Spriggrield Street Cas l The petitioner is seeking a variance from the rear yard requirement of Section 9 (c) of the Zoning By—Law to permit the construction of an addition to a Retail Store that will have less than the required rear yard measurement on the premises known as 287 Springfield Street. Three (3) persons, including the petitioner, attended the meeting. The Acting Chairman proceeded as follows: 1. Introduced members of Board. 2. Read the legal "ad" to which there was no objection. 3. Explained the "ground rules" of the method of conduct of meeting. 4. Requested petitioner to present his case. Mr. Gallerani stated that he wished to construct a forty (40) foot addition on the rear of his present drug store because of lack of space. The Chair, "Would this extension approach the ravine in the rear of the present building?" Answer "Yes, the existing rules of the State Board of Pharmacy require 20% of store space be reserved for the prescription department as well as eighteen (18) feet of depth of full store be devoted to pharmaceutical storage space, we do not meet these requirements now. We would prefer to add to the rear than go in an easterly direction to save the loss of customer parking space. .'fir. Bedard, "What plan does the State have to out the corner at the light?" Petitioner, "�ie have heard nothing about this." At this point Louis Draghetti representing the abutter on the east stated they had no objection to the proposal. Chairman, "The Board notes from your filed plot plan that the nearest corner of the addition will be 11.26 feet from the property line." Arthur Sosville commented that the Business "B" zone at the location was two hundred (200) feet deep. A general discussion then ensued relative to the three (3) deeds making up the .property, an easement held by the American T&T Co, and the common use of means of ingress and egregs to the rear of the present building by the petitioner and his neighbors. Petitioner, "No problem here." The Chair then read Section. 9(e) of the Zoning Fay-Law relative to Planning Board approval of appearance of structures erected in Business "B" districts. McMahon, "Where will loading and unloading take place?" Petitioner, "In the rear, southeasterly corners". The Chair then noted "No opposition" and "Flo Correspondence" in the case, also "No petitions." The Chair then explained the rights of an aggrieved party to any decision of the Board, and that copies of the decision could be obtained by notifying the Clerk. Adjourned at 8:25 P.M. McMahon, Jr. Clerk The Board reviewed thoroughly all the evidence presented by the petitioner at the pubAc hearing held earlier in the evening of even date. It was very evident to the Board that a Literal enforcement of the Zoning By-iaw would impose a substantial financial hardship on the petitioner in as such as insisting the proposed addition be erected in an easterly direction would cause the lose of valuable customer parking area. Further, the area described by the petitioner to be utilized for said addition borders a galley of various depths and thus unusable, any relief given the petitionter would, therefore, be without detriment to the public good. Finally, the Board noted that other structures in the immediate area, zoned in like manner, dial not meet the existing rear yard measurement as required by the Zoning By-Law, thus, judicial use of the land in questior, would not substantially derogate from the intent or purpose of the Zoning by-law. Therefore, the Board voted unanimously to grant a variance of the desired location with the following stipulations: 1. The addition shall be erected sc as to be no nearer than 11.26 feet to any abutting propert:, as shown on the p1ar, filed by the petitioner entitled "Site Plan- Edward's Drug Store, Scale 1"-.200 - McClintock & Craig, Inc. Engineers er Architects, Springfield, Kass", 2, The additioii shall conform with the existing building in general design and exterior 'treatment• 3. The petitioner shall provide the Building Inspector a detailed Mite plan showing the location of this addition on the property, in particular detailing the rear yard measurement, and must meet au other requirements set down by the Zoning. At apublic hearing held on 'Thursday, !,!arch 12, 1970, the petitioner explainedt?he hoard that he wished to serect a forty (40) foot addition on the rear of his present drug store but would be unable to do so and comply with the present By"Law setback requirement. At an executive meeting held the same evening, Thrsday, March 12, 1970s theBoard reviewed the evidence presented at said public hearing and noted in, particular the following t 1. The site under consideration is in a "Business B" district which requires a rear yard dimension of thirty--five (35) feet, the site plan filed by the petitioner shows the nearest corner of the addition to be 11.26 feet from the southeasterly property line. 2. The petitioner had explained that the Massachusetts State Board of Pharmacy required that 20w of a drug store space at a minimum be allocated to the prescription department and an additional 18% be set aside for pharmacy storage space. A denial of a variance would cause a space hardship to the petitioner as his increased volume of business demands expansion of space requirements, 3. Expansion of the present building in a general northeasterly direction would out into the petitioner's parking area which would be detrimental to his serving the public adequately. 