Calabrese Promises affected I YT The petitioner, C. A. Calabrese came before the Board at a - public hearing held on Thursday, July 14, 1983, seeking relief from Section 20, Paragraph 27 (h) of the Zoning Ordinances to allow the construction of two multi family "town house" type apartment buildings, each containing in excess of the maximum number of dwelling units allowed by ordinance. At said public hearing, the petitioner presented a plan to construct;.four (4) separate buildings on a parcel of properly zoned property located to the north side of walnut Street on a bluff overlooking the Westfield River. Said property was once, the site of a large factory building which has been totally d6molished. It has been identified as 1 Walnut Street. Under Residential A-3 zoning a multi family building is allowed provided it does not exceed eight (8) dwelling units in size. In this instance the petitioner, due to the unusual conformation of the property, seeks, to construct 2 eight (8) unit buildings and 2 ten (10) unit buildings on said property. As a result of facts presented at the hearing, coupled with "on site" visits by each Board member, the Board arrived at the following conclusions: a. The land in question drops off rather precipitously a at the river and results in a sizeable part of the parcel not being buildable. b. The petitioners plan does not exceed the ordinance requirement of a maximum of eight units per acre of lot area. c. The plan meets all other requirements of said ordinance. 4 d. There were no objection to the proposed project recorded at the public hearing. To deny the petitioner relief will cause him substantial hardship as he cannot build on a large part of this parcel due to its unique topography. 3. The granting of relief will not, in the Board's view, . substantially deviate from the intent and purpose of the zoning ordinance, as the only relief sought is for two buildings. The other two will satisfy said ordinance. Therefore, by unanimous vote, the Board grants the relief sought, subject to the following requirements: , 1. The petitioner shall record a "Notice of Variance" form provided by this Board in the Hampden County `gistry of Deeds. 2. The petitioner shall also record a copy of sitelplan submitted this Board with the Hampden County Registry of Deeds. Said plan identified as "Proposed C. Calabrese Jr. Apartments" dated May 27, 1983 and drawn by A1do ,Altobelli, Architect. 3. The petitioner shall meet all other requirements of said ordinance. 4. At a public hearing held on December 1.4, 1977 at 6:00 P.M., the petitioner explained that he wished to alter the lot lines of six existing parcels on Karen Drive to allow the creation of -four undersized lots shown as Lots #39 4, 5 and 6 on plan dated August 15, 19779 and to provide additional land for his own use at the rear of his home at 603 Cooper Street. The petitioner aloes feels that the new lots created by this alteration would tend to make the lots more saleable. The Board reviewed the facts presented and concluded the following: 1. The lots as they now exist are located in an Agricultural district and at 1109 frontage, are below the present minimum requirements -of 1201 frontage, , 2. The proposed altered lots will be, at 15+000 square feet, .below the minimum lot size required in an Agricultural district which is currently 20,000 square feet. 3, The layout for the lots on Karen Drive were approved, as submitted by Henry Calabrese, by the Agawam P]annirg Board on November 109 1960 which was prior to the present Subdivision Control law being effective in Agawam. 4. That no valid hardship exists to the petitioner, nor would such hardship exist if the relief were not granted., 5. There are no topographical or pbysical circumstances which would necessitate such requested variance. In fact the physical characteristics map of the town indicates that the lots to the rear are poorly drained soil and possibly contain a stream as their. rear boundry.
