The entire addition, including the freezer and refrigeration areas must have sprinklers installed in accordance with M.G.L. 148, Section 26G. Any existing portions of the structure that are not protected by sprinklers must be retrofit. 2. Bulk storage of vegetable or other oils must be permitted by the Agawam Fire Department in accordance with 527 C.M.R. 14, and if applicable, licensed in accordance with the same. 3. The facility must report to the Agawam Fire Department, as soon as possible,the anticipated maximum amount of oil to be stored on the property and the anticipated location of storage. The Agawam Fire Department will work in conjunction with the facility owner/operator to determine if oil storage will require a fire protection system other than sprinklers(i.e. dry chemical,wet chemical). 4. The property owner or building operator will notify the Head of the Fire Department if any quantity of hazardous liquids or gas (i.e. ammonia) is used within the cooling system for the refrigeration/freezer addition. 5. When added to the height of the building, the overall heights of these stacks exceed the limit allowed by the Agawam Zoning By-laws. This request for a Special Permit is to receive formal approval for the overall stack heights. OMG, Inc. operates a 208,0001?manufacturing and warehousing facility at 153 Bowles Road. This facility includes a 128,000 ft2 expansion built in 2005, with a building height of 40 feet. This expansion was built to house a new Electrocoat(E-Coat) paint line-installed in the summer of 2005—which has three separate exhaust stacks, ranging in height from 6 to 13 feet above the roof. In 2007, OMG also relocated an existing dip-spin paint process to the expansion. The curing oven for this system also has an exhaust stack that extends 10 feet above the roof. Recently, the Massachusetts Department of Environmental Protection (MassDEP) mandated the installation of an emissions control technology for OMG's E-Coat curing oven. In February 2009, OMG installed a wet electrostatic precipitator(WESP),which has its own rooftop stack,extending over 23 feet above the roof. Upon installation of this newest stack, OMG learned of the height limitations of the Agawam Zoning By-laws,which prompted this request for a Special Permit. Premises affected: 153 Bowles Road t Date: Se tember 14 2009 Case#: 1852 E The Agawam Zoning Board of Appeals conducted several public hearings concluding with a public meeting on September 14,2009 at the Agawam Public Library Community Room,750 Cooper Street,Agawam, MA for all parties interested in the appeal of OMG, Inc. which is seeking a Special Permit in accordance with Section 180-56 of the Zoning Ordinances, which f would allow for exhausts stacks which exceed the height requirement at the premises identified as 153 Bowles Road. After the public hearing and a thorough review of the facts presented,the Agawam Board of Appeals made the following findings: 1. The subject property is located in an area of town zoned Industrial A. E 2. The petitioner has several exhaust stacks on the existing building which exceed the height requirement allowed in an Industrial A zoning district. 3. Section 180-56 of the Town of Agawam's Zoning Ordinances states: "Industrial buildings shall not exceed two stories or 40 feet in height,except with approval of the Board of Appeals after a public hearing. These provisions shall not apply to required equipment appurtenant to industrial buildings, except that smokestacks,water tanks,grain elevators and � the like are not permissible except after approval of the Board of Appeals after a public hearing." 4. Documentation was provided showing that the existing stacks are required. f 5. According to the deed provided,certain restrictions were placed upon the subject property by f Westmass Area Development Corporate. 6. W. Bryan Nicholas,Vice-President Engineering And.Development for Westmass, sent a k letter to this board stating that"Westmass approves the installation of the stack per plan". f 7. A memo received from Sgt. Richard Niles, Safety Officer, Agawam Police Department,dated � June 16, 2009, states this project would appear to have little negative impact on pedestrian, € bicycle and/or motor vehicle traffic safety. f S. The proposed exhausts stacks are allowed uses in an Industrial A zoning district. The subject property is an appropriate location for such a use and structure. 9. No evidence was submitted demonstrating that this proposed use would have an adverse � affect on the health,safety or property value of the neighborhood. 10. The site plan, reviewed by the Safety Officer for the Town of Agawam, satisfies the concern that there will be no nuisance or potential hazard to vehicle or pedestrian safety. 1 I DECISION(p.2) OMG,Inc. Case# 1852 11. Adequate and appropriate facilities and controls will be provided by the issuance of this special permit for the proper and safe operation of the existing exhaust stacks. 12. The existing exhaust stacks are not considered so objectionable of obnoxious that the proposed use would be against the public interest or detrimental or injurious to the character of the neighborhood. Based on its findings,the Board is of the opinion that it is within the authority of the Board of Appeals to grant a Special Permit as stated under Section 180-56 of the Town of Agawam's Zoning Ordinances. Now,therefore, by a unanimous vote of its three members,the Zoning Board of Appeals hereby grants the petitioner a Special Permit to allow for the exhausts stacks which exceed the height requirement with the following conditions: I. The exhaust stacks are to remain located as shown on the plan submitted entitled OMG, Inc., 153 Bowles Road Stack Arrangements,dated 5/20/09 which has been signed by the members of this Board and shall be incorporated into and made part of this decision. 2. This special permit is for the existing exhaust stacks only. All other zoning and building regulations must be met. 3. The petitioner shall record with the Hampden County Registry of Deeds a"Notice of Special Permit"form, which shall be provided by this Board and proof of said filing must be submitted to this Board and to the Inspector of Buildings. 4. This Special Permit shall become null and void if construction does not commence within two (2)years from the date of this decision. This decision is subject to appeal in accordance with M.G.L.