4. The abutting property to the southeast contains a ravine of varying depths which prohibits any construction on that property in the area of the common property line, thus no apparant damage to said abutting property would seemingly result by the erection of said addition. 5. Rear yard measurements of existing commercial buildings in the immediate area do not meet the requirement of the Zoning fay-Law. 6. If the traffic flow at C'Brien's Corners were ever improved by a relocation of the southerly line of Springfield Street, the petitioner could possibly lose a section of his parking area which is now entirely hard topped. Taylor Co., Agents dated August 1923) Merrill & Sears.$ Civil -�ngrs. - 'do drawing number", During the Executive meeting held immediately after said public hearing the Board reviewed all the evidence presented at the hearing and arrived at the following deductions: 1. The petitioner maintains a residence principally on lot No. 52 and with a fifteen (15) foot side yard now existing between said residence and lot No. 53, the said residence is located partially on lot No. 51. The present residence could be located on a seventy-five (75) foot lost and meet the side yard requirements of the Zoning By-Law. 2. The Board noted in particular the general character of the neighborhood, there being an apartment block complex located only some two hundred (200) feet northerly of the location under consideration, the two lots immediately to of the site are seventy-five (75) feet in width, there are various other lots in the immediate area with frontages in the fifty (50) and sixty (60) foot category. In noting the above the Board felt t.iat a denial of the variance requested would serve no public good as the area is saturated with lot frontages of lesser dimensions. 4. Two (2) persons namely, the petitioner and her attorney, attended the meeting. The Chair first introduced the members of the tsoard, proceeded to read the published notice of the meeting " no objections being registered to same then explained the procedure followed in conducting the reeting. Mrs. Giordano was then called upon by the Chair to present her case, which she did with the fallowing comments: 1. She originally applied to split the present three (a) fifty foot lots into we (1 (1) 80 foot and one (1) 70 foot lot, with the idea of retaining the 80 foot lat for her existing residence. However, upon advice of her attorney was now filing a revised plan with the Board showing two (2) seventy-five foot lots. 2. The residence on the southerly lot had been purposely erected so as to be fifteen (15) feet from the side lot line as required by the Zoning By-Law. 3. Now finds it a financial burden to carry excess }and# the taxes are too mush to take care of especially with the increased valuation about to take place. 4. One lot in the area has a frontage of sixty-two (62) feet, another a frontage of sixty-six (66) feet. 5. If second lot is sold any building erected thereon will adhere to Zoning ay-Law, Mr. Progulske noted that lots to the rear of the site were seventy-five (75) feet in width with residences erected thereon. Chaizman Dandah pointed out that technically a variance could not be granted by Section 5A of the Zoning Enabling ikct, Chapter 40A of the General Lan, but if the Board were to consider the petition favorably a frontage of seventy-five (75) feet would be easier to accept. The petitioner inquired if the variance would have a limited time element. The Chair answered that if the Board approved the variance would, run, with the laud forever and a day. He also explained that with seventy-five (75) foot lots, thirty (30) foot of air apace between residences could be maintained. The Chair noted Atty. John Brennan, S5 Clematis Road, Agawam, appeared with the petitioner. At a public hearing held October 15, 19751 the petitioner's representative explained that the trailer sales building is set back a distance of approximately one hundred seventy—five (175) to two hundred (200) feet from the street. As a result the premises are not very visible to traffic approaching in a westerly direction on Springfield Street. Further the structure located at 223 Springfield Street is set back twenty—five �25) feet from the street and adds to the obstruction of the trailer sales premises. In addition, the petitioner felt that a safety hazard existed when vehicles approached the premises and made an abrupt stop due to pocr visibility of the premises. At a meeting of the Board members on November 19, 19759 the Board considered the evidence presented at said public hearings and observations from "on site" inspections conducted by each Board member, and arrived at the following conclusions: 1. When approaching the trailer sales premises in a westerly direction on Springfield Street, the premises are to a degree obstructed and a safety hazard could exist with traffic turning into the premises. 2. The Board of Appeals, in its opinion, after reviewing the evidence, dial not feel that the requested setback of five (5) feet was valid. The reason being explained in item number 3. 