1. PUBLIC HEARING CONT. —Notice of Intent�-�-Wright Street—Nardi '�
Motion was made by Ms. Messick and seconded by Ms. Galiatsos to continue the public
hearing for the Notice of Intent for Nardi on Wright Street to the next meeting as
requested by the applicant's representative.

2. PUBLIC HEARING CONT. —Notice of Intent—River Road —Kanegsberg
Jon Goddard of R. Levesque Associates was in attendance to present this Notice of Intent
as well as Mrs. Kanegsberg. Mr. Goddard stated that the original Notice of Intent that
was filed was for an addition to the existing home and garage. The applicants have now
decided to demolish both buildings and rebuild on the site. He went on to say that the
DEP comments have been addressed and he has provided the Commission with a revised
NOI narrative, plan and updated filing fee.. He stated that this is now filed as a
redevelopment project which will require mitigation and improvements. He provided the
Commission this evening with a copy of the letter he received from NHESP stating that
the project is exempt. He explained to the Commission that the existing home is 750 SF
and the proposed new home is 986 SF. He stated that as was discussed at the
Commission's site visit,proposed mitigation involves the removal of invasive species
from the entire bank and improvements to the site shall include the removal of debris
from the tow of the bank to the River. He stated that no excavation is proposed and this
work will be done by hand. There was discussion regarding whether off-site mitigation
could be provided somewhere else on the River(i.e. plantings at Pynchon Point). Ms.
Messick stated that she feels the proposed mitigation is sufficient and off-site mitigation
is not necessary. Mr. Kozloski was concerned with the silt fence placement and in

CORRESPONDENCES—The Commission received a request today from Jay Snow,
President of Silver Lake Corp. He is requesting permission to lower the level of Silver
Lake by approximately one foot in advance of the upcoming hurricane this weekend.
Motion was made by Ms. Messick and seconded by Ms. Galiatsos to issue an Emergency
Order to Silver Lake Corp. allowing for work to start August 25 and to be completed by
August 28th. Work allowed includes the removal of boards to lower the level of Silver
Lake by approximately one foot of its current level; all removed boards are to be replaced
by the evening of August 27th or prior to the commencement of heavy rain as predicted.

ENFORCEMENT ORDER UPDATES
There was nothing new to report on the outstanding Enforcement Orders, Ms. Kozloski
stated that the Main Street site owned by Drenzek has re-vegetated and the Enforcement
Order could be lifted based on are on-site by a Commission member.
Motion was made by Ms. Messick and seconded by Ms. Becker to lift the Enforcement
Order issued to Drenzek on Main Street based on a favorable site inspection by a
Commission member.

4. APRPOVAL OF MINUTES —July 28, 2011
Motion was made by Ms. Messick and seconded by Ms. Becker to approve the minutes
of July 28, 2011 as written.

Engineering recently inspected the above referenced subdivision and has the following comments:
1. The home owner at 41 Alice Eane (LoN) has installed the HMA top course for the existing driveway,
curb returns and driveway apron. The sidewalk .for this Lot 4 is in good condition. -
2. 'While visiting the subdivision, Engineering noticed that several other sidewalk panels have cracked: (see
attached photos)
a. Two panels at western curb cut of intersection School Street and Alice Lane.
b. Two panels at northeast corner of Lot 1.
c. Four panels with hairline cracks in front of Lot 5 (driveway and near hydrant).
3. Engineering received a phone call from the owner of Lot 1 (193 School St, Agawam, MA) on Monday,
June 27, 2011. He clams that since his Lot is part of the subdivision he should have 2 shade trees
planted in his yard by the developer. (See attached photos of Lot 1 which shows the tress/bushes that
the owner planted himself}

and we note the following:
1. As per our memo to the Conservation Commission dated January 22, 2009. "The
original site plan and stormwater calculations were designed and approved for pre and
post construction conditions for the entire site based on a 30,000 SF building addition
and parking lot expansion. The 2009 proposal calls for only a 10,000 5F expansion of
the building and parking lot. Therefore, the original detention pond and drainage system
design should be more than adequate for this recent submittal."
2. The new concrete access ramp detail should show how the adjoining existing island is
to be (ncorporated into the ramp's design. The proposed ramp detail appears to have
the right side wing panel constructed into part of the island. The left side of the island
lines up with the right side of the existing entrance walk and will impede the proposed,
construction.
3. The proposed accessible signs should match the most recent ADA and MAAB
regulations (i.e'$300 fine added',` see attached).

