Mr. Kozloski called the meeting to order at 6:30 PM. 5.
1.REQUEST FOR DETERMINATION- Bailey St. - Ivanov
Members visited this site to view the existing house (to be demolished) and the proposed
location for the new house. They were in agreement that as long as the work is not doi -
near the embankment, a negative determination could be issued.
Motion was made by Ms. Galiatsos and seconded by Mr. Meagher to issue a Negative
Determination if Applicability.

2.Complaint- Eastview Ave. - City of Springfield digging up pipes, Commission will coo'
site visit, DPW working with City of Springfield on this project.
3.John Decker, from Agawam DPW, requested to approve use of wattles instead of silt
fence for the project at North Westfield Street (new water line).
Motion was made by Mr. Sotichek and seconded by Ms. Becker to approve the use of
wattles instead of silt fences at the North Westfield Street water line project.

4. APPROVAL OF MINUTES - November 14, 2013

of November 14, 2013 as written.

5.Enforcement order updates - 37 Autumn St., Garden St., no updates. 1068 River Rd.,
1068 River Road - Devlina Kosch Brewer from Tighe and Bond was in attendance to
give the Commission an update on the work at 1068 River Road. Mr. Kozloski explained

that the Commission had made site visits, and that the plan was approved at the last
meeting. A question was raised whether we had actually approved the plans, and an
extension to spring at the last meeting. The homeowner was also present. There was a
general discussion of plan and timing with Ms. Brower and the homeowner. Motion to
approve plan was made at end of meeting.
7.PUBLIC HEARING—Notice of Intent-Cooper St., Genesis Health Ventures
Carl Hultgren of Quinn Engineering was in attendance to present this NOI. He explained
that the 2nd phase of work is an expansion of parking area with stormwater controls. The
delineation is slightly different than the one used on original plans.
Motion was made by Mr. Soticheck and seconded by Ms. Galiatsos to approve the
revised delineation for Heritage Hall North.

There was discussion with abutters about potential for more water to their properties. Mr.
Hultgren explained that the properties to the front of the building are at a higher elevation
than the proposed new stormwater outlets, and the water will be directed away from their
properties. Treatment methods for runoff don't currently exist, so installing treatment
BMP's is an improvement. Mr. Kozloski verified that the berm shown on the previous
plans is not shown on the current plan. Mr. Hultgren explained that with the survey and
re-design, the berm is no longer necessary.
Sandra Lynch, 40 Federal Ave., asked if all the work is being done in the back of the
building, she gets water in her basement, how is the work going to not make it worse?
Mr. Hultgren explained the ground water re-charge plan. Mr. Kozloski explained the
hydrology of Harvey Johnson Dr. Mr. Hultgren requested a continuance to the January 9
meeting.
Motion was made by Ms. Messick and seconded by Mr. Meagher to continue the public
hearing for Heritage Hall to January 9, 2014 as requested.

Mr. Halpern will send updated plans and detail sheets to the officer.

8.PUBLIC HEARING CONT.—Notice of Intent- Corey St., Russo
Rob Levesque was in attendance to present this project and described the site visit of
December 12, Mr. Levesque states that the proponent has met with Engineering and
met all of the Engineering requirements. Mr. Meagher asked how to control fertilizer
runoff into pond. Mr. Levesque said that would be a maintenance issue. The following

issues were discussed: planting of trees and bushes for various areas; possibility of
phasing, that it is probably not practical in a strict sense; erosion controls; and
monumentation, particularly around the pond area. Mr. Kozloski brought up pedestrian
issues,particularly to new School St. Park entrance and suggested that the Commission
send a letter to the Mayor about sidewalk to park. Ms. Becker raised a question about
dogs as a possible source of pollution to wetlands. Mr. Levesque again stated that would
be a maintenance issue. Mr. Kozloski asked for any public input.
Mike Martino, 89 Jennie Circle - asks whether EPA actually cleaned up whole site. There
was a discussion of clean up and where the snow would be piled. Mr. Levesque showed
the areas on the plan. Mr. Martino asked about screening. Mr. Levesque showed him tree
plantings on the plan. W. Martino states that the row of buildings closest to pond will be
visible from his back yard and asks whether there is a plan to put a fence around the
property. He then commented to Mr. Russo about noise, the view etc. Mr. Russo stated he
will make the neighbors happy.
Rachel Thomas, 43 Janelle Dr. -Asked if 30 units are really necessary and how many
units they need to make a project viable. There was discussion of zoning, setbacks,
density, etc. She then asked about tree removal. Mr. Levesque confirmed which trees will
be removed. Henry makes the point that there is no such thing as "junk trees". Mr.
Kozloski asked Mr. Levesque to explain why they are exempt from stormwater
guidelines. Mr. Levesque stated because there is no point source discharge within the
buffer zone and that he has spoken to Mark Stinson at DEP about this. Discussion of how
DEP handles case files. Mr. Kozloski stated that he would like to see one unit from
building one removed from plan. General agreement from Commission members that
project should have fewer units. Mr. Kozloski asked how we protect the wetlands.Mr.
Levesque stated that would be a maintenance issue. Ms. Messick requested that Mr.
Levesque submit a maintenance plan for the next meeting. There was further discussion
of property line. Mr. Levesque requested to continue to the Jan. 9 meeting.
Motion was made by Mr. Soticheck and seconded by Mr. Meagher to continue the public
hearing for Russo on Corey Street to January 9t'as requested.

1. REQUEST FOR DETERMINATION—Springfield Street— Stop & Shop _
Bob Gallagher of Teamwork Installation Specialists was in attendance to present this o
RDA. He explained that the Peapod Home Delivery Service will be utilizing existing -;7m
mezzanine space in the supermarket and the existing loading dock. Proposed work 'p-
includes a 300 SF steel ramp addition off the existing concrete loading dock. This work
is within 100' of the wetland. Members conducted a site visit. Ms. Galiatsos stated that
the work is all within an existing paved area and there is no new impervious area
proposed. She suggested a Negative Determination.
Motion was made by Ms. Messick and seconded by Ms. Galiatsos to issue a Negative
Determination for Stop & Shop on Springfield Street.

The members then discussed 1068 River Road. The restoration plan will be submitted at
the next meeting.
Motion was made by Mr. Soticheck and seconded by Ms. Messick to allow for the
restoration plan for 1068 River Road to be submitted by December 12, 2013.

2. REQUEST FOR DETERMINATION— 164 Southwick Street—Interbartolo
Michael Interbartolo was in attendance to present this RDA. He explained that this is an
existing single family home that is used as a group home and that the state is requiring
additional parking for staff. They are proposing adding approximately 800 SF of paving
to the east side of the driveway. There is an existing intermittent stream located north
and west of the existing paving. Mr. Kozloski and Mr. Fallon visited the site to view the
area. Mr. Kozloski stated that the intermittent stream is located on the opposite side of
the driveway of where the new pavement is going.
Motion was made by Mr. Fallon and seconded by Mr. Meagher to issue a Negative
Determination of Applicability for 164 Southwick Street.

4. ENFORCEMENT ORDER UPDATES
Garden Street—The Commission received a copy of a letter that the Planning Board sent
to Mr. Russo asking for a timeline on the submission of the revised phasing plan for his
Garden Street property. Ms. Becker stated that she was at the site last week and found
that the grass was starting to grow.
3. PUBLIC HEARING—Notice of Intent—Corey Street--Russo
Mr. Fallon left the meeting at this time.
Rob Levesque of R. Levesque Associates was in attendance as well as the applicant,
Thomas Russo, Jr. Mr. Levesque explained that Mr. Russo is proposing an apartment
project at the former Agawam.Sportsman's Club which he now owns. He stated that they
used the wetland delineation/line that was prepared by Pioneer Valley Environmental and
approved by the Commission. The Engineering Department submitted continents on the
project today. Mr. Levesque stated that he has set up a meeting with the Engineering
Department next week to go over the comments. He explained that the property is zoned
RA-3 (multi family zone) and that they must meet subdivision standards. The plan shows
a roadway with a cul-de-sac and parking. He explained that the drainage is designed so
that the surface water will flow to the low point then to a catch basin and manhole. Rain
gardens are being provided for infiltration. A stormceptor unit will be used for water
quality. He explained that there is no point source discharge and therefore the
Stormwater Standards do not apply. He stated that there will be sidewalks within the
complex but no sidewalks are proposed on Corey Street. He went on to say that the pond
on the property will be fenced. Ms. Messick asked how replication was being proposed,

Mr. Levesque stated that there will be 125 SF of wetland disturbance and they will be
providing 288 SF of mitigation. Ms. Galiatsos asked how far the decks off the back of
the buildings would be from the wetland. Mr. Levesque stated the closest is
approximately 10'. Ms. Galiatsos asked how the residents would be aware of the wetland
and protect it. Mr. Levesque stated that these are apartments and that the property will be
maintained by a property management company. Ms. Messick suggested that they pull
the buildings further from the wetland and asked why the pond is going to be fenced. Mr.
Levesque stated that there is a use limit on the pond by DEP. Mr. Russo stated that his
insurance company may also require that the pond be fenced for liability reasons. Ms.
Becker brought up the soil contamination. Mr. Levesque stated yes there is soil
contamination and the plan shows an area of use limit. He stated that they have been
working with DEP and that the areas of contamination of limited. Ms. Becker asked if
the entire site was going to be fenced. Mr. Levesque stated that he will have to discuss
that with Mr. Russo but that the plan now shows a fence on a portion of two sides of the
property. He went on to say that if Mr. Russo's insurance company requires it they will
provide a fence. Mr. Meagher asked if they would be applying fertilizer to the grassed
area and expressed concern that this would pollute the wetland. Mr. Levesque stated that
the Commission could restrict that in the Order of Conditions. Mr. Kozloski asked how
the wetland would be protected and expressed concern over mowing the property and
encroaching on the wetland. Mr. Levesque stated that a limit of work line is shown on
the plan. Mr. Kozloski asked how close the limit of work line is to the decks. Mr.
Levesque stated approximately 6'. Ms. Messick pointed out that the first Engineering
Department comment asks why this project is exempt from the stormwater standards.
Mr. Levesque stated that there are no point source discharges in the buffer zone. He
suggested the Commission contact DEP to confirm that. He then stated that they could
provide a fence along the limit of work line. The members didn't agree with that
suggestion. They scheduled a site visit for next Friday and asked that the corners of the
buildings nearest to the wetland be staked prior to the site visit. Mr. Levesque agreed to
that. Mr. Kozloski asked for public input.
Richard Bennett, Willow Brook Drive asked if the use area restriction applied to winter
use as well. He stated that this pond has been used for ice skating for years. Ms. Dachos
stated that it is private property. Mr. Bennett then asked if there would be no
maintenance behind the fence. Mr. Levesque stated correct,no maintenance beyond the
limit of work line. Mr. Bennett then brought up the issue of the new entrance to School
Street Park that will be next to this property and the amount of foot traffic that will be
going there. He expressed concerns over no sidewalks on Corey Street and asked if the
developer would consider installing sidewalks along his frontage on Corey Street. Mr.
Russo stated no, he will not. Mr. Levesque stated that the Planning Board will be
reviewing the site plan for the project next week.
Rachel Thomas, 43 JaneIle Drive asked what her recourse would be if she ends up getting
water as a result of this project. Mr. Kozloski explained that the Engineering Department
concerns must be addressed and that they are currently reviewing the drainage design.
He suggested that she also attend the Planning Board meeting next week.

hearing for the Corey Street NOI to December 12, 2013.

4. ENFORCEMENT ORDER UPDATES
Mr. Fallon returned to the meeting.
37 Autumn Street—Barbara Wojciechowski of 37 Autumn Street was in attendance to
discuss the Enforcement Order that was issued at the last meeting regarding fill that was
placed in the floodplain and more specifically the requirement that she restore the area to
its original grades by November 30th. She asked if she had any other options on this
matter and explained that she was given permission to place fill in this area previously.
She stated that dumping had occurred on this property many years ago and that they
removed debris from the site to build the house. Ms. Magda asked what her intentions
were in filling in this area. Ms. Wojciechowski stated that she has a tick problem in her
house and she was trying to alleviate that by making the area movable. She stated that
high grass is a breeding area for ticks. Ms. Messick explained that this area is floodplain
and that the capacity needs to be restored. She instructed her to use the plan she was
given(plan approved with the Order of Conditions)to comply with the Enforcement
Order. Ms. Galiatsos stated that she must remove any leftover dirt from the site. Ms.
Wojciechowski stated that she cannot comply with the time limit in the Enforcement
Order and requested an extension. Mr. Kozloski stated that either the work must be done
before the ground freezes or postpone it to the spring. Upon discussion the members
agreed to extend the time limit for restoring this area to the end of March, 2014.
Motion was made by Mr. Soticheck and seconded by Ms. Messick to extend the timeline
for restoring the area of fill on 37 Autumn Street to March 31, 2014.

