Gary Nardi,who is seeking a Variance from Section 180-27 of the Town of Agawam's Zoning rn
Ordinances,to allow for the construction of a single family dwelling on property with less than
the required frontage at the premises identified as 71 Wright Street.
After the public hearing and after a thorough review of the facts presented, the Agawam Zoning
Board of Appeals made the following findings:
1. The subject property is located in an area of Town zoned Residential A-2. J
2. The subject property is made up of 2 separate lots which together consists of J
approximately 7 3/4 acres of undeveloped land with a fifty(50') frontage. J
3. Section 180-27 of the Town of Agawam Zoning Ordinances requires a frontage of at least J
one hundred ten feet (I 10'). J
4. The petitioner is requesting relief from the frontage requirement to be allowed to build a
single family dwelling on the subject property. J
5. A stream runs through the subject property which has created significant wetlands.
b. The subject property is currently owned by Western Mass Property Services. The
petitioner is the president of this company.
7. A memo from Sgt. Richard Niles, Town of Agawam Safety Officer, dated December 10,
2010 was received by this board, stating "this project would appear to create little
negative impact to pedestrian, bicycle and/or vehicle traffic safety". J
8. Several area residents spoke in favor of this petition. J
9. There was no opposition expressed at the public hearings nor received in writing by this
board. I
10. This board has found that the subject property is unique in its topography due to
significant areas of wetlands. These specific conditions do not generally affect the zoning
district in which the subject property lies.The parcel's size and amount of wetlands
thereon exceeds its neighboring parcels.
11. This board has found that a literal enforcement of Section 180-27 of the Town of I
Agawam's Zoning Ordinances creates a substantial hardship due to extensive wetlands on J

3. Section 180-27 of the Town of Agawam Zoning Ordinances requires a frontage of at least
one hundred ten feet(I 10'). J
4. The petitioner is requesting relief from the frontage requirement to be allowed to build a
single family dwelling on the subject property.
5. A stream runs through the subject property which has created significant wetlands.
6. The subject property is currently owned by Western Mass Property Services. The J
petitioner is the president of this company.
7. A memo from Sgt. Richard Niles, Town of Agawam Safety Officer, dated December 10,
2010 was received by this board, stating "this project would appear to create little
negative impact to pedestrian, bicycle and/or vehicle traffic safety".
8. Several area residents spoke in favor of this petition.
9. There was no opposition expressed at the public hearings nor received in writing by this J
board. I
10. This board has found that the subject property is unique in its topography due to J
significant areas of wetlands. These specific conditions do not generally affect the zoning
district in which the subject property lies. The parcel's size and amount of wetlands
thereon exceeds its neighboring parcels.
11. This board has found that a literal enforcement of Section 180-27 of the Town of I
Agawam's Zoning Ordinances creates a substantial hardship due to extensive wetlands on J
the subject property. J

12.This board has found that the granting of this Variance, to allow for the construction of a
single family dwelling, will not be substantially detrimental to the public good, nor will it
derogate from the intent and purpose of the Zoning Ordinances. The neighborhood
surrounding the subject property consists primarily of residential dwellings.
Based on its findings, the board is of the opinion that the requested relief is within the authority
of the Agawam Zoning Board of Appeals to grant a Variance as stated under MGL, Chapter 40A,
Section 10.
Therefore, the Agawam Zoning Board of Appeals,by unanimous vote of its three members,
hereby grants the petitioner a Variance from Section 180-27 of the Town of Agawam's Zoning
Ordinances, to construct a single family dwelling with less than the required frontage with the
following conditions:
1. This Variance provides relief from the frontage requirement of Section 180-27 of the
Agawam Zoning Ordinances only. All other zoning requirements must be met.
2. This Variance is granted to allow for the construction of one single family dwelling on
the subject property.
3. The single family dwelling is to be constructed as shown on the plan provided entitled,
"Gary Nardi, 46 Cottonwood Lane, Agawam, MA"and signed by the members of this
board on February 14, 2011.
4. A single lot must be created from the two separate lots which create the subject property
before a building permit can be granted.
5. The deed of this subject property must be transferred from Western Mass Property
Services to the petitioner and his wife, Gary and Darilynn Nardi, before a building permit
can be granted.
6. The petitioner must go before the Agawam Conservation Commission for approval
before a building permit can be granted.
7. The petitioner shall record with the Hampden County Registry of Deeds a"Notice of
Special Permit" form, which shall be provided by this Board and proof of said filing must
be submitted to this Board and to the Inspector of Buildings.
8. This Special Permit shall become null and void if construction does not commence within
one (1) year from the date of this decision.
This decision is subject to appeal in accordance with M.G.L.Ch. 40A, Section 17 within 20
days after this decision is filed with the Agawam Town Clerk.
