The Application is being submitted as part of the proposed Cell 2 Vertical Expansion project, which is currently undergoing review by the Massachusetts Department of Environmental Protection (MassDEP) through its Site Assignment process (310 CMR 16.00), and is described in further detail below. The proposed Cell 2 Vertical Expansion project is a lined vertical expansion of the existing unlined Cell 2 landfill area at the Bondi Island Landfill located in West Springfield and Agawam, Massachusetts. A lined vertical expansion of the Cell 2 area was previously approved by State regulators and the City of Agawam In 1985, but not constructed. The April 19, 1985 Agawam Special Permit #1101 for the Cell 2 vertical expansion limited the final height of Cell 2 to a maximum elevation of 125 feet msl. 'Subsequent changes to the Massachusetts Solid Waste Regulations 310 CMR 19.000 and upgraded liner and final 'cover standards have increased site development and closure costs to the extent that the original Cell 2 lined expansion project is uneconomical to undertake at a limiting elevation of 125 feet mean sea level (msl). Therefore, the City of Springfield (owner) and Covanta Springfield, LLC (operator) have proposed to increase the closure height of Cell 2 to an elevation of 142 feet msl. The proponent also intends to increase the final closure height across the combined Cell 1, Cell 2 and West Springfield Area to the 142 feet msl elevation in order to create an approximate 28 acre surface for 3-municipality post-closure uses; preliminary discussions have been held with the Administrators in Agawam, West Springfield and Springfield. The 4-foot height increase is necessary to reorient the crest of the landfill on Cell 1 from the existing north-south orientation to an east-west orientation for post- closure use of the site. Additionally, the Proponent has proposed to increase the average daily disposal rate from 150 tons per day (tpd) to 290 tpd. The Bondi Island landfill site has been used since the 1960s for the disposal of solid waste materials. Lined landfill development in the mid-1980s in the Cell 1 area in Agawam and the West Springfield Area of Cell 1 provided the air space capacity for the disposal of solid wastes, WWTP sludge, by-pass wastes in the Cell 1 and West Springfield Area, and for the disposal of 'residual ash generated at the nearby Pioneer Valley Resource Recovery Facility (PVRRF) in the Agawam portion of Cell 1. The air space capacity of Cell 1 was increased in 2001 and 2003 for the continued disposal of residual ash from the PVRRF up to a currently approved final closure elevation of 138 feet msl. A lined vertical expansion in the northern section of the West Springfield Area (West Springfield Supplemental Liner Area or WSSLA) was constructed in 2005 and is the current active operating area at the site. The Cell 2 area was used as an unlined landfill for the disposal of solid wastes until the PVRRF was brought on-line in 1986 then closed using a soil final cover system (landfill cap). Since that time, the City has used the upper Cell 2 surface as a composting pad through a third' party agreement with a private Contractor. The composting facility handles yard wastes and serves the residents of Agawam, West Springfield and 1-1 I I I I I I I I I I I I I I I I I I Section 1 General Information Springfield. The compost facility will be relocated as the Cell 2 Vertical Expansion project is developed. This project includes the phased construction of approximately 30 acres of new liner construction over the existing unlined Cell 2 landfill area, as originally proposed and permitted in 1985. The Cell 2 area includes the so-called "Power Line Easement" area of Cell 2 that is currently occupied by a Western Massachusetts ElectriC Company (WMECo) overhead electric transmission line; these transmission lines require relocation as the project proceeds. The Cell 2 Vertical Expansion project will provid~ 7.5 to 11.5 years of additional lined waste disposal capacity for the residual ash disposal from waste-to-energy (WTE) facilities, most notably the Pioneer Valley Resource Recovery Facility (PVRRF) and the Pittsfield Resource Recovery Facility (PRRF), and contaminated soils as approved by the MassDEP. 1.2 Current Approvals The Bondi Island Landfill has several contiguous waste disposal areas: the Cell 1 area in Agawam and West Springfield, the West Springfield Supplemental Liner Area (WSSLA), and the Cell 2 area in Agawam that includes the so-called Power Line Easement area. All of these areas are identified on a plan entitled "Final Grading Plan" prepared by EnSol, Inc., dated February 2007 (Revised February 11, 2009), which is attached in Appendix B. The enclosed Special Permit Application is specific to both Cell 1 and Cell 2. The most recent Special Permit issued for the Cell 1 area allowed for a final closure height of 138 feet msl. This permit (Case #1694) dated May 12, 2003 is included in Appendix C. The most recent Special Permit issued for the Cell 2 area allowed a final closure height of 125 feet msl. This permit (Case # 1101) dated April 19, 1985 is also included in Appendix C. 1.3 Project Description The Cell 2 Vertical ExpanSion project includes the following design changes from the original project that was permitted and approved in 1985: 1. Construction of state-of-the-art double composite liner, leachate collection and groundwater protection systems in Cell 2; all overlying existing unlined landfill. 2. Increase in Cell 2 height to a maximum elevation of 142 feet msl from the previously approved elevation of 125 feet msl. 3. Minimum 2% surface grades across the completed Cell 2 area, matching 2% minimum grades in Cell 1 and the West Springfield Area. 4. Increase in Cell 1 height in the City of Agawam and the Town of West Springfield to a maximum elevation of 142 feet msl from 138 feet msl. 5. Relocation of the WMECo overhead electric transmission lines. 6. Construction of a liner overlying the eastern side slope of Cell 1 as approved by the MassDEP. 7. Upgraded final cover system for the Cell 2 area at closure. The double composite liner installed over the unlined Cell 2 landfill area will effectively "cap" the underlying unlined wastes as part of the Cell 2 development project. 8. The use of MassDEP approved processed waste materials as part of liner construction and closure construction. 1-2 I I I I I I I I I I I I I I I I I I I Section 1 General Information All waste disposal capacity created by the Cell 2 Vertical Expansion project is located within previously permitted landfill areas that overlie pre-existing unlined or lined landfill waste disposal areas. No "new" landfill area is created by this project; the "footprint" of the Bondi Island Landfill will not change as a result of the Cell 2 Vertical Expansion project. The Cell 2 Vertical Expansion project will provide an increase in the air space waste disposal capacity at the Bondi Island Landfill as follows: • Cell 2: The Cell 2 Vertical Expansion project will provide an increase in the air space waste disposal capacity of 960,000 cubic yards; including 300,000 cubic yards previously approved by the City of Agawam under Special Permit #1101 dated April 19, 1985. Special Permit #1101 provided an increase in the closure height of Cell 2 from 107 feet msl to 125 feet msl as part of the 1985 Cell 1 & Cell 2 lined vertical expansion project. This project requests an increase in the closure height of Cell 2 to 142 feet msl. • Cell 1: The project will increase the Cell 1 air space capacity in Agawam by about 45,000 cubic yards. This volume associated with the revised closure grading of Cell 1 will be utilized for permitted "grading and shaping" materials such as contaminated soils or processed RRF bottom ash. Final closure height of Cell 1 will increase from 138 feet msl to 142 feet msl; an increase of 4 feet across the top of the Cell 1 landfill area. • West Springfield Supplemental Liner Area (WSSLA): The project will increase the WSSLA capacity in West Springfield for residual RRF ash by about 15,000 cubic yards; roughly equivalent to 2.5 months of air space disposal capacity for residual ash for the Pioneer Valley and Pittsfield facilities. The WSSLA is the current active area of the site. The total site air space capacity increase due to the Cell 2 Vertical Expansion project is about 960,000 cubic yards. The maximum closure elevation across the site will increase 4 feet from the currently permitted maximum elevation of 138 feet msl (Cell 1 final closure elevation) to 142 feet msl across the Cell 1, Cell 2 and West Springfield areas. 