Nextel Communication - Case#1761 Chairperson Prouty reopened this public hearing at 6:OOPM . Sitting on this case was Dore Prouty,Fred Harpin and Joseph Conte. Nextel representative Theresa Viele telephoned she-0Aas , held up in traffic and would be a few minutes late. Members agreed to postpone the hearin itrl- Ms. Viele appeared. 'c- n Chairperson Prouty reopened the public hearing at 6:20PM. ¢ ca cl, Ms. Viele explained that Nextel has met with WMECQ and they have agreed to relocate th2site to a site that has a tower for Sprint on it and wanted to know the procedure for changing the site of this proposed permit. Chairperson Prouty explained that Ms. Viel would have to withdraw the previous application and reapply for a new permit on the new site for this antenna. Abutters Mr. &Mrs. Defillipi are still objecting on the location of this antenna as it will be added to an existing WMECO antenna in their backyard and asked if the board can deny this permit. The Board explained that if Nextel has met all the requirements_ of the FAA by-law the Zoning Board of Appeals cannot deny this permit. Chairperson Prouty stated that the consultant used by this board,Dave Maxson is presented with all the application information and agreed that this area of Town is the best location for this Nextel permit. Chairperson Prouty advised Ms. Viele that she will receive the Notice of Withdrawal. Members Prouty, Harpin, and Conte voted unanimously to allow the petitioner to withdraw without prejudice. Chairperson Prouty closed this public hearing at 6:35PM. 2. South Agawam Storage; Case 91771 Chairperson Prouty reopened this public hearing at 6:40PM. Chairperson Prouty read into the record a letter requesting to withdraw this application. Chairperson Prouty made the motion to allow the petitioner to withdraw without prejudice. Members Prouty, Conte and Hatpin voted unanimously to allow the petitioner to withdraw without prejudice. Chairperson Prouty closed this hearing at 6:45 PM. . Sitting on this case was Prouty, Harpin and Conte. Chairperson Prouty read into the record a request from Nextel requesting a 45 day extension. They have tried to meet with WMECO to see if a different location could be possible for their request. Chairperson Prouty made the motion to accept the extension from Nextel and was seconded by Harpin, Conte made the vote unanimous. They agreed to continue this public hearing to January 8,2007 at 6:OOPM. 2. Booth- Case#173 The Public Hearing was opened at 6:3OPM and Chairperson Prouty read the Public Notice. Sitting on this petition were Conte, Harpin and Prouty. Mrs. Booth of 37 Holland Drive spoke regarding their Dome they purchased nine years ago which had an in-law apartment. At that time they had to come to the ZBA for a special permit. Her - question to the Board is if they sell their house can it stay as an in-law apartment or what changes do they have to do to sell the premises. Clerk Conte stated that this use was originally allowed because it was a pre-recorded sub division and this non conforming use was allowed as part of this sub division. He recommended that this be treated as a legal non conforming use and in order to do this the apartment would need two means of egress. It currently has a back door and Mr. Conte recommended that a front entrance be installed and this structure would be allowed to continue use as a single family dwelling with an in-law apartment. By adding this means of egress this dwelling would comply with all the state laws. Joseph Mineo,33 Maple Meadows Lane spoke in favor of this permit. Chairperson Prouty closed the public hearing and the board went into a public meeting. Chairperson Prouty made the motion to grant this permit subject to compliance with all the building codes. Conte seconded and Harpin voted unanimously to approve. M1 3. Fallon - Case 41772 Chairperson Prouty opened the public hearing at 7:1 OPM and read into the record the public notice on this permit. Sitting on this case were Prouty, Harpin and Conte. Mr. Fallon stated his request to enclose the existing front porch,keeping the existing roof, maintain the existing front door and add a small addition in the rear of 747 North West St. Mr. & Mrs. Hobarcha, 761 North West St. spoke in favor of this permit. Chairperson Prouty closed the public hearing and the board went into a public meeting. Chairperson Prouty stated this was a simple case and made the motion io accept this petition Harpin seconded, and Conte voted unanimously. 4. The Federal - Case#1734 Chairperson Prouty reopened the public hearing at 7:30PM. Sitting on this case were Prouty, Conte, and Suffriti. Chairperson Prouty made the motion to accept the settlement agreement Conte seconded,and Suffriti voted unanimously. 5. Minutes of December 11, 2006 were approved. 