WHITE BROOK ESTATES (SECTION I1)
Princeton Avenue, Morningside Circle and Brookside Drive
As of this date we have not received a revised set of Definitive Plans
for the above referenced subdivision, as approved by the Planning Board on
April 4, 1985.
On April 17, 1985 we did receive a copy of the Notice of Intent and
Drainage Calculations for this subdivision. A marked up copy of the Drain-
age Calculations has been returned to the design engineer for revisions and the
inclusion of previously requested drainage area naps. It appears to the under-
signed that flood retention will be necessary in order to comply with the pro-
visions of Chapter 19, Sections 19-15 through 19-57 includive of the Ordinances
of the Town of Agawam.
In addition, we have reviewed the Engineering Division/DPU comments dated
April 4, 19859 with the design engineer. The mthods of erosion control dis-
cussed at that time, eg hay bale barriers, mulching and seeding or netting the
slope at the end of Brookside Drive and channel paving sections of tho brook,
have not been indicated on the Plans. Further, it is our understanding that no
waivers of the Planning Board Rules & Regulations have bben requested bytthe
Developer.
Therefore, when the appropriate revised Plans and Calculations are sub-
mitted, Final Review Coments will be made by this office.

PROPOSAL
The proposed development is to construct 38 homes utilizing
the remaining 21.8 acres of the former "WHITE TRACT" in Feeding
Hills.
The development will take place in two stages with 15 homes
being constructed as Section I and the remaining 23 as Section II.
The Preliminary Plan for the entire development has been approved
and it is anticipated that the Definitive Plan for Section I will
be approved so that construction will start in the fall of 1983 •
The homes will, range in price from $60,000 to- $90,000.
The land is presently zoned Agricultural although a change to
Residential will be requested. The lots for Section I conform
to Agricultural requirements.
The area presents an ideal site for residential development .
It is well-drained,buildable land. The two brooks offer aesthetic
and functional advantages while providing open-space land. This
parcel is adjacent to other residential areas which facilitates
utility connection and town services.
The developer intends to preserve as many trees and other natural
features as practicable and to cause as little inconvenience to
the area as is possible during construction.
LAND USE---PRESENT & FUTURE
The land is mostly wooded and currently unused by the owner.
It is being used without authorization by others for dumping,
snowmobiles and mini-bike trails. Numerous trees have been cut
down for many reasons resulting in an area whose natural character
and wildlife has been disrupted-It is expected that development
will deter these undesirable uses, enhance the open-space amenities
and lead to the return of wildlife to the area.
The subdivision will be known as White Brook Estates. It' consists
of 21.8 acres , 18 of which will be used for building lots and
3 acres for roads. The developer will deed to the Town of Agawam
the two adjacent parcels of land totaling about 32 acres. This
land which contains two brooks will become a valuable asset to
the town. The two parcels will facilitate site drainage and
provide open space conservation land for wildlife and passive
recreation for the abutters.
STORM DRAINAGE
The open space land surrounding the two brooks carry off
virtually all of the site drainage. The town's "Report on Storm
Drainage" ,prepared by Tighe & Bond indicated the continued use
of these brooks for present and future drainage. This report
conforms to these recomendations and the project will utilize
the brooks for drainage.
Engineered drainage structures will be used to discharge the.
water with minimum velocity in order to prevent erosion and
maintain the natural qualities of the brooks. .
SEWERAGE
There are two stages for sewering the proposed subdivision. The
initial development of 15 homes will be connected to the sewer
on Princeton Avenue. This is the maximum amount that can be
connected with gravity flow. It is planned to connect the remaining
23 homes to the town interceptor sewer north of this tract.
WATER
Connection to the town' s water system is feasible with lines_
located in Princeton Avenue adjacent to this site.
ROADS
The entire subdivision requires 2600 feet of road with about
1350 feet being completed for Section I construction. A temporary
turn-around will be installed for Section I and will be eliminated
upon development of Section II . These roads will provide an
excellent traffic pattern during and after construction.
CONCLUSION
This proposed development -is compatible wi-:h the Master Plan
guidelines in all respects, particularly within and around the
natural features of the site and in providing large areas of
open space land. It would result in vastly improving area aesthetics
and land values and become a valuable asset to the Town of Agawam.

(1) winter season has passed since the completion of all underground
work within Lhe subgrade area. Curly the roadway designs or alternatives
shown on the Definitive Plans shall be constructed.

