Division 4. Parking, Loading and Access
Requirements
Section 3-401. General.
(a) The requirements set f9rth in this
Division shall apply and, govern in all zones as
prescribed by this Chapter.
(b) No land stui:n be used or occupied, no
structure shall be deSigned, erected, attached,
used or occupied and no use shall ~e operated
unless the parking and loading facilities herein
required are provided in at least the amounts and ,
in accordance with the design standards, herein
set forth. Parking areas and loading areas established
in accordance with the Division shall not be re-
arranged or altered without approval of a Use Permit
Application by the Director of Planning.

(c) No automobile off-street parking area·
shall be reduced iO area or encroached upon by
buildings, vehicle storage, loading or unloading
or any other use where such reduction or encroach-
ment will reduce the area below that required by
this Division. .
(d) All off-street parking and loading
facilities required by this Division for any use
shall be located on and entirely within the same
record lot with that use, unless otherwise provided
for in this Article.
(e) When ~ny land or building is used for
two (2) or more purposes, the number of parking
spaces required shall be the sum of the requirements
for the various individual uses, computed separately
in accordance with this Division. Parking facilities
for one (1) use shall not be· considered as providinr
the required parking facilities for any otber use,
except as hereinafter provided.
(f) Requirements for the provision of parking
facilities with respect to two (2) or more property
uses of the same or different types may be satisfied
by the permanent allocation of the requisite number
of spaces for each use in a common parking facility,
cooperatively established and operated. The number
of spaces so designated may not be less than the
sum of the individual requirements for each use

except as herei'nafter provided, and all design
requirements contained in this Division must be
complied with. A cotimJon parking facility. so
, established must be located so that a major point
of pedestrian access to such common facility is
within a five h~ndred (500) foot walking distance
of the entranCe to each use served thereby. The
Planning Commission may attach such conditions to
the approval of a common parking facility as may
be reasonable and necessary to assure that the
use will be consistent with the purpose and intent
of this Chapter.
(g) No parking area or loading space shall
be used for the storage, sale, repair, dismantling
or servicing of any vehicles, equipment, materials
or 'supplies.
(h) For the purpose of this Division, the
number of employees for a use shall be computed
on ,the basis of the maximum number of persons to
be employed at anyone (1) time other than at'
changes of shifts.
(i) All garage or other space allocated for
parking of vehicles within buildings or in base-
ments or open spaces on the roofs of buildings
shall be considered part of the required off-
street parking facilities and may be included as
such in computing the area requirements outlined
in this Division.
(j) Off-street parking and loading facilities
that make it necessary for vehicles to back out
directly into a public road are prohibited,
except that this prohibition shall not apply to
)
the off-street parking area of one-family detached
and semi-detached dwelling units.
(k) All off-street parking and loading
facilities required by this Division for any use
shall be established in accordance with all design
standards and maintained throughout the operation
of that use; any additional off-street parking and
loading facilities required as a result of an expan-
sion of or a change in any use shall be likewise
established and-maintained, Or such _use shall be
required to cease or revert to the sta-tus described
in the Use Permit-Application for such use until
such facilities are provided.
(1) In the R-E, R-5, R-150, R-90, R-75, R-60
and R-40 ZOnes, off-street parking of motor vehicles
shall be limited to passenger vehicles, not more
than one (1) delivery type commercial vehicle not
exceeding 3/4 ton capacity and one (1) trailer which
sha~l not be used for ~welling purposes or any
accessory" use, provided such trailer is parked
behind the front building line.
(II!>" In the R-30 and R-20 Zones, off-street
parking _of moto~ vehicles shall be limited to
passenger Vehicles and not more than one (1)
delivery type commer~ial vehicle not exceeding
3/4 ton capacity per dwelling unit. Off-street
parking of trailers in said Zones is prohibited.
(D) ID the 0-2 Zone, off-street parking of
motor vehicles between the front building line
and the froDt lot liDe is prohl"blted.
(0) Parking facilities shall be provided
for the physically handicapped and aged as specified
in the Maryland Building Code for the Handicapped