1.4 Fees The Applicant has submitted a fee of $250.00 to the Agawam Zoning Officer in conjunction with the Application. Proof of payment is provided in Appendix A. 1.5 Wetland Resources Portions of the existing Cell 2 unlined landfill area along the southern and eastern perimeter are located within the 100-foot wetlands buffer zone. Alteration of Cell 2 in these areas will be minimized to the extent possible and primarily related to landfill closure and capping required under State regulations. The Applicant has submitted a Notice of Intent (NOl) for the project to the Agawam Conservation Commission. An initial public hearing for the NOl was held on February 26, 2009. 1.6 Maps Site plans including an Existing Conditions and Project Layout Plan, a Proposed Electric Tower Relocation Plan, a Base Grading Plan, a Final Grading Plan, a Facility Cross 1-3 I I I I I I I I I I I I I I I I I I I I Section 1 General Information Section (East to West), and a Baselayer and Final Cover Details Plan are included as Appendix B to this permit application. 1-4 I I I I I I I I I I I I I I I I I I I TIghe&Bond Section 2 Standards for Special Permits This section of the Application provides an overview of the project's compli,ance with the Town of Agawam's standards for reviewing applications for Special Permits, at Section 1BO-11(G) of the Agawam Zoning Bylaw, which states: (1) The Board of Appeals shall not approve any such application for a special use permit unless it finds in its judgment all of the following conditions are met: (a) The specific site is an appropriate location for such a use, building, structure or services. (b) The use as developed will not adversely affect the health, safety or property value of the neighborhood. (c) There will be no nuisance or potential hazard to vehicle or pedestrian safety. (d) Adequate and appropriate facilities and controls will be provided for the proper and safe operation of the proposed use or service. 2.1 Section lS0-11(G)la The specific site is an appropriate location for such a use, building, structure or services. The proposed Cell 2 Vertical Expansion project will not substantially change existing uses or use patterns at the site. The project will not affect off-site land or land use at a level greater than the pre-existing landfill area. Although 'project involves an increase to landfill capacity and Cell 1 and Cell 2 heights, there is no increase In enVironmental, public health or safety impacts associated with the project. The capacity increase is within previously Site Assigned and permitted landfill areas, and overlies pre-existing lined and unlined landfill cells. The MassDEP issued a Positive Determination of Site Suitability for the project on November 10, 200B. A copy of the Determination is attached in Appendix D. 2.2 Section lS0-11(G)lb The use as developed will not adversely affect the health, safety or property value of the neighborhood. The Proponent submitted a Notice of Project Change (NPC) to the Massachusetts Environmental Policy Act (MEPA) office in April 2007 seeking a determination from the Secretary of Energy and Environmental Affairs as to whether or not the Cell 2 Vertical Expansion project required further environmental review in the form of an Environmental Impact Report. The Secretary's Certificate on the NPC, dated May 11, 2007 determined that the project did not require further MEPA review. A copy of the Certificate is included in Appendix E. As outlined in the detailed Site Suitability Report submitted to the MassDEP in August 200B the project will not result in adverse impacts to public health, safety, or property value. The project is not located in proximity to drinking water supplies; sensitive 2-1 I I I I I I I I I I I I I I I I I I I Section 2 Standards for Special Permits environmental receptors; and is further than 1,000 feet away from residences, health facilities, and schools. Waste handling areas will be located a minimum 100 feet off from facility property boundaries. • Cell 2: The closest facility property boundary is the Route 5 property line to the east of the Cell 2 area; located about 120 feet from the proposed easterly Cell 2 liner edge. Also, a small portion of the Cell 2 liner in the Power Line Easement area is located 100 feet from the northern facility property boundary along M Street and is adjacent to property owned by Consolidated Edison (WMECo). • Cell 1: The closest facility property boundary is the Consolidated Edison (WMECo) property line to the north of the Cell 1 project area; located about 200 feet from the edge of the Cell 1 fill area. • West Springfield Supplemental Liner Area (WSSLA): The closest facility property boundary to the WSSLA is the Agawam Avenue property line to the west; located a minimum of 135 feet from the liner edge. A state-of-the-art groundwater protection system will be designed and constructed for the Cell 2 Vertical Expansion project. The project is the construction of a double composite landfill liner system overlying existing unlined Cell 2 landfill areas, in addition to filling over lined areas in the Cell 1 and West Springfield Area of the site. The' project includes development of lined landfill sub-cells in the Cell 2 area,constructed with state- of-the-art liner and groundwater protection systems including independent leachate collection systems drained by gravity to the perimeter of the subcells. The existing leachate collection system that conveys leachate from lined landfill cells to the Springfield WWTP was upgraded in 2007-2008. The capacity of the upgraded system will accommodate the proposed Cell 2 Vertical Expansion project. Possible air emissions from the proposed project vary little from current air emiSSions with the exception that periodic episodes of liner construction will Include additional truck traffic and heavy equipment operation during a 3-4 month construction period. Other air emissions such as dust and heavy equipment exhaust due to waste disposal operations will be equivalent to existing site use. The increase in landfill gas emissions is minimal due to the project because the waste materials to be disposed in the Cell 2 Vertical Expansion are either post-combustion residual ash or contaminated SOils. Therefore, little or no landfill gases (methane and carbon dioxide) are emitted following placement due to anaerobic decomposition processes. 2.3 Section lS0-11(G}lc There will be no nuisance or potential hazard to vehicle or pedestrian safety. Nuisance The following "nuisance" conditions are identified for the construction and/or operation of the project, along with mitigation or prevention measures: • Noise -Construction, operation, and closure activities at the site will generate heavy equipment noise including engine, back-up alarm, and truck gate noises. Mitigation measures include: o limiting site operations from 7 am to 3:30 pm; 2-2 I I I I I I I I I I I I I I I I I I I Section 2 Standards for Special Permits o construction of visual and noise reduction berms along liner edges to minimize the aesthetic and noise impact off-site; o constructing the Cell 2 subcells in a east to west sequence so that the initial subcell(s) constructed and operated will parallel Route S thereby shielding subsequent subcell development from direct observation to the east; lessening potential noise impacts. • Dust -Construction, operation, and closure activities at the site may generate occasional dust emissions. Mitigation measures include: o utilizing a water spray tanker to wet landfill access roads and suppress dust emissions; o periodic street sweeping on M Street by the City of Springfield DPW or the construction Contractor during periods of landfill construction activity; o use of alternative daily cover materials such as tarps or other approved substitute materials that are not susceptible to dust generation, o application of calcium chloride to suppress dust and maintain a wetted surface; o and limiting truck travel speeds on facility access roads to minimize fugitive dust emissions. • Litter -None. The Cell 2 Vertical Expansion project will not generate windblown litter. Waste materials received at the facility will be limited to residual ash generated at the Pioneer Valley Resource Recovery Facility (PVRRF) and Pittsfield Resource Recovery Facility (PRRF) and other resource recovery facilities, and alternative cover materials such as contaminated soils approved by the MassDEP as daily or intermediate cover material in a lined landfill. • Vectors -None. As noted above for litter, waste materials disposed in the West Springfield Supplemental Liner Area will be limited to residual ash and alternative dally cover materials that are not attractive to nuisance vectors such as birds, flies, and rodents. • Odors -Little to none. The residual ash to be disposed in the Cell 2 Vertical Expansion project area will not generate significant landfill gas emissions since the organic content of the source municipal solid waste (MSW) will have been reduced to residual ash during the combustion process; thereby limiting the potential for anaerobic decomposition in the Cell 2 Vertical Expansion area. The liner subcells for the Cell 2 Vertical Expansion will include an under-liner landfill gas extraction system, consisting of gas extraction trenches under the liner and perimeter gas extraction wells along the liner edge to extract and treat landfill gases generated within the existing Cell 2 unlined landfill. The City currently utilizes a series of gas extraction trenches within the Cell 1 and Cell 2 areas to extract and treat (flare) landfill gas. H nuisance odors are generated in the Cell 2 Vertical Expansion area, mitigation measures include the application of intermediate cover material to limit fugitive emissions, application of lime or other odor suppressants and modification of gas extraction systems to better capture, control and treat odor emissions. • Bird Hazards to Air Traffic -None . Waste materials to be disposed as part of the Cell 2 Vertical Expansion project are limited to residual ash and alternative daily cover materials that are not attractive to nuisance vectors such as birds. 