Install asbestos-cement, PVC or approved equal sewer pipe and fittings
conforming to Massachusetts Standard Specifications M5.02.7, of the size,
class and at the lines and grades shown on the Definitive Plans. The
minimum design flexure strength of asbestos-cement sewer pipe shall be
class 21;00 for sizes 4 and 6 inch diameters and class 3300 for sizes
B through 12 inch diameter. The minimum PVC sewer pipe class shall be
5DR 35, however, special 'vedding will be required. Building sewer corn-
nections shall be at lease 4 inch diameter laid at 1/8 inch per foot
pitch minIname abd shall be separated from the water service by at least
10 feet horizontally. Duilding sewer connections shall not be made di-
rectly into manholes. Long sweep elbows shall be used for all bends 11 °
or greater. A janout skull. be installed no further than 20 feet up-
stream of arty 45 or 900 bend. No foundation drains or roof leaders
shall be connected to the sanitary sewers.
Bedding shall conform to Subsection 230.610 and backfi.11ing shall meet
the requirements of Subsections 120.6OB, 150.60 and 150.64 of the Massa-
chusetts Standard' Specifications. A special bedding of sand borrow con-
forming to M1.04.0 Type shall be well compacted around all PVC sewer
pipe a minimum distance of 1 foot. Where the bottom of the trench is,
in the opinion of the Town Engineer, found to be unstable, the DEVELOPER
small excavate the unsuitable material to the width and depth ordered by
the Town Engineer, and shall replace all unsuitable materials, as direct-
ed, with a well compacted foundation consisting of granular material

Standard 202.4,,1 and shall be installed in accordance with Section 201
of the tias,achusetts Standard Specifications. Pipe connections to man-
holes shall. be made with a flexible rubber boot, and shall be cast in a
6 :Uich concrete collar. Liverts shall be brick conforming to Massachu-
setts Standard Specifications I-V,.05.1 . Preformed bituminous ,joint filler
shall conform to 1-13.05.3 and cement concrete- brick for adjusting frames
and eovors %shall conform to I-V;.05.0 of the Massachusetts Standard Speci-
fications. Type A frames and covers shall conform to Massachusetts Con-
striction Standards 202.6.0 and 202.8.0, and shall have the word "SEI ram"
imprinted in 3 inch high letter:; on the cover.
The DEVrl.OFUl shall furnish the labor and equipment, test plugs, gages
and appurtenances necessary for air testing all sanitary sewer pipes.
If leakage of air at 14 psi exceed:, 0.15 CFH per square foot in any sec-
tion of pipe, as determined by the Totim Engineer, the DEVE1APEH shall
locate the leaks and repair them at his own expense. In no event shall
the total infiltration or exfiltration including manholes, exceed the
equivalent of 100 gallons per 24 hours per inch diameter per mile of
sewer main, in ajV section of the sewer system, as determined by the
Town Engineer.
C. Drains e: If any storm drains are to be connected to the TOWN drainage
system, the DEVE10PER shall apply to the Superintendent of Public Works
for a permit to cormect to the public storm drains, and pay all fees
and deposits required.
Install reinforced concrete storm drain pipe conforming to Massachusetts
Standard Specifications M5.02.1, of the size, class and at the lines
and grades shown on the Definitive Plans. Storm drain connections to
foundation drains and roof leaders shall be installed as shown on the
Definitive Plans, and shall be at least 4 inch diameter laid at 1/8
inch por foot minirm:m pitch. The minimum flexLure strength of 4 and 6
inch diameter asbestos cement pipe shall be class 2000 D. The minimum
FVC pipe class for storm drain connections shall be SDR 41, however,
special bedding will be required.
Dedding shall. conform to Subsection 230.61, and backfilling shall meet
the requirements of Subsections 120.603, 150.60 and 150.64 of the Massa-
chusetts Standard Specifications. A special bedding of sand borrow con-

Storm drain manholes and Type C (Slope) catch basins shall conform to t " '
Agawam Construction Standards 202.2.1 and 201.3.1 respectively. Fre-
cast, concrete catch basin tops shall be as manufactured by New England
Precast Concrete, Agawam, RA; Arrow Concrete Products, Inc., Granby, CT;
or approved equal. Cement concrete brick for inverts and adjusting
frames and covers shall conform to Massachusetts; Standard Specifications
M4,05.0. Manhole fr mes and covers shall be Type A conforming to Massa-
chusetts Construction Standards 202.6.0 and 202.8.0 and shall have the
word "DRAIN" imprinted in 3 inch high letters on the cover.

