This order does not relieve the permittee or any other person of the necessity of complying with all other applicable federal, state or local statutes, ordinances, by-laws and/or regulations. 4. The work authorized hereunder shall be completed within one (1) year from the date of this order unless it is for a maintenance dredging project subject to Section 5(9). Any fill used in connection with this project shall be clean fill, containing no trash, refuse, rubbish or debris, . including, without limiting the generality of the foregoing, lumber, bricks, plaster, wire, lath, paper, cardboard, pipe, tires, ashes, refrigerators, motor vehicles or parts of any of the foregoing. t 6. No work may be commenced until all appeal periods have elapsed from the order of the Conservation Commission or from a final order by the Department of Environmental Quality Engineering. 7. No work shall be undertaken until the final order, with respect to the proposed project, has been recorded in the Registry of Deeds for the district in Which the laird is located within the chain of title of the affected property. The Document number indicating such recording shall be submitted on the form at the and of this order to the issuer of this order prior to commencement of work. 8. A sign shall be displayed at the site not less that two square feet or more than three square feet bearing the Words, "Massachusetts Department of Environmental Quality Engineering. Where the Department of Environmental Quality Engineering is requested to make a determination and to issue a superseding order, the Conservation Commission shall. be a party to all agency proceedings and hearings before the Department. 10. Upon completion of the work described herein, the applicant shall forthwith request, in writing, that a Certificate of Compliance be issued stating that the'work. has . been satisfactorily completed. 11. The work shall conform to the following described plans andtadditional conditions= 12. Construction shall be according to plan entitled: "Spearfarm Acres Plan of Lots in Agawam, Being a Subdivision of Land Shown on Land_ Court Plan 20681A Cert #8219, Scale 80 feet to an inch for Consolidated Cigar Corporation, John F. Smith Surveyor, Smith Assoc- iates, 602 White Street, Springfield, Mass. " Dated: June 30, 1978. 13. No construction other than the retension basin in the open space area which abuts lots 22, 31, 41 and 42 as cited on plan. 14. The drainage work for the retension basin should be done concurrently with the installation of the street drainage system. 15. Construction of the retension basin shall conform with the plan submitted with the following exceptions. a. The slope of the 30" pipe which enters the retension area shall be increased to a 1.00% slope thus changing the invert of the 30" pipe at the drain manhole from 193.10 to 193.70. b. Side slopes andthe bottom of the retension basin shall be loaned and seeded a quickly as possible but not later than the street drainage starts to flow into it. 16. Maintenance of the retension basin is the responsibility of the developer and any subsequent owner of the open space area. The lots in question are lot numbers 20, 21, 22, and 23, which are located in the back of the sub-division. My reasons for suspecting these lots to be inadequate are; 1) slope of the land 2) proximity to surface water Due to the closeness of the open area which has been reserved for drainage, the water table of lots 20, and 21, may be higher than that which is allowed. In addition to a possible high water table, a large portion of the land of lot 21 appears to have a slope greater than 15%. This also seems to be the case for lots 22 and 23. It must be understood that these comments come as the result of observations made from the use of soil survey maps and that actual:. conditions may be different than those which were shown to exist. Drainage catch basin leaders are undersized. Leaders are to be twelve (12) inch diameter pipe. 2. The storm drain on Dutchmaster Circle has insufficient cover at Sta. 3 + 40. A minimum of three (3) feet of cover is required. 3. The proposed drainage system does not provide sufficient capacity to accom- modate the expected 5 year storm runoff. k. On sheet 3 of 4 at Sta. 11 + 75, the storm drain crosses the water main. Utility crossings of this type are undesirable and should be avoided. The water main and drain line should continue on their respective sides along the entire length of proposed streets. It is our recommendation that the drain line on straight sections of street be located ten (10) feet to the right of the baseline., u'b all proposed streets, that the storm drain be --- kept out of the treebelts which are assigned to other utilities and that a mJn4"%1.. or 15 feet be maintained between the storm drain and water main for future newer construction, 5. Water mains shall. be 8" ductile iron class 52 pipe. 6. The types or classes of the proposed streets are not indicated. 7. The drainage outfall should be extended further to the bottom of the ravine to reduce the possibility of erosion. S. The right to discharge the drainage from the subdivision onto and across the Jeserski property should be reviewed by your Board. A brook is not shown on the U.S.G.S. map at this location.
