Pursuant to the authority of G.L. c..131 s. 40, the Agawam onser_ya ion ^
has considered your notice of intent and plans
submitted therewith, and has determined that the area on which the
proposed work is to be done is significant to one or more of the interests
described in the said act. The Agawam _Conservation Commission
hereby orders that the following conditions are necessary and all work
must be performed in strict conformance therewith:
CONDITIONS
1 . Failure to comply with all conditions stated herein, and with all
related statutes and other regulatory measures, shall be deemed cause
to revoke or modify this order.
2. This order does not grant any property rights or any exclusive
privileges; it does not authorize any injury to private property or
invasion of private rights.
3. This order does not relieve the permittee or any other person of the
necessity of . complying with all other applicable -federal, state, ' or
local statutes, ordinances, by-laws and/or regulations.
4 . The work authorized hereunder shall be completed within one (1) year
from the date of this order. The order may be extended by the
.issuing authority for one or more additional one-year periods upon
application to the said issuing authority at least thirty days prior
to the expiration date of the order or its extension.
5. Any fill used in connection with this project shall be clean fill,
containing no trash, refuse, rubbish or debris, including, without
limiting the generality 'of. the foregoing, lumber, bricks, plaster,
wire, lath, paper, cardboard, pipe, tires, ashes, refrigerators,
motor vehicles or parts of any of the foregoing.
6 . . No work may be commenced until all appeal periods have elapsed from
the order of the Conservation Commission or from a final order by
the Department of Natural Resources has elapsed.

7 . No work shall be undertaken until the final Order, with respect
to the proposed project, has been recorded in the Registry of
Deeds for the district in which the land is located. Copy to

8. Upon completion of the work described herein, the applicant
shall forthwith request, in writing, that a Certificate of
Compliance be issued stating that the work has been satisfactorily
completed.
9. A sign shall be displayed at the site not less than two square
feet or more than three square feet bearing the words,
"Massachusetts Department of Natural Resources, File

10. Where the Department of Natural Resources is requested to make a
determination and to issue a superseding order, the Conservation
Commission shall be a party to all agency proceedings and hearings
before the Department of Natural Resources.

EXTENSION PERMIT - CONTIM-D
A) When the Applicant commences with the work necessary for the installation
of the storm drains in Paul Revere Drive and outlet in the vacinity of
Independence Road, as shown in the Plans submitted to the Conservation
Commission and referenced in Condition #12, he shall comply with the following:
1 ) Prior to the start of construction of the storm drains and outlet,
two (2) sets of detailed plans showing the proposed work shall be
submitted to the Commission for review and approval. Review
comments will be sent to the Applicant within 14 days after submission.
No work on these items shall be done until final written approval by
the Commission is obtained.
2) All erosion control measures issued in conditions #13-16.
3) The outlet shall be rip-rapped with 50-100 lbs. stones. Loaming,
lime, fertilizer, mulching, and seed for erosion control shall meet
the requirements of Section 751 & 767 of the "Standard Specifications
for Highways and Bridges", Commonwealth of Massachusetts Department
of Public Works, 1973 ed.
4) All slopes 4:1 or steeper shall be mulched and seeded for erosion
control.
B) Upon completion of the installation of the storm drain in Paul Revere
Drive and outlet in the vacinity of Independence Road, the Applicant shall
remove the temporary culvert presently under Paul Revere Drive to the
North of Lot No.#94. The Applicant shall then fill this trench rip-rap
the bank of the Westerly Brook with 50-100 lbs. stones, loam, lime,
fertilize,mulch and seed for erosion control as required in Section 751 &
767 of the "Standard Specifications for Highways and Bridges". Commonwealth
of Massachusetts Department of Public Works, 1973 ed.
If the proposed storm drain and outlet as described above is not installed
within the next 12 months, the Applicant shall be responsible for maintaining
the existing culvert and trench including the removal of any debris,
cleaning the culvert of any silt, and implementing any needed erosion control
measures at that location.

Channel shall be sloped -2:1, loamed with four (4) inches of topsoil,
seeded with a mixture of reed canary grass, r.edtop or perennial
rye grass - crownvetch may be added for quick cover, and mulched '
with hay -or straw._ Single -row shrubs, such as silky dogwood or.
, red osier dogwood should be planted above normal water line.
Mulched area subject to water flow should be anchored in an
appropriate manner,
12. Culvert under Clover Hill road cleaned of- silt, sand. and debris.
13.- Brook along lots 49 53 inclusive should' be .piped.with 48" Class
III RCP as was required on subdivision plans and covered with clean
fill according to specifications of Town Engineer,
14, Woodhaven Road .Area:
No work will be accomplished on lots 120 through 138 until further
information as to soils, seasonal maximum ground water elev?.ti=
present destination of runoff water, and sources of runoff water,
two (2) ft. coutours is presented to the Commission in order to ,
judge what impact the excavation and filling of this Wetland Area
will have on downstream flooding, maintenance of natural drainage
system.,and.naintenance of sustained flow .of water throughout the

seasons. The Commission feels a period of six (6) months
.from issuance of this order is sufficient time to present this
information. At that time the more definitive plan presented
will be subject to final approval of the Conservation Commission.
15. The pipe arch culverts under Strawberry Hill and Valley Brook
Road should be of 12 gauge asphalt coated galvanized steel and
have a paved invert. The corrugations should be 2 2/31' x "
pipe sizes according to revised run-off computations and plan.-and
profile submitted June 20, 1975 by Bradford Saivetz and Associates,
Inc. on sheet 2 Of 3 and sheet 1 of 3.
Sanitary sewer and force main in Strawberry Hill Road shall be
shown in elevation or profile view prior to placement of culverts;
subject to approval of Conservation Commission and Town Engineer.
16. Lots 71 through 119 inclusive - Valley Brook Road area, as
defined by blue line on Plan: Ridgeview Heights -- Forest Hills

to alleviate water draining onto land of Noel Brown and forming
deep, stagnant pockets of water. Also show footing drain system