2-3 I I I I I I I I I I I I I I I I I I I Section 2 Standards for Special Permits • Other Nuisance Conditions -None identified. Vehicle and Pedestrian Safety Overall traffic impacts of the Cell 2 Vertical Expansion project are minor and less than those previously reviewed as part of the previous Cell 1 and Cell 2 Special Permit applications. A 1979 Environmental Notification Form (ENF) for the Bondi Island Landfill Expansion project submitted to the Massachusetts Environmental Policy Act (MEPA) office estimated a traffic impact of 100 vehicle trips. This traffic count accounted for the disposal of municipal solid waste (MSW), waste water treatment plant (WWTP) biosolids, cover materials and reSidual ash from the Pioneer Valley Resource Recovery Facility (PVRRF). Traffic associated with waste disposal and cover materials for the Cell 2 Vertical Expansion is estimated to be fifteen (15) vehicle round trips per day, a significant reduction in the number of vehicle trips previously evaluated in the ENF. For the purposes of this permit application, the following traffic use is estimated for the project: Transport Trucks (residual ash): City Dump Trucks (Cover Materials): 10 Round Trips per day 5 Round Trips per day M Street in the City of Agawam serves the Bondi Island Landfill. There is no through traffic from M Street in Agawam to Agawam Avenue in West Springfield. The Agawam Avenue intersection is gated on M-Street at the intersection. The City of Springfield owns M Street adjacent to the landfill and limits traffic at the site to vehicles using the facility. Road use for the hauling of residual ash from the nearby PVRRF is limited to M Street in the City of Agawam. Cover materials are hauled by City or Contractor dump trucks using Route 5 to M Street. Residual ash from the PRRF is delivered using the Massachusetts Turnpike, Route 91 and Route 5 to M Street. There are no adverse traffic impacts associated with the use of the site for the disposal of residual ash generated at the adjacent Pioneer Valley Resource Recovery Facility (PVRRF) and the Pittsfield Resource Recovery Facility (PRRF). Traffic patterns for reSidual ash hauling from the PVRRF are limited to a round-trip direct route from the PVRRF on M Street to the landfill and back, a one-way distance of approximately 2,000 feet. Traffic patterns for PRRF residual ash are primarily limited to state highways with the exception of local roads in Pittsfield. Continued use of the site for disposal of residual ash will limit off-site hauling of PVRRF residual ash to distant waste disposal sites. 2.4 Section 180-11(G)ld Adequate and appropriate facilities and controls will be provided for the proper and safe operation of the proposed use or service. The proposed project change will not result in a significant increase or release of pollutants at the facility. In fact, the project change increases environmental controls at the Bondi Island Landfill through the construction of a state-of-the-art liner system over the unlined Cell 2 landfill area. This letter represents MassDEP's Report on Site Suitability pursuant to 310 CMR 16.13, as in effect on June 8, 2001. The Report Number for the application is 281-001-C. On May 11, 2007, after reviewing the Notice of Project Change ("NPC") pursuant to M.G.l. c. 30, ss. 61-62H and 301 CMR 11.00, the Secretary of the Massachusetts Executive Office of Energy and Environmental Affairs ("EOEEA") issued a Certificate which determined that a Supplemental Environmental Impact Report and further Massachusetts Environmental Policy Act ("MEPA") review were not required for this project. The Certificate states that the project change will require a Major Modification of Site Suitability Report (BWP SW 38) approval from MassDEP, a modified Site Assignment from the Town of Agawam Board of Health, an Authorization to Construct (BWP SW 26), and an Authorization to Operate (BWP SW 10). The application contains sufficient information to allow MassDEP to determine whether the project area meets the criteria listed in 310 CMR 16.40 (3)(a) entitled Criteria for Landfill Facilities (Restricted Areas) and 16.40 (4) entitled General Site Suitability Criteria. MassDEP has detennined that the proposed site meets each of the site suitability criteria for a landfill facility set forth in 310 CMR 16.40(3)(a)& 16.40(4). Therefore, MassDEP is ofthe opinion that the proposed site is suitable for use as a landfill facility. The Record for this Modification of Site Assignment application consists of the application itself, this report which includes statements of fact by MassDEP pertaining to site suitability criteria, and all correspondence, notices and written comments which have been submitted in accordance with 310 CMR 16.00. The record is attached. On April 11 , 2007. a public notice of the application was published the in the EOEEA Environmental Monitor. On September 5, 2008 MassDEP received proof of the public notice of application in the local newspaper, The Republican, which was published on that date. Also on September 5, 2008, MassDEP received certified mail receipts for required notices to abutters pursuant to 310 CMR 16.10(4) and for submittal of copies of the application to the parties listed in 310 CMR 16.08. The public notice was published in the Environmental Monitor on September 10, 2008. Consequently, the Review Period commenced on September 10, 2008. MassDEP received no comments during the public comment period, which is the first 21 days of the Review PeriOd. However, MassDEP received written comments from the Connecticut River Watershed Council shortly after the comment period ended. The regulations at 310 CMR 16.11 (3) provide that during the initial 40 days of the Review Period, the applicant may modify an application, provided that said modifications do not const~ute a major modification. However, the City did not seek any revisions to the application. Existing Facility Description The Landfill is located near the junction of the Connecticut and Westfield Rivers in the Towns of Agawam and Wesl Springfield, MA. The Landfill is bounded on the north by an inactive ash·landfill and former wastewater treatment basins associated with a Consolidated Edison power plant, on the east by Route 5, on the south by wetlands and the Westfield River, and on the wes't by Agawam Avenue (three businesses are located on the far side of the street) and the inactive West Springfield Transfer Station. The Landfill occupies a total of about 68 acres, which is divided into three principal areas known as Cell 1, Cell 2, and the West Springfield Cell. .,/ I I I I I I I I I I I I I I I I I I . 1 Bondi Island Landflll Site Suitability Report -Cel/2 Vertical Expansion Transmittal No. W125063 Page 3 of 16 The Landfill is owned by the City of Springfield ('City') and operated by Covanta Springfield, LLC rCovanta"). The Landfill currently operates as an ash monofill, primarily accepting ash from the nearby Pioneer Valley Resource Recovery Facility ("PVRRF'). Cell 1 operated as an unlined landfill from 1970 until 1986, when the City began construction of a lined vertical expansion. Cell 1 initially accepted MSW and sewage treatment plant sludge, but it later accepted only MSW ash generated at the nearby PVRRF. Disposal of MSW and sewage sludge ceased in 1988 and 1990, respectively. Cell 1 is currently at or near its final pre-closure grades, but it has not received final cover. The City proposes to place additional shaping and grading material on Cell 1 so that its final closure grades will match the closure grades of the proposed expansion. Cell 2 of the Landfill operated as an unlined municipal solid waste ("MSW) disposal area landfill until 1986. It received final cover consistent with the standards in effect at that time, including a clay layer at least 18 inches thick overlain by topsoil. A large-scale composting facility is currently operating on Cell 2, but it will be relocated prior to construction of a landfill liner over Cell 2. The area between Cell 1 and Cell 2 is a power line easement that is currently used for