Verizon Wireless - r Premises affected: 1804 Main Street Date: January 22, 2007 Case#: 1776 The Agawam Board of Appeals held a public hearing and meeting on Monday,January 22,2007 at the Agawam Public Library Conference Room, 750 Cooper St., Agawam, MA for all parties interested in the appeal of Bell Atlantic Mobile of Massachusetts Corp. Ltd., d.b.a. Verizon Wireless Development, which is seeking to amend a previous Special Permit (Case# 1665, dated October 15, 2001) to replace the existing antennas with new antennas on the existing monopole at the premises identified as 1804 Main Street. After the public hearing and after a thorough review of the facts presented, the Agawam Board of Appeals made the following findings: l. The subject property is located in an area of Town zoned Industrial A. 2. The petitioner wishes to replace six (6) existing antennas with six (6) new antennas of about the same size and design as the existing antennas. 3. The Agawam Planning Board approved the site plan for this proposal on January 4, 2007. 4. The site is an appropriate location for the proposed use and structure. 5. The use, as developed, will not adversely affect the health, safety or property values of the neighborhood. 6. There will be no nuisance or potential hazard to vehicle or pedestrian safety. 7. Adequate and appropriate facilities and controls will be provided for the proper and safe operation of the proposed use. 8. The proposed use is not considered so objectionable or obnoxious that the proposed use would be against the public interest or detrimental or injurious to the character of the neighborhood. 1 Decision(page 2) h Case# 1776 Verizon Wireless Therefore, by a unanimous vote of its three members,the Agawam Board of Appeals grants approval for Verizon Wireless Development to replace the six existing antennas with the six ww antennas with the following conditions: �T'-, cp b 1. The proposed antennas will be constructed as detailed in an informational description X entitled "Panel 90/16dBi; BSA-185090/8, Ante] Manufacturers, Revision Date: 2/21Q3". 2. This decision allows for the replacement of the six (6) existing antennas with six (6,�iewn c antennas. All other conditions in Case#1665,dated October 15,2001, will remain effect. 3. The petitioner shall record with the Hampden County Registry of Deeds, a"Notice of Special Permit" form, which shall be provided by this Board and proof of said filing must be submitted to this Board and to the Inspector of Buildings.. 4. This Special Permit shall become null and void if construction does not commence within two (2)years from the date of this decision. This decision is subject to appeals in accordance with M.G.L. Acting Chairperson Fred Harpin read the legal ad and explained the procedure to be followed. Members sitting on this case were Fred Harpin, Gary Suffriti and Larry Hoague. Attorney Ellen Freyman represented Verizon Wireless. She stated that Verizon Wireless was seeking an amendment to the Special Permit granted a few months ago. The original plans were for a 129 foot tower level and when they were starting construction, it was noted that the tower needed to be at a 137 foot level for the proper elevation. All the plans are the same as on the original permit except for this increase in tower level. Acting Chairperson Harpin made a motion to accept this amendment to the original permit and members Suffriti and Hoague made the vote unanimous. 2. Pride Convenience, Inc., Case#1750 The Agawam Zoning Board of Appeals held a public hearing on April 24, 2006, at 7:00 P.M., at the Library Conference Room, Agawam Public Library, 750 Cooper Street, Agawam,MA, for all parties interested in the appeal of Pride Convenience, Inc. which is seeking a Special Permit in accordance with Section 180-44,Paragraph I which would allow for a"Drive-up Automated Teller Machine"at the premises located at 6 North Westfield Street. Chairperson Prouty stated that the petitioner, Mr. Bolduc requested a continuance to May 8, 2006 at 6:00 P.M. A motion was made by Chairperson Prouty and seconded by member Harpin to continue the hearing. 3. Chairperson Prouty made a motion to go out of sequence and the minutes of March 13, 2006 meeting were approved by member Harpin, member Suffi-iti and member Hoague. 