5. Correspondences
The Commission had sent a letter to Mr. and Mrs. Langone regarding the need to file a
Request for Determination for lot 10 Mark Drive. A "white form"was submitted to the
Planning Department but cannot be approved until the Commission receives an RDA.
Mr. and Mrs. Langone were in attendance this evening as well as their Environmental
Engineer, Stanley Tenerowicz of Sweet Bay Environmental. Mr. Tenerowicz explained
that as part of the Administrative Consent Order from DEP they were required to submit
a plan showing the limits of all resource areas on Lots 6, 7, S, 9 and 10A as well as the
building envelope on lot 9. He stated that plan was prepared and approved in October,
2012 however one modification on lot 9 was needed. He stated that the surveyor is

revising the plan and that this is the plan that will accompany these deeds and make
future buyers aware of the resource areas. He went on to say that approximately one acre
of riverfront area will be restored with grassland habitat and that bounds have been
placed along the resource area as required. Mr. Kozloski felt that an RDA would be the
best way to handle this "white form"as it will create a paper trail. Ms. Messick stated
that only a portion of riverfront exists on lot 10 and that no work is proposed in that area.
There was a lengthy discussion with Mr. and Mrs. Langone and in conclusion the
members agreed that the "white form" can be signed off on as soon as the Commission
receives notice that the plan described above has been recorded at the Registry of Deeds.
Mr. Tenerowicz indicated that he expected that to take place very soon.
The Commission received a written request for a Certificate of Compliance for 158
Elizabeth Street. Mr. Kozloski made a site visit and found that the plantings that were
required in the Order of Conditions have not been installed. The seller's attorney has
been notified. The members agreed to make a motion to issue a Certificate pending a
favorable inspection of the plantings.
Motion was made by Ms. Messick and seconded by Ms. Becker to issue a Certificate of
Compliance for 158 Elizabeth Street pending a favorable inspection by Commission
members.

Mr. Kozlosk updated the members of the proposed work to a fence at the dam on the
Westfield River in West Springfield. He stated that the owner of the dam will be
contacting the Commission when they have hired a contractor to do this work. He stated
that he spoke with DEP and was told this can be allowed under an Emergency Order.
Work to be allowed would be the fording of a stream to get access to this site.
The Commission received a written complaint from Gail Hansmann of Colonial Avenue
stating that the property owner behind her(Prince Lane) has cut small trees and saplings
and is parking vehicles within the wetland area. The members asked that a letter be sent
to the property owner asking to schedule a site visit.
170 River Road—A letter was sent to the property owner regarding whether work was
taking place within riverfront property on this lot. The Commission has not yet received
a response.
Dick Bennett was in attendance to discuss Pynchon Point. He stated that the railings
have not yet been fixed and there is a 20' section missing. He also brought up the
overgrowth of vegetation. Mr. Kozloski stated that he should contact Chris Golba and
check with DEP to determine if there is an alternative to cutting down the sumac as it will
just grow back. He went on to explain that a certain percentage of vista pruning is
allowed under the Act.

Mr. Kozloski called the meeting to order at 6:30 PM.
I. REQUEST FOR DETERMINATION CONT.—Main Street—Salmar Realty
Filipe Cravo of R. Levesque Associates was in attendance. He stated that as a result of
the recent site visit,the plan has been revised. He explained that they have eliminated the
12"culvert under the gravel drive. He stated that it previously had been used to convey
water to the adjacent parcel and that as discussed at the most recent site visit it would be
best to eliminate that culvert and fill in the swale on the other side. He went on to say
that they will construct a swale on the west side to convey the water down the gravel
drive. He stated that these changes allowed them to condense the site and reduce the total
impervious area slightly. He stated that the plan shows the area to be outside of the
elevation that the FEMA maps show as bordering land subject to flooding. A request for
map amendment has been filed. Ms. Dachos asked how many parking spaces were being
provided. Mr.Cravo stated there are a total of fifty(50) spaces shown including the ones
on the south edge of the parking lot. Ms. Dachos stated that this plan has not been
reviewed by the Planning Board yet. She asked if there would be any Conservation
Commission concerns if the parking layout were to change. Mr.Kozloski stated no,the
area is out of their jurisdiction. Rob Levesque was also in attendance. He asked Ms.
Dachos if there was a layout concern at this time. Ms. Dachos stated that the Site Plan
has not yet been received but that there was discussion at the Team Meeting on this
project regarding the stacking lane blocking some of the parking spaces. Mr. Levesque
stated that there is a stacking lane and a bypass lane provided however they could
accommodate more spaces and stay out of the Commission's jurisdiction.
Motion was made by Ms. Galiatsos and seconded by Mr.Meagher to issue a Negative
Determination of Applicability for Salmar Realty, Main Street.

2. PUBLIC HEARING CONT.—Notice of Intent—Cooper Street—Kot
Mike Mocko and Ron Huot were in attendance. Mr. Mocko explained that per DEP's
recommendation,the 12' discharge pipe from the detention basin has been eliminated and
it will now function solely as a retention basin. He stated that the water will absorb into
the soil at the bottom. He went on to say that during a 100 year storm the approximate
depth will be 2'. He stated that DEP received this revision and thanked them for taking
the work out of the riverfront area. The Engineering Department submitted a memo
approving this revision. There being no further public input,the Commission closed the
public hearing. The Order of Conditions was written at the end of the meeting.
UPDATE—Hunt Street and Pynchon Point(storm damage)
There was nothing new to update other than the trees have been planted at Hunt Street.
5. ENFORCEMENT ORDER UPDATES
1068 River Road—The property owner hired Tighe and Bond to do the restoration work
and prepare a restoration plan as required in the Enforcement Order. Tighe & Bond has
requested an extension of time to submit the restoration plan. The erosion controls have
been installed. A one month extension was requested.
Motion was made by Ms. Messick and seconded by Ms. Galiatsos to extend the deadline
for filing a restoration plan for 1068 River Road to November 30, 2013.

Mr. Kozloski stated that the restoration work won't be done until spring and they have
done a good job so far.
Mr. Fallon left the meeting at this time.
Garden Street Enforcement Order-Rob Levesque was in attendance along with the
property owner,Thomas Russo,Jr. Mr. Levesque stated that site meetings have been
held since the original Enforcement Order was issued. He stated that the site was cleared
and stripped and some dirt was stockpiled on the adjacent site that Mr. Russo also owns.
He went on to say that erosion controls had been installed along the limit of work line,
however, after reviewing the phasing plan that he prepared for this project it was noted
that Phase 1 included a large amount of the area that Mr. Russo had cleared and that it
was almost impossible for Mr.Russo to omit the other phases as Phase 1 is laid out. He
stated that erosion controls have been installed and are protecting the resource area. He
went on to say that this is an active project and that Mr. Russo would like to continue
working on Phase 1; install the roadway, water and drainage; and install a foundation in
the rear right corner and possibly the right front building. He indicated that they would

submit that as an amendment to the phasing plan. Mr. Kozloski stated that the phasing
plan was approved by both the Conservation Commission and the Planning Board and
that no one from the Conservation Commission was at the in-house meeting when there
was the discussion of getting a foundation in this year. He went on to say that all phases
were opened up entirely. Mr. Levesque stated that he will communicate with the
Planning Board on this matter. Ms. Messick stated that the Conservation Commission is
concerned with how to keep any erosion from leaving this site and getting into the
adjacent ponds. Mr. Levesque stated that two rows of erosion controls were installed and
the area was seeded as requested by the Conservation Commission. Ms. Messick stated
that she was satisfied with that work but indicated that the Commission does not have
jurisdiction over the entire site and it will be up to the Planning Board to address the
remainder of the site. Mr. Levesque stated that they are requesting that the first
Enforcement Order(cease and desist)be lifted by the Commission and they will then go
back to the Planning Board. Mr. Kozloski stated that per the second Enforcement Order,
the area must be watered. Ms. Becker indicated that the site should be watered soon as
there has not been much rain since the seed was put down. Mr. Russo agreed to that.
Motion was made by Mr. Soticheck and seconded by Mr.Meagher to lift the original
Enforcement Order(cease and desist) issued to Thomas Russo, Jr. for his property on
Garden Street.

6. Correspondence and Complaints
Mr. Fallon returned to the meeting at this time.
Autumn Street-Mr. Kozloski stated that filling has occurred within the floodplain at 37
Autumn Street. He has researched the plan for the Wojciechowski Notice of Intent and it
appears that the fill was placed in a depressed area on her site which appears to be within
the floodplain. He recommends that the original grades be re-established as shown on the
plan.
Motion was made by Ms. Messick and seconded by Mr. Meagher to issue an
Enforcement Order to the owners of 37 Autumn Street stating the following: the area of
fill is to be restored back to the original grade as shown on the approved plan and seeded.
The fill is to be removed from this site. This work shall be completed by November 30,
2013.

Paul Koretz, 45 Autumn Street was in attendance. He stated that this area has been being
filled for a couple of years. His concern is where the flood water will go with this grade
being changed. He stated that a contractor brings big truck loads in daily and they level it
off on the weekends. He went on to say that approximately 20' of bank on his neighbor's
property has washed away and water goes over their land and then onto his.

Lot 22 Coyote Circle—Mr. Kozloski stated that he has researched the NOI filing and
found that swale at the rear of lot 22 Coyote Circle is out of their jurisdiction. He
recommends that the Swale be maintained as it feeds the wetland to the north. Laura and
David Hendrickson are direct abutters to this lot to the rear on Clover Hill Drive. They
expressed their concerns over the trees that were cut in the 1 5' buffer and how much of a
slope will be in their backyard and how long the swale will be. Ms. Dachos explained
that subdivision buffers cannot be enforced by the Town and that only the abutters can
enforce them. She stated that the Planning Board no longer requires buffers as they are
not enforceable by the Town. Mrs. Hendrickson indicated the house on lot 22 Coyote
Circle is situated so that the land dips down from the house to the level of their property.
She is very concerned that any filling on the adjacent lot will cause flooding on their
property. Ms. Dachos stated that per the Engineering Department they can only make
recommendations on the proposed work. She recommended that the neighbors take
pictures to document the work in case there are issues. The Hendrickson's indicated that
they have an appointment with their lawyer tomorrow to discuss the matter. They
indicated that there is buried broken concrete along the back of the property. Ms. Dachos
stated that they should speak with the Health Department regarding that matter. Ms.
Messick stated that the Engineering Department has control over work within the existing
easement on lot 22.
WMECO—South West Street
The members set up a site visit to view the mitigation area at the WMECO site on South
West Street(former Boglish property) for next Wednesday at 2:30 PM.
Stop& Shop
Stop& Shop is proposing to enclose an existing loading dock. The members agreed to
meet with a representative on next Wednesday at 2:00 PM to view the area and determine
if a filing would be required.
164 Southwick Street—A Request for Determination is being prepared for submittal for
the next Conservation Commission meeting.
Outdoor Classroom
Jennifer Bonfiglio, CPA secretary, sent a memo to the Commission stating that she will
be pursuing CPA funding for the outdoor classroom at the High School. She asked in her
memo if a Notice of Intent would be required. The members were in agreement that yes,
a Notice of Intent would be needed for this proposal.
7. APPROVAL OF MINUTES—October 10, 2013

1. REQUEST FOR DETERMINATION'-Springliejd ', ater an:d.Sewer
Commission— South Transmission Main Replacement Project
Bob Stoops, Chief Engineer and Marty Lobik,Project.Engineer,both of Springfield
Water and Sewer.Commission were in attendance as well as-Dwight Donk, of CDM to
present this RDA. Mr. Stoop explained that this is a 6 mile poject starting at Provin Mt.
Reservoir and running to Ellison Avenue. He stated that the current water line was built
c. 1928 and that last Fall there was a significant break and subsequent:engineering studies
have found that the water line is in significant disrepair and determined that it needed to
be replaced. He stated that the Town of Agawam is going to be installing a 24" diameter
pipline on North Westfield Street in preparation for this larger project. The Town's work
will maintain supply and pressure during the larger proj&fbeing off line. He stated that
the new water line will be both 54"and 48" and they plan to start construction next Fall
and anticipate it will take approximately two years to complete. He stated that the water
line will be replaced in-kind in both size and trench. Dwight Donk of CDM then
explained that they have asked.for a Negative Determination of Applicability as this type
of proj ect is exempt. He stated that pre-application meetings have been held with both
DEP and US Army Corps of Engineers (USAGE). A 404 Water Quality Certificate and
USACE permit will be required. He explained that thirteen resource areas have been
delineated along the project route. He stated that an alternatives analysis was done for
the work and the wetland crossings and that best management practices(bmp's)will be
used including swamp/construction mats: Six stream crossings exist under the existing
pipe through concrete culverts. He stated that they will place:mats to cross the streams
and that in terms of mitigation, all areas will be restored to existing grades. He went on
to say that the excavated.soils will be separated and replaced in kind; He also stated that
there is one weltand where they found phragmytes and in that location the soils and

vegetation will be removed from the site and disposed of and new soil will be brought in.
He explained that the endangered species estimated habitat overlaps the right'of way
(ROW). They have contacted NHESP and a wildlife habitat assessment will be appended
with the 404 Water Quality Certification. There are no trees in the ROW,mostly wet
meadows. Mr. Fallon asked how.they would handle the temporary storage of spoils
during construction. Mr. Donk stated that the ROW is'1�00' wide and the construction
area will be 80' wide except in wetlands/streams it will be 45 wide: He went on to say
that the spoils areas will not.be located within the 45' area. He also stated that per Tim
McKenna of DEP they have shown the de-watering areas. Mr. Kozloski asked if there
would be an environmental engineer on site during the wetland crossings. Mr. Donk
stated that a resident engineer would serve as an environmentalist. Mr. Stoops stated
that level of information has not yet been established but they will do as required. He
suggested that construction supervision would be done by CDM and SWSC. Mr. Donk
stated that CDM has wetland.staff that would support the resident engineer. Mr.
Kozloski asked for digital copies of the plans which they could possibly put on the Town
website to make available to the public. Ms. Messick stated thavas with WMECO's
larger Greater Springfield Reliability Project,the Commission should receive updates on
the work that is being done in wetland areas. Mr. Stoops stated that they will also
conduct weekly coristruction meetings. Mr. Kozloski suggested that Commission
members be allowed to;attend those meetings when work is being done in the wetland
areas. Mr. Stoops agreed to that and stated that he will forward the monthly schedule
updates that he will get from CDM to the Commission. Mr. Lobi,k stated that they may
be able to provide station updates and pdfs of the plans, Mt. Kozloski asked:if there was
any public input.
Burt Stoneburg, 526 Cooper Street asked for clarification on the number of water lines
being replaced. Mr. Doak explained that only one water line is being replaced and the
Town of Agawam is doing a separate water main project~ Mr.,'.Kozloski stated that the
Council recently approved the funding for the Town project will take place in Route 187.
Mr. Stoneburg asked if.that would provide suitable pressure for Feeding Hills. Mr.
Stoops stated that this project will improve both water pressure and water duality and that
it is critical that the Town,project be built before this project starts.
Motion was made by Ms. Messick and seconded by Mr.Meagher to.issue.a Negative
Determination of.Applicability for the Springfield Water.and Sewer Commission South
Transmission Main.Replacement Project including that the Commission requests that
regular status reports be submitted when work is taking place within wetland areas; the
Commission recommends that an environmentalist be on-site during work within wetland
areas; and Commission members may periodically attend construction meetings; and the
Commission would like to receive a digital (pdf)of the project plans.'

