TR-2015-39 CPA TO REHAB PARKS ■ , � _�-�� �.� CPS ��`0�04° __ _ __ � � �S . __ _ _ __ _ _ -_� __ _. _ � _ _ ____ ___ _ __ ._____ :� r' �4xTIJVL�, I TR-2015-39 A RESOLUTION APPROPRIATING FROM THE COMMUNITY PRESERVATION FUND ANO AUTHORIZING THE EXPENDITURE OF COMMUNITY PRESERVATION FUNDS FOR THE REHABILITATION AND PRESERVATI�N OF TOWN OWNED LAND Whereas,voters of Agawam chose r form a Community Preservation Committee (CPA);and Whereas, pursuant to Massachusetts General Law Chapter 44B,Section 5(2)allows the CPA Committee to make recommendations to the legislative body;and I Whereas,pursuant to Massachuse General Law Chapter 44B,Section 5(3xd)states that the legislative body shall then tike such action and approve such appropriations for the CPA Committee;and f Whereas,The Community Preservation Committee has recommended appropriation and expenditure in the amount of eight thousand dollars($8,000.00)from the budgeted reserve fund balance;and Whereas,this expenditure will rehabilitate and preserve the following land owned by the Tows,of Agawam:Agawam Town call,McGrath Park, Suffield Street island,Elm& Main Street(Helen's Garden), Ind al Park-Garden Street,DPW Suffield Stred Bike Path-River Road, Anne SullivanMemorial Park, Springfield Street Island across from Sacred Heart,Pynchon Point aad the Veteran's Green; Whereas,this expenditure will supqort the ongoing efforts by the Beautification Committee; 1 NOW THEREFORE,THE AGAW M CITY COUNCIL hereby further resolves, appropriates and authorizes the expdpditure of Community Preservation Funds in the amount of eight thousand dollars($,,000.00)from the budgeted reserve fiord balance for the rehabilitation and preservation o town owned land in accordance with M.G.L.Ch. 44b,Sec. 2. Other funding sources are not readily available. This project is economically or otherwise reasonably feasible to implement and can be implemented expeditiously and within budget. The Beautification Committee will request funding as needed from the Community Preservation Administrator and Chairperson with supporting quotes. The Beautification Committee receives funding annually from Berkshire Power which has to be divided between the commercial areas in town and the remaining adopted sites. This does not provide adequate funding for the restoration and preservation of these adopted sites. Currently the Beautification Committee has adopted the following sites: Agawam Town Hall Zophia's Garden @ Town Hall McGrath Park Carol Pignatare's Garden Suffield Street Elm &Main Street(Helen's Garden) Industrial Park- Garden Street DPW Suffield Street Bike Path- River Road Anne Sullivan Memorial Park Springfield Street- Island across from Sacred Heart Pynchon Point Bridge Planters-planted twice each year Urns in front of Town Hall- planted twice each year Barrels(65)around town Fund plantings for Veteran's Green annually MA Procurement laws(M.G.L. c.30B, §4c)) Contracts under$5,000. Use sound business practices.8 "Sound business practices" is defined as ensuring the receipt of a favorable price by periodically soliciting price lists or quotes. While the law does not require a formal competitive process, it does require local jurisdictions to ensure that they have received the needed quality of supplies and services at a reasonable price.
