The Board of Appeals conducted several public hearings concluding with a public meeting on
May 26,2009 at the Agawam Public Library Childrens' Room, 750 Cooper Street, Agawam, MA
for all parties interested in the appeal of Coyote Realty, Inc. which is seeking a Special Permit in
accordance with Section ISO-44 , Paragraph I of the Zoning Ordinances, which would allow for
the construction of a bank drive-through service window at the premises identified as 1340
Springfield Street.
After the public hearing and a thorough review of the facts presented, the Agawam Board of
Appeals made the following findings:
I. The subject property is located in a Business A zoning district.
2. The petitioner proposes to construct a bank with three drive-thru service windows on the
subject property.
3. Section 180-44, Paragraph I states: "Drive-through service windows utilized by any business
shall require a special permit from the Board of Appeals in conformance with Section 180-
II" .
4. The proposed structure will meet all zoning requirements for the Town of Agawam.
5. On April 16,2009, the Planning Board voted to approve, with conditions, the site plan for the
subject property.
6. The Conservation Commission voted to grant an Order of Conditions on the subject property
on April 23, 2009.
7. The proposed bank is an allowed use in a Business A zoning district. The subject property is
an appropriate location for such a use and structure.
S. No evidence was submitted demonstrating that this proposed use would have an adverse
affect on the health, safety or property value of the neighborhood.
9. The site plan, reviewed by the Police Dept., Fire Dept., and Engineering, satisfies the concern
that there will be no nuisance or potential hazard to vehicle or pedestrian safety.
10. Adequate and appropriate facilities and controls will be provided by the issuance of this
special permit for the proper and safe operation of the proposed drive-through service
windows.
II. The proposed drive-through service windows are not considered so objectionable of
obnoxious that the proposed use would be against the public interest or detrimental or .
injurious to the character of the neighborhood.

Based on its findings, the Board is of the opinion that it is within the authority of the Board of
Appeals to grant a Special Permit as stated under Section 180-44, Paragraph I of the Zoning
Ordinances.
Now, therefore, by a unanimous vote of its three members, the Zoning Board of Appeals hereby
grants the petitioner a Special Permit to allow for the three drive-through service windows with
the following conditions:
I. The plan titled "Mixed Use Commercial for Coyote Realty, 1340 Springfield St.
Agawam, Massachusetts", dated 12/08/08 and revised 4/16/09 and signed by the
members of this Board, shall be incorporated into and made part of this decision.
2. All conditions set forth by the Planning Board in its approval of this site plan, dated April
16, 2009, except for the second recommendation, must be adhered to.
3. The dumpster located at the rear of the building must be relocated so as not to interfere
with any pedestrian or vehicular traffic.
4. The rear sidewalk must be extended for the use of all rear entrances of the building.
5: The traffic control island at the entrance/exit must be extended to the corner of the
building.
6. During inclement weather, all parking spaces on the subject property must be plowed and
clear of snow.
7. The drive-through service windows may not be utilized for any restaurant.
8. The·traffic lane on the south and-east sides of the proposed building must be at least
eighteen (18') feet in width as required by the Board of Fire Prevention Regulations, 527
CMR 1.00-50.00, Section 10.03 (10).
9. A cross property easement between this property and 1350 Springfield Street must be
added to the deeds of both properties and proof of such must be submitted to this Board
and to the Inspector of Buildings.
10. This special permit is for the drive-through service windows only. All other zoning and
building regulations must be met.
II. The petitioner shall record with the Hampden County Registry of Deeds a ''Notice of
Special Permit" form, which shall be provided by this Board, and proof of said filing
must be submitted to this Board and to the Inspector of Buildings.
12. This Special Permit shall become null and void if construction does not commence within
two (2) years from the date of this decision.
This decision is subject to appeaUn accordance with M.G.L. Ch. 40A, Section 17 within 20 days
after this decision is filed with the Agawam Town Clerk.

After consultation with this project's developer and the Agawam Fire
Department's Fire Inspector Scott Mitchell, I am making the following revisions to my
comments of 02·09·2009:
Exhibit A -traffic control island at entrance/exit:
Inspector Mitchell to consult with Deputy Fire Chief Alan Sirois as to any
concerns he may have with extending this island from where it
presently ends to the corner of the building. I would prefer the curb
extend all the way to the building. However, if this would create a hazard
to the Fire Department personnel, I would withdraw my suggestion of an
extension.
Exhibit B -north west door to Tenant Space #5:
The relocation of the dumpster to the rear of the parking lot would
increase the safe access to & from this door.
Exhibit C -open property line:
Based on concerns by Inspector Mitchell that a physical barrier installed
between the parking lots of 1340 & J 350 Springfield Street would create
a hazard to Fire Department personnel, I am withdrawing my suggestion
of a barrier devise. Developer was agreeable to the installation of
pavement markings to guide customers through the parking lot.

