TR-2015-37 NO PARKING SIGNS ALONG SCHOOL ST SF tabled. $1-Dlrs Ta de411(WI 15 rLloted Oat[ 15, TR-2015 �311 , tQ[ 5-11S A RESOLUTION REQUESTING THE INSTALLATION OF "NO PARKING" SIGNS ALONG SCHOOL STREET (Sponsored by Mayor Richard A Cohen) WHEREAS, the Agawam City Council has the authority to create "No Parking" zones; and WHEREAS, The Department of Public Works - Engineering Division has mapped out the location for the proposed "No Parking" Zones on School Street; and WHEREAS, the new four foot wide shoulder will create additional bike and pedestrian traffic on School Street; and WHEREAS, the no parking zone will create a safer environment for pedestrians and bicyclists and meet the "Complete Streets" requirement of the MASSDOT; and WHEREAS, these new "No Parking"zones will assist in improving the safe ingress and egress of vehicular, pedestrian and bicycle traffic on School Street, the safety of residents living along School Street and also the residents of the Town and those traveling along said Streets; and WHEREAS, Engineering and Police Departments believe the designated"No Parking" zones will improve the flow of traffic, both vehicular and bicycle and pedestrian, along School Street; and WHEREAS, the Town, Engineering and Police Departments have studied the creation of new"No Parking"zones and have recommended the new"No Parking" zones. NOW THEREFORE, BE IT RESOLVED THAT THE AGAWAM CITY COUNCIL in accordance with Massachusetts General Law Chapter 85, §2, that the Traffic Rules and Orders of the Town of Agawam, adopted by the Board of Selectmen on May 7, 1937; and subsequent amendments thereto, be further amended as follows, as shown on Exhibit A: Article V. Well nothing has changed we still have a large family and entertain quite frequently where will are guest park now ? We already lost 5 feet of our driveway. I have to say I don't see any increase in people biking or walking in the bike path sense it's been built just a increase of fast cars going down are street. Now the . council would like us to stop use the front of are house for parking this is rediculous . What about graduations , birthday parties and cook outs where would you like them to park ? Our lawns were left a mess and we were told in the fall that they would be back in the spring to fix are lawns and that never happened we were left with large rocks and no grass grew on my lawn . So we took it upon are selves to do are own and the grass is nothing but crap.....with all the sand and rocks. Well you have a response now. I sincerely hope before the council passes this rediculous ordinance that you ask yourselves how would feel if this was happening to you about tell your family and friends you can't park on your own street. I have trash on my lawn just about every day from passing cars. Bottles, cans fast food wrappers etc. Since the bike path work began its been a joke. Traffic has increased double of what is used to be. They were supposed to put loam and seed back, but instead we all got rocks and weeds. The street hasn't been finished, what happened to the state's contractor? Now you want no parking on the street. You build parks that don't have enough parking space's to accommodate the flow of people using them. Then where are the people to park? Maybe the town should have bought the property next to the park to create a parking lot of larger size to hold the cars...them maybe a walking path to connect the parks. If you want to hold events at the parks then you need to let the people park....No parking Ban. Maybe you folks can find out when the state will finish our street. After living on this street for over 25 years we are thing about moving, we have had just about enough. 152 School St i September 12, 2015 To Everyone Concerned I just read the article in the Agawam Advertiser concerning the possible Permanent Ban on parking along the entire length of School St. This is unbelievableP! My husband and I went to one of the first meetings concerning the bike path on School St. while the process was still in the early planning stages. I told the engineer in charge that we have a large family and frequently entertain. I specifically asked him where my guests would park. He told me that we will still be able to park on the street, as always, and that the users of the bike path would just go around our guest's vehicles. Well, we still have a large family and we still entertain frequently. Where will our guests park now? We already lost 5 feet of our driveway. School St. has become the entertainment capital of Agawam. We've had to-deal with a significant increase in fast moving cars on our street but there is very little or no increase in bike or foot traffic since the bike path was built. Now, the council would like us to stop using our own street? How would you feel if someone told you that no one can park in front of your house? What about graduation parties, birthday parties, cook outs? We have had to deal with the town's poor planning before in the 40 plus years that we have lived here. The bike