BOARD OF APPEALS PUBLIC MEETING December 10,2007
The following members attended the public meeting:

Fred Harpin-Vice Chairperson
Joseph Conte-Clerk
Gary Suffriti-Alternate
Larry Hoague-Alternate
Betty Manchino-Secretary
Chairperson Prouty opened the meeting at 6:30PM and made the motion for the Board to accept
the request to have the Board go out of order of the agenda in order to discuss the refunding of
the filing fees on the parking permits that had come before the board. Her motion was seconded
by Mr. Suffriti. All were in favor,none opposed
Chairperson Prouty-stated that she feels the board should refund the filing fees to anyone that had
applied for the parking permit that the City Council had recently repealed. This parking
ordinance was controversial from its inception and it was a difficult ordinance to grant special
permits under.
Mr. Conte stated that he had opposed this ordinance from the beginning due to the lack of
�; criteria.
M;�Iarpin stated that he disagreed with how the ordinance defined criteria and this ordinance
_rnd*it very difficult for any applicants to meet the criteria that was stated in said ordinance and
:7-felPthat the filing charges should be refunded to anyone that had applied for a permit.
vlruffriti stated that the people who had applied for this parking permit had gone through
tortes and endorsed refunds only to the applicants that had been denied or withdrew their
application not to the applicants that were awarded a permit.
Chairperson Prouty had a list of the applicants and the applicants to receive refunds would be
T.J.'s Sporthouse and South Agawam Storage to receive$500 refunds for their two applications
for this permit. David Ladizki,John's Auto Service and Anthony Cirillo would receive refunds
of$250 for their application fees. Rocky's, Agawam Specials, and Marcel Sanders would not
receive a refund as their permits were granted and they were able to park cars and receive
compensation.
Chairperson Prouty made a motion that the board request refunds to the applicants as stated
above and be submitted to the Mayor for approval. The Mayor must approve refimd requests.
The motion was seconded by Mr. Suffriti.

ratified of the boards recent decision on their parking petition.

Chairperson Prouty reopened this public hearing at 7:05PM. The applicant was present.
3. Case 41809-Pananas
Chairperson Prouty reopened the public hearing at 6:55PM and read a letter from Rhinehart
Associates requesting a continuance on this application so that the petitioner can amend the order
olconditions with the Conservation Commission.
Chairperson Prouty made the motion to continue this public hearing until January 14t'. Seconded
by Mr. Harpin. All were in favor,none opposed.

Chairperson Prouty reopened this Public Hearing at 6:58PM by reading a letter from Mr. Furman
requesting a continuance of both of these public hearings until the applicant can meet with the
Conservation Commission on December 13, 2007.
Chairperson Prouty made the motion to continue this public hearing until January 14t'seconded
by Mr. Harpin. All were in favor,none opposed.
