They would like to become more active in Town government and agencies. Mir. Rhodes asked about the heavy traffic on School Street - is the town going to do anything about it? Pars. The southeast corner consisting of about 12% of the tract, however, has a moderately shallow water table and would have severe limitations for septic tanks and a moderate limitation for homes. Also, there is about a half acre portion of the tract located midway along the west boundary that has a shallow water table with severe limitations for homes. Sewers: There is a 30" sanitary sewer in School Street abutting this property. There would be sufficient capacity available to serve this 10 acre tract if it were developed under the A-3 requirements. Water: There is a 6" water main in School Street abutting this property. The water distribution study indicates that the capacity of the main will eventually have to be increased via additional and improved connections with other mains along the length of School Street. Also, the study did not anticipate any further high density development in the area, but assumed a population density of 3 families per acre. Development of this general area at a higher density may eventually require a larger water main on School Street. A flow test conducted by this Department on February 24, 1977, indicated a fire flow tMt. of 750 gallons per minute at a residual pressure of 20 psi at the site. Static pressure in the area is 120 psi. The rapid pressure loss, due to friction in the small 6" main, is evident from these figures. The domestic demands of an additional 10 acres zoned A-3 could be met by the existing main. The adequacy of the fire flow should be commented on by the Fire Department. Drainage: The Town of Agawam has a 15" storm drain in School Street abutting the pro- posed zone change. This does not have capacity to handle the storm water runoff from a development of A-3 density. The Developers will have to look elsewhere for an outlet for the drainage. The outlet which handles the storm water from the existing apartments and condominiums might be able to be used, but a study would need to be made to deter- mine this. Traffic: We have no traffic counts on.School Street nor has the Northampton office of the Mass. D.P.W. Without this information, we cannot accurately comment on the capacity of the roadway. From general observations, we would say that the traffic,presently carried by the street, is well below its practical capacity. For your information, the Mass. D.P.W. has plans underway to install a fully actuated traffic signal system at the intersection of School and Main Streets, as well as to make improvements to the inter- section itself. The existing school and businesses at this intersection create some congestion. If this zone change is approved, we would suggest that connection be made with the traffic circulation systems serving the Corey Apartments and the Plantation Condominiums. JPS:aok John P. At the public hearing held on July 18, 1974 the petitioner stated that this parcel of land identified as Parcel B-1 on a "plan of parcels" dated June 10, 1974 by Pharmer Engineering Corp. of Holyoke, Mass. and submitted to the Board contains an area of 8.240 acres with a frontage on School Street of 113.85 feet. The petitioner also owns land abutting this parcel at the northerly end, 'L: entified as Parcel B--2 containing an area of 7.898 acres, as well as Parcel A, lying northerly and westerly of said parcel containing an area of 20.049 acres. Parcel Ate owner of recorC, -a the Colebrook Corp., which is wholly owned by the same principals as the Kingsbridge Corp. Parcel A presently contains 160 Town House apartments (20 buildings) which the petitioner intends to sell as condominium, units at a later time. Plans indicate the seven (7), eight (8) unit condominium buildings and such amenities as a tennis court and swimming pool will be con- structed on Parcel B-2. Parcel B-1 will contain eight (8) unit condominium buildingswith an additional tennis court area. The petitioner stated that under the condominium laws of the State of Haassachusetts, a minimum of 50% of the units planned have to be sold before individual deeds can be executed. By phasing the project into three identifiable parcels, separately recorded, the petitioners can more readily convey deeds when the 5C% sales point is reached in each parcel. It is the intention..:.of the petitioner to remove the deeds to the separate parcels upon completion and sale and to incorporate all three parcelsinto one deed description encompassing an area of 36.187 acres. The petitioner stated that the 30 foot wide roadways connected by a 20 foct wide rotary roadway will,, give all the condominiums owners freedom of ingress and egress from both School Street and Corey Street. It was agreed by the petitioner that such rights of travel will be contained in each individual deed written. The Board in reviewing this case agreed that the master plan of the development meets all: requirements as set forth in the Town Ordinance. The temporary deeding of land into three (3) parcels does create a problem for parcel B-1 as insufficient frontage exists on School Street. The Board feels that suitable temporary relief can be provided without substantial derrogation from the intent and purpose of the ordinance by placing a limit of time on the relief sought. The Chairman read the legal ad for the hearing to which there were no objections and then introduced the board members. The petitioner was then asked to present his case. Mr. Sam Rockwell, Presidents introduced Attorney C. Ryan who stated the site plan as presented to the Board of Appeals differs from the one used at this meeting. The line change on the revised plan is to divide the property into Phase, I, Phase II and Phase III. This is necessary to help sales, title transfer and to comply with state statutes in regard to condominiums. The Corporation has purchased the Sava property on School Street and projected a road into Phase I, and Phase II and connecting to Phase III (Corey Colonial) from theBava property of IZ feet frontage. It conforms to aU A-3 zoning requirements except for the 150 foot frontage of A-3 zone. Phase I and Phase II wil contain 120 units, 2 tennis courts and 2 more at a later date, a swimming pool, a community building plus a manager's haste. Attorney bran is to furnish the Board of Appeals with the state statute on condominium phasing. Phase I and Phase II will be divided into 64 and 56 units. The main reason for phasing is title transfer. The state statute requires 50% of the units to be sold before the deeds can be transferred. To build Phase I and Phase II all at once would cost more than $759000 to $100,000. in financing charges, vandalism, deterioration due to unoccupancy and lose of customers.who do not want to wait for titles. The state statute describes the proper share of operating expenses to be allocated per unit. Title conveyance of condominiums is a nation wide problem. The project as planned will have extra deep set tracks causing no crowding on the street, and a recreational package accessJble to all units. Mr. Ryan remarked that taxes on these same buildings as rental units would be approximately $600. versus $800. as condominiums. Mrs. Jane Miles, 187 School Street, asked if more units were planned for the Bava Land. Answer: No, just as the Planning Hoard approved. Mr. Harry Merchant, 303 School Street, asked, "Does the line movement (Phase I and Phase II) increase affect the number of units?". Answer: The line ase shorn prevents crowding. Answer: alas assured all, would be eliminated and the area landscaped. Dr. Dowling asked, "Will the road from School Street connect to Corey Street?". The answer was Yes. Attorney cyan stated a master deed conveys property to the condominum association and governs the phases of construction. Target date for Phase I and Phase II is January 1976. Mrs. George speaking for the Planning Board said the board has worked with the corporation since April 1974. She asked the question, why was the traffic circle not included in previous descriptions. She was assured that the traffic circle would be included is an added condition and that people in Phase I could use the roads of Phase, II to go to Corey Street and use the traffic circle to go to Colebrook property (Corey Colonial). Also, the Phase II area contains less units as planned than could be allowed. The Corporation does not want to crowd buildings. The Planning Board voted and recommends "in favor" of this request. Mr. Trom:blas 194 School Street, asked if units could be rented rather ma than sold as ca ndominiums. Answer: Yea, but phasing will help sell and turn the units into dondominiums. Attorney Ryan also stated the information that the Colebrook Apartments (Corey Colonial) will be turned from rental units to condominiums as fast as tenants move out.
