At a public hearing held on +curie 23, 1976 at 8t30 F.K., the petitioner explained to the Board that he wished to remove the excess top sail accwsulated when be developed the new streets in his subdivision. The Herd weighed carefully all the facts presented at the said hearing and the pbroical addence obseruad during an "on site" inspection of tko presda so and the following major considerations allowed them to arrive at a Judicial decision: 1. The total subdivision has Flwu ing Board approval and is fu r bonded. 2. Hazardous conditions wdst,such as,Moborcycle and snowmobile trails and children sliding on these mounds of excess top soil and in the boars mind shou3A be eliminated. 3. The removal of this top soil Trill in no way affect this aubdivision. 4. The petitioner underestimated the amouz* of exams top soil by at least 2= yds. 5. The petitioner is seeking relief from Chapter 20, erections 20-2 4. (a) of the Lois Ordinances to allow the use of a garage addition with less than the required side lot area. The January 8 hearing was recessed until,. February 12, 1975 in order to allow the petitiotaer.time to ' have a certified civil engineer survey his lot as the Chair and Board Members felt that evidence brought forth by abutters conflicted with the deed descriptions of the petitioner and that this survey was necessary. At the reconvened meeting the petitioner stated that his lot survey did indeed show the addition to be approximately two (2) feet short of the required fifteen (15) feet side lot clearance. The Board in reviewing the facts presented at both hearings arrived at the follo;.dng conclusions: 1. This home is located in a section of torn known as Feeding Hills and is the fastest growing residence section of town and where most of this towns future growth will take place. The land in question is zoned Residence A-2, our second highest residentUl zoning classification. 2. A building permit was issued the petitioner on April. 24, 1974 based on a drawing submitted to the Building Inspector. 3. Neighbors _uestioned the petitioner as to whether he had enough side yard clearance during the months of May 1974 and June 1974. He apparently told them he did. 4. , Letters to the Building Inspector concerning the possible violation led the Building Inspector to notify fir. Rogers of the complaint and to satisfy his department that the building was being built in compliance with the drawings submitted to his office. 5. A survey by Jmi.th do Mallen Engineering Companye 602 White Street, Springfield, August 1974 for Mr. 'dewiran, an abutter of Mr. Rogers, showed a violation of the side yard by approximately two (2) feet. 6. Letter to Mr. Pogers dated August 6, 1974 from the wilding Inspector stating that if allegations are proved to be true the . correction of the violation would be the petitioner's responsibility. The building of the addition apparently continued and the Building Inspector issued the petitioner a Notice to Abate Violation on November 14, 1974. S, A plan of the petitioner's land done by Durkee, White, Towne & Chapdelaine, Civil aigineers and band Surveyors, 356 Front St,, Chicopee, Mass. Drawing No, 71.--3286 January 23, 1975 showed a violation of approximately two (2) feet which was in agreement with the survey of Smith a Wallen of the same lots done in August 1974 for the abutter. Board Member, Mr. Zerra, voted to grant a variance for the following reasonst 1. A retaining wall or foundation similar to the garage foundation in question could be built to the lot line, This foundation is not in violation. 2. A roof or cornice can protrude three (3) feet into the fifteen (15) foot side lot area. This roof protrudes two (2) feet into this area, is legal and could remain as such. 3. The cease and desist order from the Building Department was received after the wall and building were fully erected, 4. A very architecturally imbalanced house would result if the side were moved two (2) feet to comply with the side lot requirements, This would be detrimental and devalue the surrounding homes, This home and garage as is now constructed is well balanced and enhances and compliments the neighborhood. There is thirty (30) feet of air space between buildings. 5. Although it is incumbent upon the bfilder to ascertain his boundaries and to build within legal limits, I do believe an honest mistake has been made and I therefore vote to grant the requested variance, Board Members, Mr. Shaughnessy and Mr. Peogulskef voted to dear the relief sought. Progulske, Chairman Jury Zerra, Xwuber John Shaughnessy, Clerk S The Chair opened the hearing by first apalogisiag for the late start of this hear- ing and by introducing the Board m mbers and the reading of the legal nice as posted on December 20 and 27, 1974. The Chair esplained the format that the hear- i E would follows Atty. A. Tassinari speaking on behalf of the petitioner Mr. Howard Rangers stated the following; 1. The survey showing the violation is in error and that the pins an the Bast-West lot line had been somshcwmoved and the survey is wrong, 2. The addition could be called are accessory building which requires a(65) sixty-five foot set back from street line and only a (5) fire-feet frog the side lot line. 3. The demolition of the addition Would be a substantial hardship as mW client has acted in good faith and was led to believe that no violations existed until the building had been substamia1]y completed s as he was given a building and wiring permit in accordance with the law. Atty. Tassinari stated that Mr. Rogers contiauai] ► checked with the neigWxwo to see that there was room for the addition and none complained until Mr. Conte notified us of a possible violation. The Board at this time notified Atty. Tassinari that in previewing his opening comments that the addition couldn't be classified as an accessory building if "tached and only (61) siztq-one feet from the street line. Under Riesidence A-2 an accessW building if detached and located (65) slaty five fast from street line may be placed at least (5) five feet from side lot sins. The Board further advised the petitioner that he should prove that his deed is in proper