4. Jeffrey E. Smith, Case 41751 The Agawam Zoning Board of Appeals held a public hearing on April 24, 2006, at 7:30 P.M., at the Library Conference Room,Agawam Public Library, 750 Cooper Street,Agawam, MA, for all parties interested in the appeal of Jeffrey E. Smith, who is seeking.a Special Permit in accordance with Section 180-7,Paragraph B2 of the Zoning Ordinances to allow for an addition to a residential dwelling with less than the required front set back located at the premises identified as 207 North West Street. r Page 2 April 24, 2046 Chairperson Prouty read the legal ad and explained the procedure to be followed. Members sitting this case were Doreen Prouty, Fred Harpin and Gary Suffi iti. Mr. &Mrs. Jeffrey Smith, the petitioners were present to submit their plans to the Board. When they purchased this house they had plans to build an addition to expand the house sideways. They have plans to demolish existing residence leaving the foundation and deck and rebuild house. They plan on doing their own renovations. Their architect, Mr. Frasco of Main Street, Agawam was present. Chairperson Prouty questioned on the ability of the septic system to handle this expansion and Mr. Smith stated the former owners had updated the septic system. Chairperson Prouty read into the record two letters received from residents in favor of this addition. The letters were from Mr. Einzig and Mr. Tassinari. Chairperson Prouty closed the public hearing at 7:45 and the Board went into a public meeting. Chairperson Prouty made a motion to approve this Special Permit and it was seconded by Member Suffriti. Chairperson Prouty explained the 20 day appeal process. 3. Chairperson Prouty asked if there was any other business to come before the Board. There was none. They will use an existing location antenna now 150 feet high. Verizon will add 12'x30'equipment shelter with an emergency generator. Their proposed addition would be triangular with installation of 12 panels of power density. All abutters were notified and no one appeared. This would benefit the town by adding service to more users. Coverage would provide better service to Route 57 and Route 147_ Member Suffriti questioned a picture of this unit being installed. Alex Dystrempko, engineer, explained it would be the same unit with six (6) more panels. it would be a 12xl2 triangle with antennas bolted to the mount being four(4) feet high. Member Conte questioned dimensions on this mount triangle and was told it would be 12 feet (12') long, four feet (4') tall with fourteen inch (14") wide antenna, with pipe mount coming up from triangular mount. Mr.Conte questioned if it was a flat pipe and the engineer was not sure. Member Conte and member Suffriti want to see actual pictures of what the mount would look like and requested a picture be sent to the Building Department. They were willing to give approval with stipulation that more evidence of the design would be submitted. Chairperson Prouty read the legal notice and explained the procedure to be followed. She then introduced the sitting members on this case: Doreen Prouty, Gary Suffriti, and Joseph Conte. Representing the petitioner was Jennifer Young Gaudett. She explained they proposed to add six (6) antennas within the steeple, replace Iouvers on the steeple with fiberglass material and would install separate equipment shelter in parking lot at a place designated by the church. They are seeking this area to extend customer service to Route 57 and Route 159. The petitioner went to the Planning Board with suggestion placing stockade fence around equipment shelter,but Nextel would be happy to install whatever facade governmental board requires or wants. In keeping with regulations, this antenna addition would not be visibly seen because they are using current building structure. Member Conte stated the choice of fence would be theirs just consult with church as to wha ` hey want. Mr. Conte questioned if independent consultant report had been done and petitioner said no. One abutter Diane Yvon, 89 Independence Road, questioned aesthetic behind parking lot-as U, her lot abuts the property and asked if radio waves would effect such items as garage door Un r-. openers. She was advised they would not. N Chairperson Prouty stated that the Planning Board stated there was evidence that this steeple was capable to hold weight of this project. Chairperson Prouty advised the petitioner they would need an independent consultant's opinion as stated in by-laws and would reschedule the public hearing to November 28, 2005 and 6:30 P.M. Chairperson Prouty made a motion and it was seconded by member Conte to continue the public hearing to this date. All were in favor,none opposed. In addressing public concerns, the ability to provide new or improved quality cellular and PCS service in the Agawam community is expected to enhance safety and the general welfare of the area residents. The public safety benefits of cellular and 2 PCS service are numerous and include safety, security and peace of mind of the public knowing they can call in emergencies, and to keep in touch with their families . Today, Verizon Wireless, alone, has more than 43 million