Sale of School is—ad
T O: Peter Caputo., Town Manager SUBJECT, to Quimet - Line Street -
We were successful in the sale procedure of tax title land recently sold by
the town at public auction after following the General Lars recoaeaedat4ons
relative to sale of tax title held land.
The most recent case, submitked by your office., is an Agawam resident who had
made a request to the School Committee to purchase a piece of property abutting
the lot on which her house is situated.
This land is not tax title land but is land that was taken by eminent domain for
school purposes. It is our opinion that the sale of this eminent domain t4en
property comes under Chapter 40, Section 15 - Aban&nment of Land or Easements;
Conditions. This section basically states tha arty' officer or d a men o
town e ving charge of the land (school committee in this caseIrz«3t notify
the Town Council or the Town Manager, that in their opinion the land is no
longer required for public purposes. The Town Council by a two-third vote
sha11 vote to authorize or not authorize the sale of land and specify the
minimum amount to be paid for the land. The Torn. Manager, for that amount
or a larger amount, can convey the land by deed. Such declaration to be
recorded in the Hampden County Registry of Deeds.
The School. Committee voted at a regular meeting held on ft 8, 1973 to releaa<so .
this property. An extract of the minutes of that meeting follower
"Request from Mr. & Mrs Quimet to purchase a pisoe of land
now part of the High school site was discussed. The parcel
is an extension of thoir property on Lino Street# si$e
approximately 32,1 x 75-. On a motion by D. Srjrder, 2nd
by D. Charest, the Board voted unanimously to recorwier4 to
the Torn that this request be honored. (P'let. of land is of
no value to the school and actilial1v would straighten the
school property line at that point
We consider the vote of the School Committee to release the land as sufficient,
evidence of tb*r intention to abandon however, we are also 'waiting for A.
letter of confirma ti.on from the School Committee chairman, certifying '.to .
that effect.
Attached is a letter from town Assessor E. Dumont with an estimate of the
value placed on that land awn bei ng $400. Necessary charges and fees, as
required will be added to the base price.
This information is forwarded to your office for action in placing the item
on the Council agenda to receive their approval of both the sale and the
sale price

Attached you will find a letter from Mr. & Mrs. Ouimiaet of 139 Line Street,
Feeding Hills, Massachusetts. The Ouimet's have requested that we make It
possible for them to purchase some land from the town. The land is part
of the Agawam High School lot. It is alpproxdJiae►te]y 32 feet by 75 feet brut
directly abuts their lot.
The School CQmtittee has reviewed this request and has no objection to the
sale of said land by the town. No use is being p wined for it in tie fu-
ture and its location does not legd itself in sny Voy to ruw constructive
purpose of ours.

Mr, Stephen Olivo came before the Board of Appeals at a public hearing held on
September 21, 1977 at 7:30 P.H. seeking relief from Section 20 Sub-section 25,
to allow the construction of a single famil , residence on a lot containing less
than the required area and frontage dimensions.
The Board reviewed the facts presented at this public hearing, and arrived at the
following conclusions:
1. The area is zoned Residence A-2 permitting a single family dwelling for
one housekeeping unit only,
2. Mr. Olivo received prior permission from the Board of Appeals on
September 17, 1957, to sub--divide an existing lot, which was recorded
in the Hampden County Registry of Feeds, Book 67, Page 55, and a permit
ordered issued for the erection of a single family dwelling on the
newly created lot.

3. A time limitation was placed on the building permit application by said
Board, and the petitioner was unable to st§rt construction prior to the
expiration of said permit.
Therefore, based on the statement of fact, Board Members Theodore A. Erogulske and
Ronald LaRiviere voted the relief requested, subject to the following conditions:
1. That the petitioner located the dwelling on said lot so as to conform to

the existing by-law requirements for setback, side lot and rear lot
requirements„
2. That the plans and specifications are in accordance with the building N
i
codes of the Town of Agawam concerning the erection of a dwelling.
i
3. That a "Notice of Variance" form furnished by the Board be recorded by
the petitioner in the Hampden County Registry of Deeds.
4. Fvidence of the recording shall be provided the Building Inspector prior
to the issuance of a building permit,