Realty; 1340 Springfield St.; Agawam, Massachusetts" revised 4/1412009. We recommend against
Planning Board approval and have the following comments:
Comments in italics are new comments; all other comments are outstanding from previous memos:
I. The applicant's engineer has proposed a one-way traffic'circulation scheme for the site's parking
lot. One-way traffic requires extensive signBe:e in order to inform the operator of the circulation;
this proposed signage shall be shown on the plan. The signs should include: "ONE WAY", "DO
NOT ENTER", "STOP", and others; the signs shall comply with MUTCD. The proposal is not
sufficient to maintain the intended one-way on-site traffic circulation. Additional sign'lge needs
to be proposed at multiple decision points throughout the site to inform the operator of the
circulation and to prevent wrong way travel. The proposed signage is inadequate for the
proposed traffic design.
2. A "KEEP RlGHT" sign, either a R4-7 or R4-7a, should be used at the driveway curb cut at
Springfield Street on the traffic island between the edge of the street line and the sidewalk.
3. The proposed traffic island should be shaped to channelize the traffic as intended, i.e. extended
and curved toward the south west comer of the proposed building such that traffic entering the
site will be less likely to enter going the Wrong way towards the drive-thru area or traffic coming
from the drive-thru area will turn right.
4. The existing driveway curb-cuts, for the project site and neighboring parcels, shown on the plan
do not appeS! to correspond to field conditions; the locations shown and dimensions are
inconsistent. The latest revised proposed plan does not seem to have corrected this.
5. The proposed driveway curb-cut may require the relocation of a utility pole; please show its
location on the plan. The applicant should understand that it can take a long time to relocate a
utility pole.
6. The curbing proposed along Springfield Street is required to be vertical granite curbing
complying with Town standards; please show the Town detail on the plans. Additionally, the
proposed traffic island (within the Town ROW) should be composed of sloped granite curbing;
the MHO detail is to be added to the plans. The island's curbing is not clearly indicated. The
venical granite curb and sloped granite curb details shall be shown on the plans (please see
allached). The latest revision shows the Iransition curb detail but il is unclear where on the site
this is intended to be used.
7. Please show a detail for the sidewalk curb-cut in front of the building at the planters.

8. Please confum that the spot grades shown along the eastern property line of the site are existing
grades and that the proposed grades shall match these and meet the exiting ground on the
Bdjw:ent parcel (Stop & Shop). The proposed work may require grading that extends onto the

Per your request, Engineering has reviewed the plans entitled "Mixed Use Commercial; For Coyote
Realty; 1340 Springfield St.; Agawam, Massachusetts" revised 3/30/2009. We recommend against
Planning Board approval and have the following comments:
I. The applicant's engineer has proposed a one-way traffic circulation scheme for the site's parking
lot. One-way traffic requires extensive signage in order to inform the operator of the circulation;
this proposed signage shall be shown on the plan. The signs should include: "ONE WAY", "DO
NOT ENTER", "STOP", and others; the signs shall comply with MUTCD. The proposal is not
sufficient to maintain the intended one-way on-site traffic circulation. Additional signage needs
to be proposed at mUltiple decision points throughout the site to inform rhe operator of the
circulation and to prevent wrong way travel.
2. The "DO NOT ENTER" and "ONE WAY" signs are not needed at the curb-cut, as shown on the
plan. The "STOP" sign should be placed behind the sidewalk, a stop bar should also be used at
this location.
3. A "KEEP RIGHT" sign, either a R4--7 or R4-7a, should be used at the driveway curb cut at
Springfield Street on the traffic island between the edge of the street line and the sideWalk.
Where the sign is currently proposed different controls are needed as this sign is not appropriate
in this location.
4. The proposed traffic island should be shaped to channelize the traffic as inrended, i.e. extended
and curved toward the south west comer of the proposed building such that traffic entering the
site will be less likely to enter going the wrong way towards the drive-tbru area or traffic coming
from the drive-tbru area will tum right.
5. The existing driveway curb-cuts, for the project site and neighboring parcels, shown on the plan
do not appear to correspond to field conditions; the locations' shown and dimensions are
inconsistent.
6. The proposed driveway curb-cut may require the relocation of a utility pole; please show its
location on the plan.
7. The curb radii should be modified to accommodate the design vehicle for the site (assumed to be
an SU-30, 30FT box truck). The radius at the entrance should be increased to at least 15 ft, also
the curbing proposed along Springfield Street . is required to be vertical granite curbing
complying with Town standards; picase show the Town detail on the plans. Additionally, the
proposed traffic island (within the Town ROW) should be composed of sloped granite curbing;
the MHO detail is to be added to the plans.