Curb boxes shall be file type with arch pattern base and stationary rod

K copper tubing for water services shall be a minimum of 3/4 inch dia-
meter.
Where rock is encountered it shall be removed to a depth of 1 foot below
the bottom of the pile. Only granular material approved by the Town
Engineer shall be used as backfill in any trench excavation.
E. Sidewalks and Treebolts: The DEVELOPER shall construct sidewalks on both
61den, of the roadway of such width as is :shown on the Definitive Plans.
Ilse gravel subbase and base courses shall consist of a 6 inch gravel sub-
base and 2 inch processed gravel base conforming to Massachusetts Stand-
ard Specifications M1 .03.0 Type b, and M1 .03.1 respectively, and said
courses shall be wider by 3 inches on both sides than the bituminous sur-
face. The bituminous concrete sidewalk sur0ce shall be 2 inches thick
laid in two (2) courses 1 inch each, and shall conform to the applicable
requirements of Section 701 of the Nossachusetts Standard ;:specifications.
Treehel-ts shall be- constructed on both sides of the roadway to the width
indicated on the Definitive Flans. loam meeting the requirements of
Massachusetts Standard Specifications N1 .05.0 shall be placed to a mini-
rmim compacted depth of 6 inches. The DEVELOP IR shall submit samples of
the loam to the Town Engineer for analysis and determination of the
amount of lime and fertilizer required. The work shall conform to Sec-
tion 760 of the Massachusetts Standard Specifications, and the grass seed
shall meet the requirements 'of M6.03.0. A copy of the seed certificate r..••
shall be submitted to the Torn Engineer, The treebelts shall be watered,
reworked, and reseeded as necessary to develop a satisfactory stand of
grass,
F. Utilities: Street lights shall be installed by the DEVELOPER at his
expense and he uhall be rezponsible for the cost of lighting until the
street is accepted by the T01 1. Street lights shall be the type adopted
by the Utility Committee of the Town Council. All underground utilities
and service connections shall be installed prior to the construction of
the roadway surface.

he plans to begin or resume work on any of the improvements required by
this Agreement. They `I'(NN will charge the MEVD LUM at the hourly rate
established by the Department of Public Works for inspecting the work.
No work All .4-e accepted by the TOWN which has not been inspected on a
daily basis during its progress. The presence of an inspector shall in
no way relieve the DEVi10FER from full responsibility for completing the
required work and providing the workmanship and materials specified
herein.
If. Shade Trees: On each lot two (2) shade trees shall be planted within -
twenty 20 feet from the street line and located so as not to conflict
with underground .utilities and sight distances. At the descretion of
the'Tree Warden, the'shade.trees may be planted on the treebel.t within
the street layout. trees shall be 2 1/2 inches minimum in diameter,
balled, burlaped, native and hardy species as approved by the Planning
Board, and shall be planted subject to the direction of the Tree 'Warden,
The REVM,OPAt shall guarantee for one (1 ) full year that the trees re-
main alive and Healthy.
I. Clearing and Grad Clear Eazd grade the site as shown on the Defini-
tive Plans. All areas not to be paved which are disturbed by the DEVEI
OPER shall be limed, fertilized, seeded, mulched, watered, reworked and
reseeded as necessary until a satisfactory stand of grass takes hold to
prevent erosion. Any work performed on the banks of streams, drainage
ditches or swales shall receive priority. Mulching and seeding for
erosion control shall conform to Section 767 of the Massachusetts Stand-
ard Specifications. Seed for erosion control shall meet the requirements
of m6.03.1.
Where indicated on the Definitive Plans or deemed necessary by the Town
Engineer to prevent erosion, hay bales shall be placed. Hay bales shall
meet the requirements of 116.01„1 and shall weigh at least 50 pounds each.
Hay bales shall be placed in uniform rows and secured to at least two (2)
2" x 2" x 36" stakes driven into the ground to prevent overturning, float-
ation, or displacement. Any deposited sediment that collects at the hay
bale structures shall be removed periodically as directed by the Town
Engineer.
Lightweight paper netting shall be applied on slopes steeper than 3:1 and
on seeded areas shown on the Definitive Plans or as directed by the Town
Engineer. the netting shall be secured to the ground with 1" x 1" x 12"
stakes spaced no more then 6 feet apart to prevent it from blowing or
wasting away. The netting shall be removed when and as directed by the
Town Engineer.