path is still only half finished and the company has mysteriously disappeared. Driving down the eastern part of the road is like riding on the Connecticut River in a boat. Our lawns were left with large rocks and crab grass. Cecelia Calabrese, how are we supposed to respond to a question that no one has bothered to ask us? Well, you have a response now. I am Opposed. The residents residing on School Street will be impacted permanently by this resolution. Family functions will no longer be able to be held at homes due to limited parking in their driveways. Where will they park, the only place left is on their front lawns, and how unsightly will that become.Tag sales that residents wish to hold will not be allowed. Snow removal from driveways during the winter will not occur,where will you put your car while cleaning your driveway. School Street is already impacted by an unfinished bike path; don't continue to impose additional burdens with more constraints upon us. The simple solution to this seasonal inconvenience is to allow Chief Gillis to utilize his power to place temporary No Parking Signs during events only. To penalize residents the entire year is just wrong. When the park was in its planning and development stage, consideration for parking should have been thought of and incorporated into the design then. Additional land was and is still currently available for purchase on Corey Street adjacent to the School Street Park/Corey Street entrance for parking overload. Don't penalize residents of School Street because lack of forethought when considering the necessity of parking during large events did not occur. Thank you. (413) 786-7136 Mr. Benoit asked if the Council realized that the No Parking signs that are already in front of Phelps School have been placed where parents park to pick up their children after school as well as where people park to go in and vote on election days. He thinks it is silly to have the signs there. He lives on the corner of School and Monroe Streets. He and his neighbor said that people park all along Monroe Street as well (even right up to the stop sign on the corner) and they would appreciate No Parking signs to be installed on Monroe from 50' to 100' in. Since the park went in he is constantly picking up garbage in his yard every day. The Town destroyed his driveway and front yard (which according to him was so beautiful passersby would comment on it) and he has complained to the Mayor's Office without a response. He "wants, implores and respectfully requests" to make Alice Street a No Parking street as the people who park on that street and walk are the ones littering his yard. His grass was supposed to be replaced and to date it has not been and is now grotesque with horrid crab grass, sand and weeds. I strongly support the No Parking zones as established by our engineering department and supported by the Agawam Police. I brought this subject up trying to be proactive foreseeing the increased traffic and parking with the new School Street Park on Corey Street. I disagree with George's recommendation as there may be many instances where on street parking is needed besides concerts. Putting extra stipulations in the No Parking zones will only lead to confusion and will make the zones harder to control and enforce. I am sure Chief Gillis will agree and elaborate on this point. TR-2015-30 - A Resolution requesting the installation of "No Parking" signs along School Street, Corey Street and Alhambra Circle South in designated spots(Councilor Bitzas) Discussion took place and Police Chief Eric Gillis noted the signage problems and enforcement issues if we limit the time/dates of no parking signs becoming an enforcement nightmare. Councilor Mineo wanted to know what had changed in the last few years that there is now insufficient parking for the summer concert series which would be asked of Chris Sparks (who was unable to attend the meeting). There are approximately 210 parking spots in the new lot at School Street Park with 185 in the old lot for 5000 anticipated concert-goers. It would be best to limit the on-street parking if possible. The Committee decided to ask Chris Sparks to come to the continued meeting next week to answer some of the remaining questions. What is going to happen with all the extra cars—suggested satellite parking with shuttles? Is anything being mailed to the affected residents to ask their opinion? Why was this put on the Council Agenda without a traffic/parking study being done? Where are all these anticipated cars going to go? The Committee recommended tabling this item to have another full meeting with all parties involved being present. (Chris Sparks, Engineering, Chief Gillis) with the Motion to table made by Councilor Cavallo and seconded by Councilor Cichetti. The vote was 4-0 with one absent in favor of tabling. CALABRESE, CHAIR OF COMMUNITY RELATIONS SUB-COMMITTEE FROM: COUNCILOR GEORGE BITZAS SUBJECT: TR-2015-30 DATE: JUNE 24, 2015 After hearing several concerns from area residents of School Street