Philippe Craveau of R. Levesque Associates was in attendance to present this RDA.
Commission members met with him on-site just prior to:the meeting. He explained that
the proposal for this site is the construction of a 2100 SF Dunkin,Donuts Drive-Thru
Restaurant with drive-thru lane and a fifty space parking lot; and two detention facilities.
He stated that they are outside of the 100' buffer zone to the east and while FEMA maps
show this as floodplain with an elevation of 60', they have done a topo survey and found
the lowest area of work will be at elevation 67'. Ms: Messick asked for clarification on
that. Mr. Craveau stated that the current FEMA Map shows.bordering-land subject to
flooding right through the middle of the site with an elevation of 60'. Since conducting
their own topo survey they have filed for a map amendment. Mr.Kozloski stated that as
they found at the on-site; this site drains across the road and there is a large area of
erosion/gully and the embankment may eventually.give way as a result. Mr. Craveau
stated that the area of erosion appeared to be on the adjacent property. Ms. Messick
stated that the Commission cannot issue a Negative Deterinxatiorr if the property is
shown to be within the floodplain. She suggested that the rear property cornets be pinned
and they wait to hear back from FEMA on the map amendment. Mr. Craveau reiterated
that the elevation FEMA assigned to this site is 60'. Ms. Galiatsos agreed that the
property pins be located because it was not clear if the erosion was in fact occurring on
this property. In conclusion, the members agreed that this tem'should be continued to
allow for the rear property corners to be pinned to establish wherethe-crosion,is
occurring; and legally resolve the FEMA issue.

for Salmar Realty, 389 Main Street to October 24, 2013.

3. PUBLIC HEARING CANT. —Cooper Street--Kot
Ron Huot of Anderson Associates was in attendance. The:Commission received an email
today from DEP regarding this project. Mr. Huot stated that he has spoken with the
Town Engineer and she.stated she would allow the overflow outlet structure to be
removed if he can provide a wider spreader. He also stated that the pert test that was
done resulted in 3"in 45 seconds. Mr. Kozloski asked what would happen to the
drainage when the ground is frozen. Mr. Huot.stated they will remove the pipe, provide a
wider spreader and sediment basin and that if it overflows it will go into the basin. Mr.
Kozloski asked if an alternatives analysis was done. Mr.Huot stated the original design
had the basin closer but.this alternative moved it over and out of the riparian zone. He
stated that Mr. Mocko is out of town this week but the plan will be revised to address
DEP concerns for the next meeting.

1. REQUEST FOR DETERMINATION-630 South West.Street—Dupont X-

The applicant, Larry Dupont, was in attendance this evening.'Mr. Kozloski had met with
him on-site two weeks ago.. He,explained that he has an existing garage that he would
like to remove and replace with a larger garage. Ms. Becker asked how far this location
is from the wetland. Mr. Dupont stated that.there is no standing water. Mr. Kozloski
indicated that there is an intermittent stream off the property which comes out of Leonard
Pond. He stated that though it rained the day before the site visit,it,was dry when he
looked at it. He went on to say that there is a grassed area from the back of the existing
shed to the wetland off of this property. Mr.Dupont stated that the garage is a pre-built
unit and will be constructed on a slab. He also stated that the area is very flat.
Motion was made by Ms. Becker and seconded:by Mr.Meagher to issue.a.Negative
Determination of Applicability for a new garage at 630 South.West Street by Dupont.

2. PUBLIC HEARING CONT. —Notice of Intent Cooper Street—Kot
Mike Mocko and.Ron Huot were in attendance as well as the applicant,Vadim Kot. Mr.
Mocko gave a brief overview of the project. The Commission received a memo from the
Engineering Department today which stated that an additional perc test is needed. Mr.
Huot stated that the perc test will be done next Monday or Tueday. Ms. Becker asked for
the total amount of buffer zone alteration with this project. Mr. Huot stated 840 SF. Mr.
Kozloski asked when the trenching would be done for the emergency overflow. Mr.
Mocko stated that they could schedule the work so the last item would be the trenching

for the emergency overflow. Mr. Kozloski suggested they check with the Engineering
Department on the timing of the emergency overflow work. The members then allowed
for public input.
Ted Pidgeon, 25 Tracy Drive submitted a photo of a well in his backyard with water 3.5'
down. He stated that when he dug the well years ago, the water was 6' down. He is very
concerned with the groundwater level in the area and how this.development may impact
his property. Mr. Kozloski stated that the Commission has no jurisdiction over water
below 18". Mr. Huot stated that the tests that have been done on this site show no water
or mottling for 10'.
Jean Sizek, 33 Tracy Drive stated that the engineer informed her that they may cross her
property with a water line to allow for a looped system. Mr. Huot stated that the
Engineering Department asked him to approach her for that permission as they are
recommending the system be looped to ensure adequate water pressure. Mrs. Sizek
stated that the end of Tracy Drive is not looped to Karen Drive and she has no problems
with her water pressure.
Lorraine Loomer, 475 Cooper Street viewed the plan.. She expressed concerns over
mosquito issues that would arise from the detention basin that abuts her land. Mr. Huot
stated that the Town requires that the detention basin be mowed and there should not be
any standing water to create a mosquito problem.
Vadim Kot, applicant, stated that he built two houses with wells and found that there is a
difference with the depth of water with elevation changes. Mr. Kozloski stated that the
Engineering Department must witness the test pits being dug.
Motion was made by Mr. Meagher and seconded by Ms. Becker to continue the public
hearing for the Kot Notice of Intent on Cooper Street to the next meeting (October 10,
2013).

3. UPDATE—Pynchon Point and Hunt Street(storm damage)
Mr. Kozloski stated that the restoration plan for Hunt Street has been submitted to
NHESP by the property management company for their approval. He stated that he met
with Chris Golba at Pynchon Point and it was agreed that the cracked concrete pad will
remain until next.year and that Red Maples will be planted to replace trees that were lost
during the storm.
4. Correspondence/Complaints
The Commission received an email from Jeff Strole of Aspen Square Management,the
company that manages the 67 Hunt Street site. They are asking if they need approval to
cut some trees down near the building. Mr. Kozloski and Mr. Fallon made a site visit to

determine if the work would require a filing. Mr. Fallon stated that he estimated 200' to
the top of the.bank and found that the trees in question appear to be outside of the
riverfront area and it also appears that this area is not contained in the endangered species
area. Mr. Kozloski stated that he checked with Mark Stinson who informed him that the
Commission could issue an Emergency Order if needed or just allow..the work if it is out
of their jurisdiction.
Motion was made by Mr. Fallon and seconded by Mr. Meagher that the recent request to
remove trees near the building at 67 Hunt Street is out of the Commission's jurisdiction.

Complaint— 1068 River Road—the Commission was made aware of tree cutting on the
riverbank at this.location. The members asked that a letter be sent to the property owner
asking for a site visit to view the trees that were cut.
Dick Bennett was in attendance. He stated that he has asked Chris Golba to trim along
the parking lot at Pynchon Point. He stated that the trimming would be along the edge of
the parking lot and then in 6'. Mr. Kozloski stated that they must check with NHESP on
this matter and that he will also meet with Chris Golba to discuss it.

1. PUBLIC HEARING-�Notice of Intent—Cooper Street-Kot
Ron Huot and Mike Mocko were in attendance this.evening to present this NOI for a
proposed subdivision off of Cooper Street. Mr. Mocko stated that they are proposing
some work in the 100' buffer (grading, home construction and small amount of roadway
construction) and temporary disturbance in the 200' riparian zone (emergency overflow).
He stated that the construction sequence includes revegetation plans for all lots following
construction and the use of erosion controls during construction. Ms. Messick asked for
the amount of riverfront disturbance in square feet. Mr. Mocko stated 1 %of the total
riverfront area or 840 SF. Mr. Kozloski asked how long.it would take for the detention
pond to drain. Mr. Mocko stated less than 72 hours. He went on to say that the soil
testing that was done found,very coarse,permeable soils with a drainage rate of two
minutes per inch. He stated that.the hole would not hold water and they could not gather
perc data. He went on to say that the emergency outlet (required by the Town) will
probably never be used. Mr.Kozloski then asked for any public input.
Ted Pidgeon, 25 Tracy Drive asked for the location of the perc test that was.done. Mr.
Mocko stated in the area of the detention basin. Mr. Huot stated that two were done in
the roadway layout and.two off of the roadway layout in the detention basin. Mr.
Pidgeon stated that when he built his garage he had to take out 4' of loam. Mr. Mocko
assured him that there will be no problems with drainage on this site with the soil types
he encountered. He explained that the roadway will create a grade for the water to runoff
as designed. Mr. Pidgeon stated that his lot is lower than the proposed road. Mr. Huot
stated that the natural swale that exists behind his home will be maintained and lots 2, 3
and 4 will have roof drains.

Ken Sizek, 33 Tracy.Drive asked how far the detention pond outlet pipe is from the water
line that runs through there. Mr. Huot stated that if the water line is in the middle of the
easement its 50'+1-. Mr. Huot then stated that he is working on addressing the latest
round of Engineering Department comments and requested that the hearing be continued
to the next meeting.

hearing for the Kot Notice of Intent to September 26, 2013 as requested.

2. PUBLIC HEARING CONT. —NOI—School Street Park Phase II—TOA
Peter Wells of The.Berkshire Design Group was in attendance to present a revised plan.
He stated that the eastern and western wetland lines were reflagged and another site walk
was conducted with the Commission members. He went on to say that per the Planning
Board and the Conservation Commission the following changes have been made:
adjusted/moved the parking lot(curved linear)further from the abutters; elongated and
moved slightly the detention basin; moved one infiltration trench to underneath the
pavement which allows for additional trees to be planted;and moved a portion of the disc
golf course to Phase 1 of the Park. He explained that during a 100 year storm the east
detention basin would hold 2' 5" of water and would take two hours and fifteen minutes
to drain; and the west basin would have 2' 1" of water and would take four hours and
eight minutes to drain. He also stated that they are not proposing a fence along the back
side of the basin adjacent to the wetland: Recharge has been provided where feasible
(roof and parking lot drainage)but that the site has a very high.water table and is not
conducive to recharge. Mr. Kozloski stated that more trees.may be.required along the
wetland and suggested that the Commission add that to the Order of.Conditions, There
being no further public input;the Commission closed the public hearing. The Order of
Conditions was written at the end of the meeting.
Mr. Meagher left the meeting at this time.
3. PUBLIC HEARING CONT. --Notice of Intent— South Westfield Street—
DepalmafTirone
Rob Levesque was in attendance for this item. Mr. Kozloski stated the last report by
Greg Newman indicated that there was one last standard that had not been met. They
have received a new report this week that indicates that standard has been met. Mr.
Levesque stated that he received a copy of Mr. Newman's final report. He submitted an
Operation and Maintenance Plan to the Commission this evening and he stated that an
email was sent out late.this afternoon from NHESP asking for the deed restriction and a
plan. Mr. Levesque was in agreement with the NHESP request and will provide that
information to them. The Engineering Department submitted comments today,most of

.which are conditions. Mr. Levesque stated that all comments and changes per the
Engineering Department have been made. He went on to.say that he was notified today
of the Chapter 61 A status on the land but that there is nothing in the statute that relates to
permits. He stated that an Order of Conditions issuance would not change the use and
proposed that the Commission include wording in the Order that the Chapter 61A process
must be followed. He stated that he could not find a definition of change of use and went
on to say that the owners plan to continue to farm the land.until they are ready to start
construction. Ms. Dachos stated that under Chapter 61A the Town would be notified
at the time of the transfer so that they could exercise their right of first refusal. Mr.
Tirone stated that he understands that he must notify the Town under Chapter 61A prior
to applying for building.permits. He expressed his concern that this project has been in
the design and permitting stages for approximately five years and this is the first time he
has heard of a possible issue with the Chapter 6 1 A status. Mr. Levesque reiterated that
they do not intend to take the land out of Chapter 6 1 A until they are ready to build.
There being no further public input, the Commission closed the public hearing. The
Commission then wrote the Order of Conditions.
Motion was made by Ms.Messick and seconded by Mr. Fallon to issue the Order of
Conditions for South Westfield Street as written.