6. Nextel is a Federal Communications Commission(FCC) licensed provider of digital wireless telecommunication services. Nextel provides specialized mobile radio services (SMRS)by combining traditional mobile telephone, paging, messaging and dispatch services in a single handset. Through this handset, customers communicate across a network of wireless facilities operated by Nextel. Nextel's SMR service is an alternative to and a functional equivalent of cellular and personal communications services. Nextel has entered into an agreement with Northeast Utilities dba Western Mass.Electric Power Company and is hereby applying for a Special Permit and Site Plan approval from the Zoning Board of Appeals in order to construct a wireless telecommunications facility on the premises located at 168 Maple Avenue in the Town of Agawam,MA By constructing a facility at the site, Nextel seeks to provide reliable wireless telecommunications service in the primary residential and business districts of the Town of Agawam. PROPOSED WIRELESS FACILM The premises are located on 2.9 acre parcel of land which is part of Western Mass. Electric's existing power grid. The proposed facility is a power mount which will be constructed entirely within the existing power company structure. The equipments 100 Corporate Place, 3rd Floor Rocky Hill, CT 05067 Tel 860 436 6026 necessary to run the site will be place in a 12 by 20 foot shelter located at the base of the tower. Appropriate screening from the abutting properties will be provided_ The antennas will be mounted in the areas designated on the plans Sheet Z-03. There will be 3 sectors of four antennas each. The antennas will be mounted on steel frames designed to support this type of antenna. In addition there will be 4 GPS antennas mounted in an unobtrusive place to assist in the operation of the facility and to enable Nextel to comply with FCC requirements concerning E-911 automatic location identification. NEXTEL'S FCC LICENSE Nextel is licensed by the FCC to provide wireless telecommunications services throughout the State of Connecticut, including Fairfield County.Nextel's license requires it to complete the construction and build out of its wireless network in its federally licensed areas, which include the Town of Agawam. There is a public need for wireless telecommunications services, as evidenced by the granting of a license to Nextel by the FCC. This grant constitutes a finding that the public interest will be served by Nextel's services and is consistent with the public policy of the United States"to make available so far as is possible, to all the people of the United States... a rapid, efficient, nationwide and worldwide wire and radio communications service with adequate facilities at reasonable charges, for the purpose of national defense, for the purpose of promoting safety of life and property through the use of wire and radio communication." 47 U.S_C Section 151_ Nextel's other existing sites in and around the Town of Agawam are unable to provide reliable service coverage and capacity in and around this portion of the Town. See attached Radio Frequency Affidavit. The usage in the vicinity of the proposed site exceeds the available capacity, resulting in degraded and dropped calls. By locating its antennas on an existing structure and in an area where other carriers have located,Nextel will be able to handle the high usage demand in the vicinity of the site, and provide reliable service in the least intrusive manner to its customers living, traveling and working in the Town of Agawam, and thereby comply with its FCC license requirements as well as other FCC rules and regulations governing wireless facilities. Moreover, by co- locating its equipment in an existing structure, Nextel can fulfill its FCC licensing obligations while obviating the need to build a new tower in this portion of the Town. CONFORMANCE WITH THE ZONING REGULATIONS OF THE TOWN OF TRUNIBULL The Town of Agawam Zoning Regulations classifies the premises as being in the Business BE Zone and the Wireless Telecommunications Overlay Zone. Pursuant to Section 180-94 of the Zoning Regulations, wireless telecommunications facilities are permitted uses in the overlay zoning district, subject to the granting of a Special Permit approval from the Town of Agawam Zoning Board of Appeals. a s The Town of Agawam Wireless Regulations provides for location preference guidelines for the siting of telecommunications facilities in the Town. Under Section 180- 97 the co-location of a wireless telecommunications facility in or on an existing structure, such as the one proposed by Nextel, is of the highest priority. Nextel respectfully submits that its proposed wireless telecommunications facility complies with all of the conditions and requirements for the granting of a Special Permit and conforms to the purpose and intent of the Agawam Zoning Regulations. Nextel's proposed facility fully complies with all applicable bulk and dimensional limitations_ Nextel's antennas are proposed at the minimum Height necessary to provide the required service and are on an existing structure. In addition, Nextel's equipment shelter is on the premises immediately next to the existing tower and will not appreciably change the character of the area. It is also respectfully submitted that approval of Nextel's wireless facility is consistent with other approved wireless facilities in this building and in the surrounding area and with the procedural and substantive requirements set forth in the Communications Act of 1934, as amended by the Telecommunications Act of 1996, and the FCC's rules and regulations. In fact Sprint is located on the next tower to the southeast of this structure. It is noteworthy that Nextel's proposed facility will not generate adverse traffic because it is unmanned and only requires periodic maintenance visits by a service technician. During these routine visits, the technician will use existing on site parking. The site will be monitored by Nextel 24 hours per day and 7 days per week from an offsite location. The site will have no impact on pedestrian or vehicular traffic. Nextel's facility does not and will not emanate any discernable smoke, gas, dust or other air contaminants, noise, odors or vibrations. No commercial signs are propose and the facility will not create any additional storm water runoff or require outdoor storage and/or solid waste receptacles, nor does it require any outdoor lighting_ Moreover, Nextel has and will comply with all FCC regulations concerning RF emmissions. Based on the materials submitted, Nextel respectfully submits that its proposed wireless facility will be totally unobtrusive and will have minimal, if any, impact on the existing character of the surrounding neighborhood. Attorney Jen Young Gaudet representing the petitioner Nextel arrived at 6:35 P.M. Chairperson Prouty explained that the request for this application had been sent to David Maxon, Broadcast Signal Lab for review and recommendation. Upon review of this application,Mr. Maxon's report stated that everything in the proposed facility would be sensitive to the community and had no contradictions. Chairperson Prouty closed the public hearing at 6:41 P.M. and the Board went directly into a public meeting. Chairperson Prouty stated there was no reason to question the application and made a motion to accept this request. LRB Realty Trust, LLC, Case#1740 The Agawam Zoning Board of Appeals re-opened a public hearing on November 28, 2005, at 7:00 P.M., at the Library Conference Room, Agawam Public Library, 750 Cooper Street, Agawam,MA, for all parties interested in the appeal of LRB Realty Trust, LLC, which is seeking a Special Permit in accordance with Section 180-44 Paragraph H, of the Zoning Ordinances which would allow for the creation of a Dunkin Donuts restaurant with a drive-thru service window at the premises identified as 1804 Main Street. There was no one present for the petitioners. Member Conte stated he asked the Planning Board of on update on this petition and was told the petitioners had a long way to go before their plans could be approved. Chairperson Prouty stated that the Board must make a decision by the December 11, 2005 deadline. Members went into a public meeting at 7:05 P.M. Chairperson Prouty stated that since the petitioners did not appear, send any correspondence to the Board, provide the Board with the letter from the owner of the property Mr. Gardner(which the Board had requested), has not met approval of the Planning Board or Conservation Commission, that the Board of Appeals must deny this application. The Board went over another draft of the proposed rules and regulations changes and Chairperson Prouty asked all members to review in order to vote on the acceptance of these at the December 12, 2005 meeting. 4. Proper procedures for applications for the Board of Appeals were discussed. All applications for a Special Permit should be submitted to the Building Inspector for his review and recommendations. The Building Inspector should determine that the application is appropriately filled out and then initial all applications indicating that the petitioner has applied for the correct permit. The application will then be submitted to the Board of Appeals for their review and then submitted to Planning and Conservation and other appropriated departments. This process is necessary to make sure all petitioners have filed for the correct zoning permit. Page 3 November 28, 2005 5. Chairperson Prouty stated that the December 12,2005 meeting will be a public hearing at 6:30 t P.M. for the construction of a house in a flood plain and 7:00 P.M. will be Commonwealth Communities. 6. The approximately eleven foot (I P)by twenty foot(20) equipment shed is to be completely enclosed. 4. There was no opposition expressed at the public hearing nor received in writing by this Board. 