electric transmission. The existing overhead electric lines will be moved to another location prior to the expansion project. According to the application, this area is also a historic unlined disposal area. The West Springfield Cell was used as an unlined landfill between 1965 and 1986. In 1987, the City began constructing and filling a lined vertical expansion on top of the older waste, and disposal of MSW and sewage treatment plant sludge in this area continued until 1996. A lined vertical expansion of the West Springfield Cell was constructed in 2005 and remains an active solid waste disposal area for PVRRF ash, although the cell is at or near its final pre-closure grades. The remainder of the West Springfield area has received final cover except for a small area on the northern side slope, adjacent to Cell 1. However, the majority of the final cover system has not been certified by MassDEP due to an unresolved issue with the cover. Description of Project The City proposes to construct a 30-acre vertical expansion of the existing landfill area that will overlie . Cell 2, the power line easement between Cell 1 and Cell 2, and eastern side slope of Cell 1. The expansion will provide about 900,000 cubic yards of additional capacity, and extend the operating life of the landfill by about 7.5 to 11.5 years. The landfill will accept resource recovery facility ash, primarily from the PVRRF and Pittsfield Resource Recovery Facility ("PRRF"). The amount of waste disposed of will average about 290 tons per day and 105,850 tons per year. The maximum daily tonnage will be 500 tons. The expansion area will have a new liner and leachate collection system designed in accordance with current standards. The proposed project also includes adding shaping and grading materials to Cell 1 so that its closure grades will meet those proposed for the vertical expansion area. A small adjustment to the previously-approved final closure grades for Ihe active Wesl Springfield Cell will be necessary 10 accommodate the overall closure grading plan. The permitted maximum final elevation of Cell 2 is currently 107 feel above mean sea level ems!") pursuant to a permit issued by Ihe Department on July 12, 1985. The permitted maximum final elevation of Cell 1 is 138 feet msl pursuant to a major modification permit issued on December 7, 2001 . The City proposes to increase the maximum elevation of both cells to 142 feel msl. The top slope is proposed to ~ave a 2% final grade over a 28-acre area, instead of the usual 5%, in order to maximize the potential for future post-closure uses of the Landfill . MassDEP's Finding: Based on the infonnation contained in the application, including a plan prepared using MassDEP's Geographical Information System (GIS) data, MassDEP has found that the proposed area of waste deposition would not be located within the Zone II of an existing public water supply well. According to the GIS data, there are no existing public water supply wells in the vicinity of the site. Criterion #2 Any area of waste deposition would be within the Interim Wellhead Protection Area (IWPA) of an existing public water supply provided that the proponent may conduct a preliminary Zone" study, approved of by the Department, to determine if the facility would be beyond the Zone" of the public water supply well in question: . MassDEP's Finding: Based on the information contained in the application, including a plan prepared using MassDEP's GIS data, MassDEP has found that the proposed area of waste deposition would not be located within thelWPA of an existing public water supply well. According to the GIS data, there are no existing public water supply wells in the vicinity of the site. . Criterion #3 Any area of waste deposition would be within a Zone" or Interim Wellhead Protection Area (IWPA) of a proposed drinking water source area, provided that the documentation necessary to obtain a source approval has been submitted prior to the earlier of either the site assignment application, or if the MEPA process does apply, the Secretary's Certificate on the Environmental Notification Form or Notice of Project Change, or where applicable, the Secretary's Certificate on the EIR or Final EIR; MassDEP's Finding: Based on the information contained in the application, including a plan' based on MassDEP's GIS data, MassDEP has found that the proposed area of waste deposition would not be located within a Zone" or IWPA of a proposed drinking water source area. Due to the existing uses of the site and surrounding area, the site lies within a designated Non-Potential Drinking Water Source Area. I I I I I I I I I I I I t I I I I I I Bondi Island Landfill Site Suitability Report -Cell 2 Vertical Expansion Transmittal No, W125063 Criterion #4 Page 5 of 16 Any area of waste deposition would be within 15,000 feet upgradient of the existing public water source well or proposed drinking water source area for which a Zone II has not been calculated; the proponent may conduct a preliminary Zone II study, approved of by the Department, to determine if the facility would be beyond the Zone II of the public water supply well or proposed drinking water source area in question; MassDEP's Finding: Based on the information contained in the application, including a plan prepared using MassDEP's GIS data, MassDEP has fou'nd that the area of waste deposition would not be within 15,000 feet upgradient of an existing public water source well or proposed drinking water source area, There are no existing or proposed public water source wells between the Landfill and the Westfield and Connecticut Rivers, to which groundwater flowing under the Landfill ultimately discharges, Criterion #5 It is determined by the Department that a discharge from the facility would pose a danger to an existing or proposed drinking water source area; MassDEP's Finding: Based on the information contained in the application, including a plan prepared using MassDEP's GIS data, MassDEP has found that there are no existing or proposed drinking water sources in the vicinity of the Landfill, Furthermore, due to the existing uses of the site and surrounding area, the site lies within a designated Non-Potential Drinking Water Source Area, Criterion #6 Any area of waste deposition would be over the recharge area of a Sole Source Aquifer, unless all of the following criteria are met: a, there are no existing public water supplies or proposed drinking water source areas downgradient of the site; b, there' are no existing or potential private water supplies downgradient of the site; however. the applicant may have the option of providing an alternative public water supply to replace all the existing or potential downgradient private groundwater supplies; and c. there exists a sufficient existing public water supply or proposed drinking water source area to meet the municipality's projected needs; MassDEP's Finding: Based on the information contained in the application, including a plan prepared using MassDEP's GIS data, MassDEP has found that the site does not lie within a Sole Source Aquifer. Furthermore, due to the existing uses of the site and surrounding area, the site lies within a designated Non-Potential Drinking Water Source Area. Criterion #8 Any area of waste deposition would be within the Zone A or Zone B of a surface drinking water supply. MassDEP's Finding: Based on the information contained in the application, including a plan prepared using MassDEP's GIS data, MassDEP has found that there are no existing public surface water supplies near the project. Criterion #9 Any area of waste deposition would be less than 400 feet upgradient, as defined by groundwater flow or surface water drainage, of a perennial water course that drains to a surface drinking water supply which is within one mile of the waste depos~ion area; MassDEP's Finding: Based on the information contained in the application, including plans prepared using MassDEP's GIS data, MassDEP has found that there are no existing public surface water supplies within one mile of the waste deposition area. Neither the Westfield or Connecticut River is used as a public water supply, nor does either drain to a public surface water supply. Criterion #10 Any area of waste deposition would be within a Potentially Productive Aquifer unless: a. the proponent demonstrates to the Department's satisfaction, based on hydrogeological studies, that the designation of the area as a potentially productive aquifer is incorrect; b. the proponent demonstrates to the Department's satisfaction, based on hydrogeological studies, that the aquifer cannot now, nor in the reasonably foreseeable future, be used as a public water supply due to existing contamination of the aquifer; or c. the area has been excluded as a "Non-Potential Drinking Water Source Area" pursuant to 310 CMR 40.0932, or as otherwise defined at 310 CMR 40.0006: The Massachusetts Contingency Plan. Criterion #11 Any area