customers using wireless phones . Most of the cellular users say they purchased their phones for safety and security reasons . In numerous surveys, wireless phone users have said they had used their phones to report car trouble, a medical emergency, crime or drunken drivers . The value of the wireless phones for highway travelers has been endorsed by the American Automobile Foundation, the National Safety Council and Mothers Against Drunk Driving. Mobile and portable phones are used for business and personal reasons. Emergency personnel such as police and fire departments and ambulance companies use cellular phones to respond more quickly which helps to save lives each day and to help fight crime and violence both in the inner cities and suburbs . Verizon Wireless submits that the public need for high quality mobile and portable telephone service and data transmission, and a competitive framework for such service, has been determined by the FCC to be in the best interest for the Agawam area, and that such public need far outweighs any perceived environmental effects of the proposed change to the existing facility. The Agawam Zoning Board of Appeals has the authority to grant a Special Permit for this Major Modification to the Existing Facility. Verizon Wireless contends that the granting of this permit is in harmony with the convenience, welfare, and general purpose and intent of the Zoning Bylaw. The utilization of an existing structure will eliminate the need to construct a new tower in Agawam and will be in keeping with the intent of the Zoning Bylaw. It will also enable Verizon Wireless to provide quality, state-of-the-art wireless coverage to the general public as its requests and expects . Attorney Douglas Wilkins, representing the petitioner stated that their application was pretty straight forward. They want to change the current flesh mount antenna and extend three. Attorney Wilkins stated Cingular and AT&T have merged and want to provide better coverage to customers, and they are seeking a Special Permit for a modification of the existing facility to accommodate this merger. Cleric Conte commended the petitioners on the information submitted to the Board that it contained all pertinent information. Attorney Ellen Freyman, represented the petitioner, who is seeking a Special Permit to alter a pre-existing, non-conforming panel, and to change the three existing antenna panels, and erect three additional antenna panels, on an existing telecommunication tower,at 591 North West Street. The purpose of this modification is to upgrade current customer service. Verizon is in the process of upgrading any equipment that is three years old. After the public hearing, and after a thorough review of the facts presented,the Agawam Board of Appeals made the following findings: 1. The subject property is located in an area of Town zoned Agricultural. 2. The subject property has received 2 previous Special Permits: Case#1551, dated December 2, 1997 and Case#1533, dated March 5, 1997. 3. The petitioner wishes to remove three(3) of its existing cellular antennas and replace them with six (6)PC antennas for a total of fifteen(15) antennas. 4. There was no opposition expressed at the public hearing nor received in writing by this Board. 5. The proposed replacements will not have an undue adverse impact on historic resources, scenic views, residential property values, natural or man-made resources. 6. The proposed replacements shall comply with FCC 96-326 and any and all other applicable FCC regulations regarding emissions of electromagnetic radiation and a monitoring program is in place. 7. The Board has found that the subject property is an appropriate location for such a use. 8. The Board has found that the use as developed will not adversely affect the health, safety and property values of the neighborhood. 9. The Board has found that there will be no nuisance or potential hazard to vehicle or pedestrian safety. 10. The Board has found that adequate and appropriate facilities and controls will be provided for the proper and safe operation of the proposed use. Bell Atlantic Mobile of Massachusetts Corporation, Ltd. dba Verizon Wireless Premises affected: 850 South Westfield Street Date: April 24, 2006 Case #: 1749 The Agawam Board of Appeals conducted a public hearing and meeting on April 24, 2006,at the Library Conference Room, Agawam Public Library, 750 Cooper Street, Agawam, MA, for all parties interested in the appeal of Sell Atlantic Mobile of Massachusetts Corporation, Ltd. dba Verizon Wireless, which is seeking a Special Permit in accordance with Sections 180-90 through 180-103 of the Zoning Ordinances, which would allow for the installation of wireless communication antennas and equipment to an existing tower at the premises commonly known as Oak Ridge Golf Course and identified as 850 South Westfield Street. After the public hearing, and after a thorough review of the facts presented, the Agawam Board of Appeals made the following findings: 1. The subject property is located in an area of Town zoned Agricultural. 