SUBJECT: TR-2016-27
Facts:
1. The Town of Agawam owns a parcel of land approximately 2,634 Square Feet
located at the Southwest corner of Mill and Suffield Streets in Agawam.
2. The parcel is zoned Business A.
3. Should the Town of Agawam declare the parcel for sale and dispose of said
parcel; an easement will be necessary for drainage maintenance purposes on the
parcel.
4. M.G.L. 30B §16(a) states: a governmental body duly authorized by general or
special law to engage in a transaction to convey or otherwise dispose of real
property...shall declare the property available for disposition and shall specify the
restrictions, if any that will be placed on the subsequent use of the property.
5. M.G.L. 30B §16(b) states: The governmental body shall determine the value of
the property through procedures customarily accepted by the appraising
profession as valid.
6. M.G.L. 30 §16(c)(2) states: a governmental body shall solicit proposals prior to
disposing of, by sale or rental real property or any interest therein, determined in
accordance with paragraph (b) to exceed $35,000.00 dollars in value.
Application:
For any disposition of Real Property, in the present matter, 2,634 square feet located at
the southwest corner of Mill and Suffield Streets, regardless of value, the municipality is
to declare the property available for disposition and determine the value of the property.
Passage of TR-2016-27 declares the property available for disposition and Suburban
Appraisal has conducted an appraisal of the parcel pursuant to M.G.L.30B §16(b).
Proposals and competitive bids are only necessary if the real property value exceeds
$35,000.00. In the present matter the value does not exceed $35,000.00. Therefore the
requirement for competitive bids and/or proposals is not required on this particular
parcel. Please note the requirement for competition is triggered by the value of the
property and not the price the City of Agawam expects to receive for the property.
Furthermore, I spoke to the Inspector General's Office on May 3, 2016. The Inspector
General's office confirmed no bid proposal or auction was necessary for said parcel due
to the de-minimis value. Please see the following attachments: M.G.L. c.30B §16 and the
appraisal report produced by Suburban Appraisal. It is important to note the appraisal is
not a public record and is considered confidential pursuant to M.G.L. c.4 §7(26)(i) and
M.G.L. c. 112 §173.
The disposition of the 2,634 square foot parcel in the current matter does not need to go
to bid or auction. However, after reviewing Councilmember Letellier's erroneous
conclusions at the May 2, 2016 Council Meeting I had a discussion with Councilmember
Johnson regarding the Resolution. 1 have addressed their concerns and amended it. It is

Section 16. (a) If a governmental body duly authorized by general or special law to engage in
such transaction determines that it shall rent, convey, or otherwise dispose of real property,
the governmental body shall declare the property available for disposition and shall specify the
restrictions, if any, that it will place on the subsequent use of the property.
(b)The governmental body shall determine the value of the property through procedures
customarily accepted by the appraising profession as valid.
(c)A governmental body shall solicit proposals prior to:
(1) acquiring by purchase or rental real property or an interest therein from any person at a
cost exceeding $35,000; or
(2) disposing of, by sale or rental to any person, real property or any interest therein,
determined in accordance with paragraph (b) to exceed $35,000 dollars in value.
(d)The governmental body shall place an advertisement inviting the submission of proposals
in a newspaper with a circulation in the locality sufficient to inform the people of the affected
locality, The governmental body shall publish the advertisement at least once a week for two
consecutive weeks. The last publication shall occur at least eight days preceding the day for
opening proposals. The advertisement shall specify the geographical area, terms and
requirements of the proposed transaction, and the time and place for the submission of
proposals. In the case of the acquisition or disposition of more than twenty-five hundred
square feet of real property, the governmental body shall also cause such advertisement to be
published, at least thirty days before the opening of proposals, in the central register
published by the state secretary pursuant to section twenty A of chapter nine.
(e)The governmental body may shorten or waive the advertising requirement if:

(1) the governmental body determines that an emergency exists and the time required to
comply with the requirements would endanger the health or safety of the people or their
property; provided, however, that the governmental body shall state the reasons for declaring
the emergency in the central register at the earliest opportunity; or
(2) in the case of a proposed acquisition, the governmental body determines in writing that
advertising will not benefit the governmental body's interest because of the unique qualities or
location of the property needed. The determination shall specify the manner in which the
property proposed for acquisition satisfies the unique requirements. The governmental body
shall publish the determination and the reasons for the determination, along with the names
of the parties having a beneficial interest in the property pursuant to section forty J of chapter
seven, the location and size of the property, and the proposed purchase price or rental terms,
in the central register not less than thirty days before the governmental body executes a
binding agreement to acquire the property.
(f) Proposals shall be opened publicly at the time and place designated in the advertisement.
The governmental body shall submit the name of the person selected as party to a real
property transaction, and the amount of the transaction, to the state secretary for publication
in the central register.
(g) If the governmental body decides to dispose of property at a price less than the value as
determined pursuant to paragraph (b), the governmental body shall publish notice of its
decision in the central register, explaining the reasons for its decision and disclosing the
difference between such value and the price to be received.
(h)This section shall not apply to the rental of residential property to qualified tenants by a
housing authority or a community development authority.
(i)Acquisitions or dispositions of real property or any interest therein pursuant to this section
between governmental bodies and the federal government, the commonwealth or any of its
political subdivisions or another state or political subdivision thereof shall be subject to
subsections (a), (b) and (g).

In accordance with your request for an estimate of the Market Value, as defined
herein, in the Fee Simple Estate to the above-designated property, we have
personally inspected the site of the above referenced property and have made an
analysis of the data to estimate the market value as of March 15, 2016.
This is a Restricted Appraisal Report, which is intended to comply with the reporting
requirements set forth under Standards Rule 2-2(B) of the Uniform Standards of
Professional Appraisal Practice for a Restricted Appraisal Report. As such, it
presents no discussions of the data, reasoning, and analyses that were used in the
appraisal process to develop the appraiser's opinion of value. Supporting
documentation concerning the data, reasoning, and analyses is retained in the
appraisers file. Conclusions set forth in this report may not be understood properly
without additional information in the appraisers work file. The depth of discussion
contained in this report is specific to the needs of the client and for the intended

APPRAISAL PROCESS: The appraisers considered all three approaches to value:
The Cost Approach, the Income Approach and the Sales Comparison Approach. The
Cost Approach was considered but not used, as it is not a typical value indicator for
properties like the subject. The Income Approach was considered but was not
used, as it is not a typical value indicator for properties like the subject.
Consequently, greatest emphasis was given to the Sales Comparison Approach as
there was adequate data to determine market value and this is a typical value
indicator for properties like the subject.

SCOPE OF TIJE APPRAISAL: urban Appraisal Co. has been retained by the
client named herein to appraise the above referenced property with the express
intent to establish the subjects Market Value. The following is the extent of the
data collection process:
1. An inspection of the site and improvements.
2. A determination was made of the neighborhood life cycle and the
existence, if any, of external and/or economic obsolescence.
3. Sales of commercial buildings in the greater subject area were
researched and compared to the subject.
4. Where possible rents and/or lease information for the area was compiled
and analyzed to determine market rental data.
5. The deed was reviewed along with assessor's records to determine if any
adverse easements, restrictions, and/or encroachments were obvious.
The appraisers found none that was obvious.
6. Zoning by-laws and flood hazard maps for the subject were reviewed.
7. A determination of the subjects highest and best use.
8. A series of support data was analyzed and used to estimate a current
market value.
9. A final reconciliation was made after considering the three approaches to
value used in this assignment and other data presented in this report.

APPRAISAL D VELOPMENT AND REPORTI G PR CESS:
In preparing this appraisal the appraiser inspected the subject property.
The appraisers gathered information from the subject's neighborhood and/or similar
competitive neighborhoods, and surrounding communities (if applicable) on
comparable sales of similar properties. This information was applied in the Sales
- Comparison Approach.
The Cost Approach and the Income Approach were considered but not used as
explained in the appraisal process.
This Restricted Appraisal Report sets forth only the appraisers conclusions.
Supporting documentation is retained in the appraisers file. (See page 1 for more
detail)
USE OF SUBJECT AS OF DATE OF VALUE: The land was vacant at time of
inspection. .
1110HEST AND BEST USE: The subject property is currently vacant. On
determining the Highest and Best Use of the property, the appraisers reviewed the
town's zoning by-laws. It is the opinion of the appraisers that based on current
zoning requirements, the subject site is not a buildable site and due to its size has
limited use or potential. This is based on a review of the zoning by-laws, permitted
uses, land area, and other land uses in the area. Also reviewed were the four tests
for Highest and Best Use: Legally Permissible, Physically Possible, Financially
Feasible and Maximally Productive. The lot size does not conform to current
zoning. Consequently, the appraisers considered the Highest and Best ,Use of the
site as if vacant and no use could be established based on the above data.