until all work is completed, and then only with a special permit from the
Board of Appeals as required by Section 2M(g) of the Town Code,

backfilled as required by the Superintendent of Public Works and the

and their installation shall be certified by a registered land surveyor

Iron pipe 1 1/2 inch diameter, schedule 40 galvanized, 3 feet long, may
be used at lot corners, except where a granite or precast concrete bound
is required for marking the street lines,
P. Street Acceptance: The DLVE.OPFR shall submit to the Town Rngineer for
review the final street layout plans and legal description suitable for
recording in the Hampden County Rcgistry of heeds. The plans and des—
cription shall both meet the standards of the Street Acceptance Com—
mittee and the Department of Public Works, and shall be revised if re—
quired by the Street Acceptance Committee after an on-site public hearing.
After completion of all of the improvements required by this Agreement,
the DEVELOPM, shall submit to the Town Council a Petition fdr Street
Acceptance; and an Affidavit, releasing the TOWN from all damages which
the DEMMOFIM and his successors or assigns may incur by reason of ac—
ceptance of the street by the TOWN; together trith the Street Acceptance
[Tans referred to above.
PERFORMANCE GUARANTEE: The DEVELOPER shall furnish to the TOWN a Performance
Guarantee in the amount of $ g9,26oi'p1 the fora of a proper bond; deposit of
money, or negotiable securiti6s; or irrevocable credit secured by the first
mortgage to guarantee to the TOWN the faithful performance by the Dz;V'MAPER
within two (2) years after tha date of this Agreement, or any extension there-
of, of all work required herein. The DEVELOPER shall also repair, to the
satisfaction of the TOW111, any damage to or failure of any completed work
which may occur during the term of this Agreement. Any surety accepted by
the TOWN under this Agreement must satisfactorily protect the TOWNIS interest,
and said determLiation shall be made by the Town Treasurer. It is expressly
uhderstood and agreed by the parties that any and all security required under
the Performance Guarantee will be applied as damages for the benefit of the
TOWN for failure of the I-VEIAPER to satisfactorily complete its obligations
hereunder; and it is further understood and agreed by the parties that the
TOWN specifically reserves its right to seek any additional damages incurred F
by the TOWN and not fully protected by the security under the Performance
Guarantee.
If the DEVELOF'LR fails to perform the work within the time specified and in '
accordance with the terms of this Agreement or, in the event that the

attorney's fees and legal costs incurred by the TOILIN in case of breach of
this Agreement by the DEVELOPER. The TOWN need not expend any funds to
establish the said measure of damages, Said measure of damages to be estab—
lished by reasonable estimate: to complete the said work plus the said admini—
strative expenses, attorney's fees and legal costs herein mentioned.
The DEVELOPER further warrants that all work done under this Agreement will
be performed and completed in a workmanlike manner, and that the said work
will be fit for the use intended.