order and that the survey in in error. The Chair then asked the Building Inspectors Joseph Conte to review the averts$ Mr. Conte stated the following: I received a call in June regarding the addition at 479 Southwick Street, but no zMM was given. Mr. Rogers applied for a Building Permit on April 22s 1974, and the permit wwa issued on April 24s 1974. Mr. CouC* then read from a packet of letters and correspondence received from people in the area questioning if a violations had occured. Mr. Conte had earlier testified that at the inspection that in measuring foam the Newman foundation to the Rogers foundation a reading of (30) thirty feet (1) one inch had been obtained but thus had. no bearing depending where lot lire fell* Mr. Conte sent a notice to abate violation on November 14s 1974s giving Xr. Ragsrs (30) thirty days to correct the violation. hr. Conte W= turned this file over to the Board to be used as evidence its makisag a decision, It was 91so rioted that inched in the packet is a certified plan of Lot #6 (Mr. Rogers) and Lot M that of Mr. Newmants dons by Smith & 4al.len Eng. Co.s of Springgl4d which apparwit3y bears out the claim of the violation. The Chair then asked if others wished to speak. Mr. Harold Newman stated that at the tim the hole for the foundation was done, he had no idea that there might be a violation. In June when the foundation was being poured I asked Mr. Rogers if he had enough clearance and he told me that everything was in order. I assumid t that he was rigztt as Mr. Rogers has built homes in the pasts and due to a lack of money at the time couldn't afford to hire an Engineer until Aug-ust at which time the violation was proven as far as I was concerned. At thispoint in time the Chair and other Hoard members felt that a recess was in order to allow Mr. Rogers to obtain his own survey report. The hearing rat ad- Jourrsd at 10:30 Fe . to be reconvened at 700 P.M.* Wednesday# February 12, 1975, On February► 12s 1975* at 7:30 sharp the hearing was again opened. The Chair asked Mr. Rogers* ao you have the plant showing what the lot finest are? The reply was that Xr. Rogers attorney (Tassinari) had them but was not here as yet. but I have to be honest I have seen them and I exceed the side lot requireasat by aPPraaimately (2) two feet as the survey presented by Mr. Newman shows. The Chair then notified Mr. Rogers that there was an infraction of the by-laws and you will have to explain the hardship if the Board ordered you to remove the por- tion of the building Aw4violation. Mr. Rogers then explained that to correct the violations he would have to tear dorm the whole addition which would cost approximately $►3s000• to ,$4s000., then have to be rebuilt# starting with a now foundation. It was noted. that Mr. William Zilinsky'r 476 Southwick Streets was the only one to be recorded in favor of the variance, with no othereL raking comments. The Chair asked Mr. Rogers to sum up. Mr. Sogersstated the fol.lmiings I built the building and a.s far as I knew-*I was with in the lax. I was in personal contact with the Building Inspector thru out construction. Permit under Section 20-8 g of .the Zoning Ordibances to allow removal of fill from the property located to the rear of 595 Mill. Street. At a public hearing held February 129 1975 the petitioner explained to the Board that he wished to remove as much fill as possible from the premises but would be unable to do so and meet the present By-Law requirements. The Board wiighed carefully all the facts presented at the said hearing and the physical evidence observed during an "on site" inspection of the premises and felt the following major considerations allowed them to arrive at a judicial decisions 1 The petitionerts land* .comprising approximately 5e42 acres* is located several hundred feet souther?,y of said Mill Street# having no street frontage* and is reached by use of travel rights over land of others. 2e It would be impossible for the petitioner to develop the premises* so located, in the usual manner of a sub-division for house lots without some acceptable means of travel to and from a Jpublic way. It would appear such means of travel are not available. 3. A "fill bank" operation, not properly supervised# could prove to be an inconvenience and nuisance to the neighborhood, however* permtUon for such an operation could carry control measures severe enough to provide ample means of protection for all affected parties. k. Rear 595 Mill Street, Case #831 Finally, it was felt by the Board that inasmuch as the physical character of the immediate area had alreactr changed due to the presence of at least one "fill bank", that permitting an additional" such "bank" under strictly enforced regulations would not substantially derogate from the intent of the Zoning By--Laws. Therefore, the Board of Appeals by unanimous vote grants a Special Permit for the removal of fill as petitioned subject to the following .;conditions: 1. The permit shall be for a period not to exceed two (2) years from the date of this decision. 2. The permit shall not become operative until the Building Inspector has proof that the petitioner has filed with the Treasurer of the Town of Agawam a Performance Bond in a form acceptable to said Treasurer in the amount of Bight Thousand ($a000) dollars. 3. The petitioner shall comply in full with the requirements laid out in Section 24-8gt General Provisions, paragraphs g-39 g-3a, 9-3bi S 3ci g-3d of the Zoning By—Law, which deal with grades and topsoil treatments exedpting said paragraph g-3b shall not be applicable in that part of the premises where a common property line exists with an abutter who also may be removing fill from his land after having received proper approval from the Board of Appeals. In such an instances "fill." in the vicinity of such a common property line may be removed to a predetermined elevation agreed upon by both owners. A copy of wW such agreement shall be filed with the Board previous to any such removal. 4* The petitioner shall furnish the Board an executed copy of the right of travel agreement entered into by the interested abutters before sitd permit shall become operative.