of waste deposition would be within 1000 feet upgradient, and where not upgradient, within 500 feet, of a private water supply well existing or established as a potential supply at the time of submittal of the application; provided, however, the applicant may show a valid option to purchase the restricted area, including the well and a guarantee not to use the well as a drinking supply, the exercise of which shall be a condition of any site assignment. MassDEP's Finding: Based on the information contained in the application, including a plan showing groundwater elevation contours and flow directions, MassDEP has found that the proposed project is not 1,000 feet upgradient, or within 500 feet of, a private water supply well. The only known nearby well, located at the Valley Boating and Fishing Club, has been decommissioned. Criterion #12 The maximum high groundwater table is within four feet of the ground surface in areas where waste deposition is to occur or, where a liner is designed to the satisfaction of the Department, within four feet of the bottom of the lower-most liner. MassDEP's Finding: Based on the information contained in the application, including a plan showing groundwater elevation contours, MassDEP has found that the maximum high groundwater table is not within four feet of the lower-most liner. . The lowest elevation in the expansion area is about 65 feet msl, which is at least 26 feet above the 39-foot msl groundwater elevation in that area. Criterion #13 The outermost limits of waste deposition or leachate containment structures would be within a resource area protected by the Wetlands Protection Act, M.G.L. c. 131, § 40, including the 100 year floodpl,!in. MassDEP's Finding: Based on the information contained in the application, including plans showing surveyed locations of wetland areas and rivers, MassDEP has found that neither the waste d~position area nor leachate containment structures will be within a resource area protected by the Wetlands Protection Act. However, as requested in the EOEEA Certification, MassDEP recommends that the City file a formal Request for Determination of Applicability with the Agawam Conservation Commission to ensure compliance with the Wetlands Protection Act. I I I I I I I I I I I' I I t I' I • ' I I Bondi Island Landfill Site Suitability Report -Cel/2 Vertical Expansion rmnsmittal No. W125063 Criterion #14 Page 8 of 16 Any area of waste deposition or the leachate containment structures would be less than 400 feet to a lake, or 200 feet to a Riverfront Area as defined in 310 CMR 10.00, that is not a drinking water supply, MassDEP's Finding: Based on the information contained in the application, including plans prepared using MassDEP's GIS data, MassDEP has found that neither the waste deposition area nor leachate containment structures will be within 400 feet of a lake or 200 feet of a Riverfront Area, Criterion #15 Any area of waste deposition would be within 1000 feet of ali occupied residential dwelling, health care facility, prison, elementary school, middle school or high school or children's pre-school, licensed day care center, senior center or youth center, excluding equipment storage or maintenance structures; provided, however, that the applicant may show a valid option to purchase the restricted area, the exercise of which shall be a condition of any site assignment. MassDEP's Finding: Based on information contained in the application, including aerial photos, and inspections of the surrounding area made by MassDEP, MassDEP has found that the project site would not be within 1,000 feet of any of the listed facilities. Criterion #16 Waste deposition on the site would result in a threat of an adverse impact to groundwater through the discharge of leachate, unless it is demonstrated to the satisfaction of the Department that a groundwater protection system will be incorporated to prevent such threat. MassDEP's Finding: The City proposes to construct a double composite landfill liner over the currently unlined portions of the project area, including Cell 2 and the area between Cell 1 and Cell 2. The liner covering the east side slope of Cell 1, which has a slope exceeding 4 horizontal to one vertical, is proposed to be a single composite liner (Cell 1 already has a single composite liner). Leachate collected from the existing and proposed liners will be pumped to the nearby municipal wastewater treatment plant for disposal. The application does not provide complete technical data on the liner design because the liner design is typically reviewed during the Authorization to Construct phase, However, the narrative description of the liner given in the application indicates that the liner design will be consistent with the liner standards required pursuantto 310 CMR 19.110 . Therefore, based on information contained in the application, MassDEP has found that an adequate groundwater protection system will be constructed at this site. General Site Suitability Criteria The following Site Suitability Criteria shall apply to all types of solid waste management facilities: I I I I I '. No site shall be determined to be suitable or be assigned as a solid waste management facility where: . 1. the land is classified as Prime, Unique, or of State and local Importance by the United States Department of Agriculture, Natural Resources Conservation Service; or 2. the land is deemed land Actively Devoted to Agricultural or Horticultural Uses, except where the facility is an agricultural composting facility; and 3. a 100 foot buffer would not be present between the facility and those lands classified at 310 CMR " 16.40(4)(a)1. or 2. MassDEP's Finding: Based on information contained in the application and MassDEP's GIS database, the site is not classified as Prime, Unique, or of State and local Importance by the United States "Department of Agriculture, Natural Resources Conservation Service. The site is not currently used for agricultural or horticultural purposes. Agricultural lands do currently exist south of the landfill, on the other side of the Westfield River, but there is a buffer exceeding 1,000 feet between the project area and those lands . C ritarion #18 Traffic and Access to the Site. No site shall be determined to be suitable or be assigned as a solid waste management facility where traffic impacts from the facility operation would constitute a danger to the public health, safety, or the environment taking into consideration the following factors: 1. traffic congestion; 2. pedestrian and vehicular safety; 3. road configurations; 4. altemate routes; and 5. vehicle emissions MassDEP's Finding: Based on information contained in the application and MassDEP's knowledge of site operations, the operation of the landfill does not constitute a danger to public health, safety, or the environment taking into consideration the specified factors. It is not anticipated that the project will cause a significant increase in traffic or any change in traffic patterns. Most ash disposed of at the landfill is generated at the nearby PVRRF, resulting in about 10 round trips per day. City dump trucks bringing landfill cover materials are expected to continue at the present rate of five round trips per day. Vehicles enter the landfill from a limited access highway (Route 5), so there is little or no pedestrian presence. The only surface street involved in ash transport is M Street, which currently serves traffic mainly to and from the Bondi Island landfill and PVRRF. The entrance to the landfill from Agawam Avenue is gated, fencee, and normally closed to vehicular or pedestrian access. Regular disposal of ash from the Pittsfield Resource Recovery Facility (and possibly other similar facilities) will increase traffic on routes such as the Massachusetts Turnpike, Route 91, and Route 5 as trucks make their way to and from the landfill. No site shall be determined to be suitable or be assigned as a solid waste management facility where such siting would: 1. have an adverse impact on Endangered, Threatened, or Special Concern species listed by the Natural Heritage and Endangered Species Program of the Division of Fisheries and Wildlife in its database; 2. have an adverse impact on an Ecologically Significant Natural Community as documented by the Natural Heritage and Endangered Species Program in its database; or 3. have an adverse impact on the wildlife habitat of any state Wildlife Management Area. MassDEP's Finding: Based on the information contained in the application, MassDEP has concluded that the proposed project will not have an adverse impact on the following: 1. Endangered, Threatened, or Special Concern species listed by the Natural Heritage and Endangered Species Program of the Division of Fisheries and Wildlife in its database; 2. an Ecologically Significant Natural Community as documented by the Natural Heritage and Endangered Species Program in its database; or 3. the wildlife habitat