PROPOSAL
The proposed development is the completion of Stage II of the
original development of White Brook Estates and the addition of
8 home site adjacent to the northerly boundary of the original site .
The original proposal was to build 38 homes on 21 acres. Stage I
which was approved and nearly completed consists of 15 homes.
Stage II will now consist of 2,9 homes to be erected on approximately
18. 5 acres of which 2 .7 acres will be required for the additional
1800 feet of road.
The homes to be constructed in Stage II will range in price from
$80,000 to $130,000. Construction is planned to start in the spring
of 1985 and to be completed by December of 1986.
The land for the 35 home sites is zoned RA-2 and the land for the 8
sites to the north is currently zoned Agricultural. The developer
plans to conform to agricultural zoning requirements . and will not
seek a zone change unless recommended by the Planning Board.
This area together with the additional area to the north offers
an ideal site for residential development . The land is well-drained,
buildable with utility connection readily available . It offers
many aesthetic amenities. The developer plans to preserve as many
trees and other natural features As is practicable.
LAND USE--PRESENT & FUTURE
The land is almost entirely wooded. The building of Stage I has
detered the previous unauthorized use for dumping and mini-bike
riding. The area aesthetica have improved immensely and will
continue to improve with continued construction.
When completed,White Brook Estates will consist of 43 attractive
home sites occupying approximately 40 acres of land. The site will
maintain its original wooded character which will provide for
passive recreation and hopefully for the return of wildlife to the
area.
STORM DRAINAGE
The land surrounding the two brooks adjacent- to the site carry off
virtually all of the site drainage. The Town' s report on "Storm, Drain-
age, " prepared by Tighe and Bond indicates the use of these two
brooks for present and future drainage. This report conforms to
these recommendations and the project will utilize the- brooks for
site drainage.
Engineered drainage structures will be used to discharge water with
minimum velocities in order to prevent erosion and maintain the
natural qualities of the brooks.
Also,as required by town regulationg water retention facilities will
be provided to provide adequate safeguards.
SEWERAGE
There are two stages for sewering this subdivision. The 15 sites
under construction utilize connection to the Princeton Avenue
sewer,while the remainder (Stage II) will connect to the town's
interceptor sewer at the northern end of the site.
WATER
The entire development will connect to the town water main on
Princeton Avenue.
ROADS
The entire subdivision will require about 3400 .linear- feet 'of;road
of which 1400 have been built for Stage I construction. Stage II
will require an additional 2000 linear feet. These roads will
provide an excellent traffic pattern during and after construction.
CONCLUSION
This proposed development is compatible with the Master Plan
guidlines in all respects ; particularly within and around the
natural features of the site and in providing large areas of
open space land. It would result in vastly improving area aesthetics
and land values and become a valuable asset to the Town of
Agawam.

John DePalma came before the Board of Appeals at a public hearing held on
September 1,3, 1978 seeking relief from Section 20, Paragraph 38 of the Zoning
Ordinances with leas than the required frontage on the premises known as
53 Oak Street.
A review of the facts presented at the hearing, and the observation of the "on
site" inspection by Board members, allowed the Board to conclude the following to
arrive at a judicial decision.
1, The lot is zoned agriculture.
2. It has more than the required square foot area.
3. The granting of this relief would not substantially derogate from the
intent and purposes of the Zoning Ordinance.
k, The Board looks with favor on granting a variance for one (1) single
family residence that allows the retention or a large amount of land

6. The lot is located on a legal right of way.

John DePalma came before the Board of Appeals at a public hearing held on Wednesday
June 21, 1978, at 700 P.M., seeking relief from Section 20, Paragraph 25, of the
Zoning Ordinances to allow construction of a single family residence on a lot with
less than the required frontage known as Lot #A, 140 Ridgeway Drive.
A review of the facts presented at the hearing and the observation of the "on site"
inspection by Board members, allowed the Board to conclude the following to arrive at
a Judieal decision.
1, The lot is zoned Agricultural.
2. It has more than the required square foot area.
3. The granting of this relief would not substantially derogate from the intent .
and purposes of the Zoning Ordinance.
4. The Board .looks with favor on granting a variance for one (1) single family
residence that allows the retention of a large amount of land in its natural
state. .(approximately 4.185 acres)
5.• Subsequent to various "on site' inspections by the petitioner, the Board .of
Appeals and Mr. Stone of the Department of Public Works, the petitioner agreed
to grant an easement for land to create a cul de sac on his property at
the end of Ridgeway Drive. The proposed cul de sac will expedite the turn
around of fire, police, ambulance and department of public work vehicles
and also protect the premises of the last two (2) land owners on Ridgeway
Drive from vehicular damages.
6. A substantial hardship would accrue to the petitioner if this relief is
denied, as the lend could not be utilized for any other purpose except
to revert to town ownership.
Therefore, based on the statement of facts and with the power vested in this Board
of Appeals, in and for the Town of Agawam, Massachusetts, we do vote unanimously to
grant the requested relief subject to the following conditions:
1. Proposed structure will meet all zoning requirements ,and be a set back.
minimum of thirty-five (35) feet distance from any point on the cul de sac.

