Phaneuf requested relief from the present frontage requirements of the Zoning By—Laws in order to allow the construction of a single family hems on the premises of 1095 North West Street. th the public hearing held on Friday, 3* 1968, Mr, Armand Phaneuf of 25 Ley Street* represented the petitioner and told the board that his son, Robert Phaneuf* wants to construct a single family home on a lot appradmately 7.49 acres of land with a frontage of 50.57 feet wide off North west Street. x' However* he will not be able to comply with the present fraa*age requirements and conseque:rt3,y seeks relief. During the executive meeting held on Friday, May 3* 1968, the Board reviewed the facts of the case and verified the following: 1. A hardship does exist here in that the owner has 50,57 fast access to a lot in excess of 7 acres in size and to deny the. variance would. .. deprive him the sound use of his land. Granting of this variance would not be detrimental to the publio good as the overall lot is greater than the mi ni nnim requirements of the present Zoning BY—Laws. 3. Granting of this variance would not substantially derogate fram the intent of the Zoning By—Laws. q The Board of Appeals feels that insisting on a literal enforcement of this B -law would be a hardship an the petitioner. Therefore, the Board unanimous wed to grant the petition with the following restrictions: 1. Only one residence ." accessory building can b e built on the 7.49 acre lot as described. 2. Juliano, Acting Clark A f Anthoa & Rosalie Pacella, 97=29 Maple Strget Gime Tc,e petitioners are seeking relief .from Chapter 20, Section 20--31 of the Town Ordinances to allow the construction of an addition with less than the required side lot on the premises known as 97-99 Maple Street Two persons attended the meeting (the petitioner and his wire) The Chair requested the petitioner to state his case, Mr. Pacella stated that they now have four (4) rooms, and that additional space is needed for visiting friends and relatives from out of stator. The house at present is a two family duplix. The Chair asked about parking facilities for the tenant Mr. Pacella replied that a garage would be on the bottcaa and a room above creating an appearance of a sp],it level. Parking would be provided on the side of the driveway. Member Cerra asked if they would live with a twelve (12) foot wide bedroom instead of the requested fifteen (15) foot wide. Mr. Pacella replied "yes." Member Juliano asked if they could use a twelve (12) tout wide garage. Ar. Pacella replied, "yes,, but a fifteen (15) foot wide garage would be nice." The Chair asked for a hardship reason. Mr. Pacella stated that he could not afford to rove his tenant and use the entire house as the cast would be more than he could afford. The Chair stated that a twelve (12) foot wide garager outsi,.de►,,. would yield ever eleven (11) feet inside and that thatiie sufficient for one car and that the tenth is no problem. The Chair further suggested an attempt be made to purcbase tbroe (3) feast of land from the nei shbo r. Mr. Pacella stated that the neighbors ,Mad no complaint about their addition so therefore why not grant the variance. The Chair stated that a decision based on that reason could not stand a ch&Usnge. Airs. Pacella, asked if it were not a hardship to miss one's family. The Chair replied that it is difficult to be removed from your family, but not a reason to justify a three (3) foot variance. Member Juliano cited an example bf a hardship for a variance would be if it were only possible to construct an eight (8) foot wide ad d>jtiQn to conform to �.`Y 1 Page 2 Zoning Ordinances, However, a twelve (1.2) foot addition can be constructed and still conf€m to the Zoning Ordinances and that a twelve (12) foot wide addition is sufficient in size for a roams or garage width. The sot is zoned A2 and agriculture. 2. The five acre plus size of the lot far. exceeds the square footage requirement. 3. The granting of this relief does not substantially derogate from the intent and purpose of the Zoning Ordinances. 4. The Board looks with favor on granting a variance for one (1) single family residence that allows the retention of a large amount of land in its natural state. 5. Thldre is a definite hardship on the land, because of the unavail- ability of more land to meet frontage requirements. 6. No abutters were in opposition. Therefore, based on the statement of facts, and with the power vested in this Board of Appeals, in and for the Town of Agawam, we do vote unanimouair to grant a conditional variance subject to the following conditions= 1, The lot will be limited to one single family residence, and will not be eligible for future: sub-division. 2. Ingress and akress to this and other properties as affected by a common right of way, will be as per plans on file with the Hampden County Registry of Deeds, Book 3474, Page 425, dated ig68. 