frontage is on Suffield Street with 40.52 feet. The site is in the area of Murphy's
Pub at the corner of Mill Street and Suffield Street.

NEIGHBORHOOD DESCRIPTION: The subject neighborhood is a mixed use area.
The intersections of Mill and SufFielld Street have businesses on all four corners.
Within a short distance is the Agawam Post Office and Agawam High School. A few
miles down Suffield Street, to the south, is a larger shopping area. The area is
generally residentialm, except for the major intersections where there is a
concentration of businesses. There are also condominiums and apartments mixed
in. There is no major deferred maintenance trend in the area or.other trends to
affect the marketability of the area.
pESCRLPTION OF IMPROVEMENTS: There are no improvements on the subject
site.

estimate of market value for the subject property:

COMMENTS: The camp was a vacant lot with building permits for a 3,880 square foot
building. Comp is superior to the subject. Comparable site has .32 acres of land area. +

COMMENTS: The comparable is superior to the subject as indicators are it has a multi use j
possibility. Comparable site has .58 acres of land area.
COMMENTS ON THE SALES('ONMPAFUSON APPELOACH: The appraisers used data
available to verify sales data. No one in the actual transaction was available or did not want
to confirm sales data. Public data was used for sales information, such as Assessors,
Warren Group, Registry of Deeds, and Multiple Listing Service. The appraisers gave
greatest emphasis to comp one because of its proximity to the subject and its zoning. The
appraisers adjusted Comp #1 90% of the sale price per square foot. This adjustment is
based on the data presented in this report and the fact that the subject property has no
useful purpose. All descriptions are from observations at the time of inspection and data in
this report.

WHEREAS, the City of Agawam owns the operty located t e thwest corner of Mill and
Suffield Streets, Agawam, MA, containin approxi t y 2, square feet of land with 40.52
feet of frontage on Suffield Street (Exh' it A) v' a t da May 22, 1970 and recorded in
the Hampden County Registry of De s Book#3 8, Pa e 36 (Exhibit B); and
WHEREAS, approximately 2,63 squar eet f s property located at the southwest corner of
Mill and Suffield Street, Agaw , M e n r business A development but do not meet
the size requirement; and
WHEREAS, said property s one r B s ess A use; and
WHEREAS, it is in the est in rests o th City of Agawam to dispose of said property by sale

square feet o land upon purchase of said land for drainage purposes in addition to land

WHERE S. the easement is necessary for the appropriate location for drainage maintenance;

WHE AS, the drainage easement will protect the health, safety and welfare of the general

WHEREAS The Agawam Department of Public Works and the Town Engineering Department
supports the transaction (Exhibit D); and
WHEREAS the easement constitutes an interest in real estate; and

WHEREAS it would be in the best interests of the City of Agawam to accept the easement for
drainage from the owners of Murphy's Pub upon purchase of the 2,634 square feet of land
located at the southwest corner of Mill and Suffield Streets; and
NOW THEREFORE, the Agawam City Council, in accordance with Chapter 30B §16 of the
General Laws of the Commonwealth of Massachusetts hereby declares the approximately 2,634
square feet of property located at the southwest corner of Mill and Suffield Streets, Agawam,
MA available for disposition of sale and that the Mayor is empowered to execute all necessary
documents in order to effectuate the completion of the transaction.
And the Agawam City Council hereby further resolves, pursuant to M.G.L. 40 §14 to accept the
easement from the owners of Murphy's Pub and that the Mayor is empowered to execute all
necessary documents in order to effectuate the completion of the transaction.