D. Appeals
The applicant, owner, any person aggrieved by this Determination, any owner of land abutting the land
upon which the proposed work is to be done, or any ten residents of the city or town in which such land is
located, are hereby notified of their right to request the appropriate Department of Environmental
Protection Regional Office (see Appendix A)to issue a Superseding Determination of Applicability. The
request must be made by certified mail or hand delivery to the Department, with the appropriate filing fee
and Fee Transmittal Form (see Appendix E. Request for Departmental Action Fee Transmittal Form)as
provided in 310 CMR 10.03(7)within ten business days from the date of issuance of this Determination. A

The Board of Appeals conducted a public hearing and meeting on August 13, 2012 for all parties J
interested in the appeal of Kari Trauschke, who is seeking a Special Permit in accordance with Section
180-7, Paragraph B of the Town of Agawam's Zoning Ordinances which would allow for the
construction of an addition to a residential structure with less than the required front setback and side
yard at the premises identified as 37 Annable Street.
After the public hearing and a thorough review of the facts presented, the Agawam Board of Appeals
made the following findings: J
1. The subject property is located in an area of town zoned Agricultural. J
2. The petitioner wishes to build an addition to the existing legal non-conforming residential structure.
3. Section 180-26 (Al) states: "there shall be a side yard between a principal building and any side lot
line which shall be 15 feet in its least dimension". I
4. The side yard of the existing structure is 14 feet. J
5. The front setback is 11 feet. i
6. The proposed addition will meet all zoning requirements. J
7. Section 180-7, Paragraph B of the Town of Agawam's Zoning Ordinances states a structure being
put to a nonconforming use may be "altered or enlarged in that use, but only after the granting of a J
permit thereof by the Board of Appeals".
8. There shall be no greater an encroachment than that which already exists.
9. A single family dwelling is an allowed use in a residential Agricultural district. J
10. The specific site is an appropriate location for the proposed addition, which is situated in a J
residential area. I
11.No evidence was presented to this board showing that the use, as developed, will have an adverse J
affect on the health, safety or property values of the neighborhood. J
12.No evidence was presented to this board showing that there will be any nuisances or potential J
hazards to vehicular or pedestrian safety.
13. The proposed addition will meet all building regulations providing adequate and appropriate
facilities and controls for the proper and safe operation of the proposed addition.
14.No evidence was presented to this board showing that the proposed use would be considered so J
objectionable or obnoxious that the proposed use would be against the public interest or detrimental
or injurious to the character of the neighborhood.

Based on its findings, the Agawam Zoning Board of Appeals is of the opinion that it is within the
authority of the board to grant a special permit as stated under Section 180-7, Paragraph B of the Town
of Agawam's Zoning Ordinances.
Now, therefore, by a unanimous vote of its three members, the Agawam Zoning Board of Appeals
hereby grants the petitioner a special permit to allow for the construction of an addition with the
following conditions:
1. The proposed addition will be constructed according to the plan submitted and signed by the members
of this board.
2. This special permit is for the proposed addition only. All other zoning and building requirements must
be met.
3. The petitioner shall record with the Hampden County Registry of Deeds, a"Notice of Special Permit"
form which shall be provided by this board and proof of said filing must be submitted to this board
and to the Inspector of Buildings.
4. This special permit shall become null and void if construction does not commence within two (2)
years from the date of this decision.
This decision is subject to appeal in accordance with M.G.L. Chapter 40A, Section 17 within 20 days
from the date this decision is filed with the Agawam Town Clerk.