July 1978, drawn by R. A. Foresi, Registered land Surveyor encompassing
4:185 acres in size (182.300 square feet).

a cut de sac necessary for public convenience,. over a parcel of land' as here-
in after described, not otherwise used for a public purpose, said easement
.or right-of-way over said parcel to be an easement to construct, use and ,
forever maintain a roadway including all underground utilities such as ,
sanitary seer mains, water mains, storm drain lines, telephone: and electrical
, conduit as well as the' usual appurtenances such as street signs, traffic
signs, street lights and sidewalks,

"A, permanent roadway easement being located on land of said DePalma as
recorded in Hampden County -Registry of Deed, Book 4511, Page 26, and
beginning at a point in the westerly line of Ridgeway Drive, said point
marking the south east corner of land now or former;Lyof Osmond and Stephanie
Long and being one thousand seven hundred twenty-five and seventeen
hundredths (1725.17) feet from the intersection of the southerly line of
North Street and the westerly line of Ridgeway Drive,

6. Petitioner will record said easement in the Hampden County Registry of Deeds
and furnish the Engineering Section of the Agawam Department of Public Works
and the Board of Appeals, the book and page number of said recording.
7. Petitioner shall have recorded in the Hampden County Regiatry of Deeds a
"Notice of Variance" form .furnished by the Board of Appeals. The variance
shall not become effective until the petitioner furnishes proof to the
Building Inspector that such a recording has taken place.
8. - The variance will become null and void if construction permit is not applied
for within twenty-four (24) months from the date of this decision.
9. Before actual construction is commenced, proof of set back requirement from
cul de sac boundary will be ascertained by the Building inspector in con-
junction with the builder and the engineering section of department of public
works.
10. All'other requirements of the Zoning Ordinances shall be met as well as
any other conditions deemed in the "public goon" by the Building Inspector.

The petitioner comes before the. Board seeking a variance from Section 20, Paragraph
250 of the Zoning Ordinances to allow the construction of a single family dwelling
with less than the required frontage on Lot A, 140 Ridgeway Drive.
The Chair opened the gearing by introducing the members and reading the notice of
the public Fearing. - Le then explained the procedure the hearing will follow and
called upon the petitioner to present his case.
Mr. DePalmai Due to the lack of frontage it creates a great deal of hardship. C I
cannot use this land for any other purpose except to build onehouse on it. Its econom-
ically unsound to try to develop this four (4) plus acres because of the configuration
of the land and its small frontage. This plan will take a lot of acreage out of sub-
division and leave it in open spice.
Mr. Progulske: Does your deed describe the land and is the frontage facing right on
Ridgeway Drive?
Mr. DePa.1ma: Yes, this is my only entrance and it comes right to the end of Ridgeway
Drive. I have fifty-five (55) feet on Ridgeway Drive.
Mr. Zerra; Flow did they get to this land before Ridgeway Drive was there?
Mr. DePalma: Thru a private way on Oak Street. This is part of a larger piece of
land,that has Oak Street frontagdo
Mr. Progulske: Does this parcel abut any other developments?in the immediate area:
Mr. DePalma: No. it abuts Rjhbling Acres, but there will be no further development
in this parcel.
Mr. Progulske: The plan shown a lot of different dimensions then what you proposed
tb^ the Board of Appeals. Wbat is all the back property:
Fir. DePalma: This is open space that I am.going to give to the town, to the Conservation
Commis lion. ` f
Mr. Zerra: If you leave this land to the Town I do not see any means of egress and
ingress. You cannot land lock a parcel of land. We need a more definite legal d6s-
cription of the lot you propose to sell and what land you intend to reserve for the
Town.

Mr. DePalma: I have no plans now to build.

Mr. Yacovone, 36 Ridgeway Drive: Why did you buy tLis land with such a small frontage?
Mr. DePalma: This is a portion of a larger tract that has egress and ingress from
Oak Street.
Mr. Progulske: If Mr. DePalma's land abuts Ridgeway Drive he has just as much right
to use that road for his property as all the other land owners. The fact that the
former owners did not use this entrance is not germaine to this case.
The public viewed the projected plans for the remainder of the property and much dis-
cussion ensued about possible sub-divisions for connection to the Rambling Acres sub-
division.
Mr. DePalma: I am not seeking to connect this lot to any sub-division or any other road
there will only be one (1) house on this plug four (4) acres of land.
The Clerk and the petitioner agreed to further inspect the property and work out a
plan for a cul de sac to help all the neighbors on Ridgeway Drive.
A furVier study with the petitioner, the Clerk of the Hoard of Appeals and the Department
of Public Works, resulted in Mr. DePalma agreeing to give the Town an easement to the
Town for a cul de sac to serve the townspeople.
