P. ffmiahon, Jr., Clerk The Board discussed the evidence presented at the public hearing held earlier in the evening of this date and also reviewed points observed by each member of the Board at an "cnsite" visit to the premises. The following points were the most pertinent: 1.) The proposed addition has proper ,aide yard clearance at the front corner but because of the angle of the northwesterly lot line with t he street line the front clearance diminished so that the rear corner cannot meet the Zoning by-Laws requirements. It was noted that several other residences on is the street had on.ty an approximate ten(10) foot side yard measurement which led the Beard to feel that any relief granted the petitioner would not derogate from the said Ey-Laws. 2.) Denial of relief might cause substantial hardship to the petitioner as the alternative would be to erect a detached garage which Ly the requirements of the Zoning by-Laws should have a minimum setback of one hundred (100) feel. I'Le elevation of the lot drops off sharply at the residence line which would create a grading problem to provide a driveway to a garage in the rear. 3.) The petitioner also owns the abutting lot on the aide of the proposed addition and he assured the Board that any structure built thereon , its front Line being parallel to the street fine, would necessarily create a thirty(30) foot air space throughout between the two residences. The Board, therefore, felt desirable relief -.aigl:t be granted without detriment to the public good. Therefore, based upon the facts available, the board of Appeais voted unanimously to grant a variance as petitioned with the following conditions: 1.) The variance shall not become operative until the petitioner has furnished t proof tathe Building Inspector that a "Notice of Variance" furnished by the Board has been recorded in Hampden County itegistrp of Deeds. 2.) The petitioner shall locate the addition on tree premises in accordance with q. the plan submitted to the Board. Saia plan indicated a front corner side line clearance of fifteen(15) feet five(5) inches and a rear corner side line measurement of ten(10) feet eight(S) inches. 3.) The petitioner shall provide the Building Inspector a detailed site plan showing the location of the addition wt.ich must meet all the requirements, excepteing the one varied side line measurement, set down by the Zoning By- Laws. This, also, to be accomplished prior to the issuance of a building pernit. 4.) Finally,, any violation of the above noted conditions shall cause immediate . revocation of the building permit. The petitioner was the only attending party at the meeting. The Chair first introduced the Board members, followed by reading the required legal newspaper notice and finally explaining the procedured tollowed during the meeting. Upon request of the Chairman the petitioner then stated he wished a variance from the aide yard measurement requirement as he did not have enough room to construct a breezeway and two (2) car garage and still maintain fifteen (15) foot clearance. " The garage is to be 22x24 feet with an eleven (11) foot breezeway. The front cortier of the garage is planned to be 1515" from the northwesterly property line and the rear corner 10181 from the same line. The petitioner furUer stated he also owned the adjoining lot on the proposed garage side aid it anyone bought same and buia' t thereon an air space of thirty (3C) feet could he :maintained between said garage and any structure to be erected on said adjodning lot. A garage any less than twenty-twc (22) feet wide mould be useless. In awning the next lot 6he petitioner said he would build on it himself or rive the lot to his children. n, The Chairman inquired if a supporting wall would have to be installed as it van noted elevation of premises dropped off and such a wall appeared to exist now supporting the existing car port. The petitioner answered that a new wall four (4) feet am toe rear of the present wall wak planned.as the existing wall was inadequate to support the added construction. Member Juliano inquired if the side lines of the next lot were more or Less parallel. The answer was in the affirmative. Member Juliano said there appeared to be a curve in road. The Clerk then questioned the petitioner if it would be a hardship to locate a detached garage in the rear of the house In order to ueet the By-Laws requirement, The answer was that the drop off of grade from the street line to the rear of the house was too great and the cost of adjusting the Grade would be a hardship. Also, it Brae pointed out that a detached garage mould have to tie at the least one hundred (100) feet from the street line. The petitioner stated he knew that the By-Laws stated that a thirty (30) foot air space S would be maintained. The angle of his northwesterly lot line cancels out the chance of maintaining such a clearance. Juliano, Sr., Acting Clerk &21&__l o o h P. &MM Lor pren Ases known as 455 Cony.S&Wt &SIM The petitioner is reeking relief frca aide yard and rear yard requirements of Section 6 (c) of the Zoning By-Laws to permit the construction of a single family dwelling that will hays less than the required clearance on tho premises known as 455 Corey Street. Two (2) people, including the petitioner attended the meeting. The Chair introduced the Board members, explairsed the procedures followed in holding Board meetings and read the legal newspaper notice calling the meetings, to which theme were no objections. Mr. Norman then, at the request of the Chair, presented his case. He stated that he had constructed the foundation for the dwelling in alignment with the boundary pins that were Hound. He wan then instructed to atop constuctio;n because of side yard and rear yard violations of the Zcming By.-Laws. The petitioner then went on to explain that upon exaiination of the boundary pine, it was found that they were incorrectly located. He also stated that he was unaware ttgat the property on the easterly side was a part.of Edith Avenue and constituted the side yard variance. The petitioner then went on to explain that the dwelling to be constructed has already been sold prior to ktnwledge of the violation. The Acting Chairman than discussed with the petitioner the EastoKy aide line distance as shown on the drawing submitted with the petition, pointing out that the portion of Edith Avenue abutting the property was cut-off by the construction of Route#57 and appears to be a dead street. The length of Edith Avenue on the easterly aside of the petitioners property is appro--dmately niri*�y (90) feet coming to end at the boundry lim of Route #57. Hoard Member Dandah discussed the rear yard requiresents with the petitioner and determined.tbat the North-West corner of the house would have a ten (10) foot discrepancy. This discrepancy decreases as your proceed from a nest to East direction due to the triangular shape of the lot. In making a closing statement the petitioner reiterated that the foundation was already constructed grad. the property sold. The Chair then described the rights of anyone aggrieved by the decision of the Board and further stated &Wne wishing a copy of the decision had only to leave his mass and address with the Clerk of the Board. Juliano, Sr., Acting Clerk The Board discussed the facts presented by the petitioner at thet.-pftblic hearing held earlier the same evening and noted in particular the following pertinent evidence: 1. The foundation was constructed in good faith on the basis that the boundary pins were correctly located, and without knowledge that this was a corner lot. 2. The portion of Edith Avenue cut-off by the construction of Route #57 , has been abandoned and is not used for vehicle traffic. 3. The portion of Edith Avenue abutting the petitioner will serge as a separator between residences, thereby giving adequate air space. 4. The North-West corner of the house will have a variance of ten (10) feet from the rear yard requirements. 5. The length of the houses is forty (40) feet and due to the triangular shape of the lot, twenty (20) feet of the house length would have a variance that decreases from ten (10) feet to Zero (0) feet. The rear lot line being a boundary with Route #57. It was apparent to the Board that a literal enforcement of the Zoning By-Lass would cause a hardship upon the petitioner and that granting relief would not nullify or sub- stantially derogate from the intent or purpose of the Zoning By-Laws. Based upon its findings of facts, therefore the Board of Appeals, voted unanimously to grant a variance of ten (10) feet at the north West corner at the rear yard and teen (10) feet on the Easterly side yard at the desired location with the following conditions: 1. The petitioner shall provide the Building Inspector a detailed site rUw showing the exact rear yard and side yard measurements of the existing foundation as putlined above and must meet all other requirements set down by the Zoning By-Laws and the Building Inspector, prior to issuance of a permit to continue construction. On March 11 , 1971, the Board met in executive Session, reviewed the evidence presented by the petitioner at said public hearing and determined the following facts to be most pertinent: 1.