5. The proposed facility will not have an undue adverse impact on historic resources, scenic views, residential property values, natural or man-made resources, 6. The proposed facility shall comply with FCC 96-326 and any and all other applicable FCC regulations regarding emissions of electromagnetic radiation and a monitoring program is in place. 7. The Board has found that the subject property is an appropriate location for such a use. 8. Representing the petitioner was Attorney Ellen Freyman, Alex Dystrempko and Sandy Carter. Attorney Freyman explained this permit would allow for broader coverage. They will use an existing location antenna now 150 feet high. Verizon will add 12'x30' equipment shelter with an emergency generator. Their proposed addition would be triangular with installation of 12 panels of power density. All abutters were notified and no one appeared. This would benefit the town by adding service to more users. Coverage would provide better service to Route 57 and Route 147. Member Suffriti questioned a picture of this unit being installed. Alex Dystrempko, engineer, explained it would be the same unit with six (6) more panels. It would be a 12x12 triangle with antennas bolted to the mount being four(4) feet high. Member Conte questioned dimensions on this mount triangle and was told it would be 12-feet (12') long, four feet(T)tall with fourteen inch (14") wide antenna, with pipe mount coming up from triangular mount. Mr. Conte questioned if it was a flat pipe and the engineer was not sure. Member Conte and member Suffriti want to see actual pictures of what the mount would look like and requested a picture be sent to the Building Department. They were willing to give approval with stipulation that more evidence of the design would be submitted. In keeping with regulations, this antenna addition would not be visibly seen because they are using current building structure. One abutter Diane Yvon, 89 Independence Road, questioned aesthetic behind parking logs her lot abuts the property and asked if radio waves would effect such items as garage door ` �. openers. Introduction Nextel Communications of the Mid-Atlantic, Inc., d/b/a Nextel Communications ("Nextel"or the"Applicant") respectfully submits this memorandum in support of its application for a special permit pursuant to Article XIV of the Town of Agawam Zoning Ordinance (`By-law")to co-locate a wireless telecommunication facility(the "Facility") at the Valley Community Church, 152 South Westfield Street in the Feeding Hills section of Agawam (the"Property"). The Property, designated as Map ES, Block 1,Lot 19, is owned by the Valley Community Church, Inc. The Applicant is a Delaware corporation licensed by the Federal Communications Commission("FCC")to provide wireless telecommunications service throughout Hampden County. II. The Proposed Site The Property at 152 South Westfield Street is an approximately 23 acre parcel. A strip of land along South Westfield Street is zoned Residence A-2; the remainder of the parcel, including the area in which the proposed Facility would be located, is within the Agriculture Zone. The Property is not among those designated as the Wireless Telecommunications Overlay District. A church, parsonage, theater and two outbuildings owned and used by the church are on the property. The proposed Facility will utilize the church building itself and a portion of the paved parking lot. Nextel is proposing to install antennas within the existing steeple and to place its related equipment in a communications equipment shelter set in a corner of the existing paved parking lot. Coaxial cables will run underground from the shelter to the church building,then up the side of the church and through the fascia into the church and the interior of the steeple. Exposed cables on the side of the church will be concealed by a cable tray painted to match the church's exterior siding. Existing vehicular access and parking facilities would be used by Nextel. As shown on the plans prepared by Vertical Resources Group and submitted with the application as Exhibit 1, six panel antennas will be mounted inside the existing steeple. The louvers in the steeple will be replaced with identical louvers fabricated of "stealth"materials, i.e., fiberglass or similar material that allows the transmission and reception of radio signals. Also as shown in Exhibit 1,an equipment shelter approximately 11 1/x' x 20', will be placed in a corner of the parking lot. Two small GP receive-only antennas will be mounted to the shelter, extending approximately 2' above the shelter roof. III. Need and Site Selection Nextel is continuing to develop and expand its communications system in Massachusetts and specifically in the Agawam area. Nextel has identified a need for additional coverage in the Feeding Hills area, particularly along Route 57 and 187. Consistent with the Town's By-law,the Applicant seeks first to provide adequate service to its customers by placing its antennas on towers or other existing structures. No existing towers are located within or in close proximity to the target search area at the junction of Routes 57 and 187. As detailed herein,Nextel has identified an existing building on a large property that will allow for development of a wireless service facility without any impact on its surroundings. 