(p) Requirements for the provision of
·parking facilities may be satisfied on a separate
.l ot from the use served by a permanent automobile
parking structure. An automobile parking structure
so estabilshed must be located so that a major point
of pedestrian access to such structure is within
a five hundred (SOO) foot walking distance of the
entrance to the use serviced thereby. The Planning
Commission may attach such conditions to the approval
of an automobile parking structure as may be
reasonable and necessary to assure that the
use will be consistent with the purpose and intent
of this Chapter.
Section 3-402. Design Standards.
(a) Parking Spaces and Areas.
(1) Each standard size automobile parking space
shall be a rectangle not less than one hundred and
eighty (180) square feet in area nor less than nine
(9) feet wide except that spaces provided for the
physically handicapped and aged in accordance with
the Maryland Building Code for the Handicapped
and Aged shall not be less than two hundred sixteen (216)
square feet in area nor less than twelve (12) feet
wide. Each compact size automobile parking space
shall be not less than one hundred thirty-six (136)
square feet in area with minimum dimensions of
eight (8) feet by seventeen (17) feet. In addition.
there shall be provided adequate interior driveways
and entrance and exit driveways to connect each
public parking space with a public street; except
that. where ·parking of vehicles by attendants is
provided at least fifty (50) percent of all parking
spaces shall have direct access to interior entrance
and exit dt·iveways.

(2) Parking spaces may not be installed on a grade
in excess of five (5) percent.

(3) All parking spaees shall be separated from
walkways, sidewalks, roads, streets or alleys by
curbing, and all roads, streets, alleys" sidewalks,
walkways and lot lines shall be protected from '
vehicular overhang by wheel bumpers or curbs. Wheel
bumbers or curbs shall be installed no nearer to a
street 'right-of-way line than five (5) feet.
(4) For. purposes of computing the area of any
public parking space hereunder, a parking space
may extend beyond a wheel bumper or curb provided
that:
'(a) The computed area of such parking space
does not extend beyond a wheel bumper or curb
more than two (2) feet as 'measured along the
side of the space which extends the greatest
distance beyond the wheel'bumper or curb; and
(b) The computed area of such parking space
does not extend beyond a wheel bumper
or curb which is more tha~ six (6) inches
high, and the area of overhang is f.ree of
all obstructions above curb height.
(5) Each parking space shall be clearly marked
and adequate pavement directional arrows or signs
provided. Each space or area for compact size motor
vehicle parking must be clearly marked to indicate
the intended use.
•
(6) No off-street parking area shall contain IDOre
than one hundred fifty (150) spaces. If a greater
number of spaces 1s required by this Division,
separate parking areas of not more than one
hundred fifty (150) spaces shall be provided and
shall be separated by a landscaped area at least ~
ten (10) feet in width.

(7) In tbe R-H Zone, seventy-five (75) percent
of all off-street parking spaces shall be located
underground or in an enclosed structure, and
the remaining spaces shall be so located as to
accommodate deliveries and other short term needs.
(8) In the 1-3 Zone, the following additional
design standards shall apply:
A. No off-street parking space, off-street
loading berth, or driveway shall be located
vithin twenty (20) feet of a side or rear ·
lot line; on lots qualifying under Section
3·-303(a) and Section 3-303(b), this require-
ment is reduced to ten (10) feet;
B. No off-street parking s~ace or off-street
loading area shall be located within fifty
(50) feet of a right-of-way of any public
street or highway; on lots qualifying under
. Section 3-303(a) and Section 3-303(b) this
requirement is reduced to ten (10) feet;
except that no off-street parking spac.e or
off-street loading area or driveway shall
be located within fifty (50) feet of the
right-of-way of a limited access highway;
c •. No . off-street parking space or loading
or unloading shall be permitted within the ·
setback area · of an industrial lot that adjoins
a ·residentia1 zone.·
D. No off-street loading area shall face any
limited access highwy.
(9) Off-street parking spaces for compact size
automobiles shall be provided in accordance with
the following requirements:
A. Thirty (30) percent of the total number
of spaces required by , this Division shall
be allocated for compact size autGmobiles,
except that the Planning Commission may
authorize up to a maximum of fifty (50)
percent compact size spaces within auto-
mobile parking structures. However,
this mandatory provision shall not be required
for any parking facility for residential
property, or to any parking facility with
fewer than ten (10) spaces;
B. Fiftr (50) percent of the estimated area
saved by providing compact size parking spaces
on surface parking facilities shall be devoted
to landscaping in ~ddition to any landscaping
already required elsewhere in this Article.
However, for existing facilities where there
is no reasona ,le opportunity to provide addi-
tional landscaping, the landscaping require~nt
may be waived by the Planning Commission or -'
Director of Planning when approving the Use
Permit;
C. Where off-street parking spaces are provided
in excess of the number required by this Division
such spaces may be allocated for compact size
automobiles, and no additional landscaping
shall be required for such excess spaces;
D. Owners of existing parking facilities
who desire' to allocate spaces for compact
size autOmobiles shall do so only after
approval of a Use Permit Application by
the Director of Planning.