5. CERTIFICATE OF COMPLIANCE Lot 6B Mark Drive:
Mr. Kozloski stated that he.has not yet made this inspection but will do so tomorrow.
Motion was made by Ms. Messick and seconded by Ms. Galiatsos to issue a Certificate of
Compliance on Lot 6B Mark Drive pending a favorable inspection by a Commission
member.

Mr. Kozloski stated that work has been progressing at Pynchon Point and that two trees
are to be planted, either Red Maple or a similar species. There was nothing new to report
on Hunt Street.

There was nothing new to report on the Enforcement Orders.
7. Correspondence/Complaints
Mr. Kozloski stated that an anonymous complaint was phoned in regarding a pipe coming
from the old mill building on Elm Street out to the stream. A letter was sent to the
property owner who contacted the office. He stated that the pipe is for a secondary sump
pump that he has. Mr. Kozloski stated that he contacted DEP and was informed that if it
is just water it is ok. He stated that he asked the owner to submit.a letter stating what he
had told him on the phone.
176 Garden Street—Mr. Kozloski stated that the owner of the former Turnverein
contacted the office in:response to a letter that was sent regarding possible dumping on
the property. 'A site visit was held at which Mr.Kozloski and Mr. Fallon attended. It
appears that the dumping is not on the former Turnverein property but is on the adjacent
property. A letter will be sent to that property owner regarding the dumping.

2. PUBLIC HEARING CONT. —Notice of Intent—South Westfield Street—
DePahna
Rob Levesque of R. Levesque Associates was in attendance along with Joe Tirone. Mr.
Levesque stated that he has submitted a package of revised information this week in an
effort to address the comments raised by both the Engineering Department and Greg
Newman(peer reviewer). As of Mr. Newman's last review all stormwater standards had
been met with the exception of the 65% infiltration requirement. Mr. Levesque stated
that he believes this requirement has now been met. Mr. Newman.had emailed the office
that he would not have his final review completed for this evening. Mr. Levesque then
went over Mr.Newman's most recent review and how they have addressed his
comments. Mr. Kozloski stated that a construction sequence plan must be provided. Mr.
Levesque stated that would be provided and prepared in a narrative format. Mr. Leveque
requested a continuance to the next meeting to allow for Mr.Newman's response.

Mr. Kozloski informed the members that Mark Stinson of DEP and a representative of
NHESP will be meeting at 2:00 PM at 67 Hunt Street and then over to Pynchon Point.
4. RATIFY EMERGENCY ORDER—Ramah Circle North—DPW
Motion was made by Ms. Messick and seconded.by Ms. Galiatsos to ratify the
Enforcement Order that was issued by Page Fallon to the.Agawam DPW for drainage
work on Ramah Circle North.

5. CERTIFICATE OF COMPLIANCE—21 South Street
Mr. Kozloski stated that the Order requires a deed restriction therefore the vote should be
conditional upon receiving proof of it.
Motion was made by Ms. Messick and seconded by Ms. Becker to issue a Certificate of
Compliance on 21 South Street pending receipt of proof of recording of the required deed
restriction.

6. ENFORCEMENT ORDER UPDATES—Robin Ridge
Mr. Kozloski informed the members that the Engineering Department is calculating the
amount of uncompleted work at this subdivision which includes monuments as required
by NHESP. He stated that the Town has not yet secured the bond to complete the work.

1. 6:30 PM--REQUEST FOR DETERMINATION— 150 Parker Street—Bates
Mr. Bates was in attendance. Commission met.at his property just prior to the meeting to
view the area where he is proposing to install a fence (north and south side of property).
He explained that he would like to install approximately 340' of 6' high fence. The work
will take place within the buffer zone to a wctland. The members were in agreement that
a Notice of Intent would not be required for this work.
Motion was made by Ms. Messick and seconded by Mr. Soticheck to issue a Negative
Determination of Applicability for a new fence at 150 Parker. Street, Bates.

While conducting the Parker Street site visit, it was noticed that the drainage pipe from
the street into the wetland,just north of#150 Parker Street needs repairing. One pipe is
completely removed and is on the embankment and another section is detached from the
existing drainage pipe. The members agreed to send a memo to the DPW to inform them
of the matter.
2. PUBLIC HEARING CONT. —Notice of Intent-School Street Park II—T.O.A.
Peter Wells of The Berkshire Design Group was in attendance along with Parks and
Recreation Director Chris Sparks. Mr. Wells explained that minor revisions have been
made to the plan to address the Engineering Department comments and a letter was
submitted outlining the revisions. Also, a file number was issued by DEP. Since the last
meeting Commission members walked the site with Mr. Wells. The members were in
agreement that the wetland flags be re-installed so that they can conduct another site walk
and have a greater understanding of where things are proposed(paths,parking lot). Mr.

Wells stated that in response to the Commission's concerns with the detention basin on
Phase I not functioning properly,they will check it and make sure there is a positive flow.
Mr. Kozloski then asked for any public input.
Dave Williams, 464 Corey Street expressed his concerns with the parking lot location just
off his property and questioned whether there is a vernal pool located in this area. He
stated that he has observed mallards nesting in the area as well. Ms. Messick explained
that this is not a certified vernal pool. Mr. Williams stated that he has a list of reptiles he
has seen in that location. He went on to say that a previous plan showed this area as
being a wetland overlook area. Mr. Kozloski explained that the isolated wetland is
federally protected and not in the.Commission's jurisdiction. Mr. Wells explained that
Berkshire Design has had a wetland scientist on this site during all four seasons and there
were no indicators of vernal pool species.
Mark Olson, 469-475 Corey Street stated that this land drains to a drain that is located on
Ellison Avenue adjacent to his property. He is concerned because the pipe is currently
underground and he has had problems with water in his basement. He stated that he is
very concerned with any effects this development will have on his.situation. Mr.
Kozloski stated that the Commission can send a memo to the DPW asking them to
investigate his drainage..matter. Ms. Messick asked if this area was taken into account
when doing the drainage calculations. Mr. Wells stated that the drainage is designed, as
required, so that there is no increase in flows from this site post development. He went
on to say that the drain pipe on Ellison Ave was not taken in to account as it is not part of
the development. Ms. Messick agreed that a memo be sent to the Engineering
Department and DPW to address his concerns.
Mr. Kozloski asked how close the detention pond is to the wetland. Mr. Wells stated 6'
to 8'. Ms. Messick stated that it doesn't allow for any trees to remain in this area. She
stated that she would like to see the detention pond moved at least 35' from the edge of
the wetland. She questioned why the parking lot was so big and whether that could be
moved or made smaller. Mr. Wells explained the parking spaces are needed to
accommodate the band shell. Mr. Soticheck asked how many spaces would be lost if
they were to move the detention basin 35 to 40'. Mr.Wells stated approximately twelve
spaces would be lost. Ms. Messick asked how many spaces are provided in Phase I. Mr.
Kozloski stated 215. Mr. Fallon stated that there are not many shade trees in Phase I and
asked how many were being proposed for Phase IL Mr. Wells stated that 181 additional
trees are being proposed. Ms. Messick reiterated her concern that the detention basin and
path be pulled back from the wetland. Mr. Soticheck agreed that the wetland be
reflagged and another site visit be conducted. Ms. Becker stated that she agrees that the
parking lot be reduced in size. Mr. Kozloski then stated he agrees that there is a lack of
shade in Phase I and stated that more shade trees rather than ornamental trees be
provided.

hearing for the School Street Park Phase 11 Notice of Intent to August 22, 2013 as
requested.

4. UPDATE—67 Hunt Street
Mr. Kozloski informed the members that Mark Stinson at DEP is going to attend a site
visit some time next week with the property owner. He stated that Commission members
should also be present. He will inform the members when the date and time has been
finalized.
5. CERTIFICATE OF COMPLIANCE—Lot 26 Juniper Ridge Drive
Mr. Kozloski made this inspection and recommended that a Certificate be issued.
Motion was made by Mr. Soticheck and seconded by Ms. Galiatsos to issue a Certificate
of Compliance for Lot 26 Juniper Ridge Drive.

6. ENFORCEMENT ORDER UPDATES—nothing new to report.
7. Correspondence and Complaints
Mr. Kozloski stated that the work at Pynchon Point that was allowed under the recent
Emergency Order has not been completed. The members agreed to send a memo to the
DPW asking for an update on the status of the uncompleted work and to notify them that
a restoration plan will be required.
FY 13/14 Chapter 90 Roadway Maintenance Program
The Commission received a copy of the FY 13/14 Chapter 90 Roadway Maintenance
Program memo from the Superintendent of Public Works. Work includes cold planning
and resurfacing of North Street from Maynard Street to Colemore Street. The members
were in agreement that no filing be required for this work.
Motion was made by Ms. Messick and seconded by Mr. Soticheck that the work outlined
in the memo dated July 24, 2013 from the Superintendent of Public Works regarding FY
13/14 Chapter 90 Roadway Maintenance Program does not require further filing with the
Commission.

The Commission received a letter from the owners of 21 South Street asking for an
inspection as they believe they have met all of the requirements in their Order of
Conditions. The members agreed to schedule a site visit for next Wednesday at 3:30 PM.
The owners will be notified as they wish to be present.

1. REQUEST FOR DETERMINATION—270 Main Street-Bryson
The members walked this site prior to the meeting. The applicant has filed for a change
of use of the building from industrial to mercantile and additional work includes repaving
of the parking lot and installing lights in the parking lot; and for wetlands delineation.
The site does contain bordering vegetated wetlands and the 100 foot buffer extends from
the top of the slope and around the back of the building. No work is proposed over the
slope and the closest distance of any proposed work to the bvw is approximately 180'.
The members were in agreement with the delineation and agreed that a Notice of Intent
would not be required for the proposed work. They asked that any disturbed area be
loamed and hydro-seeded. Mr. Bryson stated that they also are proposing to install a
fence and new sign as well as minor driveway improvements.
Motion was made by Ms. Messick and seconded by Mr. Meagher to issue a Negative
Determination for 270 Main Street Flea Market for the change of use and repaving of
parking lot and installation of lights in parking lot; minor driveway improvements;
installation of fence and new sign; and approving the wetland delineation.

micro burst at Pynchon Pont.

Motion was made by Ms. Messick and seconded by Mr. Soticheck to ratify the
Emergency Order issued for the removal of a partially fallen down barn at 72 Adams
Street.

9. Correspondence and Complaints
The Commission received a letter from Palmer Paving regarding the Main Street project,
more specifically,the area on Main Street where they are stockpiling material for the
project. Mr. Kozloski stated that he spoke with Mark Stinson at DEP and was informed
that an RDA is not needed for this.
Motion was made by Ms. Galiatsos and seconded by Ms. Becker to send a letter to
Palmer Paving stating that the Commission accepts their letter regarding no need for a
filing for the area being used for stockpiling for the Main Street project and that no filing
is required.

Complaint—Mr. Kozloski responded to an anonymous complaint regarding piles of dirt
and bobcat work taking place at or behind 275 Silver Street. He stated that he could see
the piles of dirt and the bobcat but no work was taking place at that time. He
recommended that a letter be sent to the property owner asking for a site visit. A draft
letter was prepared for this evening. The members read the draft and agreed that the
letter be sent.