1. The petitioner recieved a variance in September 17, 1957, but due to
time limit of one (1) year was unable to start ccnstruction.
2. The petitioner claims a hardship but Board Member John Shaughnessy
feels twenty (20) years have gone by since the previous permit expired,
more than ample time to reapply to the Board of Appeals for an ex-
tension or renewal of this permit and the hardship is self imposed.
3. The plot plan presented at the hearing and the legal description of
cf the property are nct in agreement. A difference of 1.75 feet on
Central Street frontage - east side lot difference of .50 feet and
rear lot difference cf .58 feet.
Since a unanimous vote is required to grant a varikLnce this request is hereby denied.

Premises affected
The petitioner came before the Board of Appeals at a pubUc hearing held on
February 41 1976, at 7:30 P.M, The Board reviewed the facts presented at said
public hearing as well as evidence at "on site" inspections conducted by the
Board of Appeals members, which resulted in the following conclusions.
The Board by unanimous decision authorized the Building Inspector to issue
a building permit to allow the completion of said non-conforming structure
which was granted a Special Permit in 1955, subject to the following conditions.
1. The perimeter area of the building is not to be increased.
2. The second floor will be used for aircraft wing repair, aircraft
radio and flight simulator instruction and other aircraft related
items.
3. The petitioner will complete construction,within(18) eighteen
months from the date of this decision,
4. The storage trailer will be removed from the premises prior to
completion of construction, and no other trailer will. replace it.
5. The building will be painted in its entirety#

The petitioner is seeking relief from Section 20, Paragraph 401, of the Zoning Ordinance
to allow an addition to the present club house, the alteration and relocation of locker
roosts and sanitation facilities, to expande golf cart parking areas„to expand their
parking facilities and the year round use of all facilities at 850 So. Westfield Street♦
It is claimed by the petitioner that conditions imposed by previous actions of the
Board has created a substantial hardship on him in restricting the physical sin* of
the existl1w club house. He is presently unable to accommodate the request .to
utilise he taoilities for many and varied social functions. y
On Kay 30 19" , the Board weighed carefully all the facts presented at the public
homing and arrived at the fallowing conclusions: y"

2, ere were no objections at the public hearing to the construction tf this
addition. '
3 ` fihare were no objections to the use of the Club House and all misted
facilities for total year round use thereof.
4. There ,were no objections to use the premises for golf outings, `wr ag
partiey, Christmas parties and other related social functions. ,
5i The corporation pays the highest premium fire insurance rate due to very
low pressure in the water mains. "
G. The real estate taxes and personal property taxes'exceed $20,000k year. '

to their utmost on a year round basis. ,
Bs Upon weighing all the evidence, the Board concluded that to deny the petitioner
the right to build the addition and the right to the use of the facilities on
a year round basis, would effect a substantial hardship.

10. Finally, it was felt by the Board that a special permit under strictly
enforced regulations would not substantially derogate frcm the intent
or purposes of this Zoning Ordinance.
Therefore,, with the power vested in this Board of Appeals in and for the Tom of

building length and the area proposed to modify and enlarge the vehicle
parking facilities. This revised map will be pert of the record,

of Deeds a "Notice of Variance" form furnished by the Board. The variance
shall not become operative until the petitioner has furnished proof to the
Building Inspector, the Zoning Officer of the Town, that such recorditag has

9. The petitioner must meet all requirements of the Conservation Casmission of
the Toms with regard to flowing water.
20. All other reyuirraents of the Zoning Ordinances shall prevail and any other
conditions laid dorm by the Building Inspector shall be not.
11. This special permit shall expire immediately upon the golf course terminating
as a business.
12. Finally, this Special Permit may be revoked by the Building Inspector and/
or the Board of Appeals if in their opinion the operation of the club hones
is not in the interest of the "public good".

house because we are now to small to handle weddings and we want to enlarge our

We have had some cancellations because we could not handle the UM M number of
people. The golf course needs more incomes, we want to take on more outing and
our present club house is not large enough for us to feed the big outings. We
can presently food about one bundred people but onr gory minimum .ehou]d be at
least two hundred people."