Park regarding parking near their homes during concert events, I expressed these concerns to the Administration. I was informed by the Mayor that the Engineering and Parks & Recreation . Departments along with the Police Department were already working on a resolution to address these issues by designating No Parking zones during concert events. During conversations regarding.this issue, Chris Sparks asked if I was willing to sponsor the resolution. to bring to the Full Council to which I agreed as I sympathize with the residents who have asked for my assistance. This issue poses safety concerns for the residents along School Street, Corey Street and Alhambra Circle South as well as those traveling these streets to utilize School Street Park. These departments studied and recommended the No Parking zones which were designated on the map attached to the resolution. A traffic study is not available at this time because the concert event season has not begun and in my opinion, without the concert events, there would be no need for the placement of these signs. The study and evaluation can be done after the first concert in July if necessary. We would have a better understanding of the magnitude of the parking problem at that time. As you can see from the Community Relations Sub-Committee minutes dated June 10, 2015, as many as 5000 concert attendees are expected during a concert We must address this issue in some manner and hopefully the area residents will attend our meetings to express their concerns. As Chair of the Community Relations Sub-Committee,you can invite whomever you wish to attend our meeting on June 29, 2015 and/or our July 13, 2015 City Council meeting in order to ask any specific questions that you or any other committee member may have. The Administration along with the Park & Recreation and Engineering Departments as well as the Police Department are certainly willing to answer any additional questions you may have. As I mentioned, I am unable to attend the June 29"' sub-committee meeting but would again like to suggest an amendment to the resolution. Because these potential No Parking zones are intended solely for the summer concert series and park events, there is no need for parking restrictions during other seasons. In my opinion, it is unnecessary to have restricted parking year round. He also stated that he had worked with officers for traffic control and off-site parking is in the hands of the Police Department. Chief Gillis feels the solution is to use temporary no parking "sandwich-type" boards for the evening of the event. The town needs to keep those areas open for emergency vehicles. The August 12'b concert is expected to be the biggest concert of the summer season with KIXX country. The committee discussed creating an Ordinance that would cover the entire town of temporary No Parking zones in the event it is needed. Also discussed a Resolution to create permanent No Parking all along School Street and the current resolution should be withdrawn. Councilor Calabrese will ask Barbara to find sample legislation in Massachusetts. 2. TR-2015-33 - A Resolution appropriating from the Community Preservation Fund and authorizing the expenditure of Community Preservation Funds for the Purchase and Installation of Dedication Plaque at School Street_ Park (CPA) The maximum is $6,000.00 for the memorial and beautification around the flag pole. Motion to send a positive recommendation to the Full Council made by Councilor Cavallo and seconded by Councilor Cichetti. The vote was 4 YES, 0 NO, 1 ABSENT(Councilor Bitzas). 3. I agree with his suggestions for the police to utilize temporary no parking "sandwich-type" boards for the evening of the event(s). We also discussed the need to evaluate how these temporary boards would work after the Grand Opening on July V. As we all witnessed, these boards worked quite well and there were no parking issues that evening or during the July 8`' concert event as well. Therefore in my opinion the Resolution is no longer necessary. As sponsor of TR-2015-30, I respectfully withdraw this item and ask that you remove it from our next City Council Agenda during the July 13, 2015 meeting. I have searched the Massachusetts General Laws, and am unable to find any such law. I have attached copies of the Massachusetts General Laws that pertain to definitions related to this topic, as well as the operation of bicycles within the Commonwealth of Massachusetts. If 1, in my capacity as Chief of Police, have never heard of such a law, then I would suggest that it would be unreasonable to expect the average citizen to be aware of such a law if one actually exists. To that end, it seems to me prudent to erect "NO PARKING" signs in the areas that have dedicated bike lanes, as a matter of practical safety for those persons wishing to use the bike lanes. Every person operating a bicycle upon a way, as defined in section one of chapter ninety, shall have the right to use all public ways in the commonwealth except limited access or express state