Facts:
1. The Town of Agawam owns a parcel of land approximately 2,634 Square Feet
located at the Southwest comer of Mill and Suffield Streets in Agawam.
2. The parcel is zoned Business A.
3. Should the Town of Agawam declare the parcel for sale and dispose of said
parcel; an easement will be necessary for drainage maintenance purposes on the
parcel.
4. M.G.L. 30B §16(a) states: a governmental body duly authorized by general or
special law to engage in a transaction to convey or otherwise dispose of real
property...shall declare the property available for disposition and shall specify the
restrictions, if any that will be placed on the subsequent use of the property.
5. M.G.L. 30B §16(b) states: The governmental body shall determine the value of
the property through procedures customarily accepted by the appraising
profession as valid.
6. M.G.L. 30 §16(c)(2) states: a governmental body shall solicit proposals prior to
disposing of, by sale or rental real property or any interest therein, determined in
accordance with paragraph (b) to exceed $35,000.00 dollars in value.
Application:
For any disposition of Real Property, in the present matter, 2,634 square feet located at
the southwest corner of Mill and Suffield Streets, regardless of value, the municipality is
to declare the property available for disposition and determine the value of the property.
Passage of TR-2016-27 declares the property available for disposition and Suburban
Appraisal has conducted an appraisal of the parcel pursuant to M.G.L.3013 §16(b).
Proposals and competitive bids are only necessary if the real property value exceeds
$35,000.00. In the present matter the value does not exceed $35,000.00. Therefore the
requirement for competitive bids and/or proposals is not required on this particular
parcel. PIease note the requirement for competition is triggered by the value of the
property and not the price the City of Agawam expects to receive for the property.
Furthermore, I spoke to the Inspector General's Office on May 3, 2016. The Inspector
General's office confirmed no bid proposal or auction was necessary for said parcel due
to the de-minimis value. Please see the following attachments: M.G.L. c.3013 §16 and the
appraisal report produced by Suburban Appraisal. It is important to note the appraisal is
not a public record and is considered confidential pursuant to M.G.L. cA §7(26)(i) and
M.G.L. c. 112 §173.
The disposition of the 2,634 square foot parcel in the current matter does not need to go
to bid or auction. However, after reviewing Councilmember Letellier's erroneous
conclusions at the May 2, 2016 Council Meeting I had a discussion with Councilmember
Johnson regarding the Resolution. I have addressed their concerns and amended it. It is

Section 16, (a)If a governmental body duly authorized by general or special law to engage in
such transaction determines that it shall rent, convey, or otherwise dispose of real property,
the governmental body shall declare the property available for disposition and shall specify the
restrictions, if any, that it will place on the subsequent use of the property.
(b)The governmental body shall determine the value of the property through procedures
customarily accepted by the appraising profession as valid.
(c)A governmental body shall solicit proposals prior to:
(1) acquiring by purchase or rental real property or an interest therein from any person at a
cost exceeding $35,000; or
(2)disposing of, by sale or rental to any person, real property or any interest therein,
determined in accordance with paragraph (b) to exceed $35,000 dollars in value.
(d)The governmental body shall place an advertisement inviting the submission of proposals
in a newspaper with a circulation in the locality sufficient to inform the people of the affected
locality.The governmental body shall publish the advertisement at least once a week for two
consecutive weeks.The last publication shall occur at least eight days preceding the day for
opening proposals.The advertisement shall specify the geographical area, terms and
requirements of the proposed transaction, and the time and place for the submission of
proposals, In the case of the acquisition or disposition of more than twenty-five hundred
square feet of real property, the governmental body shall also cause such advertisement to be
published, at least thirty days before the opening of proposals, in the central register
published by the state secretary pursuant to section twenty A of chapter nine.
(e)The governmental body may shorten or waive the advertising requirement if:

(1) the governmental body determines that an emergency exists and the time required to
comply with the requirements would endanger the health or safety of the people or their
property; provided, however, that the governmental body shall state the reasons for declaring
the emergency in the central register at the earliest opportunity; or
(2) in the case of a proposed acquisition, the governmental body determines in writing that
advertising will not benefit the governmental body's interest because of the unique qualities or
location of the property needed.The determination shall specify the manner in which the
property proposed for acquisition satisfies the unique requirements. The governmental body
shall publish the determination and the reasons for the determination, along with the names
of the parties having a beneficial interest in the property pursuant to section forty]of chapter
seven, the location and size of the property, and the proposed purchase price or rental terms,
in the central register not less than thirty days before the governmental body executes a
binding agreement to acquire the property.
(f) Proposals shall be opened publicly at the time and place designated in the advertisement.
The governmental body shall submit the name of the person selected as party to a real
property transaction, and the amount of the transaction, to the state secretary for publication
in the central register.
(g) If the governmental body decides to dispose of property at a price less than the value as
determined pursuant to paragraph (b), the governmental body shall publish notice of its
decision in the central register, explaining the reasons for its decision and disclosing the
difference between such value and the price to be received.
(h)This section shall not apply to the rental of residential property to qualified tenants by a
housing authority or a community development authority.
(i)Acquisitions or dispositions of real property or any interest therein pursuant to this section
between governmental bodies and the federal government, the commonwealth or any of its
political subdivisions or another state or political subdivision thereof shall be subject to
subsections (a), (b) and (g).

SCOPE OF Tl1E APPRAISAL: urban Appraisal Co. has been retained by the
client named herein to appraise the above referenced property with the express
intent to establish the subjects Market Value. The following is the extent of the
data collection process:
i 1. An inspection of the site and improvements.
i 2. A determination was made of the neighborhood life cycle and the
existence, if any, of external and/or economic obsolescence.
3. Sales of commercial buildings in the greater subject area were
researched and compared to the subject.
4. Where possible rents and/or lease information for the area was compiled
and analyzed to determine market rental data.
5. The deed was reviewed along with assessor's records to determine if any
adverse easements, restrictions, and/or encroachments were obvious.
The appraisers found none that was obvious.
6. Zoning by-laws and flood hazard maps for the subject were reviewed.
7. A determination of the subjects highest and best use.
8. A series of support data was analyzed and used to estimate a current
market value.
9. A final reconciliation was made after considering the three approaches to

In preparing this appraisal the appraiser inspected the subject property.
The appraisers gathered information from the subject's neighborhood and/or similar

USE OF SUBJECT AS OF DATE OF VALUE: The land was vacant at time of
inspection. .
HIGHEST AND BEST USE: The subject property is currently vacant. On
determining the Highest and Best Use of the property, the appraisers reviewed the
town's zoning by-laws. It is the opinion of the appraisers that based on current
zoning requirements, the subject site is not a buildable site and due to its size has
limited use or potential. This is based on a review of the zoning by-laws, permitted
uses, land area, and other land uses in the area. Also reviewed were the four tests
for Highest and Best Use: Legally Permissible, Physically Possible, Financially
Feasible and Maximally Productive. The lot size does not conform to current
zoning. Consequently, the appraisers considered the Highest and Best ,Use of the
site as if vacant and no use could be established based on the above data.

EIGH ORHOOD DESCRIPTION: The subject neighborhood is a mixed use area.
The intersections of Mill and Suffielld Street have businesses on all four corners.
Within a short distance is the Agawam Post Office and Agawam High School. A few
miles down Suffield Street, to the south, is a larger shopping area. The area is
generally residentialm, except for the major intersections where there is a
concentration of businesses. There are also condominiums and apartments mixed
in. There is no major deferred maintenance trend in the area or.other trends to
affect the marketability of the area.
DESCRIPTIONi! OF IMPROVEMENTS: There are no improvements on the subject
site.
SALES COMPARISON APPROACH: The following sales were used to determine the
estimate of market value for the subject property:

greatest emphasis to comp one because of its proximity to the subject and its zoning. The
appraisers adjusted Comp #1 90% of the sale price per square foot. This adjustment is
based on the data presented in this report and the fact that the subject property has no