3. Right of way information and legal description of land as per plan furnished by the petitioner, and it becomes a part of this case. Five (5) persons attended the hearing. The Chair first introduced the Board Members, next read the required published legal notice of the hearing, to which there were no questions and finally explained the ground rules covering the meeting procedures. The petitioner then, at the request of the Chair, explained he was trying to expand his building as he was desperate for office space and in addition would like to provide some rental apace. He stated the office space would be in front of the present building. He went on to say that he hoped to improve the looks of the present building.at the same time and take awa the gas station appearance of same. He further explained that he could not drop back ten 110) feet with the proposed frontage set back as that would cut off the present service entrance and furthermore he would lose one-half (1/2) of his proposed parking, meaning parking would have to be both in front and back of the building. The Chair then inquired how much of'the expansion was for the petitioner's business use. The petitioner stated former gas station look would be locked in by addition, a firewall corridor would connect old and new buildings and porcelain like exterior of former gas station would be replaced. He showed details on plot plan filed with petition. Chair stated, "Present basic roof tine is flat, do you plan to continue same plane on new roof?" The petitioner produced an artist's conception of the proposed building and changes in the old. Member Zerra, "What is the set back from the street?" Petitioner, "Twenty-five (25) feet. " The Clerk then stated, "You mean twenty-five (25) feet from River Road but only ten (10) feet from School Street do you not?" Petitioner answered in affirmative. Member Zerra then remarked that customers do not like to park in rear of business and walk around to front entrance. Petitioner answered he hoped to reserve use of back door for their own operations. The Chair again asked for the set back proposed on School Street. The petitioner answered, "Ten (10) feet and twenty-five (25) feet from inside of sidewalk on River Road. Member Zerra repeated statement about customers walking from parking in rear. Chairman noted loading and unloading would be in rear and then questioned possible hazard from lessened visibility at the intersection. The petitioner stated they had checked this possibility and measured from property pin at Intersection of School Street and River Road to stop sign on south side of School Street which proved to be forty-six (46) feet, not affecting the visibility. The chairman answered that the visibility might be interfered with from the River Road approach to School Street, however. The petitioner thorn stated that the angle of approach from River Road to School Street is gradual, therefore, there will be no problem. Member Zerra then inquired if roof line of present building and proposed building would be the same. Petitioner replied in the affirmative. The Clerk then asked if the wooden fence in the rear of the present building was on the rear of property line. The answer, "No, we plan to remove fence and clear out part of wooded area, but also plan to leave a portion of the same woods as a buffer area between our land and that of the county. No one appeared in favor of the petitioner upon inquiry of the Chair. No one appeared in opposition to petition upon inquiry of the Chair. The Chair stated no correspondence or petitions had been received. He further explained the rights of any party aggrieved by a decision of the Board, and further how one might procure a copy of the decision by leaving his name and address with the Clerk. A review of the facts presented at the hearing,. and the observation of the "on site" inspection by Board members, allowed the Board to conclude the following, . to arrive at a judical decision= 1, The lot is Boned A2 and Agriculture, 2, It has more than the required square foot area — being approximately 51 acres. 3. The lot has a fifty (50) foot frontage on Southwick Street, A minimum of one hundred tan (110) feet is required in the A2 zoning district. 4, The grunting of this relief would not substantially derogate from the intent and purposes of the Zoning Ordinances, 5. Petition OF Donald Preston Premises Jfocted The petitioner is seeking relief from the setback and side yard requirements of Section 5 (c)s (d) of the Zoning by--Laws to permit the construction of a proposed addition that will have less than the said setback and side yard measurements on the premises known as 22 Valentine Street. At a public hearing held December 9, 19?U, the petitioner explained he wished to construct a single story, four (4) room addition to his existing residence to correct acrowded living condition and would be unable to do so because of the lack of one (1) foot in the required side yard measurement determined by the said Zoning By--Law. He further pointedout that the proposed addition would not extend beyond the line established by the westerly edge of the existing garage which is a distance of fourteen (14) feet from the westerly lot Line. In addition, the existing garage is to be moved forward so as to be even with the front line of the existing residence and the said fourteen (14) foot side yard measurement is to be maintained. The fret setback of the said existing house is thirty-one (31) feet. On January 14, 1971, the board met in Executive Session, reviewed the evidence presented by the petitioner at said public hearing and determined the following facts to be most pertinent: 1. Moving the proposed addition one (1) foot easterly would make the blending; of the buildings more complex, therefore more expensive, and incidentally would block light from an existing room. Further, adding space within the confines of the existing residence would be prohibitively expensive and not structurally feasible as determined by an architect. It became apparent to the Board that a literal enforcement of the Zoning By Laws would impose a dubstantial financial hardship upon the petitioner, 2. U the petitioner were granted relief the resulting air space between his planned addition and the residence westerly thereof would be thirty-three (33) feet, seven and one-half (7j) inches. The proposed four (4) room addition was to correct a crowded living :' condition for his growing family. 