A RESOLUTION APPROPRIATING FUNDS FROM FREE CASK TO THE RESERVE FUND
ACCOUNT 16605 57300

Whereas,the Agawam City Council appropriated funds from the Reserve Fund Number 16605-
57300 to the Wastewater Professional Services Fund Number 22542-52190 in the amount of
$269,875.00 by means of TO-2016-30; and
Whereas, TO-2016-30 was approved by the Agawam City Council on September 19,2016 and
approved for passage by Mayor Richard A. Cohen on September 20,2016;and
Whereas,the Agawam Department of Public Works utilized the funds from TO-2016-30 for the
emergency replacement of the sewer main on Main Street; and
Whereas,the emergency basis of the sewer work on Main Street necessitated the transfer of
funds as listed in TO-2016-30; and
Whereas,TR-2016-78 appropriates the same amount of funds from the Wastewater Retained
Earnings Account to the General Fund as this resolution; and
Whereas, free cash has sufficient funds to allow for the appropriation of$269,875.00;
Whereas, it is necessary to appropriate$269,875.00 through two separate actions to the Reserve
Fund Account.
NOW THEREFORE,BE IT RESOLVED that the Agawam City Council appropriate two
hundred and sixty nine thousand and eight hundred and seventy five dollars ($269,875.00)from
free cash to the reserve fund account 16605 57300.

The funds being requested for transfer are for the emergency repair/replacement of a critically failing 12-inch
clay tile sanitary sewer main in Main Street. The emergency repair/replace of the sewer main will consists of
constructing a.new 12-inch PVC sewer main to by-pass the impacted area, the depth of the new main will range
from 10 feet to I2 feet. The total new sewer will be approximately 442 linear feet in length and will involve the
installation of two new sanitary sewer manholes. The proposed work is necessary to preserve the health and
safety of the public due the risk of the sanitary sewer main collapsing and causing sewer backups in people's
homes, and also a sanitary sewer overflow that would negatively impact the waters of the Commonwealth.

all traffic control devices(cones,barters,bmrlcades,arrow/VM boards,etc...)to meet MUTCD
rtequir ments. We arc anticipating that MassDOT will allow the lane closed to traffic for the duration of
the project. Traffic control details are being worked out at this time.
• The concrete highway may be encountered In the work area,please include a separate additional Square
Yard ire for saw cutting,excavvdon and disposal should that be the cue.
• All materials to be included in price inchWing gravel bacdc$il,pipe,mar&oles,manhole frames&
covers,F1MA,etc...
• CDF waiver is pawing with MassDOT,assume%41.03.1 Type B all density costs are to be borne by the

• We are choking with MessDOT regarding the pavement restoration but for the time being assume 4"

■ According to bore log data from the Sept.2013 from the SWSC project just south of rho proposed
project,the GWT is anticipated to be slightly below the pipe invart ele ration nearest the Rt 57 overpass.

No work will be permitted on weekends during the rem of The Big A additionally no work will,be

• The contractor will be permitted to start work at 7AM and will be allowed to work until 30 mitts before
dusk.

Hi Steve,
I say change the account.
The funds have to come from Wastewater Retained Earnings. The funds expended for the repairs came from the
professional services account.
We had to use reserve fund because Retained Earnings had not been grtified.

EARNINGS ACCOUNT TO THE GENERAL FUND

Whereas, the Agawam City Council appropriated funds from the Reserve Fund
Number 16605-57300 to the Wastewater Professional Services Fund Number 22542-
52190 in the amount of$269,875.00 by means of TO-2016-30; and

Whereas, Town authorities have been in contact with State authorities to review
the legal process with the use of and transfer of retained earnings.
NOW, THEREFORE, BE IT RESOLVED that the Agawam City Council
hereby appropriates the sum of two hundred and sixty nine thousand and eight hundred
and seventy five dollars ($269,875.00) from the Wastewater Retained Earnings Account
to the General Fund to reimburse the Reserve Fund 16605-57300 for the emergency
replacement of the sewer main on Main Street.

At the finance and council meeting last night the Town Order TO-2016-79 was tabled.Attached to this email is a revised
order that Stephen Buoniconti did but the old version was on the agenda that was not correct. The attached order
reimburses the General Fund for the Emergency Main Street Sewer Repairs and this version should be submitted to
replace the one submitted. Also I believe an appropriation from Retained Earnings should be a town resolution (TR) not
a town order(TO)
If your intent is to increase the Reserve Account 16605-57300 by$269,875,a second resolution should be done for a
supplemental appropriation from free cash.
If you do not wish to increase the reserve account budget you will not need a second resolution. A free cash
appropriation could be done later if there is a future need.