2. PUBLIC HEARING—Notice of Intent—School Street Park Phase II—Town of
Agawam
Peter Wells and Brian Darnold of the Berkshire Design Group were in attendance this
evening as well as Chris Sparks, Director of Parks and Recreation. Mr. Wells began the
presentation stating that Phase II contains approximately 26 acres and the main access to
this phase will be off of Corey Street. The plan shows a paved drive with a parking lot
for approximately 175 cars. He stated that Phase II will contain the following: picnic
areas,pavilion, spray park(two zones with seating around.it),playground,picnic tables
with shade structures (some out in the open), flag pole, band shell and lawn seating; nine
hole disc golf course, lighting for parking lot and walkway, beach volleyball and a
concession/restroom/storage building. He stated that there will be two detention basins
for the drainage. He went on to say that there will be approximately 4200 sq.ft. isolated
wetland disturbance(under the 5,000 sq.ft. threshold) and is considered a category 1 with
Army Corps of Engineers. Brian Darnold then went over the drainage design. He
explained that the parking lot will be pitched into a vegetated swale; the runoff then goes
into a treatment chamber and then to a detention pond with an outlet control structure.
An additional swale with culvert will be constructed along the abutters' side of the
parking lot. He stated that due to the sandy soils, infiltration in the parking lot isn't
possible. He stated that initially the detention ponds were to be designed as rain gardens,
however, due to the soil types that will not be possible. All roof leaders will provide
infiltration. The Engineering Department submitted comments that Mr. Darnold
reviewed with the Commission. He stated that he will be meeting with the Town
Engineer next week to go over and address these comments. Mr. Kozloski asked if they
were taking trees and removing stumps. Mr. Wells stated that they will have to do some
clearing for the walkway but will try to save as many trees as possible. Mr. Kozloski
stated that the Commission is concerned with the number of trees to be removed. Mr.
Wells stated that they will be clearing a large area but will replant some of the trees. Mr.
Kozloski asked for the number of trees to be planted. Mr. Wells stated they are
proposing approximately 160 new plantings. Ms. Dachos explained that this area was the
former town tree farm and that over the years the trees that were usable were removed.
She stated that most of the trees that are left are not usable. Ms Messick asked if
electricity would be provided to this phase. Mr. Wells stated yes, there will be power to
the area and lockable outlets will be provided. Ms. Galiatsos asked about security and
whether any cameras or gates are proposed. Mr. Sparks stated any major service road
will be gated and they have not included cameras. He went on to say that the gate to the
existing parking lot remains open however the gate to the back field is locked everyday.
Mr. Kozloski then asked for any public input.
Richard Golas, 486 Corey Street asked if runoff to his property would be more or less
than currently. Mr. Darnold stated that the proposed swale along the property line may
allow for less water than currently flows towards his property but at a minimum, he will
receive no more water than currently flows there.

4. DISCUSSION—CPA Plan
Mr. Kozloski stated that the CPA Committee is working on a priority plan and has asked
for the Commission's input on items they would like to see added to the priority plan(i.e.
open space they would like to see the Town purchase; farmland they would like to see
protected through APR's, etc.). Ms. Galiatsos stated that she would like to see the Town
purchase the Fini Farm on James Street which is on the market currently. Ms. Messick
stated she would like to re-endorse the goals contained in the Open Space and Recreation
Plan.
Motion was made by Ms. Messick and seconded by Mr. Soticheck to re-endorse the goals
contained in the Town's Open Space and Recreation Plan.

5. DISCUSSION—Member of Open Space and Recreation Plan Committee
The Mayor is appointing a Committee to work on updating the Town's Open Space and
Recreation Plan. A representative of the Conservation Commission must be appointed.
Ms. Messick agreed to serve on this Committee as the Conservation Commission's
representative.
Motion was made by Ms. Messick and seconded by Ms. Becker to appoint Jill Messick to
serve as the Conservation Commission's representative on the Open Space and
Recreation Plan Committee.

3 . CORRESPONDENCE
Letter was received from Palmer Paving Co. regarding the area
across from Six Flags where gravel, concrete and other material
from the highway construction on Main St is being stored until
it is removed after construction is completed. The letter
indicated that they will not require filing a Determination of

Applicability as was requested by Mr. Kozloski. Mr.Kozloski
will check with Mr. Stinson at DEP to determine what is
required.
4 . COMPLAINTS
Richard Bennett was present to discuss the damage done to
Pynchon Point by the microburst. Mr. Bennett indicated that
Ralph Myer (Chris Golba was out of town) , did some emergency
work to open it up for the Fire Works . However, additional work
was required and Mr. Bennett requested the assistance of the
Commission to follow-up on required work.
Mr. Kozloski, Mr. Fallon, Ms. Becker, Ms. Messick and Ms.
Galiatsos had also reviewed the damage to Pynchon Point. Mr.
Kozloski stated that DPW should have had the Commission on site
to approve the work before it was done. An Emergency Order will
be issued to complete the removal of downed trees and other
debris within 30 days. The debris includes the destroyed picnic
bench and trash barrel. In addition, trail damage including the
broken handicap rail will need to be repaired. The cleared area
near the river will need to be seeded and maintained.
5 . DISCUSSION on the Appointment of a Commission member to be
on the Mayor' s Open Space Commission
A motion was made by Mr. Soticheck to nominated Ms. Messick to
represent the Commission and seconded by Ms. Becker.

Optasite Towers LLC—Main Street
A site visit was made by Mr. Kozloski, Ms. Becker and Ms. Galiatsos at the Optasite Towers on
Main Street. Vegetation was growing on the rounding slops, and the area surrounding the
detention pond was growing. The silt fence had been removed.
Motion was made by Ms. Becker and seconded by Mr. Meagher to lift the Enforcement Order
issued to Optasite Towers for property at the rear of 369 Main Street.

4. COMPLAINTS
Silver Lake: Mr. Kozloski received a complaint that work was being done at 90 Edgewater
Road on Silver Lake. The homeowner was doing work to put in a retaining wall on his property
for which a Request for Determination had previously been filed. Mr. Kozloski will look at the
area and work being done.
Main Street Area Across from Six Flags Mr. Kozloski noticed that Palmer Paving Co doing
the MA DOT work on Main Street was storing gravel, concrete and other material from the
highway construction on Main St. on the property where the old motel had been. Mr. Kozloski,
Ms. Becker, Mr. Fallon and Ms. Galiatsos did a site visit and found that that material was
dumped too close to the wet lands and that the site fence boarding the wetlands on the west side
of the property was not properly installed. The construction chief was requested to file a Request
for Determination for Applicability for this activity.
41 Lexington Road: Agawam DPW notified the Commission by letter that the town
cannot clean and maintain the catch basin on 41 Lexington Road as the work was not permitted
by Town ordnance. A letter notifying the property owners of this matter had been drafted for
this evening and was approved by the Commission.
5. Miscellaneous: Mr. Kozloski indicated to the Commission that they should take an active
role in determining properties that could be presented to the CPA for purchase of Open Space.
Mr. Kozlosi asked members to review the Open Space and Recreation Plan and discuss it at the
next meeting.
6. Approval of the Minutes—June 13, 2013
Motion was made by Mr. Meager and seconded by Ms. Messick to approve the minutes of June
13, 2013 as written.

A letter was drafted to go to the two property owners at the end of Lexington Street
which summarizes what was agreed to at the most recent site visit: 28 Lexington Street-
no digging or clearing out of the trench that exists is allowed; the lawn may be mowed up
to three feet from the existing trench. 41 Lexington Street—hay bales are to be removed
from around the catch basin; nothing shall be placed near or in front of the catch basin
that would prevent flow to the basin. Also,the Commission shall follow up on having
the DPW add this catch basin location to their maintenance list.

two property owners (Hannon and Piccoli) at the end of Lexington Street as reviewed this
evening and also a memo to the DPW regarding maintenance of the catch basin.

The Commission received an inquiry regarding the placement of an emergency generator
at the Insurance Center of New England facility on Suffield Street. A plan was sent to
the Commission showing the approximate location. The members were in agreement that
a filing would not be required.
Motion was made by Mr. Soticheck and geconded by Ms. Messick that the proposed
emergency generator installation as shown at the Insurance Center of New England on
Suffield Street does not require a filing with the Conservation Commission.

The Commission received a copy of a revised plan for the solar facility on Shoemaker
Lane which shows the elimination of the maintenance building. The members viewed the
plan and had no problem with the building being removed.
Mr. Kozloski reported that he met with an interested buyer of 41 Logan Place this week
as there is a gully/ravine in the backyard that they would like to install a fence along.
They have a small child. Mr. Kozloski stated that he informed them that a fence should
not be a problem.
Adams Street—Grimaldi
The office received a"white form" for a lot on Adams Street that is owned by Larry
Grimaldi. Mr. Grimaldi was in attendance this evening. He explained that the
Commission members met with him on this property last fall when he purchased it from .
the Town at auction. He has demolished the existing house and has applied for a building
permit to construct a new one. There is an existing barn on the property that is in major
disrepair and he feels it poses a safety hazard. He would like to remove the barn as it has
partially fallen down.
Motion was made by Ms. Messick and seconded by Mr. Soticheck to issue an Emergency
Order for the removal of a deteriorated barn that is posing a safety risk at 72 Adams
Street.

The members viewed a GIS map of this property to determine if the house construction
would require a filing. They drew a line on the map and indicated to Mr. Grimaldi that as
long as now work is done beyond this point, a filing is not required for the construction of
the new house. At this point, Mr. Grimaldi informed the Commission that he intends to
build the house first and then work on dismantling the barn. The members informed him
that an Emergency Order is only good for 30 days. He did not think he could get the
work completed within 30 days.

motion to issue an Emergency Order at 72 Adams Street.

with the Conservation Commission and to attach the plan the Commission marked up this
evening.

Due to the large wetland on the property, the members agreed that a Notice of Intent

1. REQUEST FOR DETERMINATION—Corey Street—TDR Properties LLC
Mr. Fallon left the meeting at this time.
Rob Levesque of R. Levesque Associates was in attendance along with the property
owner, Mr. Russo. Mr. Kozloski stated that there is an existing wetland delineation on
this property that is still valid under the Governor's Permit Extension Act. Mr. Levesque
stated he was not aware of the existing Determination. The two plans were compared at
the meeting. Mr. Levesque that the bordering vegetated wetland boundary is basically
the same and the land under water is the same but that he has provided information on
isolated land subject to flooding. He agreed to work with the existing delineation. Mr.
Russo asked if he could continue cleaning on the property. Mr. Kozloski stated that he
should not be working without an Order of Conditions. Mr. Levesque requested to
withdraw this RDA without prejudice on behalf of TDR Properties, LLC as there is an
existing valid Determination/wetland delineation under the Governors Permit Extension
Act on this property. He asked that the minutes reflect that he provided additional
information to the Commission on isolated land subject to flooding.

withdrawal of the Corey Street Request for Determination of Applicability filed by TDR
Properties LLC, without prejudice and to acknowledge the submittal of additional

Mr. Russo asked if he could do some mowing on the site. The members agreed that yes
he could but not beyond the wetland boundary. Mr. Russo stated that there is a tree on
this property that overhangs onto Alhambra Circle that he would like looked at. Ms.
Dachos informed him that he should contact the DPW Superintendent to get his
permission to do anything with the tree.
Mr. Meagher left the meeting at this time. Mr. Fallon returned to the meeting at this
time.
2. PUBLIC HEARING CONT. --Notice of Intent—South Westfield Street—
DePalma
Rob Levesque, Ralph DePalma and Joseph Tirone were in attendance for this item. Mr..
Levesque provided the Commission with a package of revised information to address the
report prepared by Mr. Newman. He briefly went over the revisions: Stormwater
recharge was addressed by adding several rain gardens, disconnected roof leaders on end
units to provide additional recharge; addressed DEP standards;provided a copy of the
homeowners document;met with Michelle Chase, Town Engineer, regarding these
responses two days ago. He explained the to avoid point source discharges from two
outfalls from South Westfield Street they have tied them into the existing drain pipe and
also provided a stormceptor and level spreader to avoid point source discharge as well.
He explained that the Planning Board has requested a list of waivers which he will
submit. He explained that he missing area in the drainage calculations have been
resolved; the road grade and some units have been raised slightly; and five rain gardens
and one bio retention basin have been provided. Mr. Kozloski asked if borings were
taken in the detention basin. John Tomaczewski of R. Levesque Associates stated yes
and several other areas as well. Mr. Kozloski asked if a construction sequence had been
prepared. Mr. Levesque stated he will provide a formal document. He stated that a
NPDES stormwater plan must be provided and asked if that could be a condition in the
Order of Conditions. He went on to say that they are finalizing the details with NHESP
regarding the design of the box culvert. Ms. Messick stated that she was happy to see the
stormceptor being provided and stated that he construction sequence should include
limits on the amount of clearing that will take place at one time. Mr. DePah a stated that
when constructing a development like this he usually likes to back himself out of the site
to limit the amount of construction vehicles in front of developed units. He stated that
minimizes impacts to the residents as well as the roadway. He also stated that the land
will be farmed again this year. Mr. Levesque asked for a continuance to the June 13t'
meeting.