2 Propagation plots depicting existing and proposed coverage in the Agawam area are included as Exhibit 2. Nextel's propagation plots depict coverage from sites within an approximate radius of six miles from the proposed site, rather than sites (Nextel's and others') within eight miles of the Agawam border. Nextel submits that the radius shown is appropriate in this instance, in that Nextel's existing system includes a number of sites between the outer limits of an eight mile radius and the proposed site. Therefore, use or modification of such sites would have no effect on the existing coverage gap and need for the proposed Facility. The first plot within Exhibit 2 is a map showing Nextel's coverage without the proposed site. That propagation plot indicates an area that currently experiences less than —95 dbm signal level. That map also depicts the existing network in the surrounding area. A list of the existing and proposed sites depicted on the plot is also included in Exhibit 2, and represents significant use of co-location on existing towers and structures. In addition,Nextel maximizes the performance of individual sites and the system as a whole by implementing technological refinements as they become available. Repeaters would not be a technologically appropriate solution for the existing coverage gap along Routes 57 and 187; repeaters are low power devices typically used to provide coverage to a small area or an area of inadequate coverage within an otherwise acceptable coverage area. The second propagation plot in Exhibit 2 shows the predicted coverage from the proposed site. This propagation map shows that the proposed site will result in adequate coverage to the heavily traveled target area along and surrounding Routes 57 and 187. 3 The last propagation plot in Exhibit 2 shows the predicted composite coverage from the proposed Facility and surrounding sites. In general,properly located sites will provide Nextel's customers with a high level of wireless service while minimizing the number of facilities required overall. As shown, the proposed site, in conjunction with existing and approved sites in Agawam and surrounding towns, will allow Nextel to provide its customers a high level of service, with minimal impact on the community. IV. Analysis As demonstrated through this narrative, plans and additional documentation, the proposed Facility fully complies with the language and spirit of Article XIV. The proposed Facility is allowed by special permit, pursuant to Section 180-94.A of the By- law. The co-located Facility will expand the availability of wireless service facilities within Agawam without any adverse effect on the community. The specific standards of review set forth in Section 180-99 of the By-law are addressed below. (1) The proposed personal wireless service Facility is within a zoning district in which a building-mounted facility is allowed by special permit,pursuant to Section 180- 94.A of the By-law. (2) As demonstrated in Section II above and in Exhibit 2, the Applicant is not able to use existing towers or facility sites in or around Agawam to provide adequate coverage and capacity to the existing coverage gap. Likewise, repeaters do not provide a solution to the existing coverage gap. Nextel submits, however, that its proposed use of an existing building with no visual impact is consistent with the requirement to use existing sites or otherwise to minimize the impact of proposed sites. 4 (3) The proposed Facility will have no effect on historic resources, scenic views, residential property values,or natural or man-made resources. On behalf of Nextel, EBI Consulting has prepared a National Environmental Policy Act Screening Report (included as Exhibit 3), which confirms that there will be no adverse impact from the proposed Facility on any of the criteria outlined in the National Environmental Policy Act. No portion of the proposed Facility will be visible from outside the Valley Community Church property,and no other impacts will be experienced. The Facility will not generate noise or odors. The proposed Facility will be unmanned and will not require water, sewer, drainage or other public facilities. There will be no impact on pedestrian or vehicular traffic from the proposed Facility;a service technician will visit the site approximately once per month for routine maintenance. (4) The Applicant has proposed a Facility in which the visual impact of the antenna