(e) Paving Specifications.
All off-street parking and loading areas
shall be so drained as to prevent damage to
abutting properties or public streets and
shall be paved "with a minimum of:
(1) Six (6) inches of concrete; or
(2) Six (6) inches of bitumin~us asphalt; or
(3) Six (6) inches of compacted gravel and
two (2) inches of bituminous asphalt; or
(4) Other paving as approved by the Director
of the Department of Public Works.
(f) Lighting Reguirements.
Adequate lighting shall be provided for all
parking facilities used at night. Lighting of
off-street parking facilities shall be installed
and maintained in a manner nO"t to reflect or
cause glare into abutting or facing residential
premises, nor to cause reflection or glare which
adversely affects safe vision of operators of
vehicles moving on roads and highways.
Section 3-403. Quantity of Parking Spaces Regulred.
(a) Ambulance Service.
Adequate space to accommodate all motor
vehicles operated in connection with such use
and two (2) additional parking spaces per "each

Five (5) reservoir spaces for each teller
window or similar device designed to serve drive-
in patrons to be prQvided in the approach lane
to each drive-in window or in a common reservoir
storage area, plus one (1) parking space for each
employee.
(f) Bowling Alleys.
Five (5). parking spaces for each alley.
(g) Car Wash, Mechanical.
One (1) parking space for each employee, and
reservoir space equivalent to five (5) times the
maximum Simultaneous washing capacity of the
mechanical car wash.

persons for whom seating is provided in the main

Division 5. Screening and Landscaping
Requirements.
Section 3-501. Screening Required in Commercial
and Office Zones.
In all commercial and office zones where a
lot abuts a lot or land proposed in the Plan for
residential use or a secondary residential street,
a screening area along such abutting lot line shall
be provided. Such screening area shall be improved
with landscaping, walls, or fencing of at least
seventy-five (75) percent of continuous opacity at
all times to a height of five (5) feet. The Planning

relating to the nature and type of the screening
for any such lot, and may require additional screening
in such manner and of such materials as may be

By means of this letter and at the request of our client, Frank Ferrentino, we would like to
expand on an issue that came up during discussions on Mr. Ferrentino's parking lot
requirements.
Mr. Ferrentino has approached his lender, Berkshire Bank, about the requirement of
removing a portion of the building to obtain the extra parking that the Planning Board
expressed comfort with. Within this approach, the lender expressed a change in their
collateral would require additional measures and/or securities to remain in compliance
within the lender's interest.
Mr. Ferrentino asked this office to check if the Planning Board would reconsider his past
site plan for his business to open and have a positive economic effect for both the
community and Mr. Ferrentino.

Dear Member,
By means of this letter and at the request of our client, Frank Ferrentino, the
undersigned would like to give written notice for the anticipated parking requirements as
per the parking guidelines provided by the Agawam Planning Department.
Within the provided guidelines, a Restaurant, Class I states:
One (1) parking space for each fifty (50) square feet of floor area devoted to
patron use, excluding restrooms within the establishment, and one (1) parking space for
each eighty (80) square feet devoted to patron use on the property outside the
establishment, and one (1) space for each two (2) employees. (Bold tex1 and underline
added)
Based on the most recent proposed floor plans:
1. The take out area is shown as 519 sf. If we take out the floor space based on
the coolers or vending machines, that number drops to approximately 460 sf.
2. The Pub portion of the restaurant is shown as 856 sf. If we take out the bar
service area for employees of 196 sf., that number drops to approximately 660 sf.
3. The pool table playing room is shown as 327 sf. If we take out the pool table and
2.5' around the perimeter for players, that number drops to 194 sf.
Taking the aforementioned totals yields 1,314 square feet of floor space devoted to
patron use. Within this, if you take the given parking at twenty-two (22) spaces that
would equate to 59.7 sf per space provided, without the required employee parking. If
we take the employee count at six with the 1,314 square feet offloor space devoted to
patron use, the total parking required would be approximately 30 spaces. Under the
current proposal, that would demonstrate a design 26.7% deficient is parking spaces
(73.3% in compliance; 66.5 sf per space provided).