4. Correspondence/Complaints
Ms. Dachos explained that Mr. Vandergriff of Lexington Street stopped in the office last
week to inform the Commission that work is being done on the adjacent property that is
in violation of what was agreed upon during a prior site visit by the Commission
members. She stated that she spoke with the Mayor about the possibility of the Town
pumping out the catch basin in question once a year. Although the catch basin is located
on private property, it can cause a public safety problem when it is clogged and water
ponds on the street. During the winter this would cause icing on the street. Mr: Kozloski
stated that he had gone back out there and found that the neighboring homeowner had
mowed or weed whacked up to the swale. Haybales were in place,the heavy rain hit and
haybale and water ran towards Mr. Vandergriff s property. Mr. Vandergriff was in
attendance and submitted pictures to the Commission. He stated that his neighbor came
onto his side of the fence and dug out an area. He stated that there was just a trickle of
water going into the catch basin and that was no problem,however since the neighbor
dug out the area there is ponding water. He also stated he called the Police who told
them not to trespass. Mr. Kozloski asked if having the Town pump the catch basin out
once per year would be part of the solution. Mr. Vandergriff stated that would be up to
his wife who owns the property and that she would be concerned with any damage that
may be done. Ms. Messick stated that the work would be done from the street and they
wouldn't need to go onto her property. Ms. Dachos suggested the Commission issue a
Cease and Desist; allow no further work beyond a dernarked area; remove the haybales
and have the Town clean the catch basin once a year. Mr. Vandergriff stated that his
neighbors have also cut down trees and arborvitaes which helped to soak up some of the
water in the area. Mr. Kozloski suggested that fabric be placed over the catch basin. Mr.
Vandergriff stated that there is fabric over the catch basin. Mr. Kozloski stated the fabric
must be cleaned regularly. He also stated that both sides should agree to share the cost of
cleaning the catch basin regularly if the Town doesn't do it. Mr. Vandergriff stated that
his neighbor's house is for sale. He asked how the new owners would know of the
agreement. Ms. Dachos suggested that the Commission be made aware when it is sold so
that a letter can go out to the new homeowners as well. The Commission scheduled a site
visit to meet with both parties the following Wednesday at 2:30 PM.
Complaint— 1422 Main Street—Mr. Kozloski stated that a complaint was made that
work was being done around the pond at this location. He issued an Enforcement Order
and met with the property owner. The property owner submitted a letter to the
Commission stating that the work he'd done to install a fence was for safety reasons. Mr.
Kozloski suggested that the Enforcement Order be ratified and then lifted.

Enforcement Order issued to Rayonia for property at 1422 Main Street.

1. Request for Determination- 174 Edgewater Rd.- Sullivan
Mr. Sullivan requested to take down several trees in his yard near the bank of Silver
Lake, which had been damaged in the various storms and are close to the house.
Several Commission members did a site visit and agreed that the trees posed a danger
to the house. Ms. Galiatsos made a motion to issue a negative determination, Mr.
Meagher added the condition that no heavy equipment be used on the bank of the lake,
and that the stumps stay in place, and then seconded the motion.

2. Public Hearing Cont. - Notice of Intent- 497 South Westfield St. - DePalma
Mr. Meagher stepped down for this part of the meeting.
Greg Newman presented his review of the project as it is currently presented. There
was an extensive conversation about stormwater management BMP's, and LID BMP's.
Specific recommendations were discussed, as per his report. Mr. Kozloski went through
a list of several questions as well. Michelle Chase spoke about Town issues. Gary
Weiner agreed that Levesque Assoc. will work cooperatively with Mr. Newman and the
Town to make changes to the plan. Recommendations in addition to what is contained
in Mr. Newman's report are: add construction plan and phasing plans to application,
Levesque Assoc. to address all questions contained in report, and to consult with Greg
while doing so.
Mark Soticheck made a motion that all questions from Greg Newman be addressed by
Levesque. Seconded by Ms. Messick.

1. REQUEST FOR DETERMINATION—North Westfield Street—Town of
Agawam
Melissa Coady of Tighe and Bond was in attendance to present this RDA on behalf of the
Agawam Department of Public Works. She explained that the Town is proposing to
install a new water line in North Westfield Street from the intersection with North Street
to the Westfield Town line. She explained that the Springfield Water and Sewer
Commission plans to install a new water main next year. She stated that the existing fine
in North Westfield Street is an 8"line that is approximately sixty years old. They will be
installing a new 12" and 24"ductile iron water line and all work will take place within
the right of way shoulder. She explained that there are two jurisdictional areas associated
with this work,one of which is May Hollow. Mr. Soticheck asked if the existing pipe
was being removed. Ms. Coady stated no, it will be left in place. She stated that at the
end of the project the entire length will be fully milled and overlaid. She expects that the
work will begin by the end of summer and continue into next year. Mr. Kozloski stated
that he contacted DEP on this matter and was informed that this work is exempt. He
asked Ms. Coady to suggest that since one lane will be closed during construction that the
public be notified of the work. Ms. Coady agreed to that. Ms. Dachos stated that there is
a Westfield road reconstruction project planned for 187 and that the Town should look
into that in terms of scheduling.
Motion was made by Mr. Soticheck and seconded by Ms. Messick to issue a Negative
Determination of Applicability to the Agawam DPW for the new water line in North
Westfield Street.

2. PUBLIC HEARING—Notice of Intent—Suffield Street—Cumberland Farms
Paul Wilson of Cumberland Farms, Inc.was in attendance along with Attorney Dennis
Powers and David A. Kelley, P.E. of Core States Group. Mr. Kelley began the
presentation by explaining that they are proposing to demolish the existing store (minus
the restaurant) and build a new 4500 SF convenience store with new pumps and storage
tanks. He stated that the improvements will allow for less impervious area on the site and
an increase of 12,500 SF of open space on the entire site. A site visit was held with the
members just prior to this meeting. He stated that all existing debris will be removed and
a gate with a lock will be installed and the area behind the fence is to be maintained. A
new fence is being proposed to prevent access to the wood line. He stated that per the
Commission visit they will provide additional flowers on the south side of the site. Mr.
Kozloski noted the importance of the area behind the fence being"policed" and stated
they may acid a requirement of that to the Order of Conditions. Mr. Kelley agreed with
that. Ms. Messick asked if any grade changes were proposed. Mr. Kelley stated no. Ms.
Messick asked that the fence direction on the southerly side be adjusted to protect that
area. Mr. Kelley agreed to that. There being no public input,the Commission closed the
public hearing. The Order of Conditions was then written. A copy can be obtained from
the Town Clerk's office or the Conservation Commission office.

4. ENFORCEMENT ORDER UPDATES
There was nothing new to report since the last meeting. Mr. Kozloski did however have
the photos that he had taken of the Optasite Tower site prior to the last meeting. The
photos show that no vegetation has been established in the detention basin yet.
5. CORRESPONDENCES
The Commission received an email from Brian Morrissey of Citizens Energy with
proposed planting plans for the two solar sites in town. The Commission walked both
sites last week. The members had all received copies of the proposed planting plans.
Motion was made by Ms. Messick and seconded by Mr. Soticheck to approve the
proposed planting plan submitted for the Main Street solar facility.

Motion was made by Mr. Soticheck and seconded by Ms. Messick to approve the
planting plan for the Shoemaker Lane solar facility, requiring that the plantings be
monitored for five years to ensure they remain alive and healthy.

regarding a sewer problem at the end of Franklin Street and that he contacted DEP and
was informed that as long as the work is within the easement then no filing is necessary.

Commission will also be exempt but he recommended that an RDA be filed.

1. DISCUSSION—Cooper Street—Kot
The appropriate people were not yet in attendance for this discussion. The Commission
moved on to the next discussion item.
2. DISCUSSION-North Westfield Street—DePalma
Rob Levesque of R. Levesque Associates was in attendance as well as Ralph DePalma.
Ms. Dachas explained that she put this item on the agenda to gain input and support from
the Conservation Commission on the design of the proposed project on this site. She
stated that she has sat down with Mr. DePalma to look a proposed commercial building
for this site and is asking for the Commission's support in locating the building at the
front of the site, close to the road, with parking in the rear. She explained that Mr.
DePalma gained approval from the Historical Commission to demolish one of the
existing houses and that this area is a potential future National Historic District. She
went on to say that the Historical Commission also supports locating the parking lot in
the rear. She asked if the Conservation Commission members would be amenable with
this design that would allow for parking in the buffer zone. Rob Levesque then addressed
the Commission members. He first showed a conceptual plan with the original design of
the building in the back and parking in the front with a rain garden in the front parking lot
and no point source discharge in the buffer zone. The building would be in the buffer
zone. He showed a second conceptual plan with the building up front and parking in the
rear which according to him would require filling having to be placed for the parking lot
due to the slope and the buffer zone would be used for stormwater management. He
reiterated that the original plan would be an open drainage system with no point
discharge. Ms. Messick stated that while she would make her decision on whatever plan

is submitted she agrees that it is more appealing to place the building at the front of the
site. Shed asked if it were possible to rearrange the parking lot in the rear to minimize
the impacts to the resource area. Ms. Galiatsos stated that she feels the layout is more
appealing with the building at the front and would support it if it could be accomplished
with minimal impacts to the resource area. Mr. DePalma spoke at this time and stated
that in considering the alternative design the amount of fill needed will be very
expensive; a different type of sprinkler system for the building would be needed and it
may not be do-able. He stated that he would schedule a time to meet with Ms. Dachos
again and discuss the alternative design further. Mr. Kozloski asked for the distance from
the parking lot to the wetland with the alternative design. Mr. Levesque stated
approximately 3' to the edge of the wetland in one corner. Mr. Kozloski stated that other
projects have been designed with impacts closer to a wetland. In conclusion, the
members were supportive of the alternative design if impacts to the resource area can be
minimized.
1. DISCUSSION—Cooper Street—Kot
Ron Huot of Anderson Associates and Mike Mocco,Environmental Consultant were in
attendance as well as the property owner, Vadim Kot. Mr. Mocco explained that they are
working on the Definitive Plan design for a proposed subdivision and he requested to be
placed on the agenda to gather some guidance and have an informal discussion with the
Commission regarding the design of the stormwater system. He presented a plan
showing a cul-de-sac with six lots. The lot grading shows buffer zone encroachments in
two locations. The storm drain design shows an infiltration basin with a sediment
removal structure for pre-treatment. Mr. Mocco stated that the Engineering Department
has requested an emergency overflow be provided for storms greater than the 100 year
storm. He stated that the site currently drains to the brook. Ms. Messick brought up a
recent point source discharge discussion the Commission had with Mark Stinson of DEP.
Mr. Mocco stated that he is not sure this would be considered a point source discharge
since it is an overflow for a greater than 100 year storm. There was a general discussion
of the frequency of a 100 year storm and how recent storm events have changed and
appear to be getting more intense. Mr. Mocco stated that the stream currently receives a
substantial amount of untreated water. Mr. Kozloski asked where the pipe from the
detention basin would outlet. Mr. Mocco stated the pipe would go to the edge of the
wetland and would require an 8' cut. Mr. Kozloski stated that the overflow outlet in the
detention basins will provide for only temporary impacts to the buffer zone while
installing the pipe. Mr. Soticheck asked what size pipe they would use and how they
would handle any silt or debris. Mr. Mocco stated it would likely be a 12" smooth barrel,
plastic pipe and would have to be cleaned and maintained. Mr. Kozloski asked for the
volume of the proposed detention basin. Mr. Mocco stated approximately 5,000 cubic
feet. Mr. Kozloski asked about the house on the other side of the stream. Mr. Huot
stated that house is 20' above the stream bed. Ms. Messick stated that she would like to
see an alternatives analysis. Mr. Mocco thanked the members for their input and pointed
out that this will be a low impact development designed detention basin.

the grass is not growing in the detention basin yet.
8. CORRESPONDENCE& COMPLAINTS
The Commission received a letter from Brian Morrissey of Citizens Energy requesting a
site walk at the Shoemaker Lane solar facility. The members agreed to schedule this site
walk for the following Friday at 2:00 PM. Mr. Kozloski stated that while conducting the
site visit at the Optasite area he noticed on the adjacent solar site that there was no
vegetation along the road and it appeared that there was some erosion occurring. The
members agreed to walk the Main Street site after the Shoemaker Lane site next Friday.
Mr. Kozloski then informed the members that he had drafted two Ietters to send to the
Mayor. One is regarding Pynchon Point and the other is regarding the bike path on River
Road. Both letters are in regards to the need for maintenance and policing. Copies will
be sent to Deb Dachos, Chris Golba and the Police Chief.
Motion was made by Ms. Messick and seconded by Mr. Soticheck to send the two letters
to the Mayor that were drafted in regards to Pynchon Point and the Bike Path.

Mr. Kozloski informed the members of Springfield Water and Sewer's plans to replace
an existing water main from I;Irovin Mountain to Springfield. .A pipe will be reinstalled

I. REQUEST FOR DETERMINATION— 148 Edgewater Road—Kovalsky
Mr. and Mrs. Kovalsky were in attendance as well as Scott Mertz of World Class Pools.
Mr.Mertz explained that this RDA was filed for work on an existing pool which
includes: remove and replace existing concrete patio of in-ground pool and renovate pool
(new liner, steps and diving board). Commission members met on-site just prior to the
meeting to view the area as this lot abuts Silver Lake. Ms.Messick stated that there will
be no grade changes or fill brought in,this is just a replacement of what exists. She
stated that existing retaining wall is to be capped as well. She went on to say that the
members discussed during the site visit the placement of haybales or silt socks in front of
the existing fence to prevent any potential erosion. The other members were in
agreement with Ms. Messick. There was no public input.
Motion was made by Ms. Messick and seconded by Ms. Galiatsos to issue a Negative
Determination of Applicability for Kovalsky at 148 Edgewater Road for pool repairs and
requiring that haybales or silt socks be placed in front of the existing fence for erosion

by Newman Environmental Engineering out of Worthington, Mass.

Intent as this proposal was the lowest bid.

