts,baseball field,bleachers,concession stand/resumm facility at--"
the High School,including paving, lighting, landscaping and other site improvements related to
such construction, and for reconstruction and renovation of the High School locker rooms,
including original equipment and furnishings and including the payment of all other costs
incidental and related to such projects;;and
WHEREAS, If applicable and approved Community Preservation Funds will be utilized to
reduce costs;and
WHEREAS, if applicable and approved,Massachusetts School Building Authority funds will be:
utilized to reduce costs; and
WHERAS,a Request for Qualifications(RFQ)is being prepared, for the Architectural&Design
Phase of the project,to be disseminated and distributed; and
WHEREAS,said facilities shall and will be owned by the City of Agawam;and:
WHEREAS, it is in the best interests of the City of Agawam to meet the needs and requirements
of physical education and the students and for the development of such various programs to
appropriate and authorize borrowing in the amount of $7,750,000.00 for the costs of the
planning,design,construction, original equipment and furnishing of a new track,turf field,
tennis and basketball courts,baseball field,bleachers, concession standlrestroom facility at the
High'School, including paving, fighting„ landscaping and other site improvements related to such
construction, and for reconstruction and renovation of the High School locker rooms, including;
original equipment and furnishing,and including the payment of all other costs incidental and
related to such projects
NOW THEREFORE, BE IT RESOLVED BY THE AGAW AM CITY COUNCIL HEREBY
RESOLVES TO AUTHORIZE THE FOLLOWING:
That 7,7 0,000.00 is appropriated to pay costs of the planning,design,construction,original
equipment and furnishing of a new track,turf field,tennis and basketball courts,baseball field,
bleachers,concession stand/restroom facility at the High School,including paving,lighting,
landscaping and other site improvements related to such construction,and for reconstruction and:
renovation of the High School locker rooms,including original equipment and furnisId ag,and
including the payment of all other costs incidental and related to such projects;and to meet this
appropriation,the treasurer, with the approval of the Mayor, is authorized to borrow said amount

Designer Selection Procedures

1: These procedures govern the selection of designers for any municipality or local public agency building
project subject to the state designer selection law, M.G.L.c. 7C §§44-57.Any other local law governing-
the procurement of services will be Inapplicable to these procurements,
2. The Mayor("Approving )teas the authority to conduct the designer selection process for the
Awarding;Authority, The Approving Body may delegate any duties described herein to the extent such
delegation is permissible bylaw
3. The.Approving Body shall designates the Individual or group of individuals(hereinafter referred to as"the
Committes")who will conduct the designer selection process. No member of the Committee shall
participate in the selection of a designer for any project if the member,or any of the members immediate
family:
a. has a direct or Indirect financial interest in the award of the design contract to any applicant;
b, is currently employed by, ors a consultant to or under contract to,any applicant
c. is negotiating or has an arrangement concemIng future employment or contracting with any applicant or
d has an ownership interest in,or is an officer or director of any,applicant
4. A Request for Qualifications(RF for each contract subject to these procedures shall be advertised in a
newspaper of general circulation in the locality of the building project,in the Central Register published by
the Secretaryof the Commonwealth,and in any other place required by the Approving Body,at least two
weeks before the deadline for filing applications.
5: The advertisement shall contain the following information:
a a description of the project, including the specific designer services sought,the time period within which
the project is to be completed,and, if available, the estimated construction cost;
b If there is a program for the building project,a statement of where and where the program will be available
for Inspection by applicants;
c n and where a briefing session(if any)will be geld;
d. the qualifications required of applicants,
r
e the categories of designers'consultants,if any,for which applicants must list names of consultants they
may use
f whether the fee has been set or will be negotiated; if the flee has been set, the amount of the fee must be
listed in the advertisement;;
g.. when and where the RF4 can be obtained and the applications must be delivered.
6 The RFO shall include the current"Standard Designer Application Form for Municipalities and Public
Agencies not within DSB Jurisdiction,"which is available for download from the Massachusetts Designer
Selection Board website at Procedures for MuniciRalities and Public Agencies not within.D51a
Jurisdiogn The Application;Form may be amended to include additional information on a project-specific
basis.
7. The Committee shall evaluate applicants based on the following;criteria:
a. prior similar experience;
b. past performance on public and private projects;
c. rnancial stability;
d. identity and qualifications of the consultants who will work with the applicants on the project;and
e., any other criteria that the Committee considers relevant to the project
8. The Committee shall select at least three finalists. Finalists may be required to appear for an interview or
provide additional information to the Committee,provided that all finalists are affgrded'an equal
opportunity to do so
9. The Committee shall rank the finalists in order of qualification and transmit the list of ranked finalists to
the Approving Body.'No person or firm, including applicants'listed consultants, debarred pursuant to
M.G.L. c. 149 §44C, shall be included as a finalist on the list
The list must be accompanied by a written explanation of the reasons for selection including the recorded
vote, If any.The written explanation and recorded vote,if any, shall be public records and shall be
maintained in the contract file:
10. If the fee was set prior to the selection process, the Approving Body shall select a designer from the list of
finalists. If the Approving Body selects a designer other than the one ranked first by the Committee,the
Approving Body shall file a written justification for the selection with the Committee and maintain a copy in
the contract Tile,
11. If the fee is to be negotiated, the Approving Body shall review the list of finalists and may exclude any
designer from the list if a written explanation of the exclusion is filed with the Committee and maintained
in the contract file. The Approving Body shall request a fee proposal from the first ranked designer