18. Brook between Lots 19 and 20, 33 and 34: According to Plan
on Sheet 1 of 3, Bradford Saivetz and Associates, Inc. , Dated:
February 59 1974. In addition: rip-rap will be placed from
property line to head wall on brook bottom. Pipe entrance to
be covered with appropriate grate to prevent debris from entering
culvert. Rip-rap .place at entrance to main channel of brook.
Repair of sidewalks, treebelts, berms and roadway must be made
immediately after installation of culvert.
19. All pipe entrances to main channel will be rip-rapped according
to plan and at approval of Town Engineer.
20. All necessary drainage easements deeded to Town of Agawam.
21. Lots 33 - 36 inclusive, 97 - 105 inclusive: No construction
until necessary engineering plan and profile for construction of
future flood retention area design and placement to be at dis-
cretion of Campanelli, Inc. , subject to final approval of the
Conservation Commission.

not presented to Commission at the time of Continuation. The
Commission has observed flooding problems on land of others
following channelization of brook. Though flooding has not had
serious consequences at this time, the Agawam Conservation
Commission has determined that a flood retention area may be
necessary at such time as Valley Brook Road West and Provin
Mountain Drive Areas are developed in the future. We, there-
fore, order that this retention area be available in- order to
develop this plan to accommodate the additional drainage. The
actual construction of the retention area, (if deemed necessary
upon receipt of plan by the Agawam Conservation Commission) may
be done at such time as the development is extended to the
Valley Brook Road area.
22. This permit covers work on Lots 18 - 32 inclusive, 33• 53 inclusive,
57 - 66 inclusive, 71 - 82 inclusive, 84 - 119 inclusive, 120 -
138 inclusive. It allows no work to be done in any other area
except grading, loam and seeding of Lots 3, 6 - 11 inclusive, 17,
11 - 16 inclusive (cul-de-sac on Valley Brook Road) , 12 - 17
inclusive, Valley Brook Road* the foregoing described on plan
as "approximate:.limit:-,.of disturbed area".
23. Lots 3; 6 - 11 inclusive, 1411 - 16 inclusive, 12 - 17 inclusive,
Valley Brook Road Area must be graded, loamed and seeded with
quick growing ground cover, grass or crownvetch to alleviate
siltation of brook channel.
24. All grading and seeding must be completed by September 15, 1975.
25. All work in main channel of brook done according to Subdivision
.plans entitled Forest Hills Estates - Section II - Revised
Drainage Channel for Solitario Realty Trust by Pharmer Engineer-
ing Corporation. Date - November 15, 1972, and as amended by

In view of the fact that this brook channel has been incomplete
since 1972 contributing to erosion and sediment that has caused
problems for abuttors, The Commission orders all work in main.

remain in natural state.
15 All lots will be loamed and seeded within one month from removal ,

8 Upon c0pletion of the work describM herein, the applicant shall

issued stating that the work has been satisfactorily completed.
9 . A sign shall be displayed at the site not less than two square feet

11 . The work shall conform to the following described plans and
additional condition3.
Proposed Site Drainage - Ramah Circle South - Received April 25, 1977
and Ramah Circle South - Brook to be channeled- Received June 9, 1977.
These Conditions supercede the original Order of Conditions issued
on December 15, 1975.
12. All manholes and catch basins to be constructed on the 36" main
should be at least six (6) foot inside diameter, particAlaxly as
they are to be used for cleaning purposes.
13. As the brook enclosure will stop existing surface drainage from
flowing into the brook, catch basins should be constructed to
collect this surface drainage and lead it to the brook. Elevations
will have to be taken along the southerly gutter , of Washington
Avenue and the easterly gutterline of Ramah Circle South to determine
the location and number of catch basins which will be required.
14. A manhole jor catch basin) should be constructed where the proposed
piping joins the existing culvert under Washington Benue.
15. No storm water runoff from the property should 'be allowed to run
onto the public way unless a catch basin is provided at the point
where the drainage enters the way.
16. Steps should be taken to insure that ,no ,silt from the proposed
construction is carried into the existing culvert under Washington
Avenue as thii culvert is substantially blocked by silt at the
present time.

12. Road will extend from edge of field to brook crossing, nor more than
250' long and no more than 50' wide.
13. Brook crossing will be constructed frith -three (3) 30" pipe abreast at
a length sufficient to support width of road.
14, Road over brook will be stabilized so that no siltation will affect
doi•mstream properties.
15. No fill other than for specified road construction will be allowed .in
wetland.
16. Alteration will be limited to .removal of dead trees and undergrowth
as stated in Letter of Intent.