Rob Levesque and Joe Tirone were in attendance this evening. Mr. Kozloski stated that
comments have not been received from the Engineering Department. He passed out
information he gathered regarding requirements of rain gardens for the members to read
as a basis for determining if the rain gardens proposed in the revised plans would be
adequate. This information will be used when reviewing the comments from the
Engineering Department. Mr. Levesque was present to answer questions and provide
additional information on the revised plan that he presented at the last meeting which
incorporated as many low impact development designs as possible based on the required
size of the project and Agawam's zoning requirements. At the last meeting he requested

that the Commission members submit questions in writing so that he could respond in an
appropriate manner. He also indicated that some preliminary stakes have been placed on
the site as requested by the members. Mr. Kozloski gave Mr. Levesque a typed list of
questions and indicated that a full site visit should be made by the Commission. A site
visit was scheduled for March 28`h at 1:00 PM. Mr. Kozloski asked if soil tests on each
area indicated on the maps were made by borings or test pits. Mr. Levesque indicated
that borings were used for the tests. Mr. Kozloski indicated that the new regulations
prefer test pits. Mr. Levesque indicated that the borings provided the required
information. He stated that the conversion from detention basins to bio retention basins
will provide for greater infiltration. There was discussion if additional rain gardens could
be added at the end of cul-de-sac. Mr. Levesque stated that there is concern with
additional rain gardens in areas where people would be present due to potential dangers
to children/people. Mr. Kozloski requested that measures of rain run-off and changes in
cubic fee per area to wetlands be submitted. Ms. Galiatsos asked if there was a way to
measure current rain run off amounts to the wetlands now, during construction, and after
construction. Mr. Levesque indicated that information was provided in the NOI package.
Mr. Fallon requested information on the water budget for the wetland on South Westfield
Street. Mr. Levesque indicated that 3.9-1.6 acres of roof tops will drain into the detention
basin,back of units roofs will drain into the wetland. Roof tops in front of units will go
into the roadway drainage. He further explained that driveway run off would be collected
and solids removed and then run into the wetland. He indicated that point source
discharge will be avoided if possible. He explained that all of this information is also
included in the stormwater report. Ms.Becker asked what affect on the wetlands would
occur if there were a major storm event with flooding. Mr. Levesque stated as indicated
in the NOI and stormwater report, each size storm event was analyzed and taken into
consideration for the design of up to a 100 year storm,there should be no flooding. He
also indicated that the design has emergency overflows to provide a fail safe for the
resource areas and stream. Mr. Kozloski expressed concern over the density of the
buildings and that there is no open space other than the large wetland area. His concern
was that people will use the wetland area and that may result in damage to the wetlands.
He stated that some of the buildings are closer than 35 feet from the wetland and that
units 72-77, 32-46,unit 19 and 65 are between 28 to 30 feet from the limit of work. Mr.
Levesque stated that condominiums built in Agawam are not required to provide open
space and that Agawam's zoning allows for 5 to 8 unit buildings and 40 feet frontage
allowing no options for moving units away from resource areas. Ms. Messick asked if
there was a possibility of reducing the number of units for the project. Mr. Levesque
stated that scaling back on the number of units is not economically feasible. He indicated
that a number of alternative designs were analyzed and that the submitted design is the
best possible option.
After additional discussion on the size and economic feasibility of a smaller project, the
Commission indicated that a meeting with the Engineering Department is required and
that a peer reviewer should be hired to assist the Commission in reviewing the regulations
and Engineering Department comments in determining the effects of the project to the
resource areas. Three bids will be required and the peer reviewer should be hired as soon

as possible. Mr. Levesque,the Engineering Department and the peer reviewer will work
together to assist the Commission,

Notice of Intent and stormwater report.

Meadow Street. Mr. Golba informed Mr. Kozloski that they also are proposing to replace
a guardrail at 140 Pine Street. The members were in agreement that guardrail
replacementirepair is considered a normal maintenance activity and would not require a
wetland filing.
Motion was made by Ms. Messick and seconded by Ms. Galiatsos that the proposed
guardrail replacement/repair at Meadow Street and also at 140 Pine Street would not
require a filing with the Conservation Commission as this work is considered normal
maintenance.

5. PUBLIC HEARING CONT. —Notice of Intent—South Westfield Street—
DePalma
Rob Levesque and John Tomaczeski of R. Levesque Associates were in attendance as
well as Mr. Tirone. Mr. Levesque gave a brief overview of the project stating that the
plan shows 131 condominium units with 5-8 unit buildings. He stated that as a result of
the prior discussion with.DEP regarding Low Impact Development(LID)designs he has
provided additional information including a letter on LID considerations. He provided
the Commission with revised plans this evening that show bio retention basins and rain
gardens as part of their environmentally sensitive design approach. He reminded the
Commission members that they are not only dealing with environmental regulations on
this project but they must also conform to zoning and subdivision regulations (i.e.
pavement width, sidewalks,roadways, etc.). He explained that last year they met with
the Planning Board to determine if they would allow any flexibility with the Subdivision
Rules and Regulations as this is a condominium project and not a subdivision. He went
on to say that the roadway must meet the subdivision regulations. Mr. Kozloski asked if
the detention basin could be moved further towards South West Street. Mr. Levesque
stated no as that would be up-gradient and wouldn't allow for flow. Mr. Kozloski asked
how they are proposing infiltration. Mr. Levesque stated that bio retention basins allow
for treatment and infiltration. Mr. Kozloski then asked how they did the soil borings.
Mr. Levesque stated with a backhoe. Mr. Kozloski stated he understands that the state
now favors the use of geo-probes for permeability rates as they are more accurate. Mr.
Levesque stated that standard engineering practices were used and that the soil testing
was very extensive and all of the information is contained in the NOI and stormwater
report. He then stated that since there was a prior discussion of a peer review he has not
finalized this design but would like to if the Commission favors the changes. He went on
to say that the design of this project is much more environmentally sensitive than other
projects and that the DEP stormwater regulations have not changed since 2008. Ms.
Messick stated that she would like to see an alternatives analysis with everything pulled
out of the resource area and buffer zone. Mr. Levesque stated that there would be no
project and the alternative would be a no build. Ms. Becker stated that fewer units would
reduce impacts. Mr. Levesque explained that there are no wetland impacts with this
project, only buffer zone and a small amount of riverfront at the detention basin. Mr.
Kozloski stated the impact will be that the wetland will eventually shrink and dry and that
is the purpose of providing infiltration. He stated that detention basins do not put water
back into the ground. The members then agreed that a site visit is needed. Mr. Levesque
stated that he can have the roadway staked out when he knows that a site visit is being
scheduled. There was then discussion of whether the Commission wanted to hire an
outside consultant for this review. Ms. Galiatsos stated that she has been reviewing the

stormwater regulations and asked for an explanation on detention basins vs. bio retention
basins. John Tomazcewski stated that bio retention basins are basically large scale rain
gardens with a special bottom that allows for both infiltration and treatment. Ms.
Galiatsos asked if they are to be vegetated. Mr. Tomazcewski stated yes,there is list of
vegetation and trees that are allowed in the bio retention basins. Mr. Kozloski asked if
they have resolved the issue with the Town drainage that will be part of this project. Mr.
Levesque stated they have not resolved that issue yet but will be meeting with the
Engineering Department on that matter. He requested that the Commission continue this
hearing to their next meeting which is March 14, 2013.

Kate Bednaz of R. Levesque Associates was in attendance to present this RDA. She cn
explained that Mr. DePalma would like to place fill on these properties in advance of his
proposed development in this area. She explained that the Commission approved the
wetland boundaries in September of 2012. She explained that stabilization measures
such as silt fences and haybales will be placed along the rear of the area and will be
maintained. She stated that a seed mix will be placed as well.Ms. Galiatsos asked if the
site was level. Ms. Bednaz stated that the site slopes from the front to rear and levels off
in the rear and that the fill is proposed to be placed at the front of the properties. Ms.
Fallon asked what the elevation of the silt fence would be in relation to the surface grade.
Ms. Bednaz stated that nothing would be piled against the silt fence,the fill will be
tapered up and will allow for surface waters to drain toward the wetland. Ms. Messick
asked what the depth of the proposed fill would be. Ms.Bednaz stated she was not sure.
Ms.Messick stated that she has a problem with changing grades on those lots without
knowing the amount of fill and what it will look like. She went on to say that since the
Wendy's has been built, a full growing season has not yet taken place so the Commission
does not know if there will be any impacts to that large wetland behind these properties
and reiterated that she is very concerned with changing the grades. Ms. Bednaz stated
that while she did not have information on the grades,the fill would be graded out to
pitch toward the wetland which wouldn't change the hydrology much and may even
allow for more infiltration. Ms. Messick asked what type of soil he was proposing to
being in. Ms. Bednaz stated that she did not know but believes the fill will be coming
from a nearby site. She went on to say that no piles will remain longer than 30 days. Ms.

Galiatsos asked if the houses would be demolished first. Ms.Dachos stated that one of
the existing houses is on the historic inventory and went before the Historical
Commission under the Demolition Delay ordinance and was given approval to demolish.
She also stated that if the fill is coming from the Farmington Heights site, there are
stockpiles of fill that exist and the Town has received complaints regarding blowing dirt,
etc. Ms. Bednaz stated that she could get more information for the Commission on the
type of fill and the amount. Ms. Messick stated that in summary,the additional
information to be provided should include: how much fill;type of fill and where it is
coming from; a grading plan or estimate on the grades;how long will the fill be there;
estimated timeline for development of the site; stabilization plan; and dates on when the
fill would begin to be brought to the site and when that activity will end. Ms. Dachos
recommended that the Commission require a"construction entrance"as well. Ms.
Galiatsos stated that she agreed with that recommendation. Ms.Bednaz stated that she
could include formal bmp's and stabilization measures as well.
Motion was made by Ms. Becker and seconded by Ms. Galiatsos to table the RDA for
NWST LLC, 26, 32 &38 North Westfield Street to the next meeting(February 28 h)to
allow for additional information to be provided to the Commission.

2. PUBLIC HEARING-Amendment to Order of Conditions—Agawam Bike Loop
- Town of Agawam
Rich Bertolli of Fuss and O'Neill and Deborah Dachos were in attendance to present this
request for an amendment to the existing Order of Conditions. Ms. Dachos explained
that MassDOT has required that the project limit be extended to provide for a connection
of the bike loop to the existing Riverwalk on River Road. The extended project area also
includes the realignment of School Street, shifting it slightly to the south. She went on to
say that the amendment includes impacts to floodplain and riverfront area. Rich Bertoli
of Fuss&O'Neill stated a small portion of the additional work will impact riverfront
area. He went on to say that School Street will be lowered to provide compensatory
flood storage. Ms. Dachos stated that this will provide a significant increase in flood
storage(3,864 cf). There being no public input,the Commission closed the public
hearing.

Order of Conditions for the Agawam Bike Loop.

Ms. Galiatsos stated that she and Mr.Kozloski made a site visit to the Agawam
Corporate Center to view the area that was staked out where they have requested to clear
an existing walking path. She stated the area they thought may be an isolated wetland is

would know if there are any conflicts with the Town Drainage Ordinance. Ms.Messick

1. REQUEST FOR DETERMINATION—26, 32& 38 North Westfield Street—
NWST LLC
Kate Bednaz of R. Levesque Associates was in attendance to present this RDA. She
explained that Mr. DePalma would like to place fill on these properties in advance of his
proposed development in this area. She explained that the Commission approved the
wetland boundaries in September of 2012. She explained that stabilization measures
such as silt fences and haybales will be placed along the rear of the area and will be
maintained. She stated that a seed mix will be placed as well. Ms. Galiatsos asked if the
site was level. Ms. Bednaz stated that the site slopes from the front to rear and levels off
in the rear and that the fill is proposed to be placed at the front of the properties. Ms.
Fallon asked what the elevation of the silt fence would be in relation to the surface grade.
Ms. Bednaz stated that nothing would be piled against the silt fence,the fill will be
tapered up and will allow for surface waters to drain toward the wetland. Ms. Messick
asked what the depth of the proposed fill would be. Ms. Bednaz stated she was not sure.
Ms. Messick stated that she has a problem with changing grades on those lots without
knowing the amount of fill and what it will look like. She went on to say that since the
Wendy's has been built, a full growing season has not yet taken place so the Commission
does not know if there will be any impacts to that large wetland behind these properties
and reiterated that she is very concerned with changing the grades. Ms. Bednaz stated
that while she did not have information on the grades, the fill would be graded out to
pitch toward the wetland which wouldn't change the hydrology much and may even
allow for more infiltration. Ms. Messick asked what type of soil he was proposing to
being in. Ms. Bednaz stated that she did not know but believes the fill will be coming
from a nearby site. She went on to say that no piles will remain longer than 30 days. Ms.

Galiatsos asked if the houses would be demolished first. Ms. Dachos stated that one of
the existing houses is on the historic inventory and went before the Historical
Commission under the Demolition Delay ordinance and was given approval to demolish.
She also stated that if the fill is coming from the Farmington Heights site, there are
stockpiles of fill that exist and the Town has received complaints regarding blowing dirt,
etc. Ms. Bednaz stated that she could get more information for the Commission on the
type of fill and the amount. Ms. Messick stated that in summary,the additional
information to be provided should include: how much fill; type of fill and where it is
coming from; a grading plan or estimate on the grades; how long will the fill be there;
estimated timeline for development of the site; stabilization plan; and dates on when the
fill would begin to be brought to the site and when that activity will end. Ms. Dachos
recommended that the Commission require a"construction entrance" as well. Ms.
Galiatsos stated that she agreed with that recommendation. Ms. Bednaz stated that she
could include formal bmp's and stabilization measures as well.
Motion was made by Ms. Becker and seconded by Ms. Galiatsos to table the RDA for
NWST LLC, 26, 32 & 38 North Westfield Street to the next meeting(February 281) to
allow for additional information to be provided to the Commission.

