A review of the facts presented at the hearing, .and the observation of the "on site" inspection by Board membere, allowed the Board to conclude the following to arkive at a judical decisions 1, The lot is zoned Business A. 2. The area is a mixture of single family residences, duplexes, as well as a quadruplex, and business establishments. 3. E. S. Development, came before the Board of Appeals at a public hearing held on November 23, 1976. The petitioner is seeking r relief Pram Section 20, Paragraph 43 A of the Zoning Ordinances, to allow the commercial occupancy of a building with less than the required set back distance on the premises known as 655 Springfield Street, Each Board member reviewed the evidence as presented at the said public hearing and after observing the premises during "on site" inspections the entire Board arrived at the following facts t 1. The property is zoned business. 2. The building has been occupied by a real estate office since November 1, 1976. 3. The structure was formally residential in use. 4. The building is (18) ei teen feet back from, the Town line on Springfield Streets (17rseventeen feet short of the required (35) thirty--five feet. 5. The building was constructed in 19410 prior to the adoption of the Zoning Ordinances. 6. The structure on the lot to the east of the petitioner's has a setback no greater than that of the petitioners 7. Even as a residential use, the structure was in violation of the setback requirement. After weighing all the facts the Board has determined the followings 1. A severe financial hardship exists because it would be eeonomica14 unfeasible to move the structure or remove part of the structure so as to make it comply with the setback requirements. To deny the petitioner use of the building would serve no purpose since the structure's setback will remain in violation of the Town Ordinance. 2. Development Corporation came before the Board of Appeals at a public hearing held on October 12, 1977, at 7:30 F.M. The petitioner is seeking relief from Section 20, Subsection 21 and Subsection 25 to allow the construction of a two family resi- dence at the promises known as 22-24 Kensington Street. A review of all the facts presenters at the public hearing, and the observation of G the land and construction on the site by members of the Board, allowed Board members John Shaughnessy and Jerry terra to conclude the following: 1. In his opinion these requirements have not been fully met. Therefore,, Mr. Roberts votes to deny the petitioner's request.
