day, January 5, 1978, the Board voted 4-0 to modify the subdivision

Dear Mr. Bruno:
The Subdivision Control Law, Chapter 41 of Massachusetts General
Laws , specifies in detail the process of rescinding a subdivision.
The first requirement is that original plans of the subdivisions,
as they were originally approved, must be presented to the Planning
Board for their endorsement that the plan has been rescinded, and
then subsequently recorded with the Registry of Deeds, along with
the letter which is enclosed.
We suggest that you contact John P. Stone , Town Engineer, and make
arrangements with him to have reproducible duplications of the
original subdivision plans made for this purpose.
In regard to the modification of the waysy please note that Tannery
Road must terminate in a cul-de-sac or turn around. We understand
that there is now an existing drain outlet in this area which must
be maintained. This modification must be shown on a plan which can
be approved by this Board. Meyers Drive, which has been wiped out
only in part, must now be drawn to show the grades and utilities,
to serve the two remaining lots and terminate in a turn around or
cul-de-sac. Both these plans will require engineering services.
Again, we suggest you talk to the Town Engineer for his suggestions
in regard to the utilities , especially what would need to be shown
on these modified ways.
Because these five lots are being retained as building lots, the new
plans will have to be submitted to the Planning Board, and we recom-
mend a new covenant referring only to these five lots be granted.
This way we will be able to rescind all previous covenants, which
will help clear title to the land. We have a standard form of
covenant, if your attorney would wish to use it.