2. PUBLIC HEARING- Amendment to Order of Conditions—Agawam Bike Loop
—Town of Agawam
Rich Bertoili of Fuss and O'Neill and Deborah Dachos were in attendance to present this
request for an amendment to the existing Order of Conditions. Ms. Dachos explained
that MassDOT has required that the project limit be extended to provide for a connection
of the bike loop to the existing Riverwalk on River Road. The extended project area also
includes the realignment of School Street, shifting it slightly to the south. She went on to
say that the amendment includes impacts to floodplain and riverfront area. Rich Bertoli
of Fuss & O'Neill stated a small portion of the additional work will impact riverfront
area. He went on to say that School Street will be lowered to provide compensatory
flood storage. Ms. Dachos stated that this will provide a significant increase in flood
storage (3,864 cf). There being no public input, the Commission closed the public
hearing.
Motion was made by Ms. Galiatsos and seconded by Ms. Becker to issue an Amended
Order of Conditions for the Agawam Bike Loop.

7. Correspondence and Complaints
Ms. Galiatsos stated that she and Mr. Kozloski made a site visit to the Agawam
Corporate Center to view the area that was staked out where they have requested to clear
an existing walking path. She stated the area they thought may be an isolated wetland is
a detention pond. A letter will be sent to the property manager stating that the clearing of

1. WORKSHOP--Mark Stinson, Circuit Rider—DEP
Mark Stinson was in attendance this evening to go over DEP's stormwater management
standards with the Commission members. He stated in January of 2008 DEP changed
their"stormwater policy"to "stormwater standards". He provided the Commission with
a copy of DEP's BMP Manual Vol. 2, Ch. 2 which outlines best management practices
for stormwater design such as detention basins, infiltration basins, rain gardens, etc. He
had previously provide the members with copies of"Essential Steps for Review of
Stormwater Reports by Conservation Commissions", "10 Essential Steps for
Conservation Commission Review of Notices of Intent under the Massachusetts
Wetlands Protection Act",and"Massachusetts Stormwater Management Regulations
Outreach for Commonly Occurring Problems". The last referenced document is provided
to engineers who prepare Notices of Intent. He pointed out that step 3A of"Essential
Steps for Review of Stormwater Reports by Conservation Commissions" entitled
Consideration of Environmentally Sensitive Design&Low Impact Development stresses
the importance that all analysis of providing consideration of environmentally sensitive
design and low impact development start as early as possible in the design/permitting of a
project. He stated that the point of these standards is to get the water into the ground
where it is generated rather than routing it to a point sometimes far away from where it is
generated, and then to a detention basin or other drainage structure. Mr. Kozloski stated
that he will set up a meeting with the Engineering Department to go over tonight's
workshop information and ensure that they aid the Commission in following the
guidelines/standards.

4. PUBLIC HEARING—Notice of Intent—South Westfield Street—DePalma
Rob Levesque and Gary Weiner of R. Levesque Associates were in attendance to present
this Notice of Intent. Mr. Levesque explained that this is a 50 acre site that contains four
large wetlands and a perennial stream and that the Commission approved the wetland
delineation in 2009. He stated that the proposal is to construct 131 condominium units
with a boulevard style entrance with up to four parking spaces per unit. He explained
that an NHESP submittal was made and that he met with them today to go over their
concerns with the project. He went on to say that he met with the Town Engineering
Department this week and has spoken with Mark Stinson of DER He explained that in
terms of stormwater design,there will be stormwater basins and grassed swales. Mr.
Kozloski stated that while it appears that some of the soils are permeable,not all soil
borings were taken in areas where infiltration should occur to determine if that is feasible.
Gary Weiner then explained that 42 soil borings were taken and a mix of soils were
found. He went on to say that much of the soil is C type which are permeable but at a
slow rate. He went on to say that soils location dictate which bmp's would be best. He
stated that the front portion of the front buildings (along South Westfield Street)and,per
the Town, a small portion of roadway drainage (will include two town drainage
easements) from South Westfield Street will go into the roadway drainage then to a
stormceptor manhole and then discharge towards the wetland. He stated that the rear
portion of the roofs will discharge overland to the resource area. Mr. Kozloski stated that
this is the originally submitted plan and that no changes have been made to improve
infiltration on the site. He stated that he wants to go out to the site and look at where the
borings were taken in relation to the wetlands. Mark Stinson stated that test borings are
typically needed in certain areas and they then can be compared to the Soil Survey book.

He stated that DEP's manual Vol. 3 Ch. 1 is all about soils. Mr. Weiner stated that the
standards are very clear on infiltration(i.e. soil evaluator required). He went on to say
that four areas for roadway runoff from units have been designed with three basins. He
stated that they could not meet three of the ten standards for the three basins but that
further low impact development techniques will be looked at. He also stated that the
roofs will drain off to the rear of the buildings and will sheet flow, Mr. Stinson explained
that there are two types of bio retention basins: 1) for infiltration and 2)treatment. He
stated that it's very important that they be clear on which type they are proposing. Ms.
Galiatsos asked for clarification on the road runoff treatment and how it will be
maintained. Mr. Weiner stated that the runoff will pass through a stormceptor unit which
has the ability to remove some sediment and also grease and oils. He stated that an
Operations.and Maintenance Plan—Long Term has been provided and contains the
maintenance requirements of the stormceptor units. Mr. Stinson asked if there will be a
new point source discharge from the Town drainage/easements and if so,they will be
subject to stormwater standard#7. Mr. Levesque stated that he will be meeting with the
Engineering Department again next week and will relay that information to the Town
Engineer. Ms. Messick asked how the hydrologic connection between the bordering
vegetated wetland to the east and Taylor Pond will be maintained. Mr. Weiner explained
that NHESP was concerned over the ability of the turtles to pass through so it will be an
open bottom culvert. Ms. Messick asked about the proposed wildlife guidance devices.
Mr. Levesque explained that this site contains NHESP Priority Habitats for Rare Species
as well as Estimated Habitat attributable to the eastern box turtle and at the beginning of
the project where the two roads come close,a wildlife guidance device will be installed
as NHESP wants that access maintained. He went on to say that per today's meeting
with NHESP they will open the culverts with a grate on top. Mr. Kozloski asked if the
sidewalks could be something other than concrete such as porous pavement blocks. Mr.
Levesque stated that the Subdivision Rules and Regulations require all sidewalks be
concrete. Ms. Dachos explained that concrete sidewalks are required on both sides of the
road but a waiver could be requested in terms of the material however there are two
criteria that must be met to grant a waiver: is it in the Town's best interest and
topography. Mr. Levesque stated that the most environmentally sensitive approach
would be stone dust but not in this case. He stated that he will continue to work with
DEP on their concerns. Ms. Messick asked if anything other than level spreaders with
riprap could be used for the pipes between two buildings. Mr. Levesque stated they will
be flared end pipes. Mr. Weiner stated that he can Iook at velocities to see if matting
would suffice rather than riprap. Mr. Levesque stated that they are requesting a
continuance of tonight's public hearing to February 28 h. He stated that would provide
them an opportunity to meet with the Planning Board(February 7 h)and continue to
address best management practices with DEP.
Ms. Messick asked if turtles were seen on the site, has it been surveyed? Mr. Levesque
stated that the polygon triggers the NHESP review. Mr. Kozloski asked how much Town
drainage is included in this point source discharge. Mr. Levesque stated there is a 20"
pipe and discharge that exists and is being rerouted. Mr. Weiner stated that he will work

with the Commission and on any proposed changes to the bmp's. Mr. Kozloski then
asked for public input.
Steve Czerpak, 544 South Westfield Street stated that in the winter when the snow plows
are out and after heavy rains, water ponds on his property. He is concerned because the
water ponds in an area where children wait for the school bus. He stated that the sewer
project has contributed to the problem. He had photos to show the members. Ms.
Dachas asked that he put his concerns in a letter and include photos and that she will
forward the information to the DPW Superintendent.

hearing for the Notice of Intent for South Westfield Street by Depalma to February 281'
as requested by the applicant's representative.

5. REQUEST FOR EXTENSION—Order of Conditions— South Street—Twin
Brook Farms
Mark Benoit was in attendance this evening to present his request for a three year
extension to his Order of Conditions on South Street. He explained that due to the
economy they have not begun the project but hope to do so soon. There was a general
discussion of the Permit Extension Act. In conclusion, the members agreed to a two year
extension.
Motion was made by Ms. Messick and seconded by Ms. Galiotsos to extend the Order of
Conditions for Twin Brook Farms on South Street for two years to March 13,2015 in
compliance with the Permit Extension Act.

6. DISCUSSION—Request for Amendment—Order of Conditions—Bike Loop
Ms. Dachas explained that the ENF for the Bike Loop project was submitted to DOT in
2009 but not reviewed until now. She went on to say that they have received funding for
the construction of the project and that DOT now wants the project limit extended
(originally ended at School Street Park) to connect it directly with the Riverwalk. It will
now be extended east to the end of School Street at River Road. She explained that the
only additional jurisdictional work is 200' from the river and floodplain. She stated that
they are now extending the 10' bike path across the front of Dee Services, adding a new
handicapped accessible crosswalk and then run the 10' bike path to the crosswalk that
connects to the existing Riverwalk. She went on to say that both DOT and the
Engineering Department want the alignment of School Street to be corrected - it will be
moved slighting to the south. Work in the resource area will include 450 cubic feet of fill
to be brought in to construct the 10' path and to compensate for the fill, a portion of
School Street will be dropped 6"to provide for 3,780 cubic feet of additional flood
storage. She explained that the area is already paved with driveways, roads and parking

lots and the result of this change will provide for substantial additional flood storage and
she is requesting an amendment to the Order of Conditions to allow for this change. Ms.
Messick asked if dropping that portion of School Street 6"would create drainage
problems. Rich Bertoli of Fuss & O'Neil was in attendance and stated no,that it will
slope towards River Road and will continue to two catch basins at the intersection that
exist and will be maintained. Mr. Stinson stated that there was some confusion with the
ENF and he wasn't sure what work has been done. Ms. Dachos stated that she attended
the MEPA site walk yesterday.
Motion was made by Ms. Messick and seconded by Ms. Becker to allow for the above
discussed changes to the Bike Loop project under an Amendment to the Order of
Conditions rather than a new Notice of Intent.

7. CERTIFICATE OF COMPLIANCE—618 Cooper Street
Mr. Kozloski recommended that a Certificate be issued at this time. This Order applied

Mr. Kozloski brought up 242 River Road at this time. He explained that a site visit was
held and the homeowner wants to construct a car port over his driveway which involves
the installation of three sauna tubes. The property is located in the floodplain. He
questioned whether it would be allowed per zoning. Ms. Dachos stated that she will
check with the building inspector to determine if it is allowed per zoning. The members
agreed that a Request for Determination would be sufficient.

work. The members were in agreement with his recommendation.
The Commission received a letter from Jeff Strole of Aspen Square Management
regarding the Agawam Corporate Center at the end of Hunt Street. The letter outlines

their intent to clear an existing walking path on this property. The members asked that a
response letter be sent stating that the area of the proposed clearing should be marked on-
site. The Commission members could then meet on-site to view the proposed area/work.
Mr. Kozloski asked if any of the members would be available to make a site visit at 242
River Road. The homeowner is proposing to construct a car port over his driveway. This
property contains riverfront and appears to be in a floodplain. The members agreed to
meet next Wednesday at 3:30 PM,
Mr. Kozloski then informed the members that Chet Nicora has agreed to make photo
i.d.'s for the Commission members. He stated that he will have Pam contact the
members through email when he gets some available dates from Mr. Nicora.
Mr. Kozloski then showed photos that he took during a site visit with members of DEP
and WMECO representatives at the former Boglish property on South West Street. The
photos show the mitigation area that was permitted for the Greater Springfield Reliability
Project. He explained that, as the members are aware, 80%of the plantings have been
installed. They are waiting to plant cedar plants in the spring.
Mr. Kozloski informed the members that Mark Stinson, Circuit Rider for DEP's western
region, would like to attend a Commission meeting to discuss stormwater management.
He had requested to attend this evening's meeting, however the agenda was full. The
members agreed to start their next meeting at 6.00 PM and invite Mr. Stinson to attend
for a workshop with the members from 6:00 to 6:30 PM.

wetlands and associated 100' buffer zones. An isolated wetland which is out of the
Commission's jurisdiction is shown close to Suffield Street. Ms. Bednaz stated that there
is also a stream in this area but off of this site that eventually flows under Suffield Street
(Route 75)that is shown as perennial but may be intermittent. In conclusion,the
members were in agreement with the boundaries of the bordering vegetated wetlands and
100' buffers as shown on the plan that was submitted.
Motion was made by Mr. Fallon and seconded by Ms. Galiatsos to issue a Positive
Determination for 32 Shoemaker Lane, approving the wetland boundaries as shown on
the plan and field-verified.
