Interest would be running from that date up to the date of the recording of the proposed deed. In addition since there would be a twelve-month acceleration of the itermination of the pumping station maintenance agreement between the Town and Campanelll dated July 12, 1974 , thii would mean that for the twelve-month period the Town would be paying the electrical bill which Campanelli advises is running between $120.00 and $135.00 per month. This Would mean that the own would be expend- ing a total sum of between $1 ,440.00 and $1 ,620.00 together with the cost of the ordinary maintenance of this pumping station in addition to the other pumping stations maintained by the Town. The latter parcel being contiguous to the • recently acquired Ridgeview Park area. Campanelli is requesting in return, from the Town, forgiveness of $8, 227.73 in taxes. The Conservation Commission feels this proposal would be a tremendous asset to the Town as the property is valued at approximately $190,000. Given the constraints of 2j and the difficulties of acquiring funding for the purchase of park land, property for recreation will be exceedingly difficult to acquire. This parcel is particularly important as it would provide excellent active recreation areas and would protect the brook run-off in the Ridgeview Park area from pollution; as no development would occur near the brook. (Exhibit 1) COST TO THE TOWN-. Taxes penalties and interest as of November 1 , 1981 amounis to $8,227.73. Interest running from that date to date of recording of proposed deed. Twelve months acceleration of the pumping station maintenance at • approximately $120.00 - $135.00 a month. (Exhibit II) BENEFIT TO TOWN: The offer consists of two parcels. One contiguous to the recently acquired Ridgeview parcel, is suited for active recreation or other compatible Town use, and provides better access than at present. The smaller parcel is wetland and is suited only for passive purposes. Acquisition of "this parcel would relieve the pressure to develop this wetland. Costs of maintaining the pumping station would have been born by the Town approximately one year from now even without the donation of the parcel. Forgiveness of taxes must be weighed against the tax advantages to the Town of open space vs. development of 38 lots as follows : The following figures are taken from Agawam Master Plan - 6; • pages 46-56. '�' BOARD OF APPEALS 1980 mAy 16 AN ID 16 x y 4' DECISION OF BOARD OF APPEALS ATE0 Date May 15, 1980 Petition OF Campanelli, Inc. _ _ -- Premises affected Lots #1 thrQuah 17 1911a Brook Rd.,& Provin M ._ Dr. Case #955 The petitioner, Campanelli, Inc., came before the Board at a public hearing held on Thursday, April 3 1980, seeking relief from the Zoning Ordinances (Section 20, Paragraph 38j to allow the construction of seventeen (17) single family dwellings on lots which fail to meet the current zoning requirements governing frontage and area. The petitioner's spokesman explained at the hearing that title to the land in question was acquired in June of 1973, Said purchase encompassed a total of 138 lots and was part of a larger subdivision identified as $'Ridgeway Heights and Forest Hilla°, Agawam, Mass„ Plan X 279. The area in question identified as subdivision of "Forest Hills Estates" dated September 1R70 was approved by the Agawam Planning Board on December 21, 1970. Zoning requirements then in effect mandated a minimum lot size of one hundred ten (110) foot frontage and fifteen (15) thousand square foot land area for Agricultural Districts. In accordance with Chapter 40A of the State Statues these lots enjoyed immunity from any changes affecting their size for a period of seven (7) years from date of approval. This protection terminated on December 21, 1977. The land immediately to the west and abutting said property is divided into 29 lots and shown on a plan titled "Ridgeview Heights+l. Said subdivision yet to be constructed was approved by the Planning Board on May 29, 1973. Based on the seven year time frame, this subdivision plan will expire on May 29, 1980. Land laying immediately to the north of said property and separated by the City of Springfield Water Department right-of-way was subdivided into approximately 59 lots. This property has recently been transferred by the owner of record to the inhabitants of the Town of Agawam and recession action will be taken shortly to eliminate said subdivision. To grant relief for the petitioner in this instance might well set a precedent since larger lot sizes are now required in all Agricultural Zoned Districts. The denial of the.relief sought would not create a substantial hardship to the petitioner as the land area (including the adjacent 29 lots) is yet to be developed with surfaced street ways, water facilities, sanitary sewers and surface drainage systems. The petitioner also has a choice to apply for the rezoning of this area to Residential A--2 which, if approved, would allow him to build on lebser' sized- lots. In the BoardIs opinion the granting of relief sought would not be in the public good as the owner of this subdivision has enjoyed a period of seven years in which to activate their subdivision. Sanitary sewer and force main in Strawberry Hill Road shall be shown in elevation or profile view prior to placement of culverts; subject to approval of Conservation Commission and Town Engineer. 16. Lots 33 - 36 inclusive, 97 - 105 inclusive: No construction until necessary engineering plan and profile for construction of future flood retention area design and placement to be at dis- cretion of Campanelli, Inc. , subject to final approval of the Conservation Commission. The Commission has observed flooding problems on land of others following channelization of brook. Though flooding has not had serious consequences at this time, the Agawam Conservation Commission has determined that a flood retention area may be necessary at such time as Valley Brook Road West and Provin Mountain Drive Areas are developed in the future. We, 'there- fore, order that this retention area be available in order to develop this plan to accommodate the additional drainage. The actual construction of the retention area, (if deemed necessary upon receipt of plan by the Agawam Conservation Commission) may be done at such time as the development is extended to the Valley Brook Road area. 22.