WHEREAS, the City of Agawam owns the property located at the southwest corner of Mill and
Suffield Streets, Agawam, MA, containing approximately 2,634 square feet of land with 40.52
feet of frontage on Suffield Street (Exhibit A) via a taking dated May 22, 1970 and recorded in
the Hampden County Registry of Deeds Book#3508, Page #36 (Exhibit B); and
WHEREAS, approximately 2,634 square feet of said property located at the southwest corner of
Mill and Suffield Street, Agawam, MA are zoned for business A development but do not meet
the size requirement; and

the appropriate location for drainage maintenance; and
WHEREAS, the drainage easement generously granted by Cloverleaf Realty Group Inc. will
protect the health, safety and welfare of the general public; and
WHEREAS, the easement constitutes an interest in real estate; and
WHEREAS The Agawam Department of Public Works and the Town Engineering Department

General Laws of the Commonwealth of Massachusetts hereby declares the approximately 2,634
square feet of property located at the southwest corner of Mill and Suffield Streets, Agawam,
MA available for disposition of sale, subject to an easement for drainage maintenance and that
the Mayor is empowered to execute all necessary documents in order to effectuate the
completion of the transaction.
And the Agawam City Council hereby further resolves, pursuant to M.G.L. 40 §14 to accept the
easement from Cloverleaf Realty Inc. and that the Mayor is empowered to execute all necessary
documents in order to effectuate the completion of the transaction.

DRAINAGE EASEMENT
Cloverleaf Realty Group Inc., a Corporation with the location of its principal
office at 664 Suffield Street, for consideration of less than one hundred dollars, the
sufficiency of which is hereby acknowledged.
Grant to the TOWN OF AGAWAM, a municipal corporation located in the
County of Hampden with its principal office at 36 Main Street in said Agawam,
Massachusetts, the following described easement for public purposes in Agawam,
Massachusetts, to wit:
BEING an easement for the purposes of constructing, repairing and maintaining a
permanent storm drainage easement necessary for public convenience and health over a
parcel herein described, said easement and right of way over said parcel to be an
easement together with the right to enter with men, equipment, machinery and material to
construct drainage facilities, landscape, alter grades and slopes, to move or remove any
structures, together with the right to inspect, repair, maintain, and improve said storm
drainage facilities, including the right to trim, and remove any and all trees and shrubbery
located on the land within said easement, and do any and all other things reasonably
necessary for construction and maintenance of said storm drainage easement.
The description of the land over which the storm drainage easement is granted is
more particularly bounded and described as follows:
Beginning at an iron pipe found on the westerly sideline of Suffield Street- Route
75, said iron pipe bearing S4-55-06W a distance of 89.29 feet from an iron pipe found on
the southerly sideline of Mill street; thence running S4-55-06W along the westerly
sideline of Suffield Street-Route 75 for a distance of 40.52 feet to a point; thence running
N89-01-26W for a distance of 65.84 feet to a point; thence running S87-03-19W for a
distance of 137.45 feet to a point; thence running N2-14-31 W for a distance of 40.41 feet
to a point; thence running N87-03-19E for a distance of 142.5 feet to a point; thence
running S89-01-26E for a distance of 65.84 feet to an iron pipe found at the place of
beginning. Said described easement contains 8,280 square feet of land.

WHEREAS, the City of Agawam owns the property located at the southwest corner of Mill and
Suffield Streets, Agawam, MA, containing approximately 2,634 square feet of land with 40.52
feet of frontage on Suffield Street (Exhibit A) via a taking dated May 22, 1970 and recorded in
the Hampden County Registry of Deeds Book#3508, Page#36 (Exhibit B); and
WHEREAS, approximately 2,634 square feet of said property located at the southwest corner of
Mill and Suffield Street, Agawam, MA are zoned for business A development but do not meet
the size requirement; and
WHEREAS, said property is zoned for Business A use; and
WHEREAS, it is in the best interests of the City of Agawam to dispose of said property by sale
to be developed for Business A use; and
WHERAS, The owner(s) of Murphy's Pub desire to purchase the 2,634 square feet of land
located on the southwest corner of Mill and Suffield Streets, Agawam, MA to be developed for
Business A use; and
WHEREAS, the owners of Murphy's Pub will generously grant an easement through the 2,634
square feet of land upon purchase of said land for drainage purposes in addition to land
continuing the easement through land currently owned by the owners of Murphy's Pub (Exhibit
Q and
WHEREAS, the easement is necessary for the appropriate location for drainage maintenance;
and
WHEREAS, the drainage easement will protect the health, safety and welfare of the general