Per your request we have reviewed the site plan entitled: "Site Plan; Prepared for: Coyote
Realty, 1340 Springfield St., Agawam, Massachusetts; Prepared by: Architectural Insights, 3
Converse Street, Palmer, MA 01069; Scale: 1"=20'; Date: 12108/08", and we note the
following:
1. Show size, type, and location of existing/proposed water and sewer services.
2. Indicate where pavement alterations are on plan. Add pavement detail to plan.
3. Show location for all types of curbing; add corresponding details to plan.
4. The proposed sidewalk is to be located completely within the R.O.W. Show the Town
sidewalk/curb ramp detail on the plan (see attached).
5. 90· parking spaces should use a minimum parking aisle width of 24 feet.
6. All the circulation aisles are very wide for one-way circulation. Circulation aisles greater
than 15 FT encourages two-way traffic.
7. Show curb cuts across the street and for the properties next door to the subject site.
8. Designate lanes for the Drive-up and ATM queue and for the escape/exit lane. It
appears that there will be conflicts between the drive-through queue & escape lane at
N.W. comer of building. A parking study/queue study based on use of offices will be
required.
9. Please show the extents and dimensions of the canopy.
10. Add accessible parking signage detail to the plan (see attached standard accessible
parking sign). Show the overall signage for the site. When applicable, signs should meet
M.U.T.C.D. standards (i.e. one-way, do not enter, etc,)

11. The applicant should confirm that they are or are not going to keep the connection to
the western adjacent properties parking lot.
12. We have attached our memo to the Conservation Commission dated February 10, 2009
for additional comments.
13. A plan showing traffic flow, signage, and parking spaces for all 3 phases needs to be
shown.
14. When necessary, accessible curb cuts and crosswalks should be shown for all of the
accessible spaces. Additional accessible spaces and curb cuts may be required by
Building Dept. based on the accessible route from the parking space to each of the
building entrances. Details of the curt cuts should be added to the plans to avoid
compliance issues in the field.
15. Van accessible space should be located in the front parking area.

Description of Site: Site is currently fully developed with two commercial buildings.
The rear of the property is wetlands. See attached aerial photo. A filing with the
Conservation Commission has been submitted.
Provision for Traffic Flow: Two 22' curbcuts are provided onto Springfield Street. The
traffic flow through the site is intended to be one-way from east to west. This may
present confusion since there is an unrestricted access from the adjacent retail
establishment. See also comments from the Agawam Safety Officer. Two-way traffic
flow would be preferable.
Parking: Forty-one (41) spaces have been shown. Using Agawam's Parking Guidelines,
1.5 parking spaces for every 200 sq.ft. of gross floor area for retail establishments would
result in the need for 67 parking spaces. There are no recommendations for bank
buildings. Based upon this analysis, additional parking spaces would be necessary.
Drainage: See Engineering comments.
Public Utilities: See Engineering comments.
Landscaping/Screening and Buffers: The following landscape note must be placed on
the plan: "The following landscape note must be placed on the plan: "All plantings must
be maintained and that portion of the public way abutting the parcel and including the
treebelt shall be maintained in a safe and attractive condition by the owner of the
parcel. "
Sign Location: An elevation of the sign should be submitted.
Exterior Lighting: All lighting must be recessed and shielded.

Safety Concerns:
I. How will the proposed "Exit" curb cut affect the present curb cut for the
entrance/exit of#1350 Springfield Street (Phipps Liquors)? Close proximity may
create confusion for motor vehicle operators. Also, the greater the number of
curb cuts, the greater the hazards to pedestrians utilizing the sidewalk;
specifically, Junior High School and Granger Elementary School students.
2. Will there be a physical separation (barrier devise) between the parking
lots of#1340 and #\350 Springfield Streets? This would control the flow of
traffic from crossing over the property line? The lack of some type of barrier
could lead to the operation of motor vehicles in such a manner that is convenient
to one operator and hazardous to pedestrians, bicyclists, and lor other motor
vehicle operators (wrong way operation).
3. How will motor vehicle traffic, which enters at the "Entrance", turns left to use
one of the II parking space bordering Springfield Street, only to discover all II
are in use, be prevented from turning right near the "Exit "? Will these motor
vehicle operators be expecied to turn left, exit onto Springfield Street east bound,
and re-enter via the "Entrance" in search for a parking space?