remaining on the list and begin contract negotiations. If the Approving Body is linable to negotiate a
satisfactory fee with the first ranked designer, negotiations shall be terminated and undertaken with the
remaining designers,one at a time,in the order in which they were ranked by the Committee until
agreement is reached. In no event may a fee be negotiated which is higher than the maximum fee silt by
the Approving Body prior to selection of finalists.
1 If the Approving Body is unable to negotiate a satisfactory tee with any of the finalists,the Approving
Body shall recommend that the Committee select additional finalists.
11 The Approving Authority may allow a designer who conducted a feasibility study to continue with the
design of a project. However,the Approving Authority may commission,at its discretion, an independent
review, by a knowledgeable and competent individual or business doing such work, of the feasibility of the
designers work to insure its reasonableness and its adequacy before Billowing the designer to continue
on the project,provided the Approving Authority otherwise complies with the statutory requirements for
selecting a designer under Chapter 7C of the General Laws, including those set forth in M.G.L.c.7C
(a)(i).
1 4; Every contract for design services shall include the following,
a. certification that the designer or construction manager has not given, offered, or agreed to give any
person, corporation, or other entity any gift, contribution, or offer of employment as an inducement for,or
in connection with,the award of the contract for designservices;
b. certification that no consultant to,or subcontractor for,the designer or construction manager has given,
offered, or agreed to giver any gift,contribution,or offer of employment to the designer or construction
manager, or to any other person, corporation, or entity as an inducement for, or in connection with, the
award to the consultant or subcontractor of a contract by the designer or construction manager,
c: certification that no person,corporation, or other entity, other than a bona fide full-time employee of the
designer or construction manager,has been retained or hired by the designer or construction manager to
solicit for or In any way assist the designer or construction manager in obtaining the contract for design
services upon an agreement or understanding that such person,corporation,or other entity be paid a fee
or other consideration contingent upon the award of the contract to the designer,and
d. certification that the designer has internal accounting controls as required by M.G,L c.;3d, §39R(c), and
that the designer has filed and will continue to file an audited financial statement as required by M.G.E..c.
4,§99R(d).
All fees shall be stated in design contracts, and in any subsequent amendments thereto, as a`total dollar
amount. Contracts may provide for equitable adjustments In the event of changes in scope or services.
15, The Awarding Authority shell not enter into a contract for design services unless the Awarding Authority
or the designer has obtained professional liability insurance covering negligent errors,omissions, and
acts of the designer or of any person or business entity for whose performance the designer is legally
liable arising out of the performance of the contract.The total amount of such insurance shall at a
minimum equal the lesser of one million dollars or ten percent of the project's estimated cost of
construction, or such larger amounts as the Awarding Authority may require, for the applicable period of
limitations.A designer required by the Awarding Authority to obtain all or a portion of such insurance
coverage at its own expense shall furnish a certificate or certificates of insurance coverage to the
Awarding Authority prior to the arward of the contract.
16 Every contract for design services shall include a provision that the designer or,its consultants shall not
be compensated for any services involved in preparing changes that are required for additional work that
should have been anticipated by the designer in the preparation of the bid documents,as reasonably
determined by the individual responsible for administering the design contract.
17 In the event of an emergency that precludes the normal use of these designer selection procedures,the
Approving Body may elect to authorize expedited procedures to address the emergency.The Approving
Body shall document in writing the reasons for the emergency declaration, the proposed scope of work,
the estimated cost of construction,the established fee for the needed design services, and any other
relevant Infiortnation.
The Approving Body may select three finalists any standing list of designers who have applied for
projects of a similar nature, or may otherwise select three designers to be considered as finalists for the
project.The Approving Body shall rank the finalists in order of qualification and select the designer for the
emergency work.
I& The Awarding Authority shall publish the name of any designer awarded a contract in the Central
Register.
19. The following records shall be kept by the Awarding Authority:
a. all information supplied by or obtained about each applicant;
b. all actions taken relating to the project; and
c, any other records related to designer selection.
All records shall be available for inspection by the state Designer Selection Board and other authorized
agencim
20. The Awarding Authority shall evaluate designers"pedbrmance on contracts using the Designer Selection
Board evaluation form(s)in accordance with M.G.L.c. 7C,§48(g),and file completed evaluations with
the Board and any other agency named in M.G.L,c.7C,§48(g)-
21. Nothing in these Procedures shall be interpreted to require the establishment of a board or waive or
reduce the requirements of any other applicable law or regulation-
22, For any munWpal design or construction,pro" t that includes funding provided by the Commonwealth, in
whole or in part(such as reimbursements, grants and the like),cities and towns must incorporate
minority-owned business enterprise and women-owned business enterprise participation goals.'If
applicable, the Awarding Authority shall take steps to assure that it complies with all State Office of
Minority and Women Business Assistance requirements.