3. The erection of the proposed sign with a setback of twenty-five (25) feet from the property line would provide sufficient visibility to traffic approaching in either directions if the sign were placed at a height of fifteen (15) feats as measured from ground level to the top of the sign. Grise Premises affected —trot 42-W"hyop Street _ �ase��4 The petitioner is seeking relief from the lot size requirements of Section b, paragraph 7g of the Zoning By-Law to permit the construction of a two (2) family dwelling on the premises known as Lot No.42 Winthrop Street. At a public hearing held on March 3, 1971 the petitioner stated he wished to construct a two family residence on said lot but would be unable to comply with either the lot frontage or lot area requirements of the Zoning By-Law. At an Executive Meeting held April 7, 1971 the Hoard reviewed the facts presented at said public meeting and discussed paints observed during an on site visit to the premises made by each Board member and after considerable discussion arrived at the following: 1. The records show that said lot is described on a plan of lots recorded on December 4, 1c)p8 in Hampden County Registry of Deeds, Book of Plans 2, Page 163. This plan does not carry the approval stamp of the Agawam Planning Board. There were no subdivision regulations in effect in the Town at that time. 2. Lot No.42 does not enjoy the exemption afforded certain lots as described in Section 81-FF of the 'Subdivision Control" section of Chapter 41 of the General Laws of the Commonwealth of Massachusetts. 3. Finally, a thorough consideration of the facto leads the Board to feel it has no jurisdiction in this matter and suggests the petitioner file a new subdivision plan with the PUnping Board, allocating, at least, the present minimum lot site requirements as set down by the Zoning By-Laws. The Board in taking this action, does so with the assurance the petitioner is the owner of sufficient adjacent land that can be utilized to accomplish the action suggested and still erect the number of two family dwellings desired. Finally, the Chair explained the procedures followed for public hearings. A recorded plan entitled "Plan Showing propertyr owned by Esther Gosselin Agawam, bass. dated Sept. 19D7" as well as a plan entitled "Down of Agawam, Mass., Dept. of Public Works, Plot Plait of Wail ut, Maple, Suassr, Dwight, UkWgton, Winthrop Streets, date Feb. 1959" were both referred to during a general discussion that followed about the said acceptance. John J. Beltr+andi., 41 Lexington Street, Agawam, joint owner with Mr. prise, of the land Tinder discussion offered the following, "There used to be a brook flowing in the rear of the lots in question that kept the shopping center met, there is no atom drainage at the foot of Dwight and Sher Streets„ therefore, this area as well as that at the foot of Winthrop Street is very wet, ponded at times. After a discussion with the Town Engineer as to how to correct the ground water condition in this general area, we (Mr. Grise and 1) agreed to inst all a storm drain in Winthrop Sweet, with necessary catch basins,, to connect with the store drain in Walnut Street. In addition, we will install two catch basins with connecting pipe to the first named storm drain to pick up as much ground crater in the vicinity of ray home at the foot of Lexington Street. This should alleviate, somewhat,, the accumulation of ground water that principally drains from the high ground near Tower Terrace and the utility company. Further, at the present time there is a one and a half (1j) inch water wain and four (4) inch cower line serving Lot 45, the Devecchi residence. Four (4) persons attended the meeting. The Chair explained to the attendees (same as preceding hearing) that the introduction of the Board members and stateemsnt of meeting procedures weauld be waived. He then. read the published legal ad of the meeting,, no meats resulting. The petitioner, upon request of the Chaixman, presented his case by referring to all of the evidence presented at the previous hearing an Lot No.42 Winthrop Street. He stated the same reasons prevailed can this petition as on the said previous one. The Board recognized there was no new evidence to'Lbo presented. No one *else appeared in favor of the petition. No one else appeared opposed to the petition. The Chair again stated: 1. No correspondence had been recekved. 2. No petitions had been received. 3. Grise Premises affected Int 43 idnthrn Str&et C&W225,,, The petitioner is seeking relief from the lot sine requiriments of Section 6, paragraph 78 of the Zoning By-Law to permit the construction of a two (2) family dwelling on the premises known as Lot No.43 Winthrop Street. At a public hearing held on March 3, 1971 the petitioner stated he wished to construct a two family residence on said lot but would be unable to comply with either the lot frontage or lot area requirements of. the Zoning By-Law. At an Executive Meeting held April 7, 1971 the Board reviewed the facts presented at said public meeting and discussed points observed during an on site visit to ths' premises made by each Board member and after considerable discussion arrived at the following; 1. The records show that said lot is described on a plan of late recorded on December 4, 1908 in Hampden County Registr7 of Deeds, Book of Plans 2, Page 163. This plan does not carry the approval stamp of the Agawam Planning Board. There were no subdivision regulations in effect in the Town at that time. 2. Lot No.43 does not enjoy the exemption afforded certain lots as described in Section 81-FF of the "Subdivision Control" section of Chapter 41 of the General Laws of the Commoratealth of Massachusetts. 3. Finally, a thorough consideration of the facts leads the Board to feel it has no jurisdiction in this matter and suggests the petitioner file a new subdivision plan with the Planning Board, allocating, at least, the present minimum lot size requirements as set down by the Zoning By-Laws. The Board in taking this action, does so with the assurance the petitioner is the owner of sufficient adjacent ]and that can be utilised to accomplish the action suggested and still erect the number of two family dwellings desired.