2. The present fourteen (14) foot side yard measurement of the existing structure must have been an error on the part of the contractor who � erected the residence. 3. The proposed addition will maintada said fourteen (14) feet clearamm and will have a front set back of thirty-one (31) feet, similar to that of the existing residence. 4. Moving the proposed addition one (1) foot easterly world awkee the s blending of the buildings more ccmplax, therefore, more expensive. Further, the presesat residence is not structurally able to support the proposed addition, this determined by an architect. 5. The air space betwesen the proposed addition and the residence westerly thereof will be thirty-three (33) feet, seven and one-half (7j) motes, The Board members had noted during a visit to the site and the neighborhood that the fourteen (14) feet side yard measurement to be mai.ntafxxed by the petitioner was in excess, in general, of the distance between many residences in the mediate area and their respeective boundaries. r E- It became apparent to the Board that the denial of relief to the petitioner by a literal <` enforcement of the Zoning By-Laws would impose a substantial financial hardship upon him; if relief were granted, the above mentioned air spade between the proposed addition i and the residence westerly tLereeof would be substantial enough so that such relief would not nullify or substantially derogate from the intent or purpose of the Zoning By-Lasr& - finally, the side yard dimension maixntaimd generally in the neighborhood appeared to be k less than the petitioner's measurement, tLeereefore, any relief afforded him would be 4 without substantial detriment to -the public good. Three: (3) persons attended the meeting. Due to the season attendance the Chairman waived the full reading of the rules governing the .Hoard's hearin.;s we explained in general the ground rules utilised. He then introduced theBoard members and proceeded to read the published legal notice of the meeting which resulted in a short discussion prompted by the petitioner of the reason for including a setback consideration as weU as side yard measurement in the notice. It developed that the front lix-ie of the garage as rimed forward still came within the setback requirements of the said Zoning By-Law. The petitioner then presented his case by stating that the size of his family now necessitated additional living space and that he was not violates lines of existing structures and intenMd to maintain the present fourteen (14) foot side yard dimension. He intends to move the garage for4Lrd on a new foundation up to the front line of the existing residence. The existing fourteen (14) feet side yard must have been established through error, he stated. Thirsdiscrepency shave%s the result of a recent survey, he commented. The Chair agreed tU the lack of side yard measurement could have resulted from an error. The petitioner then stated that by moving over one (1) foot to provide required side yard clearance mating of the proposed new roof and the er dsting house roof would be a major problem. His architect had advised him that the proposed method of addiAg space was financially easier than constructing a second, story on his bresaent hoses as structurally the present building was not capable of supporting same. The Chairman stated he noted the neighbor affected by the suggested construction had clearance of a minima of 19.62 feet to their coon lot line and inquired it this would result in an air space approximating thirty-four (34) feet between the two (2) home. The petitioner agreed to this figure. The Clerk of the Board questioned the air space figure stating that it was difficult to determine where the commor4property line was because a row of shrubs apparently did not designate said line. After a short general discussion on this item the petitioner agreed to measure the air space as he quoted distances only from pUns available. Vice-.Chairman Progulsxke inquired if any construction had been started. The petitioner replied that nothing would be done until the spring of '7l. YV lot frontage is(72.22) seventy-two point twenty-two hundred feet and my next door neighbors is severity feet in frontage. These lots arA plot plans were approved by the 19A Planning Board. Had arty lot not th+everntty-five (73) foot frontage minimum I would not be here tonight. If this lot had a seventy-five (75) foot frontage I could build this addition and mast all the requirements. Because of the angle of my lot line in relation to air proposed addition there mill be a wall triarwLul.ar section of a few square feet encroaching on the fifteen foot (15) side lent not back. The rear of this addition will be (19r) nineteen feat from the property line and as I said before, only a smaI2 section will be less than (15e) fifteen feet. I will maln- tain at least (26I) twenty-six foot of air space between the frontage of this adds- tion and aq neignbors building. At the rear of this building I will have (429) feuty- two feet of air sparse. The for part of this addition will conform with side lnt and air space requirements. Mr. Zerra: I visited this lot arA I found that he has ampler apacee for this addition to be built upon. Another factor is our snow removal, ortinanae. No cars can be park- ed an the street during winter months. Mr. Shaughoessy= I checked the Planning Boards records and could not find out way they allowed these two (2) lots to be built upon.