Massachusetts Wetlands Protection Act M.G.L. c. 131, §40
C. General Conditions
1. Failure to comply with all conditions stated herein, and with all related statutes and other regulatory
measures, shall be deemed cause to revoke or modify this Emergency Certification or subject to
enforcement action.
2. This Emergency Certification does not grant any property rights or any exclusive privileges; it does not
authorize any injury to private property or invasion of property rights.
3. This Emergency Certification does not relieve the applicant or any other person of the necessity of
complying with all other applicable federal, state, or local statutes, ordinances, bylaws, or regulations.
4. Any work conducted beyond that described above, and any work conducted beyond that necessary to
abate the emergency, shall require the filing of a Notice of Intent_
5. The Agent or members of the Conservation Commission and the Department of Environmental
Protection shall have the right to enter and inspect the area subject to this Emergency Certification at
reasonable hours to evaluate compliance with this Certification, and may require the submittal of any
data deemed necessary by the Conservation Commission or the Department for that evaluation.
6. This Emergency Certification shall apply to any contractor or any other person performing work
authorized under this Certification.
7. No work may be authorized beyond 30 days from the date of this certification without written approval
of the Department.
D. Special Conditions
All debris must be removed from the river front property. Notify Conservation Commission when this
work has been completed so that a follow-up inspection can be made.
E. Appeals
The Department may, on its own motion or at the request of any person, review: an emergency
certification issued by a conservation commission and any work permitted thereunder; a denial by a
conservation commission of a request for emergency certification; or the failure by a conservation
commission to act within 24 hours of a request for emergency certification. Such review shall not
operate to stay the work permitted by the emergency certification unless the Department specifically so
orders. The Department's review shall be conducted within seven days of: issuance by a conservation
commission of the emergency certification; denial by a conservation commission of the emergency
certification; or failure by a conservation commission to act within 24 hours of a request for emergency
certification. If certification was improperly granted, or the work allowed thereunder is excessive or not
required to protect the health and safety of citizens of the Commonwealth, the Department may revoke
the emergency certification, condition the work permitted thereunder, or take such other action as it
deems appropriate.

We have reviewed the plan entitled "Preliminary Subdivision Plan - Agawam, Massachusetts;

6-17-2011" and we note the following;
TRAFFIC
1. A. A Sight Distance review will be required where Aspenwoods Lane intersects Silver
Street.
2. The connector between Doane Ave. and Aspenwoods Ln. will require signage (one
waylstop sign) to help traffic navigate through this intersection. It is recommended that
this connector be named Doane Ave_ Ext. or Aspenwoods Ln. Ext,
DRAINAGE
1. Tie existing C.B.'s at end of Doane Ave. into new drainage system in Aspenwoods
Estates. Size proposed d-pond accordingly.
2. Proposed subdivision must maintain existing storm water drainage path along the
southern most residential property line of Doane Ave. & include in drainage
calculations/d-pond design,
WATE R/S EWE R
I. Water litre location in Aspenwoods Ln. is too close to the proposed C.B.'s.
2. Extend water line in Aspenwoods Ln. to back of proposed cul-de-sac to service the lots
in this area, install hydrant at end of line.
3. Proposed water line in Aspenwoods Ln. is to be looped with existing water line in
Doane Ave_
4. Indicate how Lot 13 is to be tied into the sewer.
OTHER
I. Please show the building envelopes.
2. If Lots 1, 9, & 10 are developed as industrial lots, larger waterlsewer systems may be
required in Aspenwoods Ln. Industrial development of these three lots might generate

more than the 400 vehicle trips per day which a Lane is designed to handle. Industrial
traffic would also have to be taken into consideration when designing the pavement
thickness in Aspenwoods Ln.
3, Signage ("Not A Throughway") would be needed on Doane Ave, (and Doane Ave Ext.
or Aspenwoods Ln, Ext.) to prevent the heavy vehicular travel created by these
industrial lots from traveling through Doane Ave.