2. The subject property has received 4 previous Special Permits: Case#1741, dated October 24, 2005, Case #1736, dated June 27, 2005, Case #1717, dated June 14, 2004, and Case #1691, dated May 12, 2003. 3. The petitioner is seeking to amend the last previously granted Special Permit, Case #1741, dated October 24, 2005 4. The new plans show a revised antenna height of one hundred thirty-seven (13T) feet, which is eight(8) feet higher than the previously granted antenna height of one hundred twenty-nine (129') feet. 5. There was no opposition expressed at the public hearing nor received in writing by this Board. 6. The proposed replacements will not have an undue adverse impact on historic resources, scenic views, residential property values, natural or man-made resources. 7. The proposed replacements shall comply with FCC 96-326 and any and all other applicable FCC regulations regarding emissions of electromagnetic radiation and a monitoring program is in place. 8. The Board has found that the subject property is an appropriate location for such a use. 9. The Board has found that the use as developed will not adversely affect the health, safety and property values of the neighborhood. 10. The Board has found that there will be no nuisance or potential hazard to vehicle or pedestrian safety. 11. As per- the plans and specifications submitted, the six (6) new antennas (three (3) replacement and three (3) additional) will each be forty-eight (48) inches in length, three and one- half (3 . 5) inches in width and seven (7) inches in depth. The PCS antenna specification sheet is attached to this application. A structural report has been prepared and is included. As shown on the enclosed plan, the antennas will be mounted at the same height as the existing antennas . No additional equipment is necessary. The proposed wireless telecommunications antennas meet the goals outlined in the Town' s Zoning Bylaw. Verizon Wireless is not constructing a new tower. By locating the additional antennas on an existing tower, the construction of a new tower in Town is eliminated. A new tower would have far greater visible impact on the community and could not be camouflaged from public view. In addressing public concerns, the ability to provide new or improved quality cellular and PCS service in the Agawam community is expected to enhance safety and the general welfare of the area residents. The public safety benefits of cellular and PCS service are numerous and include safety, security and peace of mind of the public knowing they can call in emergencies, and to keep in touch with their families . Today, Verizon Wireless, alone, has more than 43 million customers using wireless phones. Most of the cellular users say they purchased their phones for safety and security reasons . In numerous surveys, wireless phone users have said they had used their phones to report car trouble, a medical emergency, crime or drunken drivers . The value of the wireless phones for highway travelers has been endorsed by the American Automobile Foundation, the National Safety Council and Mothers Against Drunk Driving. Mobile and portable phones are used for business and personal reasons. Emergency personnel such as police and fire departments and ambulance companies use cellular phones to respond more quickly which helps to save lives each day and to help fight crime and violence both in the inner cities and suburbs. Verizon Wireless submits that the public need for high quality mobile and portable telephone service and data transmission, and a competitive framework for such service, has been determined by the FCC to be in the best interest for the Longmeadow area, and that such public need far outweighs any perceived environmental effects of the proposed change to the existing facility. The Agawam Zoning Board of Appeals has the 3 authority to grant a Special Permit for this minor modification to the existing facility. Verizon Wireless contends that the granting of, this permit is in harmony with the convenience, welfare, and general purpose and intent of the Zoning Bylaw. The utilization of an existing structure will eliminate the need to construct a new tower in Agawam and will be in keeping with the intent of the Zoning Bylaw. It will also enable Verizon Wireless to provide quality, state-of- the-art wireless coverage to the general public as its requests and expects .