We have also analyzed the parking layout if the three bay garage was removed from the
southern portion of the existing structure. This approach would potentially yield thirty-
four (34) parking spaces. Mr. Ferrentino would option to use this approach as a "Iast-
resort" within his planning efforts. Due to the fact of it would involve removing a
equitable portion of the building and, potentially, some concerns from the lending
institution.
Within the aforementioned, the total proposal will bring the parking to:

~ Mr. Ferrentino still maintains that the neighbor will let him park vehicles
after his renter's business hours, which end typically around 5:00 pm.

Description of Site: Fully developed with building and pavement for parking.
Provision for Traffic Flow: There is an existing curbcut on to Main Street. The width
and radii must be shown on the plan. See Engineering comments.
Parking: The plan shows 22 parking spaces. The dimensions of the spaces are not
shown. A floor plan of the proposed building layout should be provided so that a
parking analysis can be conducted. The building is currently 4525 square feet. Using
Agawam's parking guidelines, if the entire space were to be used as a restaurant, ninety
spaces would be necessary. I have spoken to the applicant about the need for additional
parking and suggested that adjacent properties owners should be contacted to determine
if cross-property easements may be possible.

Public Utilities: See Engineering comments.
landscaping/Screening and Buffers: A landscaping plan must be submitted showing
size, location and species of all plantings. The following landscape note must be placed
on the plan: "All plantings must be maintained and that portion of the public way
abutting the parcel and including the treebelt shall be maintained in a safe and attractive
condition by the owner of the parcel. fl
Treatment of the treebelt must be provided. The treebelt sees a high volume of
pedestrian traffic. Installation of a sidewalk may be needed.

Exterior Ughting: All exterior lighting must be shown on the plan including any
building mounted lighting.
Rendering or Elevations: Colors and textures must be provided.
Dumpster location: All dumpsters must be fenced, screened and gated. The type and

Per your request, we have reviewed the Site Plan entitled "Ferrentino's Pizza & Pup, 1676 Main Street,

comments:
1. All walkways and ramps must meet ADA and AAB standards. Please show construction details for the
curb cuts and handicap tamps.
2. The accessible parking signs arc to confonn to the design and verbiage specified in M.O.L. C.40 S.22A
and AAB CMR 23.00 (see attached and include it in the details).
3. The proposed handicap parking spaces should be 9 feet width and 8 feet for access aisle van space.
4. Please show on the plans the location of the oiVgrease trap detail for any connection coming from a
kitchen/cooking area. Only wastes requiring separation shall undergo treatment.
5. The sewer lateral location service should be shown on the plans.
6. Please note that if there are any changes proposed to the curb cut on Main Street, a curl> cut permit may
be required by MassDOT. The driveway is shown reusing the existing curb cut, but the proposed
driveway narrows to approximately 19 to 20 feet wide before increasing to 23 feet. This roay make it
difficult for vehicles to enter the site if another vehicle is in the driveway waiting to turn out Onto Main
Street. 1be curb cut shall be a minimum of 24 fcet wide at its narrowest point.
7. A Stop line and center yellow line should be painted at the entrance to help control traffic flow.
8. It is recommended that stop sign be installed at the exit of the property.
9. It is unclear as to how the dumpster will be accessed at its proposed location when cars are parked in the
nearby spaces.
10. Employee only space needs to be removed as it conflicts with the adjacent parking space to the north.
11. Show the exiting building just to the south of the property and how storm water runoff impacts this area.
12. Please show the proposed snow storage areas.