of any state Wildlife Management Area. The City filed a Rare Species Information Request Form with the Massachusetts Division of Fisheries and Wildlife, Natural Heritage and Endangered Species program (NHESP), specifically requesting information relative to habitats of Endangered, Threatened or Special Concern Species; Ecologically Significant Natural Communities; and Wildlife Management Areas. The application includes a letter dated April 19, 2007 from NHESP, which stated that the project area falls outside of Priority and Estimated Habitat and that NHESP had no rare species concerns associated with the site. In addition, there are no state Wildlife Management Areas in the vicinity of the site. Criterion #20 Areas of Critical Environmental Concern. No site shall be determined to be suitable or be assigned as a solid waste management facility where such siting: 1. would be located within an Area of Critical Environmental Concern (ACEC), as designated by the Secretary of the Executive Office of Environmental Affairs; or 2. would fail to protect the outstanding resources of an ACEC as identified in the Secretary's designation if the solid waste management facility is to be located outside, but adjacent to the ACEC. ' MassDEP's Finding: Based on'the information contained in the application, and verified by MassDEP, MassDEP has found that the proposed site will not be l\lcated within or adjacent to an Area of Critical Environmental Concem. Criterion #21 Protection of Open Space, No site shall be determined to be suitable or be assigned as a solid waste management facility where such siting would have an adverse impact on the physical environment of, or on the use and enjoyment of: I I I I I :1 I I 'I: '.' MDC reservations; 4. lands with conservation, preservation, agricultural, or watershed protection restrictions approved by the Secretary of the Executive Office of Environmental Affairs; or 5. conservation land owned by private non-profit land conservation organizations and open to the public, MassDEP's Finding: Based on the information contained in the application, and verified by MassDEP, MassDEP has found that the proposed site will not have an adverse impact on the lands listed above. The proposed project is not located in or near any state forests; state or municipal parklands or conservation land, or other open space held for natural resource purposes in accordance with Article 97 of the Massachusetts Constitution; MOC reservations; lands with conservation, preservation, agricultural, or watershed protection restrictions approved by the Secretary of the Executive Office of Energy and Environmental Affairs; or conservation land owned by private non-profit land conservation organizations and open to the public. The only mapped open space in the Mass GIS database adjacent to the site is identified as a West Springfield Pump Station west of the Landfill. The use of that parcel is currently not similar to the protected lands listed above, and the presence of the Landfill should not impair its usage as a pump station. Criterion #22 Potential Air Quality Impacts. No site shall be determined to be suitable or be assigned as a solid waste management facility where the anticipated emissions from the facility would not meet required state and federal air quality standards or criteria or would otherwise constitute a danger to the public health, safety or the environment, taking into consideration: 1. the concentration and dispersion of emissions 2. the' number and proximity of sensitive receptors; and 3. the attainment status of the area. MassOEP's Finding: Based on information contained in the application and MassDEP's knowledge of the site, MassDEP finds that the proposed site will meet required state and federal air quality standards or criteria and will not otherwise constitute a danger to the public health, safety or the environment. Air pollution emissions are not expected to increase as a result of the project, except for an increase in emissions from construction equipment during brief construction periods. Emissions during construction are expected to be similar to other civil engineering construction projects of similar size and scope. Air pollution emissions of dust and equipment emissions during future operation are expected to be the same as current emissions. Incinerator ash arrives at the site in a moist state and typically does not generate significant dust. Dust from haul roads is controlled as needed, typically by water spray. A permit issued by MassOEP on December 7, 2001 requires that the hauling trucks and bulldozer used during Landfill operations have air emission controls. MassDEP will continue to require the use of such emission controls. I I I: I I I I I I I, I I I ,I I I I I Bondi Island Landfill Site Suitability Report -Cell 2 Vertical Expansion Transmittal No. W125063 Criterion #23 Page 120(16 Potential for the Creation of Nuisances. No site shall be determined to be suitable or be assigned as a solid waste management facility where the establishment or operation of the facility would result in nuisance conditions which would constitute a danger to the public health, safety or the environment taking into consideration the following factors: 1. noise; 2. litter; 3. vermin such as rodents and insects; 4. odors; 5. bird hazards to air traffic; and 6. other nuisance problems. MassDEP's Finding: . Based on information contained in the application and MassDEP's knowledge of the site, MassDEP finds that the operation of the facility will not result in nuisance conditions which would constitute a danger to the public health, safety or the environment. Nuisance conditions are not expected to increase due to the project except for potential increases in noise and dust during the brief liner construction period. Noise emissions will include engine noise, vehicle back up alarms, and truck gate noises. Problems with noise will be mitigated to some ex1ent by limiting operations to 7 am to 5 pm. In addition, the lands surrounding the site are mainly commercial and industrial and are generally not "sensitive receptors· with respect to noise. There is a low potential for litter, vermin attraction, odors, and bird hazards because the Landfill will accept only resource recovery ash. MassDEP notes that the PVRRF does not always achieve complete destruction of all organic materials in the waste stream, but MassDEP has not found that the remaining organics cause any significant nuisance conditions. Criterion #24 Size of Facility. No site shall be determined to be suitable or be assigned as a solid waste management facility if the size of the proposed site is insufficient to properly operate and maintain the proposed facility. The minimum distance between the waste handling area or deposition area and the property boundary shall be 100 feet, provided that a shorter distance may be suitable for that portion of the waste handling or deposition area which borders a separate solid waste management facility. MassDEP's Finding: Based on information contained in the application and verified by MassDEP, MassDEP finds that the size of the proposed site is sufficient to properly operate and maintain the proposed facility. The distance between the waste handling area or deposition area and the property boundary is greater than 100 feet. Therefore, this criterion is satisfied. I I I I I I I. Where an area adjacent to the site of a proposed facility has been previously used for solid waste disposal the following factors shall be considered by the Department in determining whether a site is suitable and by the board of health in determining whether to assign a site: 1. the nature and extent to which the prior solid waste activities' on the adjacent site currently adversely impact or threaten to adversely impact the proposed site; 2. the nature and extent to which the proposed site may impact the site previously used for solid waste disposal; and 3. the nature and extent to which the combined impacts of the proposed site and the previously used adjacent site adversely impact on the public health, safety and the environment; taking into consideration: . a. whether the proposed sile is an expansion of or constitutes beneficial integration of the solid waste activities with the adjacent site; b. whether the proposed facility is related to the closure and/or remedial activities at the adjacent site; and c. the extent to which the design and operation of the proposed facility will mitigate existing or potential impacts from the adjacent site. MassDEP's Finding: Based on information contained in the application and MassDEP's knowledge of the site, MassDEP finds that this criterion is satisfied. Specifically, MassDEP finds that: The site of the proposed project has previously been used for solid waste disposal. The proposed project is a vertical expansion of an existing landfill and as such will be buill on top of existing solid waste. The areas immediately