highways where signs specifically prohibiting bicycles have been posted, and shall be subject to the traffic laws and regulations of the commonwealth and the special regulations contained in this section, except that: (1)the bicycle operator may keep to the right when passing a motor vehicle which is moving in the travel lane of the way, (2)the bicycle operator shall signal by either hand his intention to stop or turn; provided, however, that signals need not be made continuously and shall not be made when the use of both hands is necessary for the safe operation of the bicycle, and (3) bicycles may be ridden on sidewalks outside business districts when necessary in the interest of safety, unless otherwise directed by local ordinance. A person operating a bicycle on the sidewalk shall yield the right of way to pedestrians and give an audible signal before overtaking and passing any pedestrian. Operators of bicycles shall be subject to the following regulations: (1) Bicyclists riding together shall not ride more than 2 abreast but, on a roadway with more than 1 lane in the direction of travel, bicyclists shall ride within a single lane. Nothing in this clause shall relieve a bicyclist of the duty to facilitate overtaking as required by section 2 of chapter 89. (2)(i) The operator shall ride only upon or astride a permanent and regular seat attached to the bicycle; a passenger shall ride only upon or astride a permanent and regular seat attached to the bicycle or to a trailer towed by the bicycle. (ii) The operator shall not transport another person between the ages of one to four years, or weighing forty pounds or less, on a bicycle, except in a "baby seat°, so-called, attached to the bicycle, in which such other person shall be able to sit upright; provided, however, that such seat is equipped with a harness to hold such other person securely in the seat and that protection is provided against the feet or hands of such person hitting the spokes of the wheel of the bicycle; or upon or astride a seat of a tandem bicycle equipped so that the other person can comfortably reach the handlebars and pedals. Said helmet shall fit the person's head, shall be secured to the person's head by straps while the bicycle is being operated, and shall meet the standards for helmets established by the United States Consumer Product Safety Commission. These requirements shall not apply to a passenger if the passenger is in an enclosed trailer or other device which adequately holds the passenger in place and protects the passenger's head from impact in an accident. (iv) A violation of clause (ii) or(iii) shall not be used as evidence of contributory negligence in any civil action. (3) The operator shall give an audible warning whenever necessary to insure safe operation of the bicycle; provided, however, the use of a siren or whistle is prohibited. (4) The operator shall park his bicycle upon a way or a sidewalk in such a manner as not to obstruct vehicular or pedestrian traffic. (5) The operator shall not permit the bicycle to be drawn by any other moving vehicle. The operator shall not tow any other vehicle or person, except that bicycle trailers properly attached to the bicycle which allow for firm control and braking may be used. (6) The operator shall not carry any package, bundle or article except in or on a basket, rack, trailer or other device designed for such purposes. The operator shall keep at least one hand upon the handlebars at all times. (7) Every bicycle operated upon a way shall be equipped with a braking system to enable the operator to bring the bicycle traveling at a speed of fifteen miles per hour to a smooth, safe stop within thirty feet on a dry, clean, hard, level surface. (8) During the period from one-half hour after sunset to one-half hour before sunrise, the operator shall display to the front of his bicycle a lamp emitting a white light visible from a distance of at least five hundred feet, and to the rear of said bicycle either a lamp emitting a red light, or a red reflector visible for not less than six hundred feet when directly in front of lawful lower beams of headlamps on a motor vehicle. A generator powered lamp which emits light only when the bicycle is moving shall meet the requirements of this clause. Any alteration to extend the fork of a bicycle from the original design and construction of the bicycle manufacturer is prohibited. NOW THEREFORE, BE IT RESOLVED THAT THE AGAWAM CITY COUNCIL in accordance with Massachusetts General Law Chapter 85, §2, that the Traffic Rules and Orders of the Town of Agawam, adopted by the Board of Selectmen on May 7, 1937; and subsequent amendments thereto, be further amended as follows, as shown on Exhibit A: Article V. ParkinQ Section 2 Prohibited on Certain Streets Upon the following streets or highways or parts thereof, parking is hereby prohibited: Add: Beginning on School Street at the intersection with River Road and extending the entire length of School Street on both sides until the intersection with Main Street.