structure is fully mitigated. Nextel's antennas will be fully concealed in the Valley Community Church steeple. Coaxial cables that are not underground will be concealed by a cable tray painted to match the existing church siding. The proposed equipment shelter will be set in a corner of the church parking lot in an area acceptable to the Church. Bollards will be installed on two sides for safety purposes. In order to minimize excavation and loss of parking spaces,no landscaping is proposed immediately around the shelter. Significant natural vegetation will screen any view of the shelter from off--site. (5) Exhibit 4 includes a calculation of electromagnetic radio frequency power density performed in compliance with applicable Federal Communications Commission 5 regulations. The calculation demonstrates that the proposed Facility will comply fully with the applicable Federal Communications Commission standards for radio frequency emissions. The Applicant represents that it will comply fully with monitoring requirements of the Town of Agawam. IV. Conclusion As stated above and shown in the attached exhibits,Nextel has demonstrated a need for a wireless telecommunications facility at 152 South Westfield Street in Feeding Hills. Consistent with the intent of the By-law, the proposed Facility makes use of an existing structure and fully mitigates any adverse visual impact. The antennas will be fully concealed, and the equipment shelter will not be visible from surrounding properties. In keeping with the By-law's purposes, as set forth in Section 180-90 the P g Y Pm'P > proposed Facility will preserve the character and appearance of the community while simultaneously allowing adequate personal wireless services to be developed. There will be no effect on the scenic, historic, environmental and natural or man-made resources of the community,and no effect on property values. Availability of expanded wireless communications, including E911 capability,will enhance the public safety and welfare. The purpose of this Report is to evaluate the above-referenced property for environmental and historical concerns specified by the Federal Communications Commission (FCC) in 47 CFR 1.1307, the Nextel Communications Scope of Work dated January 1,2002,and general industry standards. The Subject Property, known as MA5745AlJohnson Corner, consists of an approximately 22.93 acre lot that is-predominantly undeveloped woodland unproved with five structures. A church building, built in 1965, is located on the central portion of the Subject Property. A residential dwelling (parsonage) with two associated outbuildings,built circa 1930, are located on the northern portion of the Subject Property. A theatre building,built in 1978,is located on the northeastern portion of the Subject Property. As of the date of this Report, Nextel Communications proposes to collocate its antennae on the existing church steeple, which is currently owned by Valley Community Church. Additionally, Nextel Communications proposes to place a prefabricated shelter on the ground in the adjacent parking lot for the storage of telecommunications support equipment. Please find the attached National Environmental Policy Act (NEPA) Checklist,NEPA Summary Report, and associated documentation for the above referenced site. According to Mr. Brad Fuller, Chairperson of the Valley Community Church and Agawam Building Department records, the existing church currently proposed to be occupied by Nextel Communications was constructed between 1965 and 1967. A review of the Massachusetts Historical Commission (MHC) records indicates that no National or State Register historic districts are located within a 250-foot area of potential effect (APE)of the proposed project site. In summary, the proposed action at the above-referenced property was determined to meet the conditions set forth in Stipulation VA of the National Programmatic Agreement for Collocation of Wireless Antennas (NPA). Therefore, the collocation is recognized to have minimal or no adverse effects on historic properties and review of the collocation under the consultation process set forth under Subpart B of 36 CFR Part 800 is not required. According to the PA,the licensee has properly taken into account the effects of their action on historic properties and has fulfilled its Section 106 compliance responsibilities. As such, the collocation requires no further environmental processing under Section 1.1307(a)(4)of the FCC Rules. If aM questions were answered "Yes": The collocation does not meet the stipulations set forth in the NPA. Therefore, consultation with the applicable SHPO is re uired in accordance with Section 106 of the National Historic Preservation Act and its implementing regulations, 36 CFR Part 800 (i.e., written determination/concurrence that no historic resources will be affected by the collocation is required from the SHPO).