adjacent to the new liner will be inactive landfill under intermediate or final cover. There are also inactive solid waste disposal areas undergoing closure on the Consolidated Edison site to the north of the project area. Prior solid waste activities on adjacent and underlying areas will not adversely impact or threaten to adversely impact the proposed site, provided the liner is designed to account for differential settlement of solid waste. The liner should be steep enough to allow positive drainage despite any potllntial differential settling, and also strong enough that it will not fail due to voids developing under the liner. There have been a number of successful vertical expansions of landfills in Massachusetts. The proposed project will not adversely impact adjacent areas olthe Bondi Island Landfill, provided that the proponent takes reasonable care to avoid damaging the final or intermediate cover over the adjacent areas and other landfill infrastructure. The proposed project should not have any impact on the Consolidated Edison solid waste disposal areas to the north of the project area. The combined impacts of the proposed site and th.e previously used adjacent areas will not adversely impact public health, safety, and the environment. The proposed landfill liner will act as a cap for underlying unlined waste disposal areas, and therefore it will mitigate impacts that may be caused by the underlying waste. The proponent has submitted plans showing that the final cover for the proposed facility will be integrated with the final cover for adjacent areas. I , •• I I I ·1 I I I I I '. In evaluating proposed sites for new solid waste management facilities the Department and the board of health shall give preferential consideration to sites located in municipalities in which no existing landfill or solid waste combustion facilities are located. This preference shall be applied only to new facilities which will not be for the exclusive use of the municipality in which the site is located. The Department and the board of health shall weigh such preference against the following considerations when the proposed site is located in a community with an existing disposal facility: 1. the extent to which the municipality's or region's solid waste needs will be met by the proposed facility; and 2. the extent to which the proposed facility incorporates recycling, composting or waste diversion activities. MassDEP's Finding: Based on information contained in the application and MassDEP's knowledge of waste control infrastructure in the region, MassDEP finds that this criterion is satisfied. The proposed project will continue operations of the existing Landfill located in the Towns of Agawam and West Springfield, so MassDEP and the Board of Health need not give preferential consideration to the proposed project. However, the waste disposed of in the Landfill will be resource recovery facility ash generated at the PVRRF in Agawam, PRRF in Pittsfield, and possibly other similar facilities. The application st~tes that the PVRRF and PRRF serve 16 and 17 regional communities, respectively. As a result, the Landfill will not be for the exclusive use of Agawam or West Springfield. The PVRRF and PRRF have programs to comply with MassDEP's Waste Ban regulations and prevent recyclable and compost able wastes from being combusted. Criterion #27 Consideration of Other Sources of Contamination or Pollution. The determination of whether a site is suitable and should be assigned as a solid waste management facility shall consider whether the projected impacts of the proposed facility pose a threat 10 public health, safety or the environment, taking into consideration the impacts of existing sources of pollution or contamination as defined by the Department, and whether the proposed facility will mitigate or reduce those sources of pollution or contamination. . MassDEP's Finding: MassDEP has reviewed whether the projected impacts of the proposed project pose a threat to public health, safety or the environment, taking into consideration the impacts of existing sources of pollution or contamination as defined by MassDEP. The City has proposed to mitigate and reduce the potential sources of pollution or contamination associated with the operations of the Landfill by constructing an impervious liner with leachate protection; using operating practices that control dust and nuisances; using equipment with air emission controls; and discharging leachate to the sanitary sewer for treatment at the Bondi Island wastewater treatment facility. In addition, the future operation of the Landfill will be the same as current operations. Further, the impervious liner system will serve as a cap for underlying inactive landfill areas, which should reduce groundwater pollution caused by leachate from those areas. The character of future operations is expected to be the same, except for the increase in the average daily disposal rate. Consequently, MassDEP has determined that the proposed future operations also do not pose a threat to public health, safety or the environment. Criterion #28 Regional Participation. The Department and the board of health shall give preferential consideration to' sites located in municipalities not already participating in a regional disposal facility. The Department and the board of health shall weigh such preference against the following considerations when the proposed site is located in a community participating in a regional disposal facility: 1. the ex1ent to which the proposed facility meets the municipality's and the region's solid waste management needs; and 2. the extent to which the proposed facility incorporates recycling, composting, or waste diversion activities. MassDEP's Finding: MassDEP and Board of Health need not give preferential consideration to the proposed project because it is an existing site covering two municipalities (Agawam and West Springfield) that already participate in a regiQnal disposal facility (i.e., the PVRRF). However, the 'waste disposed of in the landfill will be resource recovery facility ash generated at the PVRRF in Agawam, PRRF in Pittsfi.eld, and possibly other similar facilities. The application states that the PVRRF and PRRF serve 16 and 17 regional communities, respectively. Therefore, the landfill is important in meeting the region's solid waste management needs. The landfill accepts contaminated soil for alternative daily cover purposes, diverting material that might otherwise use disposal capacity. Also, as noted above, the PVRRF and PRRF have programs to comply with MassDEP's Waste Ban regulations and prevent recyclable and compostable wastes from being combusted. CONCLUSION MassDEP hereby issues a Positive Determination of Site Suitability for the proposed vertical expansion of the Bondi Island landfill, proposed by the City of Springfield, under the authority of Massachusetts General laws ("MGl") Chapter 111, section 150A and 150M", as amended, and 310 CMR 16.00. According to the provisions of MGL Chapter 111, section 150A and 150AYz, as amended, and 310 CMR 16.00, the Agawam Health Department shall proceed with a public hearing pursuant to 310 CMR 16.20 for the purpose of deciding whether or not to grant a site assignment for the parcel of property which is the subject of this Report. Pursuant to MGL Chapter 111, section 150A and 310 CMR 16.20(7), the Agawam Health Department shall commence a public hearing pursuant to 310 CMR 16.20 within 30 days of its receipt of MassDEP's Site Suitability Report. At least 21 days prior to commencement of the public hearing the applicant (City of Springfield) shall cause notice of the public hearing to be published. Such notice shall be published in daily, or if not possible, weekly newspapers of general circulation in the municipality. I I I =------------._- I I I I I I I I I I I I I I I I I I I EOEA 113384 NPC Certi ficate May 11,2001 Project Site Description The Bondi Island Sanitary Landfill is located in West Springfield and Agawam on a parcel of land bounded to the east by Route 5 and the Connecticut River; to the north by the Con- Ed power generation facility; to the west by Agawam Avenue; and to the south by open space and the Westfield River. Other facilities located in the vicinity of the Bondi Island Landfill include the Springfield Regional Wastewater Treatment Facility; the Pioneer Valley Resource Recovery Facility; and the Springfield Regional Composting site. The landlill area is approximately 68 acres in size. The landlill is divided into three general areas: Cell I on the western portion of the site in Agawam and West Springfield (39 acres); Cell 2 on the eastern portion of the site in West Springfield (27 acres); and a power line easement (2 acres) dividing the two cells and currently occupied by a Western Massachusetts Electric Company (WMECo) overhead electric transmission line. The project change proposed in the NPC is an increase in capacity and height for the lined landfill development of the Cell 2 area. The lined Celli areas in Agawam and West Springfield comprise the western half of the project site and total approximately 38 acres of lined landfill area equipped with leachate collection and environmental control areas. The lined Cell 1 area in Agawam was used for the disposal of residual ash generated by the Pioneer Valley Resource Recovery Facility (PVRRF) until 2006 when filling operations began in the West Springfield Supplemental Liner Area (WSSLA) in Cell I, which was reviewed by MEPA in a 2003 NPC. Disposal operations continue to date in the WSSLA for residual ash generated by the PVRRF and processed bottom ash and/or fly ash generated by the Pittsfield Resource Recovery Facility (PRRF). MEPA History The project was originally reviewed by MEPA in 1979 in an Environmental Notification Form (ENF) submitted by the City of Springfield, (the proponent) for the expansion of the Bondi Island Sanitary Landfi II. The project involved the construction of a lined landfill area over the Cell I area in Agawam and West Springfield for the disposal of ash residue and non-processiblc waste from the Pioneer Valley Resource Recovery Facility (PVRRF) and the interim (6 to 9 month) use of the unlined Cell 2 area for solid waste disposal. The project was reviewed in a Draft Environmental Impact Report (DEIR), a Final ErR (FEIR), and two Supplemental EIRs in 1983 through 1985. The City of Springfield filed a NPC in August of2001 that proposed changes to the final operating grades within the Cell I lined landfill area. No further review was required in the September 7,2001 Certificate on the NPC. A second NPC was filed in September of2003 for the construction ofa supplementalliner'and leachate collection system across the northern section of the existing lined West Springfield Area at the landfill. The Secretary did not require any further MEPA review on the changes proposed in the 2003 NPC. Review of the NPClProject Change Description The current NPC proposes an increase in capacity and height of the Cell 2 area of the Bondi Island landfill. The project will involve the sequential phased construction and operation of approximately 30 acres of lined waste disposal cells in Cell 2. Cell 2 is an unlined landfill cell that was used prior to 1986 for the disposal of solid waste materials. The Cell 2 area includes a power line easement that is currently occupied by a WMECo overhead electric transmission line. The upper surface of Cell 2 is currently used by the City of Springfield for composting operations under a third party agreement. The composting operation will be relocated as the Cell 2 liner project is developed. The project change includes increasing the final closure height of Cell 2 from 125 feet msl to 142 feet msl and increasing the Cell I closure height in Agawam and West Springfield to a maximum elevation of 142 msl from 138 msl. The height increase on Cell 2 is associated with a proposed increase in the permitted annual waste disposal rate from the existing allowable annual rate of 54,750 tons to an annual disposal rate of 105,850 tons. This translates to an increase of 140 tons per day, 365 days per year. In addition to disposing residual ash from the PYRRF and the PRRF. the proponent is seeking approval from MassDEP to accept contaminated soils and residual ash from other municipal waste combustion facilities. Preliminary estimates of leachate generation for the proposed the lined Cell 2 area is based on a generation rate of 1,000 gallons per day (gpd) per acre. This approximately 30-acre lined landfill development project will be phased into three 10 acre phases with a net leachate generation of about 10,000 gpd per 10 acre phase. The current average leachate flow from lined areas of the landfill is about 15,000 gpd. The City of Springfield is currently upgrading the existing facility leachate collection and pumping station systems; this work will provide an upgrade system to transmit leachate to the Springfield Waste Water Treatment Plant. The Cell 2 lined landfill development project will provide approximately 7.5 to 11.5 years of additional waste disposal capacity for the PVRRF and the PRRF. The project will provide an increase in height to match the abutting Cell I and West Springfield landfill areas. The proponent hopes to achieve minimum 2% surface grades across the completed Cell 3 area, matching 2% minimum grades in Cell I and the WSSLA. The ultimate goal of the project is to develop the top of the Bondi Island Landfill into an approximately 28-acre multi-use platform for post-closure uses to benefit the citizens of Agawam, West Springfield and Springfield. The NPC also proposes the relocation of overhead WMECo electric transmission lines to develop landfill capacity in the area of the power line easement of Cell 2. WMECo is currently reviewing two options for relocating the transmission lines. Option I, relocation of the power lines along Agawam Avenue in West Springtield is the preferred option and will maximize the potential for post-closure use of the site. The proponent and WMECo should note comments from the Pioneer Valley Planning Commission (PVPC) regarding the need to consult the recently adopted Regional Transportation Plan for the Pioneer Valley Region when considering these options. . Permitting The project change requires the following permits and/or approvals from MassDEP: BWP SW 38 -Major Modification of Site Suitability Report; BWP SW 26 -New Major Expansion; and BWP SW \0 -Authorization to Operate (A TO) a Landfill. The project also requires Site Plan Review from the Agawam Planning Board; an update to an existing Special Permit from the Agawam Board of Appeals; a Site Assignment Renewal from the Agawam Board of Health; and an amended or new Order of Conditions from the Agawam Conservation Commission. As part of the BWP SW 26 permit the proponent will need to demonstrate the design adequacy of the liner, gas collection and leachate collection systems as impacted by construction over the existing lined and unlined landfill areas. The proponent must demonstrate that the operation of the landfill expansion can be conducted without damaging the final cover of adjacent landfill areas. Since there will be existing solid waste below the liner throughout the project area, design plans should provide for adequate landfill gas collection below the liner. Although there are existing landfill gas collection systems in Cell I and Cell 2, the area between the cells currently does not have a landfill gas collection system. The NPC plans show that "approved shaping/grading material" will be used to bring the top of Cell I to its final pre- capping grade. The proponent should note comments from MassDEP that a Beneficial Use Determination (BUD) may be required as part of the Authorization to Construc!. Stormwater from capped areas, and areas not impacted by waste disposal operations. is currently transported by swales, culverts, and sheet How to regulated wetland areas to the east and south of the landfill. The proponent must demonstrate during permitting that the specified final closure top slope (2%) is adequate to ensure positive drainage of stormwater. It is expected that construction of additional impervious area (i.e. capped landfill areas) will result in an increase in storm water rates and volume. The proponent must demonstrate that the storm water management structures will meet applicable performance requirements in the Solid Waste Management regulations at 310 CMR 19. 115. The stormwater and wetland resource impacts of the project will also be reviewed by the Agawam Conservation Commission during the Wetlands Protection Act permitting process. Conclusion Although the landfill capacity and Cell 2 height increase exceeds the general 10 percent criterion under 3 \0 CMR I I .06(6)(a), I find that the change in the project is not likely to significantly increase environmental consequences. The capacity increase is within previously Site Assigned and permitted landfill areas, and overlies existing pre-lined and unlined landfill cells. The proposed change will result in increased environmental controls at the landfill through the construction of a state-of-the-art liner system over the currently unlined Cell 2 landfill area. The new Cell 2 liner system will include leachate collection and under-liner gas extraction systems that will help mitigate existing environmental impacts at the facility. Based on a review of the information provided by the proponent and after consultation with the relevant public agencies, 1 find that the potential impacts of this project do not warrant further MEPA review. The proponent should continue to work closely with MassDEP, local officials and interested citizens to resolve outstanding information requests and should respond to comments raised during the review ofthis NPC in the MassDEP permitting process.
